Chapter 1 General provisions

Article 1 The present provisions are hereby formulated in accordance with the “Regulation on the supervision and management of civil nuclear safety equipment” for the purpose of strengthening the supervision and management of the imported civil nuclear safety equipment.

Article 2 This provisions is applicable to the registration management of the foreign units (hereinafter referred to as the foreign units) engaged in the design, manufacture, installation and non-destructive test activities of the civil nuclear safety equipment for the civil nuclear facilities within the territory of the People’s Republic of China and the safety inspection of the imported civil nuclear safety equipment.

Article 3 The nuclear safety supervision and management department of the State Council shall be responsible for the registration management of the foreign units, and implement supervision and inspection of the foreign units’ activities of design, manufacture, installation and non-destructive test of the civil nuclear safety equipment.

The nuclear safety supervision and management department of the State Council and its subordinated inspection institutes shall carry out safety inspection of the imported civil nuclear safety equipment according to the laws and regulations.

Article 4 The operating units of civil nuclear facilities shall agree in the foreign trade contract for civil nuclear safety equipment the following main contents:

(1) The foreign units shall cooperate with the nuclear safety supervision and management department of the State Council in the supervision and inspection;

(2) The requirements related to the supervised manufacture, inspection before shipping, supervised installation and acceptance of the imported civil nuclear safety equipment;

(3) The issues related to the technical conditions and safety inspection of the imported civil nuclear safety equipment.

Chapter 2 Registration of the foreign units

Article 5 The foreign units shall go to the nuclear safety supervision and management department of the State Council to apply for registration in advance.

Those who plan to be engaged in design, manufacture or installation activities of the civil nuclear safety equipment shall apply respectively according to the types of activities (design, manufacture and installation), equipment types and the nuclear safety classification.

Those who plan to be engaged in the non-destructive test activities of the nuclear safety equipment shall apply for it according to the non-destructive test methods. The

non-destructive test methods include: radial test (RT), ultrasonic test (UT), magnetic powder test (MT), eddy current inspection (ET), penetrant test (PT), leak test (LT), visual test (VT), etc.

Article 6 The foreign units who applying for registration shall meet the conditions specified in Article 31 of “Regulation on the supervision and management of civil nuclear safety equipment”, mainly including:

(1) To abide by the provisions of the laws and administrative regulations of the People’s Republic of China;

(2) Being the business enterprise legally established in the country (region) where it is located;

(3) Having the work performances related with the activities that are planned to be engaged in, and for over 5 years;

(4) Having the work places, facilities and equipment corresponding to the activities that are planned to be engaged in and the professional technical personnel who are examined qualified;

(5) Having the quality assurance system corresponding to the activities that are planned to be engaged in;

(6) Having obtained the corresponding qualifications specified by the nuclear safety supervision and management department of the country where it is located;

(7) Having the mature or proven technologies of design, manufacture, installation and non-destruction test of the civil nuclear safety equipment;

(8) To adopt the national standard of the civil nuclear safety equipment of the People’s Republic of China, the industrial standards or the standards accepted by the nuclear safety supervision and management department of the State Council.

Article 7 Those who apply for registration shall submit the following application materials:

(1) Application for registration of foreign units;

(2) Certifications of the operating enterprise legally established in the country (region) where it is located;

(3) The materials certifying the qualification specified by the nuclear safety supervision and management department of the country where it is located has been obtained, or the materials certifying the other relevant qualifications have been obtained;

(4) The materials describing performances of engaging in the nuclear safety equipment activities of nuclear facilities;

(5) The materials describing the ability related with the civil nuclear equipment activities proposed to be engaged in, including the personnel, plant building, equipment, technical abilities and the abilities of implementing the codes and standards, etc.;

(6) The corresponding quality assurance programs or the quality management manuals;

(7) Other materials that are required to be submitted by the nuclear safety supervision and

management department of the State Council.

The above materials to be submitted by the applicant shall be in Chinese or in both Chinese and English.

Article 8 The nuclear safety supervision and management department of the State Council shall, after receiving the registration application, make formal examination of the submitted application materials, and shall accept when they meet the conditions.

Article 9 The nuclear safety supervision and management department of the State Council shall finish the examination within 45 work days after accepting the application, allow it to be registered when the conditions are met, and issue the “Confirmation of registration of foreign units of the civil nuclear safety equipment activities of the People’s Republic of China”, and publicize it; for those not meeting the conditions, notify the applicant in written form and state the reasons.

In the course of examination, the nuclear safety supervision and management department of the State Council may organize the specialists to make technical evaluation, and send people to the foreign unit to make spot investigation when necessary. The time necessary for the technical evaluation and spot investigation is not counted in the period specified in the previous Article.

Article 10 Form of the confirmation of registration is divided into four types:

(1) Confirmation of registration of foreign design institute of the civil nuclear safety equipment of the People’s Republic of China;

(2) Confirmation of registration of foreign manufacturing units of the civil nuclear safety equipment of the People’s Republic of China;

(3) Confirmation of registration of foreign installation company of the civil nuclear safety equipment of the People’s Republic of China;

(4) Confirmation of registration of foreign non-destructive test institute of the civil nuclear safety equipment of the People’s Republic of China.

Article 11 The confirmation of registration shall carry the following contents:

(1) Unit name, country (region), residence and legal representative;

(2) Types and scopes of activities allowed registering;

(3) Valid period of the registration;

(4) Serial number of the confirmation of registration;

(5) Organ issuing the confirmation of registration and the date of issuance.

Article 12 The nuclear safety supervision and management department of the State Council shall, after finishing registration of the foreign units, send a copy of the registration information to the nuclear industry department of the State Council in charge and other related departments.

The nuclear safety supervision and management department of the State Council shall

publicize periodically the registration information of the foreign units.

Article 13 The valid period of the confirmation of registration is 5 years.

Before the confirmation of registration expires, those foreign units who need to continue to be engaged in the related activities shall apply for registration again to the nuclear safety supervision and management department of the State Council 6 months before expiry.

Article 14 Those registered foreign units who want to change the name, country (region), residence or legal representative shall apply to the nuclear safety supervision and management department of the State Council for making change in its confirmation of registration within 30 days after making registration change in its local country (region) by submitting the following materials: (1) Application for making change in the registration;

(2) Duplicated copy of the original confirmation of registration;

(3) Statement of the change and the related certification materials;

(4) Other materials required by the nuclear safety supervision and management department of the State Council to be submitted.

The nuclear safety supervision and management department of the State Council shall examine and verify the change in the confirmation of registration of the foreign units. When the situation verified is true, the application for the change in the confirmation of registration should be approved. The valid period of the original confirmation of registration is applicable to the changed confirmation of registration.

Article 15 Those who want to change the type or scope of the registered activities shall apply again for the change to the nuclear safety supervision and management department of the State Council

Article 16 It is prohibited to engage in design, manufacture, installation and non-destructive test activities of civil nuclear safety equipment without confirmation of registration or not according to the type and scope of the activities specified in the confirmation of registration.

It is forbidden the foreign units carry out the design, manufacture, installation and non-destructive test activities of civil nuclear safety equipment within the territory of the People’s Republic of China by entrusting the domestic units who have not received the related licenses of civil nuclear safety equipment or by trusting the foreign units who have not received the confirmation of registration.

It is forbidden to forge, transform, or transfer the confirmation of registration.

Article 17 The registered foreign units shall obey the laws and administrative regulations, and the nuclear safety supervision and management provisions of the People’s Republic of China when carrying out the design, manufacture, installation and non-destructive test activities within the territory of the People’s Republic of China, and shall be responsible for the quality of the corresponding activities engaged in.

Chapter 3 Supervision and inspection of the nuclear safety supervision

Article 18 The registered foreign units shall accept the supervision and inspection of the nuclear safety supervision and management department of the State Council and the representative institute when carrying out the design, manufacture, installation and non-destructive test activities within the territory of the People’s Republic of China, and state the facts as they are and provide the necessary data.

Article 19 The operating units of civil nuclear facilities shall submit a report in written form to the nuclear safety supervision and management department of the State Council and its agencies within 20 days starting from the date when the foreign trade Contract becomes effective. The contents of the written report shall include the Contract terms related with technology and quality, the technical appendixes of the Contract, the delivery date and the overall schedule, etc.

The operating units shall submit the written report to the nuclear safety supervision and management department of the State Council and its agencies 1 month before starting the design, manufacture, installation and non-destructive test activities of the related civil nuclear safety equipment. The contents of the written report shall include the contents of the design, manufacture, installation and non-destructive test activities, the time schedule, the quality plan and the supervised manufacture plan of the related civil nuclear safety equipment of the operating unit.

Article 20 The nuclear safety supervision and management department of the State Council and its agencies shall determine the contents that have to be supervised and inspected, work out the corresponding supervision and inspection plan based on the report submitted by the operating units of civil nuclear facilities according to the stipulations of this provisions, and notify the operating units the plan in written form.

The operating units shall inform the nuclear safety supervision and management department of the State Council and its agencies in written form 2 months before starting the inspection points determined in the supervision and inspection plan.

Article 21 The nuclear safety supervision and management department of the State Council and its agencies are entitled to take the following measures when supervising and inspecting the design, manufacture, installation and non-destructive test activities of the civil nuclear safety equipment made by the foreign units:

(1) To get to know about the situations from the legal representatives of the related units and other personnel;

(2) To enter the related units to make site inspection;

(3) To consult, duplicate the related documents, records and other related data;

(4) To ask the operating units of civil nuclear facilities to investigate and handle the quality problems or defects discovered, and to submit the statement of the related situations and the subsequent handling report.

When the nuclear safety supervision and management department of the State Council and its agencies are making supervision and inspection, the operating units shall send their people to cooperate at the site.

Article 22 During supervision and inspection, the nuclear safety supervision and management department of the State Council and its agencies shall record the inspection contents, the problems found and the handling situations, and the record shall be confirmed by signatures of the supervisors and inspectors, the persons of the operating units of civil nuclear facilities and the relevant responsible persons of the units to be supervised and inspected.

In case that the relevant responsible persons of the units that have been supervised and inspected refuse to sign the record, the supervisor and the inspector shall keep the related situations in the record.

Chapter 4 Supervised manufacture, inspection before shipping, supervised installation and acceptance of the operating units of civil nuclear

facilities

Article 23 The operating units of civil nuclear facilities shall make supervised manufacture, inspection before shipping, supervised installation of the imported civil nuclear safety equipment, and make acceptance of the quality of the imported civil nuclear safety equipment.

Article 24 The operating units of civil nuclear facilities shall provide adequate number of personnel who have professional knowledge and business abilities for the corresponding supervised manufacture, inspection before shipping, supervised installation and acceptance.

Article 25 The operating units of civil nuclear facilities shall work out the plans of supervised manufacture, inspection before shipping, supervised installation and acceptance, and formulate the corresponding inspection requirements.

The personnel who are responsible for supervised manufacture, inspection before shipping, supervised installation and acceptance shall implement the plans of supervised manufacture, inspection before shipping, supervision installation and acceptance and the inspection requirements.

Article 26 The operating units of civil nuclear facilities shall verify the quality of design activities of the imported civil nuclear safety equipment.

Article 27 The operating units of civil nuclear facilities shall verify the quality of the non-destructive test activities of the imported civil nuclear safety equipment.

The verification specified in the previous Article can be made in the forms of the site witness, examination of the documents, etc.; or by random re-inspection when necessary.

Article 28 The operating units of civil nuclear facilities shall make supervision and inspection of the implementation of the quality assurance programs or the quality management manuals of the registered foreign units.

Article 29 The related personnel of the operating units of civil nuclear facilities shall keep a record of the contents of inspection, verification or supervision, the problems found and the handling situation. When nonconformities to the Contract or the related provisions found, the operating units shall handle them timely, and report the related situation to the nuclear safety supervision and management department of the State Council for putting on file.

Chapter 5 Safety inspection of the civil nuclear safety equipment

Article 30 The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall make safety inspection of the imported civil nuclear safety equipment according to the laws. The safety inspection may take the form of independent inspection or verification.

The imported civil nuclear safety equipment whose safety is not inspected or inspected not qualified shall not be allowed to be used on the civil nuclear facilities within the territory of the People’s Republic of China.

Article 31 Bases for safety inspection of the imported civil nuclear safety equipment mainly include:

(1) Laws, administrative regulations, and provisions on nuclear safety supervision and management of the People’s Republic of China;

(2) The national standards of the civil nuclear safety equipment, the industrial standard or the standards accepted by the nuclear safety supervision and management department of the State Council when the foreign units applying for registration;

(3) The foreign trade contract;

(4) The technical specification of the related equipment.

Article 32 The personnel who are engaged in safety inspection of the imported civil nuclear safety equipment shall be familiar with the related laws and regulations, the standards and the related technical documents, and shall have the corresponding inspection skills.

Article 33 When the imported civil nuclear safety equipment arrives at the port, the operating units of civil nuclear facilities shall report it to the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it for inspection, and provide the following documents:

(1) Application for inspection of the imported civil nuclear safety equipment;

(2) Duplicate of the confirmation of registration;

(3) Packing list;

(4) Product quality certificate.

The documents submitted by the operating units shall be in Chinese or English.

Article 34 The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall examine the documents submitted for inspection by the operating units of civil nuclear facilities according to this provisions, and may make inspection of the arrived equipment when necessary.

For the equipment that conforms to the requirements, “Imported civil nuclear safety equipment port inspection release permit” shall be issued. The operating units shall take the “Imported civil nuclear safety equipment port inspection release permit” to the related institute to go through the formalities for commercial inspection according to the stipulations of the related laws and regulations.

For the equipment that does not conform to the requirements, the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall notify the operating units of the situation in written form and state the reasons.

Article 35 The operating units of civil nuclear facilities shall apply to the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it for inspection 20 working days before the scheduled unpacking inspection of the imported civil nuclear safety equipment, and submit the following documents:

(1) The general assembling drawing, the delivery inspection and test report, and so on, and the product as-built document of the imported civil nuclear safety equipment;

(2) The report on results of supervised manufacture, inspection before shipping, supervised installation and acceptance of the operating units;

(3) The report on handling the problems found by the nuclear safety supervision and management department of the State Council during supervision and inspection and the closing situations;

(4) The records of the non-conformances of the imported civil nuclear safety equipment activities, and the major and essential non-conformances record;

(5) Other documents that have to be submitted as required by the nuclear safety supervision and management department of the State Council.

The above documents submitted by the operating units shall be in Chinese or English.

The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall examine the above application documents for unpacking inspection, and shall send the safety inspection personnel to be present at the site for witness before the unpacking inspection.

Before the safety inspection personnel arriving at the site, the operating units shall not make the unpacking inspection.

Article 36 After unpacking inspection, the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall issue the unpacking inspection report within 20 working days.

For the equipment inspected not qualified, the nuclear safety supervision and management

department of the State Council and the inspection institutes subordinated to it shall state in the report the reasons for the off-qualification; and the operating units of civil nuclear facilities shall not carry out the installation and commissioning activities.

Article 37 The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall make inspection of the test in the commissioning stage involving the safety performance before installation and loading.

The operating units of civil nuclear facilities shall notify the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it of the test involving the safety performance of the imported civil nuclear safety equipment 30 days before starting the test. The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall make necessary selection of the witness points, and make the witness record.

The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall issue the inspection report within 30 working days after all the tests involving the safety performance of the imported civil nuclear safety equipment are finished.

Article 38 The nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall issue the safety inspection report after examination of the documents and records, unpacking inspection, installation inspection and the test inspection involving safety performance in the commissioning stage before loading.

The equipment not qualified in the safety inspection, the operating units cannot operate and use.

Article 39 The supervision and inspection personnel and the safety inspection personnel of the imported civil nuclear safety equipment shall keep technical secret and business secret for the unit to be inspected; shall not abuse their powers to encroach on the legitimate rights and interests of the enterprise, shall not take the advantage of their positions to ask for briberies or accept money or properties; and shall not be engaged in or participate in business activities of the civil nuclear safety equipment.

Article 40 The safety inspection made by the nuclear safety supervision and management department of the State Council and the inspection institutes subordinated to it shall not lighten or transfer the related responsibilities of the foreign units and the operating units of civil nuclear facilities.

Chapter 6 Legal responsibility

Article 41 If the nuclear safety supervision and management department of the State Council and its agencies, its subordinated inspection institutes and the related staff members have one of the following acts, the chief management persons who have direct responsibilities and other persons of direct responsibilities shall be punished according to the law; those who have committed a crime shall be

punished according to the law:

(1) Those who refuse to accept or register the application for registration that is in conformity with this Provisions;

(2) Those who find acts violating this Provisions do not investigate and handle the illegal acts or do not handle them according to the law after receiving reports on offences;

(3) Those who disclose the technological secret or business confidential of the unit being inspected;

(4) Those who abuse one's power to infringe upon the enterprise lawful rights and interests, or take advantage of their positions to ask for and accept money or property;

(5) Those who engage in or participate in the business activities of civil nuclear safety equipment;

(6) Those who have other law-breaking acts in the course of supervision and management of the imported civil nuclear safety equipment.

Article 42 If those foreign units who have one of the following acts, the nuclear safety supervision and management department of the State Council may suspend or take back the confirmation of registration according to the seriousness of the case:

(1) Those who have violated the relevant laws, administrative regulations, and the nuclear safety supervision and management regulations of the People’s Republic of China;

(2) Those who are engaged in design, manufacture, installation and non-destructive test activities of civil nuclear safety equipment not according to the type and scope of activities stipulated in the confirmation of registration;

(3) Those who have changed the unit name, the country (region), residence or legal representative without going through the formalities for the changes in the confirmation of registration according to the stipulations;

(4) Those who have committed tampering or transferring of the confirmation of registration and other deceptive acts.

Chapter 7 Supplementary Provisions

Article 43 Those foreign units who apply for registration of activities of manufacture and installation of civil nuclear safety equipment, and plan to carry out the non-destructive test activities of the civil nuclear safety equipment manufactured and installed by themselves do not need to apply for registration of non-destructive test activities separately.

Article 44 The operating units of civilian nuclear facilities who entrust the supplier of complete set of civil nuclear safety equipment, the general construction contractor of the nuclear island of civil nuclear facilities or the license holder of civil nuclear safety equipment to procure the equipment, the entrusted procurement unit shall undertake the relevant responsibilities of the operating units stipulated in this Provisions. But the operating units shall undertake all the responsibilities for utilization and operation safety of the imported civil nuclear safety equipment.

Article 45 The definition of some technical terms is as follows:

Safety inspection: it refers to the inspection or verification of the safety performance of the imported civil nuclear safety equipment under the precondition that it is checked qualified by the foreign units, and the supervised manufacture, inspection before shipping and supervised installation made by the operating units of civil nuclear facilities are qualified, including the three stages: inspection of the related documents formed in the process of activities; unpacking inspection; and the installation inspection and the test inspection involving safety performance in the commissioning stage before loading,

Article 46 The Provisions shall go into effect as of January 1, 2008.
