Social Security recently changed their rules for what canhappenafteryouaredeniedbyajudge.Previously,whenaclientwasdenied,therewerethreeoptions.ItcouldbeappealedtotheAppealsCouncil,youcouldstartanewcase,orboth. Often,wewouldadviseclientstodoboth.BeginningJuly28,SocialSecurity’sruleshavechanged. You
cannolongerstartanewcasewhenyouhaveappealedacasetotheAppealsCouncil.Nowwemustchoosebetweenappealingthedenialorhavingyoustartanewclaim.Thisisadifficultchoicetomake.Ifyourconditionshavegotten
worsebetweenthetimeyouappliedandthetimeyouweredeniedatyourhearing,thejudgemayhavedeniedyoubasedonmedicalrecords fromwhenyoufirst applied and, as your conditiongetsworse,theAppealsCouncilwon’tconsideranythingthathappenedafter thehearing. This iswhereanewcasecouldbehelpful,asa new case would look at your worsened condition. However,choosingtoforgotheAppealsCouncilandstartanewcasewouldcauseyoutoloseanychanceatthebackpayfromwhenyouapplieduntilthejudge’sdenial,whichcouldbe2-3yearsworthofmoney.Insomeinstances,itcouldevencauseyoutonotbeeligibleforSSDatall,duetothelengthoftimesinceyoulastworked.Ifyoualreadyhaveacaseat theAppealsCouncilandanew
claim thatyoufiledbefore July28,SocialSecuritywill continuetoprocessbothclaims. Ifweappealedyourcase to theAppealsCouncil and advised you to start a new claimbut you have notyetdoneso,don’tfileonenow. Ifyouaredeniedbya judge inthefuture,beassuredthatwewilltakeaverycarefullookatyourdenial,yourcondition,yourworkhistory,andthenewrulesandadviseyouon ifwe feel it’sbest foryou toappealornot. Ifwechoosenot toappealyourdenialand insteadadviseyou tofileanewclaim,andyouareupsetbythatordon’tunderstandwhy,feelfreetocontactusandwewillhelpyouunderstandourdecisionandhowthisnewlawimpactsyou.

Therenever seems to be enoughmoney.But, if you’re on afixedincomefromsocialsecuritydisabilityorothersettlement,it’seventoughertomakeendsmeet.Creatingamonthly
budget is critical toliving within yourmeansandeliminatingdebt. It’s also a greatwaytoreducethestresscaused by runningout of money beforemonth’send.Herearesomequicktipstohelpyoumakeyourownbudget:
1) Make a list of each one of your monthly expenses. Onceyouhavealistofallyourexpenses,comparethemagainstthemoneyyoucancountoncomingineachmonth.Ifyou’respendingmore thanyougeteachmonth, seewhereyoucancut expenses. For example, you might cut some premiumcablechannelsorrentamovieinsteadofgoingtothecinema.Makefamilymealsinsteadofgettingtake-out.And,conserveelectricitybyshuttingofflightswhennotinuse.Itmaysurpriseyouhowmuchthesesimplestepscansave.
2) Track every expense down to the dollar. Getinthehabitorwritingdownallpurchases.Youmightevenwanttogetanotebookwhereyoucanrecordeverydollarspent.Whenyoulookbackonthemonth,you’lltrulyseewhereallyourmoneyisgoingandyou’llfindthatyou’relesslikelytospend

Instructions:Creamthebutterandsugar.Addeggs,oneatatime,beatingwellaftereachaddition.Siftsalt,sodaandflourtogether3times.Alternativelyadd sour creamandflourmixture, endingwithflourmixture. Addvanilla.Greaseflouratubepan.Mixtoppingingredientsandsprinkleasmallamountonthebottomofthepan;add½ofthebatter.Sprinkleonmoretoppingandrestofbatter. Then,sprinkleontheremainingtopping.Bakeat300degreesfor1-1/2hours.Donotopenovendoorforthefirsthourofbaking.

Ifyourchildhasaphysicalor learningdisability, it’s important tobe preparedwhen sending themback to school.There are resourcesavailablethroughthestateandthepublicschoolsystem.But,youwilloftenneedtobeproactivetofindthemandsometimesfightfortherighttousethem.Herearesomestepstohelpyouadvocateforyourchild:
1.Knowthelaw.LearnaboutlawssuchasthefederalIndividualswith Disabilities Education Act (IDEA) and state laws aboutwhich agencieswill providewhich services for your child.Thelegaljargonmayseemoverwhelmingatfirstbuttheschooldistrictorstate’sdepartmentofeducationcanbeagreatresource.
2.Understandtheprocess.Don’tberushedwithoutallthefacts.Getall yourquestions answeredbefore you commit to an approachforyour child’s treatment.Don’t assume that the schooldistrictknowswhat’sbestforyourchild.
3.Meetotherslikeyou.Therearethousandsofotherparentswhohavegonethroughwhatyouarenowgoingthroughandquiteafewofthemjoinsupportnetworkstomeetothersandsharetheirexperiences.Manyof these groupshavewebsiteswith awealthofinformationandmanyevenofferadvocacyclassesforparents.
4.Speakup.Youwillgetlotsofadvicefromexpertsabouttreatmentforyourchild.Thatadvicemaybeconfusingorevenconflictwithyourownopinions.Remember,though,thatyourquestionsand
concerns are important somake sure you’re clearlyheard.Afterall,youknowyour child better thananyoneelse.5.Get it in writing. Everychild in public schoolsthat needs specialeducation must have anIndividualized Education Plan (IEP). The IEP details the specificteachingapproachthatwillbetakenandtherapyrecommendationsforthechild.Itshouldalsodiscussgoalssothechild’sprogresscanbeaccuratelymeasured.Knowwhat’sinyourchild’sIEPandwhatis not. If there’s something you think is needed, such as a therapy,that’snotinthere,oddsareitwon’thappen.Besuretopointoutkeyomissions to school officials right awayand share thatwritten IEPwithyourlegalteamatouroffice.
6.Makeyourchild’steachersawareifyou’retryingforSSIforthechildand,asthehearingapproaches,asktheteachertowriteastatementabouthowthechild’sdisabilityimpactstheirperformancesowecansend it to the judge.You should also let us know if the teacher iswillingtofillouttheforms.
7.IfyouhavenotlookedintoSSIbenefitsforyourchild,contactusforafreeevaluationtoseeifyourchildhasapotentialclaimforSSI.

SENDING YOUR CHILD WITH A DISABILITY BACK TO SCHOOL:TIPS FOR PARENTS

Strappingone’schildintothecarseatisaregulartaskformostparents.Unfortunately,evenverysmallchildrenareabletounbucklethemselves, leading to distracted parentsbehindthewheelandcaraccidents.Researchers at the Yale School of
Medicine surveyed 378 parents. Slightlyover half reported that at least one of theirchildren had successfully unbuckled their
seatbeltswhileinacarseatoneormoretimes. Childrenasyoungas12monthswereabletoextricatethemselves,and75%ofthekidswere 3 years old or younger. Boysweremore likely thangirls tounbucklethemselves(59%ofboys,asopposedto42%ofgirls).Morethan40%ofkidswho“freed”themselvesdidsowhilethe
vehiclewasmoving. Thedistraction toparents, as theypullover,reprimandtheirchildren,and then buckle themin again, increases thechancesofaseriousinjury3.5times.So be sure to double
check that your child’sseat is installed properlyand that children arefastenedsecurely.
DON’T TAKE CHANCES WITH KID’S CAR SEATS frivolouslygoingforward.Ifyouhaveacomputer,youmaywantto
takeadvantageoffreebudgetingprogramslikeBudgetSimple.comorMint.comtotrackexpensesandmakesureyou’restickingtotheplan.
3) Put money aside each month for basic living expenses.Yourrentormortgage,phone,insurance,gas,andelectricbillsmustbeyourfirstpriority.Afterthatcomesfood,gasolineandentertainmentif there’s money left. But, remember that you don’t have to spendeverydollar.It’saverysmartideatosaveforarainydayifyoucan.
4) Use only cash or a debit card for purchases.Usecreditcardsonlyinatrueemergency.Ifyoudon’thavethecashforthatitem,don’tbuyit.Usingcreditcardscanencouragespendingbeyondyourbudgetandleadtobigproblemslater.
5) Shop with coupons and buy on sale.Clippingcouponsandbuyingonlydiscounteditemscansavehundredsofdollarseachyear.Besuretocheckthenewspaperand,ifyouhaveaccesstheinternet,visitcouponwebsitesforsavings.
6) Never shop on impulse.Eventhebestbudgetcangoawryquicklyifyoustrayfromtheplan.Toavoidthat,makeashoppinglistandpurchasejustthoseitemsonthelist.Ifthere’sagreatsaleonanitemthehouseholdreallyneeds,youmaywanttomakeanexceptionbut,dososparinglyandonlyiftheitemisreallyneeded.
7) Review and update your budget regularly.Afterafewmonthsofbeingonabudgetandtrackingyourexpenses,you’llhaveagoodsenseofwhat’strulyneededandwhatcanbecut.Reviewandadjustthebudgeteveryfewmonthstosavemoredollarsandtoadapttochangesinincomeorlifecircumstances.
