The rhetorical cogency of analogical argumentation in late medieval and early modern political
thought
From the middle ages through early modern times the idea that the whole creation was regulated
by some kind of law, which had been imposed by the divine Intellect – and yet this eternal law
bound its source, God as well, who participated in it necessarily, but by His free will –, was a
common belief, shared by a great deal of legal- and political thinkers. In this paper I intend to
look behind the typical argumentation method, the analogical argumentation, of this era, to find
the sources of its cogency, and to understand what made the correspondences between, say, God
and kings, the human body and the body politic, the family and the state, etc. intelligible.

Das Rheingold by Richard Wagner. Riflessioni e metodi sul rapporto tra Diritto e Teatro
musicale
Nella poderosa architettura del Ring wagneriano, Das Rheingold costituisce l’antefatto
dell’intera vicenda, che viene poi a svolgersi nelle tre opere successive (Die Walküre, Siegfried e
Götterdämmerung). Nell’opera già si concretizzano le ragioni profonde e giustificatrici dell’intera
vicenda destinata a condurre alla caduta finale degli dei. La Tetralogia può essere indagata sotto
innumerevoli profili, stimolati dall’intrecciarsi nel capolavoro wagneriano di temi mitologici,
filosofici, politici, psicologici, sociali. Das Rheingold si presta, tuttavia, ad essere letto anche
nella prospettiva del diritto dei contratti, e – sotto questo profilo – costituisce un esempio di un
più ampio approccio al tema del rapporto tra Diritto e Teatro musicale. In Das Rheingold, la
vicenda del contratto assume particolare rilievo. Non è un caso: l’opera si situa a cavallo degli
anni 1853-1854, nella grande età delle codificazioni, e in un periodo di profonde trasformazioni
socio-economiche. Analoghi approcci sono proponibili per numerosi altri titoli della Storia del
teatro musicale.

Das Rheingold by Richard Wagner. Reflections and methods on the relationship between law and
musical theatre
In the powerful architecture of Wagner's Ring, Das Rheingold is the background of the whole
affair, which will develop three subsequent works (Die Walküre, Siegfried and
Götterdämmerung). Das Rheingold already reflects the deep reasons of the whole affair destined
to lead to the final fall of the gods. The Tetralogy can be investigated under countless profiles,
stimulated by the intertwining in the Wagnerian masterpiece of mythological, philosophical,
political, psychological, social themes. Das Rheingold may, however, be also read in the
perspective of contract law, and - in this respect - is an example of a broader approach to the
relationship between Law and Musical Theatre. In Das Rheingold, the relevance of the contract
is particularly important. It is no coincidence: the work was written in the years 1853-1854, in
the great age of codification, and in a period of profound socio-economic transformations.
Similar approaches are to be proposed for numerous other titles in the history of musical theater.

Segno, simbolo, diritto: argomenti per un’ipotesi di lavoro
La polarità segno-simbolo attraversa la modernità giuridica. In Hobbes, crocevia imprescindibile,
il “segno” (mark) convive con la sfera simbolico-letteraria. Ciò inaugura due linee parallele: da
un lato l’identificazione del normativo con l’unilateralità semiotica del “segno” (Bentham: diritto
sistema di “segni”) e, dall’altro, la progressiva riemersione della pluriversità del “simbolico” (il
Weltbild weberiano, la Repräsentation schmittiana, forse alcuni aspetti di Kelsen). Tali
“riemersioni” rivelano tratti comuni: humus storico-culturale (primo Novecento e l’idea di
Gestalt); profilo semiotico-normativo connesso al cangiante milieu europeo; registro simbolico-
letterario come individuazione del giuridico. Di qui l’ipotesi di lavoro: “segno” e “simbolo”
rappresentano nozioni correlate e non polari. Concettualmente distinte e funzionalmente
divergenti, esse forse operano a due connessi livelli epistemici (denotativo-espressivo e
fondativo). Il registro simbolico-letterario, mediazione tra i due livelli, emerge particolarmente
nelle crisi degli assetti politico-istituzionali: può allora configurarsi una semiotica giuridica più
articolata o “inclusiva”?

Sign, Symbol, Law: Arguments for a Working Hypothesis
The polarity sign-symbol crosses the legal modernity. Within Hobbes, an unsurmountable
milestone, “sign” (mark) and symbolic-literary dimension coexist.
Accordingly two parallel directions emerge: the identification of law with the semiotic univocity
of “sign” (Bentham: law as a “system of signs”) and the pluriversity of “symbol” (the weberian
Weltbild, Schmitt’s Repraesentation, some aspects of Kelsen’s theory). These dynamics have
common traits: the historical-cultural context (the beginning of the last century, the idea of
Gestalt); a semiotic-legal profile directly related to the changing social milieu; the symbolic-
literary dimension as an individuation of law. The working hypothesis: “sign” and “symbol” are
not polar but related to each other. Though conceptually distinct, they play on two connected
epistemic levels (denotative-expressive and fundative). The symbolic-literary dimension, as a
mediation, emerges in particular during the political-legal crashes. Is it possible a more
articulated and “inclusive” legal semiotic?
Borges, Gustavo Mariano (Universidade Federal de Goiás – UFG,
Real territories: photographs of illegalities in properties
The aim of this paper is to examine primarily how the imaginary, the ego and narcissism are
crucial in the process of creation of the significant “property” and its relation with the “city”,
despite the strong ideological influence of individualism. The stages of the research were: a
theoretical, an empirical photographic study, two exhibits of the photos, a questionnaire was
administered and the analysis of all the data collected. It was verified that the city was built
disorderly because of public Power connivance in Goiânia. The relevance of the capitalist,
liberalist and individualist imaginary in the development of the city is visible, since the owners
abuse the area by using public goods (street and sidewalk). Furthermore, these evidences reveal
the need of an imaginary resignification of the social function of the property, so as to prevent
more illegalities and guarantee a balanced relation between “public” and “private”.

Genesi e Popol Wuh. Miti delle origini, idee di comunità, diritto alla diversità culturale
La presentazione riguarderà un confronto tra due narrazioni fondanti diverse idee o “modelli” di
comunità: da un lato la Gemeinschaft pensata da Tönnies e rielaborata da Schmitt e, dall’altro
lato, la Comunidad cui fanno riferimento i popoli indigeni latinoamericani. Un confronto che
parte da due miti delle origini – quello narrato nel Libro della Genesi e la cosmogonia Maya
Quiché narrata nel Popol Vuh – e giunge ai riflessi che ancora oggi tali narrazioni producono
nell’argomentazione pubblica in tema di diritti e libertà nelle società multi- e inter-culturali
contemporanee. Lo studio si concentra in particolare su come gli elementi dell’identità culturale e
dell’appartenenza possano essere utilizzati per motivare la produzione di norme e politiche di
segno opposto, orientate all’esclusione piuttosto che all’inclusione, alla discriminazione come
all’emancipazione di singoli individui o gruppi sociali.
Genesi and Popol Wuh. Origin myths, ideas of community, right to cultural diversity
The presentation will shows a comparison between two ideas or "models" of community, Tönnies
Gemeinschaft, reworked by Schmitt, and the Comunidad which the indigenous peoples of Latin
America referred to. A comparison that starts from the respective origin myths (the biblical
Genesis and the myth of Babel on one hand, and the Maya cosmogony narrated in the Popol Vuh
on the other) and arrives at the reflections on rights and freedoms that these narratives still
produce today, in contemporary multi- and inter-cultural societies. The study focuses in particular
on how the element of identity and belonging to a community can be used to motivate the
production of norms and policies in the opposite direction, oriented to the exclusion or inclusion,
to discrimination or emancipation of individuals and social groups.

Rappresentazione del potere e potere della rappresentazione. Ritratti di giudici
Nella lettura di Louis Marin, ciò che il chiasmo tra rappresentazione e potere maschera è che il
potere della rappresentazione non è mai il ritorno del potere che essa rappresenta, ma sempre
l’invenzione di un altro potere. Nella ritrattistica dei giudici, i solenni dispositivi rappresentativi
del potere del giudicare mostrano, prima facie, le virtù e le qualità del giudice; dietro di esse,
tuttavia, come nel ritratto del giudice del pittore Titorelli di Kafka, campeggia la Giustizia nei

suoi molteplici volti, così come essa si dà a vedere allo sguardo che sul dipinto si posa. Non si dà
percezione senza interpretazione: ogni sguardo coglie quel potere retrostante che rafforza e
moltiplica il potere della decisione, attribuendogli uno dei sensi possibili che la Giustizia rilascia,
ben al di là dell’intenzione dell’autore. La potenza iconica, infatti, non può essere totalmente
sorvegliata e indirizzata: la rappresentazione del potere deve misurarsi col potere della
rappresentazione.
Representation of Power and Power of Representation. Judicial Portraiture
According to Louis Marin, the chiasmus between representation and power always masks the
presence of another power. In judicial portraiture, the solemn representation of the symbols of
judgement’s power shows, prima facie, virtues and qualities of the judge: behind them, however,
as in the court portrait painter Titorelli Kafka, stands Justice in its diverse faces, as the observer
perceives them. Perception is always interpretation: every look captures the rear power that
strengthens and multiplies the power of decision, giving it one of the possible ways that the
Justice releases, well beyond the intention of the author. The iconic power, in fact, cannot be fully

Dall’immagine del pensiero all’immagine del diritto. Riflessioni deleuziane sulla semiotica
filosofico-giuridica
Il tema del segno emerge ripetutamente nella riflessione di Deleuze, il quale in un’occasione
chiarisce che la sua filosofia va considerata una “teoria dei segni e degli eventi”. Se il pensiero di
Deleuze può essere letto come una linguistica filosofica (Fabbri), occorre considerare come il suo
discorso sul segno abbia potenzialmente una valenza filosofico-giuridica. Per comprendere
quest’ultima si deve forse sottoporre l’immagine del pensiero del diritto alla medesima critica che
il filosofo francese volge all’immagine del pensiero filosofico. La torsione trascendentale cui
viene sottoposta l’immagine del pensiero gius-filosofico tramite l’intercessore Deleuze apre ad
una concezione semiotica in grado di raccontare il campo del diritto secondo un punto di vista
eccentrico. Tale campo può essere illuminato dalla riflessione deleuziana, anche quando questa
non sembra riferirsi direttamente al diritto, ma tratta di scontro con i segni (Proust), segno-affetto
(Spinoza), archeologia dei segni (Foucault).

From the image of thought to the image of law. Deleuzian reflections about philosophical-
juridical semiotics.
The theme of the sign comes up many times in the reflection of Deleuze, who once specified that
his philosophy could be considered a "theory of signs and events". If the thought of Deleuze can
be interpreted as philosophical linguistics (Fabbri), we need to consider the philosophical-
juridical implication of his views on sign. To understand that, we should subject the image of
juridical thought to the same criticism that the French philosopher expressed towards the image
of the philosophical thought. The transcendental twist to which the image of philosophy of law is
subject, through the intercessor Deleuze, opens to a semiotic conception which can describe the
field of law according to an eccentric point of view. This field can be illuminated by the
reflections of Deleuze, even when they don’t pertain directly to the Law, but they concern the
collision with the signs (Proust), the sign-affect (Spinoza), the archaeology of signs (Foucault).

Perché gli squali non mordono gli avvocati? Riflessioni su diritto e comicità
È opinione comune che diritto e comicità esprimano i due opposti principi dell’ordine e del caos:
mentre il diritto mira a creare un ordine, attraverso una serie di principi e regole, il comico lavora
contro la logica, le regole e l’ordine. Il diritto definisce ciò che è serio, ciò di cui si ritiene non si
debba ridere, in quanto considerato, in linea di principio, bonum et aequum per l’intera società.
Tuttavia, quando il diritto diviene soggetto di comicità, il comico rivela che la legge non è sempre
giusta, e che i consociati richiedono una maniera differente di vivere la propria responsabilità
sociale.
Gli autori discuteranno, da una parte, alcune regole elaborate per salvaguardare il Diritto della
derisione e, dall’altra, la rappresentazione verbale e visiva del diritto entro la cornice comica di
alcune celebri opere letterarie e cinematografiche.
How is it that sharks do not bite lawyers? Marginalia on the relationship between law and comic
It is generally agreed that law and comic embody the two opposing principles of order and chaos:
as the law aims at creating an order out of a set of rules and norms, the comic works against logic,
rules and order. Law defines what is serious, that is what we are not supposed to laugh at, being it

conceived, as a matter of principle, bonum et aequum for the entire society. But, when the law
becomes a humorous subject, the comedy unveils that the law is not always right and society
demands a different way to live its social responsibility.
The authors will discuss, on the one hand, some of the rules made in order to preserve Right from
derision and, on the other one, the verbal and visual representation of the law within the
humorous framework of some popular literary works and movies.

Il diritto di fronte al tribunale della storia
Le moderne democrazie occidentali sono ossessionate dalla memoria nella sua dimensione
individuale e collettiva. Negli ultimi anni si è assistito ad un crescente fenomeno di
giuridificazione della storia: il passato è posto di fronte a un tribunale permanente, nel quale
l’umanità è, al contempo, giudice e accusatore. Così, in nome dell’obbligo morale e politico di
ricordare, si fa un uso strategico della narrazione storica nelle aule giudiziarie: da una parte, se ne
impiegano metodi e strumenti, anche interpretativi, dall’altra, si pretende di stabilire nelle
sentenze la verità storica. Solo la lotta contro l’oblio ed ogni tentativo di manipolazione del
passato da parte del potere può giustificare la “tribunalizzazione della storia” in atto. In fondo,
Benedetto Croce ci ricordava che la “storia non è mai giustiziera, ma sempre giustificatrice; e
giustiziera non potrebbe farsi se non facendosi ingiusta”.
The Law in front of the court of history
Modern Western democracies are obsessed by the memory in its individual and collective
dimension. In the last years there has been a growing phenomenon of “juridification of history”:
the past is set in front of a permanent court, in which humanity is, at the same time, judge and
prosecutor. So, in the name of the moral and political obligation to remember, it makes a strategic
use of historical narrative in the courtrooms: on the one hand, they employ methods and tools,
including interpretation, on the other, it is pretended to establish the historical truth in the
sentences. Only the struggle against forgetting and every attempt of manipulation of the past by
the power can justify the process called “tribunalizzazione della storia”.

Indici dell’umano. Retorica delle neuroimmagini nel processo e nella “neurolaw”
L’intervento si propone di analizzare, con i metodi propri della retorica, il fenomeno dell’utilizzo
del neuroimaging in ambito processuale e filosofico-giuridico. Prendendo le mosse da posizioni
giusfilosofiche, di filosofia della mente e di neuropsicologia cognitiva, si esamineranno gli
impieghi delle neuroimmagini nell’ambito dell’argomentazione processuale e filosofico-
giuridica. Il metodo adoperato sarà quello della retorica, sia nella sua accezione classica, sia in
quella della argomentazione forense.
L’obbiettivo è quello di tracciare, per quanto possibile, un confine tra l’impiego delle
neuroscienze in ambito clinico e quello persuasivo-argomentativo in gioco nel processo, ma
anche in molti discorsi filosofici, riconducibili ai campi oggi denominati neurolaw e
neurocriminology. Si punterà anche ad illustrare come il metodo della retorica, intesa come
logica e argomentazione probatoria, ma anche come metalinguaggio, possa ricoprire un ruolo di
fondamentale importanza, non solo in questo specifico settore degli studi filosofico-giuridici, ma
anche in generale per l’accostamento teorico di Law and Humanities.
Indexes of the Human: Rhetoric of Neuroimaging in the Courtroom and in "Neurolaw"
The presentation aims to analyse, with the methods displayed by rhetoric, the use of
neuroimaging both in the courtroom and in philosophical reflections on law. Building on
positions in the fields of philosophy of law, the philosophy of mind and cognitive
neuropsychology, we will examine the uses of neuroimaging within both legal argumentation and
philosophical constructions. The method will be that of rhetoric, in its classical meaning and in its
legal one.
The goal is to draw, as much as possible, a boundary between the use of neuroscience in the
clinical activity and in the persuasive-argumentative one, at stake in the trial, but also in many
philosophical discussions, as in very recent fields like neurolaw and neurocriminology. It will
also aim to illustrate how the method of rhetoric, understood as logical and evidential reasoning
(but also as a meta-language), can play a key role, not only in the specific fields of philosophical
and legal studies, but also, in general, for the theoretical juxtaposition of law and the humanities.

La legge del piccolo schermo. Pratiche del discorso giuridico e televisione
Come mostra il crescente interesse verso la dimensione figurativa del diritto, le rappresentazioni
della giustizia fanno a tutti gli effetti parte del discorso giuridico e delle pratiche della sua
comunicazione. Le immagini non producono norme giuridiche ma rappresentano (e influenzano)
regole di condotta e percezioni del diritto. In stretto dialogo con alcuni filoni dei Visual Studies,
l’intervento intende riflettere su alcuni modelli di rappresentazione del fenomeno giuridico
prodotti in ambito televisivo, con particolare riguardo alla sfera giudiziaria. Ricostruire le forme
con cui la tv racconta le vicende giudiziarie consente di riflettere sul rapporto tra la messinscena
televisiva del sistema della giustizia e le logiche di giustificazione o critica dei sistemi normativi,
etici e culturali della società contemporanea. L’obiettivo è quello di decodificare i contenuti della
comunicazione televisiva per rispondere ad alcuni interrogativi di ordine generale: quali
immagini del giudizio, del crimine, del diritto vengono riprodotte e diffuse nei palinsesti
televisivi? Quale rapporto si instaura tra universo giuridico e racconto televisivo? Cosa si
nasconde dietro il carattere concorrente e in parte delegittimante che il racconto televisivo di
ambientazione legale instaura col sistema giudiziario?
The TV Rule. Legal Discourse’s Practices and Television
As increasing interest towards the figurative dimension of legal science shows, the justice’s
representations belong to legal discourse and to its communication’s practices. Images don’t
produce law, but do represent and influence behaviour rules and law’s perception. In close
connection to some Visual Studies’s strands, our contribution aims at reflecting on some models
of representation of legal phenomenon produced by TV, with particular reference to the judiciary
sphere. Investigating how TV talks about court cases allows reflecting on the relation between
TV production of judiciary system and trends of justification or critics of normative, ethic and
cultural systems. Our purpose is to decipher TV communication’s contents in order to answer
some general questions: which images of process, crime, law are reproduced and spread in TV
programms? What is the relation between legal sphere and TV storytelling? What is behind the
competing and somehow delegitimizing nature of the TV narrative towards the judicial system?

Critica letteraria e metodo retorico in Eric Voegelin

Nella sua corrispondenza con l'amico e scrittore Robert Heilman, Eric Voegelin rivela che
relativamente alle sue ricerche di filosofia politica, la critica letteraria risulta essere una delle sue
occupazioni principali. Un pregevole studio frutto di questa corrispondenza è senz'altro l'analisi
del racconto Il giro di vite di Henry James, nel quale Voegelin rintraccia la persistenza nella
società americana dell'eredità puritana.
Le interpretazioni di Eugene Webb e Charles R. Embry, due studiosi del filosofo tedesco, ci
consentiranno di mettere in rilievo le importanti novità contenute nella teoria letteraria
voegeliniana che può a buon diritto essere collegata al metodo retorico. Ci soffermeremo in
particolare sul simbolo del “Tempo del racconto” che rappresenta quell'esperienza dell'Essere nel
flusso della storia.
Literary criticism and rhetorical method in Eric Voegelin
In his correspondence with the friend and writer Robert Heilman, Eric Voegelin reveals that in
relation to his researches in political philosophy, literary criticism is one of his permanent
occupations. A fine result of the correspondence is the analysis of the novella The Turn of The
Screw by Henry James, in which Voegelin finds the persistence in the American society of the
puritan heritage.
The interpretations developed by Eugene Webb and Charles R. Embry, two scholars of the
German philosopher, will allow us to put into the important originality of the voegelinian literary
theory, that can be deservedly related to the rhetorical method. A matter of peculiar interest is the
symbol of the “Time of the Tale” which represents that experience of the “Being in flux” in
which the cosmic, divine and human elements are combined into one story.

La nuova civiltà del vetro
Quando, nel 1908, Filippo Turati ebbe a sostenere che «la casa dell’amministrazione dovrebbe
essere di vetro», senza saperlo dava avvio ad una secolare riflessione sul tema della trasparenza,
le cui origini, almeno per quanto riguarda la pubblicistica italiana, sono fatte ufficialmente risalire
proprio a quella intuizione turatiana. Più o meno negli stessi anni, Paul Scheerbart dedicò alla
Glasarchitektur una meditazione trasognata che vedeva nell’uso massiccio del vetro

nell’architettura il fulcro di una nuova utopica civiltà: «il nuovo ambiente di vetro trasformerà
completamente l’uomo», perché, come ebbe a commentare Walter Benjamin, il vetro è nemico di
ogni segreto. Così, dall’utopia architettonico-urbanistica scheerbartiana, alla trasformazione della
realtà sociale attraverso il mito della trasparenza, il passaggio era fin troppo chiaro: si trattava di
un mutamento che aveva a che fare con i modi dello sguardo, e di cui sarebbe il caso di
ripercorrere i primi passi per comprenderne le implicazioni e intenderne l’attualità.
The new glass environment
When Filippo Turati argued that "the administration's house should be made of glass" he started a
long reflection on the issue of transparency. More or less in the same years, Paul Scheerbart
wrote a book called Glasarchitektur, which is a dreamy meditation about the use of glass in
architecture – that would have been at the heart of a new utopian civilization: "the new glass
environment will completely transform men", because, as commented Walter Benjamin, the glass
is the enemy of all secrets. Thus, through this architectural utopia, the transformation of social
reality passed through the myth of transparency: this is a transformation that implicates the ways
of eye-look.

Costituzionalismo e cultura pop
Oggetto dell’intervento è l’illustrazione di una corrente pensiero che domina da decenni nel
panorama costituzionalistico nordamericano che va sotto il nome di costituzionalismo popolare.
Più in particolare si porrà attenzione sull’atteggiamento nei confronti della cultura di massa che
traspare in modo più o meno esplicito da queste teorie.
Dopo aver sommariamente ricostruito le caratteristiche del costituzionalismo popolare, nel saggio
si illustreranno le posizioni di tre autori, poco noti nel panorama costituzionalistico italiano,
Richard Parker; Sanford Levinson; e Jack Balkin.
Da tutti e tre traspare una rivalutazione della sensibilità populist e cioè di quell’atteggiamento
mentale che non è pregiudizialmente maldisposto nei confronti della cultura di massa. Si proverà
ad argomentare che questo atteggiamento è alla base di una nuova nozione di costituzionalismo e
di diritto.

Popular constitutionalism and pop culture
The subject of this essay is a constitutional theory which has been dominating the North
American academic scene for decades which goes under the name of popular constitutionalism.
More in particular it will be pointed out the attitude towards popular culture of the authors which
belong to this tradition is generally benevolent.
After briefly describing the main feature of popular constitutionalism, the theories of Richard
Parker; Sanford Levinson; e Jack Balkin, will be discussed.
All three authors claim to endorse a populist attitude which is characterized with a refusal of
common prejudices against mass culture. It will be argued that such an attitude may ground a
new concept of constitutionalism and law.

alla musica contemporanea, ossia la trasfusione del metodo retorico nella musica occidentale.
Nella musica il rapporto tra norme o canoni dell’arte ed attività soggettiva del compositore
assume una pluralità di gradazioni, assai più evidente che in altre manifestazioni umane. Il genere
“Ricercare-Fuga” attraversa i secoli recando con sé una sedimentata panoplia di norme regolanti
le modalità espressivo-compositive, cionondimeno mantenendo un grado di inesausta freschezza.
Il presente scritto indaga l’origine delle norme compositive, il consolidarsi ed il dissolversi dei
canoni compositivi, in comparazione con la monolitica perduranza del genere musicale
“Ricercare-Fuga” e si addentra nelle motivazioni che hanno portato ad una tanto estesa
formalizzazione dell’aspetto architettonico sotteso alla forma compositiva, tracciando un
parallelo con le origini e la storia del diritto positivo. L’intangibilità dell’elemento normativo
insito nella “fuga” consente di fare emergere gli aspetti archetipici della tecnica compositiva
umana, così come il processo nomopoietico che le è proprio, e le difese interne apprestate ai
tentativi di riforma o modificazione. Si sondano infine le convergenze tra retorica, metodo

retorico e ‘ricercare’, specie per quel che attiene alla inventio e dispositio, così come quelle tra
contraddittorio e sviluppo di soggetto e controsoggetto nella ‘fuga’.

“Daß die Fuge keine Fuge mehr ist”: the regulation of the genus ‘ricercare-fugue’ from the
renaissance to the contemporary music, or the transfusion of the rhetoric method in the western
music. The relationship between rules and canons of the art and the subjective activity of the
composer in music discloses several gradations, probably much more than in other human
activities. The complex “Ricercare-Fugue” passes through centuries, with a solid sediment of
rules concerning the way to compose, nevertheless keeping an unexhausted freshness. This paper
investigates the origins of the composing rules in wider terms, the reinforcing and the dissolution
of the composing canons, comparing them with the ‘monolithic’ continuity of the musical genre
Ricercare-Fugue; it deepens the reasons of the vast formalization of the ‘architecture’ of this kind
of composition, comparing them to the origin and history of the positive law. The intangible
number of rules of the “fugue” allows to identify the archetypical perspectives of the human way
to compose, the process of regulation in music and the internal ‘defenses’ from the attempts of
reform or alteration. Lastly the convergences between rhetoric, rhetoric method and ‘ricercare’
are examined, especially in connection with inventio and dispositio, as much as the alignment
between the juridical contradictory and the development of subject and reply in the ‘fugue’.

The musical regime of the word harmonizes its semantics with prosody and rhythmic structures.
In the relationship between word and music, each musical instant makes sense beyond its own
simple presence. The Gadamer’s search in 1983 (Verità e metodo) marks a dividing line between
hermeneutics and linguistics. In the relationship between text and interpretation, the linguistic
structures and process of understanding are emphasized. The activation of hermeneutic
procedures to determine a structure of sense for a musical composition has its reason because the
music is a language that appears text. In that direction the reconstruction of the musical sense
gets slot only in the direction of hermeneutics that regards the speaking subjects in a mediation

dimension, not least the legal horizon mediation. In effect both law and art find their own
expressiveness in the trialità del logos.
Poetry and music between language and law
Il regime musicale della parola è ciò che accorda la sua semantica alle strutture metriche e
ritmiche. Nella relazione tra parola e musica, ogni istante musicale acquista un senso che si
risolve al di là della semplice presenza. A partire dalle ricerche di Gadamer del 1983 (Verità e
metodo) in cui si traccia una linea di demarcazione tra impostazione ermeneutica e linguistica,
nel rapporto tra testo e interpretazione, l'accento si è spostato sulle strutture linguistiche e sul
processo del comprendere. L'attivazione di procedure ermeneutiche nel determinare una struttura
di senso di una composizione musicale trova la sua ragione nel ritenere che la musica sia un
linguaggio che si presenta come testo. In tale direzione la ricostruzione del senso musicale trova
un suo spazio solo in direzione di un'ermeneutica che guardi ai soggetti parlanti in una
dimensione di mediazione, non ultima la mediazione nell’orizzonte giuridico dato che diritto e
arte si richiamano in quanto entrambi trovano nella trialità del logos una propria espressività
metricamente comprensiva.

Il cerchio di gesso del Caucaso offre al lettore diversi spunti suggestivi sotto il profilo della sfera
emotiva che influenza la dimensione giuridica dell’agire umano. Le pictures of law sono
molteplici: il testo si apre con la decisione della controversia fra gli abitanti di due kolkhoz e si
chiude con la decisione del giudice Azdak sull’appartenenza del bambino conteso fra la madre
che l’ha abbandonato e la serva che l’ha cresciuto. I giudizi di Azdak non si basano
sull’argomentazione giuridica tradizionale, supportata dalla conoscenza della normativa e dalle
formalità processuali, ma combinano una dimensione iconografica ed emotiva. Nel testo teatrale
emerge in più punti il motivo del disprezzo delle formalità nel procedimento, ovvero di un
rispetto solo apparente da utilizzare per il proprio comodo, affiancato ad una maggiore attenzione

per gli aspetti più ‘umani’ della giustizia, meglio percepibili attraverso un ragionare per immagini
rispetto al linguaggio giuridico formale e ‘dotto’.
Around the Caucasian Chalk Circle: pictures of law and legal language in the play by Bertolt
Brecht
The Caucasian Chalk Circle offers to the reader many evocative references to the emotional
sphere that influences the legal aspect of human actions. There are many pictures of law
emerging from the text: it opens with the discussion of a dispute between two Caucasian villages
and closes with the decision of judge Azdak regarding whether a disputed child belongs to his
mother or to the servant who has raised him. The judgments of Azdak are not supported by
traditional legal argumentation based on legal knowledge and formal procedures; instead, they
are built on an emotional and iconographic dimension. In the play, the themes of disdain for
formalities of legal proceedings themselves and their hypocritical respect when deemed
convenient arise in several points and are accompanied by a deeper focus on the human aspects of
justice, more easily perceived by pictures of law in place of formal and cultivated legal language.

La presente riflessione aspira a riesumare la memoria del diritto moderno celata nella narrativa di
Kafka. Definisce questa memoria “involontaria” nel senso proustiano di inconscia, per
distinguerla da quella “volontaria” ̶ consapevole e organizzata ̶ della teoria e della storia del
diritto. Partendo dal postulato sociologico secondo cui la memoria è costituita essenzialmente da
processi di ricostruzione (Halbwachs, 1987), cerca di mostrare come gli scritti di Kafka con
proiezione di senso giuridico ̶ Davanti alla Legge (1915), Nella colonia penale (1919), Il
processo (1925), Il castello (1926) ̶ siano in grado di illuminare alcuni aspetti dell'esperienza
giuridica moderna che le rappresentazioni ufficiali del diritto, non immaginarie e accademiche,
trascurano o sopprimono.
The “involuntary” memory of modern law in Kafka̕ s fiction

My proposal is to exhume the memory of modern law hidden in Kafka̕ fiction. I call this memory
“involuntary” in the Proustian sense of the unconscious, to distinguish it from the “voluntary”
memory ̶ aware and organized ̶ of legal theory and history. Starting from the sociological
postulate that the memory of society is a reconstruction of the past composed of several layers,
where what is stated as social memory is just one of the possible memories (Halbwachs, 1987), I
try to show how the writings of Kafka with legal sense projection ̶ Before the Law (1915), In the
Penal Colony (1919), The Trial (1925), The Castle (1926) ̶ are able to illuminate some aspects
of the modern legal experience that official representations of the law neglect or suppress.

Argomentazione giuridica con i topoi della ‘competizione’ e della ‘non discriminazione’
confrontandoli con la dialettica classica
Attualmente le nozioni più frequenti dell’argomentazione giuridica sono la „competizione” e la
„non discriminazione”. Sono topoi che fungono da “carte vincenti” nei ragionamenti giuridici,
mentre in verità svolgono un ruolo ideologico. In confronto a ciò vorrei presentare il modo
dialettico-classico dell’argomentazione giuridica (soprattutto di Cicerone) che mira ad indagare la
realtà umana in modo pratico. Questo modo di ragionare retorico-dialettico usa un linguaggio che
si addice bene alla realtà - in parte mutevole - del diritto mentre mantiene il suo carattere
persuasivo. Il modo di pensare ideologico moderno ci impedisce di accostarsi alle peculiarità reali
delle cose, come fanno attualmente i concetti della ‘competizione’ e della ‘non discriminazione’.
Per palesarlo si deve passare oltre il linguaggio odierno.
Juridical argumentation with the topics of ‘competition’ and ‘non-discrimination’ in opposition
to the classical dialectical argumentation
Nowadays, the most frequent notions of juridical argumentation are “competition” and “non-
discrimination”. These have the function of trumps in legal argumentation. In fact, however, they
play an ideological role. In opposition to them I would like to show the dialectical-rhetorical
method of legal argumentation (eminently that of Cicero) directed at analysing human reality in a
practical way. This rhetorical-dialectical method uses a language that fits well to the – partly
changing - reality of the law, while maintaining its persuasive character. The modern ideological
way of thinking, using notions such as “competition” and “non-discrimination”, hampers us in

grasping the real peculiarity of things. In order to unveil this, we have to look behind the
language we use today.

La storiografia ottocentesca ha tramandato una lettura della storia giuridica romana come un
percorso quasi insensibile alle vicende emotive dei suoi interpreti, così come al contributo delle
arti per la traduzione della politica e dei programmi giuridici avviati dal potere imperiale. Mentre
già nel 1951 Marguerite Yourcenar (Memorie di Adriano) provava a leggere la fragilità del potere
e le fantasie che lo accompagnano, restituendoci un profilo di Adriano in tutta la sua umanità,
studi archeologici hanno dimostrato la permeabilità del diritto agli influssi culturali e artistici. Il
contributo che si propone prova a rendere ancora più evidente questo rapporto attraverso uno
sguardo incondizionato ai famosi pannelli della villa di Livia, moglie di Augusto, a Prima Porta.
Le immagini e il ritmo con cui la natura si dispiega parlano molto dell’imperatore e delle sue
visioni come ‘ordinatore del mondo’.
In the gardens of Power. Law and Politics through painted Nature
XIXth century storiography has passed on to us a conception of the history of Roman law as a
path almost insensitive to the emotional events of its interpreters, just as it was to the contribution
of the arts to translate the politics and the juridical programmes carried out by the Imperial
power. While in 1951 Marguerite Yourcenar (Memoirs of Hadrian) already tried to read the
fragility of power and the fantasies which accompanied it, giving us an image of a very humane
Hadrian, archaeological studies have shown the permeability of the Law to cultural and artistic
influences. This paper tries to make this relationship even more evident through an unconditional
look at the famous panels of the villa of Livia, Augustus’s wife, at Prima Porta. The images and
rhytm of Nature tell us about the visions of the Emperor as ‘ruler of the world’.

Il ruolo della semiotica viene spesso ridotto, dal positivismo giuridico, alle prospettive
antiumanistiche che hanno variamente afflitto la cultura del 900: dallo strutturalismo alla teoria
dell’informazione e alla linguistica, in una visione, come precisa Jori, “volutamente ristretta”
della semiotica giuridica. Il riemergere dell’estetica giuridica (Legendre, Robilant, Heritier), nella
sua originaria relazione con la retorica (Meyer, Manzin) permettono oggi di riaprire l’orizzonte
semiotico giuridico, provando a riconsiderare l’arsenale metodologico della Scienza Nuova
vichiana.
Il dibattito americano, nel contesto dei movimenti delle Law and Literature e delle Law and
Humanities, ha poi conferito una nuova centralità al tema delle origini giuridiche del metodo
nelle scienze sociali, recuperando la tradizione emblematica moderna come fonte normativa della
contemporanea società dell’immagine (Goodrich) e il ruolo del visual law nella società
dell’immagine e nel processo (Manderson, Sherwin).
Così l’idea di una semiotica giuridica vichiana non ristretta, a un tempo linguistica e iconica, nel
suo veicolare i contenuti della tradizione giuridica e retorica classica occidentale nel linguaggio
moderno di una Scienza Nuova può forse consentire di configurare un research program in
semiotica giuridica umanistica fondato sulla precedenza antropologica dell’affectio sulla ratio
(‘svolta affettiva’, Sequeri).
Una lettura ‘vichiana’ può indicare così le origini anche giuridiche della semiotica, mostrando al
tempo stesso l’originaria fondazione antropologica di ogni sapere scientifico (le radici del logos
nel pathos e nell’ethos), consentendo la configurazione di una semiotica giuridica dei filosofi del
diritto, posta accanto alla semiotica giuridica dei semiotici, volta a contribuire al superamento
della separazione tra le “due culture”. L’idea di Mondo 0, radicata variamente in autori come
Bühler, Popper, Dupuy, Petitot, Lotman, Vernadskij, Bateson, Varela, costituisce una prima
figura di lettura di temi semiotici da una prospettiva filosofica giuridica, che si innesta nel
problema vichiano del verum et factum convertuntur.

and Humanities.
The role of semiotics is often reduced, by legal positivism, to the (anti)humanistic view who have
variously afflicted culture in the 19th century: from structuralism to information theory and
linguistics, in a vision, how Jori states, "deliberately restricted" of legal semiotics. The legal

aesthetics re-emerging (Legendre, Robilant, Heritier), in its original relationship with rhetoric
(Meyer, Manzin, Mooney) now allows to open differently the horizon of a legal semiotics, trying
to reconsider the methodological arsenal of Vico's New Science.
The American debate, in the context of Law and Literature and Law and Humanities’
movements, giving a new centrality to the theme of the legal origins of the method in the social
sciences, taking the modern emblematic tradition as a normative source of the image in
contemporary society (Goodrich) and promoting the role of visual law in the society of the
spectacle and within the trial (Manderson, Sherwin).
The idea of a Vichian legal semiotics not restricted, both linguistic and iconic, that convey the
content of the Western legal tradition and classical rhetoric in modern language of a New
Science, could set up a research program in humanistic legal semiotics grounded on the
anthropological priority of affectio over ratio ('affective turn', Sequeri).
A Vichian view can indicate legal origins of semiotics, showing the original anthropological
foundation of all scientific knowledge (the logos’ roots in the pathos and ethos) and allowing the
configuration of a philosophers of law’s legal semiotics next to the semioticians’ legal semiotics,
beyond the separation between the "two cultures". The idea of the World 0, variously rooted in
authors like Bühler, Popper, Dupuy, Petitot, Lotman, Vernadsky, Bateson, Varela represents an
initial figure of reading semiotic issues from a legal philosophical perspective, starting from
Vico's principle ‘verum et factum convertuntur’.

La “legge sulla cittadinanza” nel teatro di Euripide
Nel 451/450 su proposta di Pericle fu approvata ad Atene una legge che ridefiniva i requisiti per
la cittadinanza: essa spettava solo ai figli di genitori entrambi ateniesi; ne erano esclusi i figli
"bastardi" (nothoi). La questione dei nothoi compare in tre tragedie di Euripide: Ippolito, Medea,
e Ione. I "figli" di cui queste tragedie trattano sono tutti nothoi. Alcuni studiosi hanno visto in
queste tragedie la celebrazione del mito dell’autoctonia; la mia lettura va in un’altra direzione:
Euripide mostra la solitudine esistenziale dei nothoi, assieme agli effetti disgreganti prodotti dalla
nuova legge sia sul piano delle relazioni affettive e familiari sia sul piano dell'etica pubblica e

dell'universo simbolico condiviso. Diversi elementi suggeriscono questa lettura, e in particolare
talune discrepanze tra l’uso scenico del diritto e gli istituti giuridici vigenti.
The “Citizenship Law” in Euripide's Theatre
In 451/450 BC, upon Pericles' proposal, a new law redefining the prerequisites for citizenship
was approved in Athens: citizenship was confined to those individuals whose parents were both
Athenian; “bastard” sons (nothoi) were excluded. The question of nothoi comes into play in three
of Euripides' tragedies:Hippolytus, Medea, and Ion. The “offspring” these plays talk about are all
nothoi. Some scholars see these tragedies as celebrating the myth of autochthony, but my own
reading goes in a different direction: Euripides portrays the corrosive effect of the new law both
on the level of family relations and on that of public ethics and the shared symbolic universe of
universe of Athens. Different elements support this reading, and in particular certain
discrepancies between the representation of the law on stage and the legal principles actually
enforce at the time.

Könczöl, Miklós (Pázmány Péter Catholic University & HAS Institute for Legal Studies,
Law and Persuasion in Plato's Laws
Plato’s attitude to rhetoric has been a most contested issue in recent scholarship. In this paper, I
seek to answer the question of whether the next-to-ideal constitution depicted in his Laws allows
for any kind of rhetoric. Persuasion, to be sure, plays an important role in the Laws, as it does in
the Phaedrus. It is, however, hard to argue that this is something new in comparison with e.g. the
Gorgias. If there is any kind of development in Plato’s attitude to persuasion, then it can be
characterised with an increasingly detailed qualification, one that makes the respectable way of
persuasion more remote from rhetoric. With the final step made in the Laws, the ‘nationalisaton’
of public speaking, there is no point in calling it rhetoric any more, and Plato tacitly draws the
consequences: he does not use the term.

Law and opera as practical-cultural artefacts or the productivity and limits of a plausible
counterpoint
Beyond the already significantly explored possibilities of law in opera and law as opera — the
first one reconstituting more or less direct juridical themes in operatic plots, the second one
exploring the methodological analogies between legal adjudication and performance —, this
paper endeavours to acknowledge a third productive counterpoint between law’s practical world
and dramma per musica’s discourse genre, both of them now considered as explicit cultural
artefacts. which, as specific occasions for the creation of communitarian meanings, are
significantly inscribed in the deployment of what may be called the Idea of Europe (or the
possibilities of the Western Text). The mapping of this counterpoint will allow us to consider a
certain law and a certain opera, with rigorously located emergence conditions: which means
considering a plausible argument of continuity, but also facing the challenge of two parallel (even
though intentionally very different) alternative debates.

Friedrich Dürrenmatt mette in discussione la validità delle leggi e delle procedure che governano
La società occidentale. Egli stravolge nei suoi racconti il significato di regola che conforma
l’andamento processuale o i confini tradizionali del ragionamento giuridico, senza che questa
trasfigurazione letteraria rischi di minare il loro aspetto formale. Dürrenmatt sostiene che la legge
è una invenzione allo stesso modo in cui lo sono i suoi racconti; che la legge è a suo modo una
finzione a cui si può credere o non credere. L’originalità di Dürrenmatt risiede in due aspetti del
suo approccio. In primo luogo, egli concentra la sua riflessione sulla retorica giuridica e sul
potere della parola. Egli situa il potere giuridico nell’arte di discutere e di giustificare pur
rimanendo sempre all’interno delle istituzioni, a dimostrazione che la potenza del discorso è tale
da essere in grado di rendere plausibile una menzogna e di convincere la maggioranza degli

individui. In secondo luogo, egli differenzia la retorica giuridica dalle forme retoriche filosofiche
e letterarie che sviluppano una concezione diversa di giustizia.
Justice in panne. Justice and relativism in the work of Friedrich Dürrenmatt
Friedrich Dürrenmatt discussed the validity of laws and procedures that governed the Western
society. In his dramas, he upset the meaning of rule that shapes the procedural pattern or the
traditional boundaries of legal reasoning, without any risk to destroy their formal aspect.
Dürrenmatt argued that the law is an invention similarly as his literature since the law is a
theoretical fiction that you can believe or not believe. Author's originality lay in two aspects of
his approach. First, he focused his consideration on the legal rhetoric and the supremacy of
words. He set the legal power on the art to discuss and justify although by staying in institutions,
according to the evidence that the power of discourse is such so as does plausible a lie and
convinces most people. Second, he differentiated the legal rhetoric from the philosophical and
literary rhetorical forms that produce a different view of justice.

Immaginario collettivo e diritto
La produzione cinematografica e documentaristica, come in generale quella artistica, presenta
un particolare interesse in relazione alla ricostruzione del diritto consuetudinario in forza del
valore di testimonianza che la stessa assume nel tempo, al di là degli specifici intenti e del
peculiare contesto in cui è stata prodotta.
In alcuni casi la produzione cinematografica e documentaristica ha fortemente contribuito a
diffondere una visione stereotipata di alcuni fenomeni e ha concorso alla creazione di un
immaginario collettivo in materia di culture “altre” o ritenute tali.
Nel caso della Sardegna tale produzione ha messo in evidenza alcune caratteristiche esotiche,
in bilico tra mito e realtà e tra narrazione e mito e ha fortemente condizionato le scelte
politiche ed economiche che avrebbero dovuto garantire l’affrancazione dal “malessere
atavico”.
Collective imaginary and law

Movies and documentaries production, like all kind of art production, are particularly
interesting in reconstructing customary law, because of its strong value as a witness along
time, far beyond any specific aim and of the specific context in which it has been produced.
In some cases Movies and documentaries production has strongly contributed in spreading a
stereotyped vision of some phenomena and has contributed to create a collective image of
cultures that are different or perceived as different.
As far as the Sardinian case this production has highlighted some exotic features between
myth and reality, and between myth and narration, and has had a major impact on the political
and economic choices that should have granted freedom from the atavistic uneasiness.

Mostrare il diritto: la prova-per-manufatto”
Nel 2005 cinque tribù di Aborigeni reclamarono il loro diritto di proprietà su una porzione del
territorio australiano. Di fronte al National Native Title Tribunal, esibirono un canvas dipinto, che
raffigurava il loro “paese”. I rappresentanti delle cinque tribù affermarono che, attraverso
l’esibizione del canvas, stavano mostrando alla Corte il proprio diritto. Altri simili casi hanno
caratterizzato la storia delle relazioni tra Australiani e Aborigeni.
La presente relazione “Mostrare il diritto: la prova-per-manufatto” indaga la cultura aborigena al
fine di rispondere alla domanda: È possibile mostrare il diritto? Inoltre, essa sviluppa un nuovo
concetto: il concetto di “prova-per-manufatto”. Da un lato, tale concetto si radica nella relazione
di metonimia tra diversi aspetti della cultura aborigena: in particolare, sullo stretto rapporto tra le
concezioni aborigene di “territorio” e di “diritto”. Dall’altro lato, “prova-per-manufatto” designa
un oggetto inter-culturale, finalizzato a dimostrare la “aboriginality” dei suoi proprietari nel
contesto di una negoziazione inter-etnica.
Showing the law: Evidences through Artworks
In 2005 five Aboriginal Australians tribes claimed their right to inhabit a portion of Australian
land. In front of the National Native Title Tribunal, they exhibited a painted canvas, symbolizing
their country. Representatives of the tribes stated that they were showing their law. Other similar
cases occur in history of relationship between Australians and Aborigines. The present paper

“Mostrare il diritto: la prova-per-manufatto” investigates Aboriginal culture in order to answer
the question: How is possible to show a law? Furthermore, it develops the new concept of
“Artwork-evidence”. On one side, this concept relies on the metonymical relationship between

Normative Images in Fairy Tales
The analysis of the representations of normativity in literary texts is a main topic of Law and
Literature Movement. In the context of this researches, my paper focuses on normative images in
fairy tales. The reason for my choice is twofold: first, fairy tales use normative images in a
pedagogical function, in order to teach children the normative basics of social life; second, fairy
tales are normative representations, because narrative functions have here juridical nature.
For this two reasons, my paper is divided into two parts. In the first part, I explore the
relationship between the figurative languages and graphic images, used in fairy tales to explain
normative concepts to children. In the second part, I examine the thirty-two narrative functions
identified by Vladimir Jakovlevič Propp in his famous book Morphology of the Tale (1928), with
the intention of reducing them to just six normative functions: (i) the prohibition; (ii) the
imposition; (iii) the subtraction; (iv) the commutation; (v) the obligation; (vi) the jurisdiction.
The aim of my paper is finally to show not only how fairy tales use normative images, but also
how normative images used in fairy tales can influence Philosophy of Law and General Theory
of Law.

La teoria classica del diritto nega che il diritto moderno possa essere sensibile e, quindi,
«responsabile» rispetto ai propri contesti sociali e culturali. La critica postmoderna del diritto
propone «responsività», trascendenza ed esteticizzazione del diritto come rimedi e strategie di
cambiamento. Possiamo immaginare di aumentare la responsabilità della prassi giuridica tramite
esperienze e procedure estetiche? Il paper cerca di rispondere a tale quesito accostando il senso

classico moderno del diritto a un senso estetico. La prima parte argomenta che la figurazione
modernista del discorso giuridico, ignorando le dimensioni estetiche del diritto, tende determinate
trappole; la seconda parte, muovendo da alcune riflessioni su arte ed estetica esplora la specifica
performatività della prassi giuridica e del esecuzione musicale e presenta il jazz, con la sua etica
implicita, come pratica che potrebbe portare a un nuovo senso di diritto.
Aesthetic and juridical experience. On the relationship between law and music
Classical positivist theory of law denies that modern law could be «responsive» to its social and
cultural contexts. Postmodern critics of the law ion fact propose responsiveness, transcendence
and the aestheticization of the law as remedies and strategies of reform. Can we imagine
increasing the responsibility of the social practice of the law by aesthetic experiences and
procedures? The paper will answer by investigating on the classical modern and the aesthetic
sense of the law. The first part argues that the modernist image of the juridical discourse ignores
the aesthetic dimensions of law and sets certain traps to understanding; the second part starts with
some reflections on the relationship between art and aesthetics; it investigates then on the specific
performativity of the juridical and the musical practice in order to present, at the end, jazz with
its own implicit normativity as a musical practice which could lead us to a new sense of law.

L’idea della forma come “configurazione in costante trasformazione” è impressa nella nozione
originaria di rhythmos. Obiettivo dell’intervento è recuperare questa idea ripercorrendo l’analisi
che, in un importante saggio del 1951, Benveniste offre del termine, per rielaborarla attraverso la
riflessione di Maldiney su L’esthétique des rythmes (1967), ed infine accostarla al campo
giuridico, nel tentativo di contribuire alla riflessione già avviata nell’ambito dell’estetica
giuridica, e di muovere qualche passo verso i giuristi chiamati a fronteggiare sia la deriva

Rhythm and Transformation. Toward an Aesthetics of Law
When there is art, the form of the artwork retains its track as a movement. In Aesthetics this
process is called as formativity, but one can also define it as “openness” to the “transformation
and otherness.”
The idea of form as configuration “in constant transformation” is given in the original notion of
rhythmos.
My aim is – as first – to recover this idea through an important reconstruction of the term
rhythmos that Benveniste offered in 1951. As second, to elaborate this notion through Maldiney’s
thesis in L’esthétique des rythmes (1967). And finally, to approach the legal field with a
reformulated concept of form that could be useful to face both the formalistic drift of the juridical
system and the exorbitant increase of new orders and forms.

Justice as the Judicial Symbol
For many centuries and across the globe courts of law have generally been furnished with typical
symbols of justice, such as the Lady Justice, scales, swords, hammers or sometimes even books
held in her arms. Usually we take these symbols for a given but, to analyze their deeper meaning,
I for example reflect upon the following questions: (a) what truly is the meaning and role of
symbols in society, (b) what is the meaning of the typical symbols in a courtroom, (c) why justice
as a symbol has ever been portrayed as a woman, not man. As this is an essay from the area of
psychoanalytic jurisprudence, I employ in the analysis certain findings and definitions established
within Jungian analytical psychology. In connection with the typical justice symbols, I also
discuss the difference between symbols, signs, and archetypes.

Come mostra il crescente interesse verso la dimensione figurativa del diritto, le rappresentazioni
della giustizia fanno a tutti gli effetti parte del discorso giuridico e delle pratiche della sua
comunicazione. Le immagini non producono norme giuridiche ma rappresentano (e influenzano)
regole di condotta e percezioni del diritto. In stretto dialogo con alcuni filoni dei Visual Studies,
l’intervento intende riflettere su alcuni modelli di rappresentazione del fenomeno giuridico
prodotti in ambito televisivo, con particolare riguardo alla sfera giudiziaria. Ricostruire le forme
con cui la tv racconta le vicende giudiziarie consente di riflettere sul rapporto tra la messinscena
televisiva del sistema della giustizia e le logiche di giustificazione o critica dei sistemi normativi,
etici e culturali della società contemporanea. L’obiettivo è quello di decodificare i contenuti della
comunicazione televisiva per rispondere ad alcuni interrogativi di ordine generale: quali
immagini del giudizio, del crimine, del diritto vengono riprodotte e diffuse nei palinsesti
televisivi? Quale rapporto si instaura tra universo giuridico e racconto televisivo? Cosa si
nasconde dietro il carattere concorrente e in parte delegittimante che il racconto televisivo di
ambientazione legale instaura col sistema giudiziario?
The TV Rule. Legal Discourse’s Practices and Television
As increasing interest towards the figurative dimension of legal science shows, the justice’s
representations belong to legal discourse and to its communication’s practices. Images don’t
produce law, but do represent and influence behaviour rules and law’s perception. In close
connection to some Visual Studies’s strands, our contribution aims at reflecting on some models
of representation of legal phenomenon produced by TV, with particular reference to the judiciary
sphere. Investigating how TV talks about court cases allows reflecting on the relation between
TV production of judiciary system and trends of justification or critics of normative, ethic and
cultural systems. Our purpose is to decipher TV communication’s contents in order to answer
some general questions: which images of process, crime, law are reproduced and spread in TV
programms? What is the relation between legal sphere and TV storytelling? What is behind the
competing and somehow delegitimizing nature of the TV narrative towards the judicial system?

Le società distopiche si diffondono con sempre maggiore successo nella letteratura e nella
cinematografia contemporanee, non necessariamente in opposizione a mondi utopici, ma quali
realtà autonome, ispirate a finalità apparentemente non dissimili da quelle perseguite nelle società
utopiche (pace, sicurezza, benessere). È proprio l’ambiguità della distopia a renderla affascinante
agli occhi dell’uomo di oggi. Dando risalto e consistenza al difetto di valore, la distopia assume
per il corpo sociale il medesimo ruolo che i sogni assumono per il corpo umano: strumenti
attraverso i quali la società e l’uomo riconoscono e rielaborano il disorientamento assiologico,
riacquistando la capacità di distinguere la regola buona da quella cattiva e il sistema sano da
quello corrotto. Il presente contributo intende riproporre alcune fra le più famose distopie
letterarie e cinematografiche, alla ricerca degli elementi costitutivi di modelli distopici in grado di
interpretare le negatività delle società contemporanee.
Dystopian societies: literary models and cinema visions
The dystopian societies spread with increasing success in literature and contemporary cinema, not
necessarily in opposition to utopian worlds, but as autonomous entities, apparently aiming at the
same goals of the utopian societies (peace, security, well-being). It's precisely the ambiguity of
dystopia that makes it attractive to the modern man. Emphasizing the lack of values, dystopia
assumes, for the social body, the same role that dreams take for the human body: the instruments
through which society and man recognize and rework the axiological disorientation, regaining the
ability to distinguish good and bad rules and the sound system from the corrupted one. This paper
aims to revive some of the most famous literature and cinema dystopias, in search of the
constituent elements of dystopian models that can interpret the negativity of contemporary
societies.

The analysis of argumentation underlying complaints about a lack of judicial impartiality
To ensure a proper application of the law in an impartial, just and fair manner is essential to the
public’s trust in the office of the judge and the judge’s authority. In the Netherlands, as in many
other European countries, various statutory provisions present parties to the proceedings with the
right to seek a judge’s disqualification if these parties have doubts about the impartiality of the
judge. Recent research shows that the number of cases in which Dutch judges are challenged is

growing. This increase may be related to the changing role of the judge. A reorientation on the
judge’s role demands the judge to be more active and more communicative during court hearings.
In this contribution I will analyse the argumentation underlying disqualification requests that are
based on complaints about the communicative and rhetorical performance of the judge.

Tra vocazione teatrale e professione forense: l’influenza della pratica legale nelle commedie di
Carlo Goldoni
La relazione si propone di dimostrare come Goldoni abbia utilizzato la professione forense per
realizzare la sua opera teatrale. Infatti la pratica legale gli offrì efficaci strumenti per conoscere
“il mondo” in cui viveva e operava, cioè la società della Repubblica Veneta del XVIII secolo, e
per rappresentarlo attraverso il “teatro”.
Pertanto il diritto è presente nelle commedie goldoniane (su 114 opere se ne contano almeno 20
di argomento giuridico): ciò è evidente nell’utilizzo del linguaggio e delle categorie concettuali
tipiche della professione forense.
Ma l’autore non dimentica che il diritto ha come referente necessario l’uomo, la sua condizione
esistenziale e le sue reazioni emotive. La giustizia in Goldoni si coniuga, dunque, sempre ad
intuitive e umane ragioni di equità, essendo consapevole che la platea vuole comprendere chi
abbia ragione e chi torto ed essere rassicurata dalla certezza che, almeno a teatro, “giustizia è
fatta”.
Between theatrical vocation and legal profession: the influence of legal practice on Carlo
Goldoni’s comedies
The paper aims to demonstrate how Goldoni has used legal profession to make his comedies. In
fact, legal practice gave him effective instruments to understand "the world" in which he lived
and worked (the Republic of Venice of the eighteenth century) and to represent it through the
"theater".

Therefore, law is recurrent on Goldoni's plays (of 114 works, 20 at least concerns aspects of
right): this is evident in the use of legal profession’s language and peculiar categories.
However, the author does not forget that law is made for man and has to consider his existential
condition and his emotional reactions. Goldoni, therefore, conjugates Justice to intuitive and
human reasons of fairness, because he consider that audience wants to understand who’s right
and who’s wrong and be reassured that, in theatre at least, “Justice is done".

Arte, Diritto e Inquisizione: L’Autodafé, di Francisco de Goya
Francisco de Goya è uno degli artisti più importanti non soltanto nella Storia dell’Arte spagnola,
ma anche in quella universale. Insieme al suo lavoro ufficiale come ritrattista della monarchia e
della nobiltà, Goya, come artista impegnato, registrò alcune delle realtà sociali più complesse di
cui fu testimone. E lo fece con uno sguardo molto particolare, precursore della modernità che
stava arrivando.
Dalla sua acuta intelligenza non poté sfuggire nemmeno la temibile Inquisizione spagnola.
L’artista dedicò al Sant’Uffizio alcune delle stampe della sua serie Los Caprichos. Tuttavia,
attorno al 1810, dipinse una piccola tavola: L’autodafé. In essa si riflette appunto un momento di
straordinaria importanza del processo inquisitorio: la lettura della sentenza, che era seguita
dell’esecuzione dei condannati.
Così, L’autodafé ci permette, in primo luogo, di studiare alcuni aspetti rilevanti del processo
penale inquisitoriale; secondo, di analizzare il contesto sociale di quel tempo e il ruolo
dell’Inquisizione in esso; infine di formulare alcune teorie sulle ragioni che portarono Goya a
dipingere con una una visione assai critica questa tela.
Art, Law and Inquisition: the auto-da-fé, by Francisco de Goya
Francisco de Goya is not only one of the most important artists of Spanish Art History, but also
worldwide. Along with his official work as a portraitist for the monarchy and the nobility, Goya,
a very committed artist, recorded some of the most complicated social realities of which he was a
witness. Additionally he did it with a very particular look, precursor of modernity that was
coming.

Not even the dreadful Spanish Inquisition could escape his acute intelligence. The artist dedicated
some of the engravings of his series Los Caprichos to the Holy Office. Besides them, around
1810 he painted The Auto-da-fé (also known as The Inquisition Tribunal). This small canvas-
painting reflects, precisely, a moment of extraordinary importance regarding the inquisitorial
criminal procedure: the reading of the court decision which was followed by the execution of the
prisoners.
So, The Auto-da-fé let us first, study some of the most important aspects of the inquisitorial
criminal procedure; second, analize the social context of that time and the role played by the
Inquisition; finally, formulate theories about the reasons that led Goya to paint this canvas.

Vizi privati e pubbliche virtù: le regole della società politica secondo Mandeville
L’eccezionale fortuna de La favola delle api di Bernard Mandeville, all’inizio del Settecento, si
spiega con l’originalità della riflessione svolta intorno alle regole della vita associata. L’assunto è
che le api, come gli uomini, non perseguono il bene comune ma il proprio egoistico tornaconto:
occorre ammettere che la società civile nasce nel punto di incontro tra pulsioni egoistiche
individuali (non necessariamente riprovevoli), norme etiche di condotta e regole giuridiche. La
psicologia degli individui e le regole di funzionamento del corpo sociale sono dunque poste in
stretta e necessaria relazione. L’impiego del mezzo letterario (la “favola” istruttiva, con
protagonisti gli animali) diventa, al di là dei motivi prettamente estetici, essenziale per portare
alla luce la trama nascosta dei meccanismi che governano i rapporti intersoggettivi. Una verità
che il letterato, insieme allo scienziato della natura, riesce a percepire ed esprimere con efficacia,
meglio del filosofo morale e del giurista.
Private vices and publick benefits: The rules of political society according to Mandeville
The exceptional fortune of Bernard Mandeville’s Fable of the bees, in the early eighteenth
century, is explained by the originality of his thought concentrated around the rules of social life.
The premise is that bees, like men, do not pursue the common good but their own selfish return: it
must be admitted that civil society begins at the meeting point between individual egoistic drives
(not necessarily reprehensible), ethical codes of conduct and juridical rules. The psychology of

individuals and the rules of functioning of the social body are therefore necessarily placed in
close connection.
The use of a literary means (the educational “fable”, with animals as protagonists), purely
aesthetic reasons aside, becomes essential for revealing the hidden plot of the mechanisms
governing intersubjective relations. A truth that the scholar, together with the natural scientist, is
able to effectively perceive and express, better than a moral philosopher or a jurist.

È opinione comune che diritto e comicità esprimano i due opposti principi dell’ordine e del caos:
mentre il diritto mira a creare un ordine, attraverso una serie di principi e regole, il comico lavora
contro la logica, le regole e l’ordine. Il diritto definisce ciò che è serio, ciò di cui si ritiene non si
debba ridere, in quanto considerato, in linea di principio, bonum et aequum per l’intera società.
Tuttavia, quando il diritto diviene soggetto di comicità, il comico rivela che la legge non è sempre
giusta, e che i consociati richiedono una maniera differente di vivere la propria responsabilità
sociale.
Gli autori discuteranno, da una parte, alcune regole elaborate per salvaguardare il Diritto della
derisione e, dall’altra, la rappresentazione verbale e visiva del diritto entro la cornice comica di
alcune celebri opere letterarie e cinematografiche.
How is it that sharks do not bite lawyers? Marginalia on the relationship between law and comic
It is generally agreed that law and comic embody the two opposing principles of order and chaos:
as the law aims at creating an order out of a set of rules and norms, the comic works against logic,
rules and order. Law defines what is serious, that is what we are not supposed to laugh at, being it
conceived, as a matter of principle, bonum et aequum for the entire society. But, when the law
becomes a humorous subject, the comedy unveils that the law is not always right and society
demands a different way to live its social responsibility.
The authors will discuss, on the one hand, some of the rules made in order to preserve Right from
derision and, on the other one, the verbal and visual representation of the law within the
humorous framework of some popular literary works and movies.

questo approfondimento si prefigge di indagare il fenomeno partendo dal sistema di regole che lo
disciplina. L’obiettivo è quello di verificare, attraverso lo strumento della comparazione tra reale
e virtuale, se all’interno della simulazione possano rinvenirsi elementi utili a preservare la
dimensione sociale ed a recuperare la fantasia delle origini, attribuendo nuovamente centralità
alla valenza extragiuridica della regola, semplice strumento per consentire ai partecipanti di
competere nel gioco.
“Messi at the Torino Football Club”: rules of the game in football and in virtual games
Virtual sports games are a growing phenomenon that fascinates traditional sports lovers. Is the
success of the multi-modal 'practice' of sport a symptom of an identity crisis or rather its natural
evolution in the age of digital culture? Given the importance of sport and the increasing related
economic interests, this study aims at investigating such a phenomenon from the point of view of
the system of rules which are implemented. The comparative approach to legal studies will
provide the methodological framework to verify if the game in the real world can recover the
essential dimension and inner values of the extrajudicial rules of the game.

l’obbiettivo di analizzare il linguaggio e il discorso metodologico della scienza economica e degli
economisti, ha lasciato in disparte l’analisi di fenomeni normativi sui quali la semiotica e la
retorica giuridica potrebbero (e dovrebbero) gettar luce. Cosa hanno in comune fenomeni
apparentemente disparati quali: le “illusioni fiscali” (Puviani, Buchanan), la “Nudge Unit” del
Governo di Cameron ispirata alla teoria del “Nudging” (Sustein, Tahler), la manipolazione di
prezzi e indici dei mercati, i “communicative imperatives” (Holmes) delle Banche Centrali? Il
filosofo del diritto che voglia comprendere questi fenomeni dovrà ripensare la normatività con

The Normativity of Economy. Research perspectives

This paper aims to explore new research perspectives for legal semiotics and legal rhetoric
applied to the analysis of economic phenomena. The “Rhetoric of Economics” (McCloskey) was
developed with the aim of analyzing the language and methodological discourse of economics
and economists, but failed to address the analysis of normative phenomena on which semiotics
and legal rhetoric could (and should) cast light. What is common to seemingly disparate
phenomena such as “fiscal illusions” (Puviani, Buchanan), the “Nudge Unit” of Cameron’s
Government inspired by the theory of “nudging” (Sustein, Tahler), manipulation of prices and
market indexes, the “communicative imperatives” (Holmes) of Central Banks? The legal
philosopher who wants to understand these phenomena will have to rethink normativity with new
categories, unless s/he wants to leave the regulation and surveillance (without punishment) of the
economy in the hands of economists.

Mater Iuris. La rappresentazione iconografica della Giustizia nella modernità
Attraverso l’analisi di immagini che raffigurano la giustizia tra il tardo medioevo e la prima
modernità si prenderanno in considerazione due piste di lavoro: 1) Una prima pista teorica
fondata sull’iconografia come veicolo di “universi simbolici” in grado di situare il rapporto tra
diritto e società; 2) Una seconda pista empirica più centrata sui simboli della spada, della benda,
della bilancia e dell’angeologia, ovvero una rappresentazione della Giustizia intesa come
mediazione tra leggi divine e terrene e come virtù extra-giuridica (iustitia mediatrix); una
rappresentazione legata all’aequitas e al bonum commune; una rappresentazione che attua lo ius
puniendi nella neonata respubblica; una rappresentazione irriverente e cieca nei confronti dei ceti
meno abbienti; una rappresentazione bifronte e ambivalente. In questa ricerca, inoltre, si
sottolinea, come punto di partenza, la “differenza sessuata” dell’iconografia relativa alla
Giustizia, così come scriveva Kantorowicz ne “I due corpi del re”. La Giustizia è una “Mater
Iuris”, mentre il diritto è un “Pater Legis”.
Mater Iuris. The iconographic representation of Justice in modernity
Through the analysis of images depicting Justice between the late Middle Ages and early
modernity we will consider two areas of work: 1) A first theoretical area established iconography
as a vehicle of "symbolic universes" able to situate the relationship between law and society; 2) A

second more empirical area centered on the symbols of the sword, of the bandage, the scale and
of the "angelic world", that is a representation of justice understood as a mediator between the
divine and earthly laws and as an extra-legal virtues (iustitia mediatrix) ; a representation linked
to the aequitas and the bonum commune; a representation that implements the ius puniendi in
respubblica newborn; an irreverent and blind representation for the poorer social classes; a
double-faced and ambivalent representation. In this research, in addition, it is emphasized, as a
starting point, the "sexual difference" of the iconography relating to Justice, as well as
Kantorowicz wrote in "The King’s Two Bodies". Justice is a "Mater Juris ", while the right is a
"Pater Legis".
Szilágyi, István H. (Pázmány Péter Catholic University of Budapest,
Natural law and the nature of law in Tolkien’s Lord of the Rings
The paper focuses on the problems of how the law appears in the ‘state of nature’ and of what we
can learn about its attributes from Tolkien’s novel. First the description of the ‘state of nature’ is
enlightened by comparing it to that of the Lockean concept. After examining three legal episodes
it is demonstrated that, in the state of nature, the true foundation of the law is not the power
relying on force and fear but the authority flowing from personal excellency and charisma, and
the art of persuasion. In the conclusion the paper argues that, according to Tolkien’s ideas, when
the mankind steps out from the ‘state of nature’ not the nature of law but the essence of power
changes: arbitrary tyrannous power is replaced by the lawful power, and, for the law’s
foundations are justice and virtue, the lawful power means morally justified power.

quello dell'actio romana per poi fondersi con questa nel corso del Medioevo, secondo una visione

wagneriani, nella mirabile sintesi di Wort, Ton und Drama, offre un materiale ricchissimo di

sul riparto dell'onere della prova e sulle forme di legittimazione attraverso il procedimento,

Proceedings in music: the Gottesgericht in Wagner
The speech aims to provide insights into proceedings and judgment in the works of Richard
Wagner, in particular in Lohengrin, in which we see a Gottesgericht strictly formalized and
marked by the Germanic system of accusatio, traditionally opposed to the Roman actio, then
merged with this during the Middle Ages, according to a vision dating back to a famous essay by
Giuseppe Chiovenda. The richness of the Wagnerian text and music, in the admirable synthesis of
Wort, Ton und Drama, offers a wealth of material of historical and legal aspects on the position
of the parties and of the judge in the trial, on the burden of proof and on the forms of legitimation
through the proceedings, a forerunner to some extent of the luhmanniana Legitimation durch
Verfahren.

Can Norms Have Truth Values?
The overwhelming majority of logicians and legal philosophers consider as an analytic truth the
thesis according to which it does not make sense to attribute truth values to norms; it is only
possible to ascribe validity or invalidity to them. Accordingly, it became a well-established
commonplace in both logical and legal thinking that a normative judgement cannot be true or
false, but only valid or invalid.
However, there is at least one prominent exception to this majoritarian view: Georges Kalinowski
who, throughout his whole oeuvre covering the areas of both legal philosophy and deontic logic,
consistently persisted in his theoretical conviction that norms can and do have truth values.
In my paper I will endeavour to reconstruct his argumentation presented in favour of this
standpoint, and to give a critical evaluation of it, in comparison with some contemporary insights
in the fields of legal logic and semiotics.

Le menti non sono documenti (e viceversa)
Sia da parte dei sostenitori della “mente estesa” che da parte dei sostenitori della
“documentalità”, è in atto un tentativo filosofico di superare i confini fra menti e documenti. Per
gli uni le menti sarebbero (anche) documenti, o sarebbero costituite (anche) da documenti. Per gli
altri i documenti, in quanto oggetti sociali, sarebbero (anche) iscrizioni di atti mentali.
I documenti di natura giuridica sembrano esemplificare in maniera interessante queste tesi, le
quali, calate in un contesto giuridico, si potrebbero ricomprendere in una più generale tesi di
semiotica giuridica secondo cui le menti e i documenti sono segni che istituiscono un reciproco
rinvio: i documenti sono segno di menti (che li predispongono, sottoscrivono, interpretano, ecc.)
e le menti sono segno di documenti (che le formano, sostengono, estendono, ecc.).
Ora, alcune cautele e sfumature (come quelle segnate nelle parentesi qui sopra) possono rendere
plausibili queste tesi. Ma nel loro nocciolo si tratta di tesi che, pur essendo suggestive, rivelano la
propria falsità una volta sottoposte a uno scrutinio logico.
Infatti, se tali tesi fossero corrette allora le proprietà delle menti dovrebbero essere identiche a
quelle dei documenti, o indiscernibili da essi. Ma quando un documento (ad es. una scansione
neuronale) viene distrutto, non si distrugge al tempo stesso la mente che ne è oggetto. E un
documento che mi riguarda potrà esistere anche quando sarò morto (quando verrà meno con me
la mia mente).
O ancora, il mio cellulare è un’estensione della mia mente? Forse è una parte di essa? Certamente
mi consente di fare cose che altrimenti non potrei fare neppure alla lontana. Ma posso gettarlo e
acquistarne uno nuovo senza con ciò gettare la mia mente e acquistarne una nuova. Anzi, è la mia
mente che decide di gettarlo e acquistarne uno nuovo. E viceversa il cellulare potrebbe continuare
a esistere dopo la mia dipartita.
Oltre questi truismi logico-concettuali si pone comunque il complesso rapporto fra menti e
documenti in quanto entità di natura segnica. Ciò vale specialmente in ambito giuridico dove certi
documenti (come le scansioni neuronali, ma anche le dichiarazioni di una parte in un rapporto
contrattuale) sono utilizzati per provare certi stati mentali, e viceversa certi stati mentali si
formano tramite il supporto di documenti che veicolano certi contenuti. Questa complessità di
rapporti non è da trascurare ma non deve essere confusa con l’erronea tesi di un’identità fra menti
e documenti.

Minds are not documents (and vice versa)
Both by supporters of the “extended mind” and by supporters of “documentality”, a philosophical
attempt to overcome the boundaries between minds and documents is taking place. For some
authors, minds would (also) be documents, or would be established (also) from documents. For
others, documents as social objects would (also) be inscriptions of mental acts.
The legal documents seem to exemplify in an interesting way these theses, which, in a legal
context, belong to a more general theory of legal semiotics, according to which minds and
documents are signs that determine a cross-reference: documents are signs of minds (that
predispose, sign, interpret them) and minds are signs of documents (that form, sustain, extend
them).
Now, some cautions and shades (such as those marked in brackets above) can make these theses
plausible. But, although suggestive, such theses reveal their falsehoods when subject to logical
scrutiny.
If such arguments were correct, then the properties of minds should be identical to those of
documents, or indiscernible from them. But when a document (e.g. a neural scan) is destroyed, it
is not destroyed at the same time the mind it is about. And a document that concerns me may
exist even when I’m dead (when my mind ceases to exist with me).
To take another example, is my cell phone an extension of my mind? Is it a part of it? Certainly it
allows me to do things that otherwise I could not do even distantly. But I can throw it and buy a
new one without thereby throwing my mind and purchase a new one. Indeed, it is my mind that
decides to throw it and buy a new one. And vice versa, my phone may continue to exist after my
departure.
Beside these logical and conceptual truisms, however, there is a complex relationship between
minds and documents as semiotic entities. This is especially true in the legal field where certain
documents (such as neural scans, but also the statements of a party in a contractual relationship)
are used to test certain mental states, and certain mental states conversely are formed with the
support of documents that convey certain content. This complex relationship is not to be
neglected but must not be confused with the erroneous identity thesis between minds and
documents.

Crimini predicibili? L’eclissi del diritto penale moderno in Minority Report di Steven Spielberg
Ispirata all’omonimo racconto di Philip K. Dick, la pellicola Minority Report di Steven Spielberg
si direbbe rappresentare, pur con qualche cedimento logico-narrativo, un ardito quanto felice
tentativo di rivelare la distopia nella realtà – e viceversa. Forte di una sceneggiatura all’altezza e
di adeguate consulenze “futurologiche”, Spielberg si è concentrato sulla problematica della
(im)ponderabilità della condotta criminale, lasciando intravedere – oltre il crepuscolo della
moderna dicotomia teorica determinismo/libero arbitrio – la concretezza dell’esperienza. Quel
che nello stringato racconto di Dick baluginava come intuizione metafisica, salvo poi spegnersi in
un tetro epilogo prossimo all’onirico, nella stemperata rivisitazione cinematografica di Spielberg
sembra invero oltrepassare la fantascienza di genere distopico per instaurare – in controluce – un
serrato confronto con le insidie della nuova metodica di polizia che va prendendo forma nel XXI
secolo: la polizia predittiva. Una metodica che si direbbe tributaria della controversa stagione del
positivismo penale, seppure rinnovata nelle premesse, e nelle promesse, dagli avanzamenti info-
telematici che caratterizzano la società contemporanea.
Predictable crimes? The Twilight of the Modern Penal System in Steven Spielberg’s Minority
Report
Inspired by Philip K. Dick’s short story of the same name, Steven Spielberg’s Minority Report
could be viewed as a somewhat successful attempt to underline a dystopia in reality,
notwithstanding some weaknesses in logic and narration. Using a fairly sound screenplay and a
realistic projection of what the future will look like, Spielberg focuses on the problems of the
(non) predictability of criminal conduct. The viewer is thus exposed to concrete experiences
beyond the “twilight” of modern theoretical dicotomy determinism/free will. In particular,
Spielberg deals here with the dangers of the XXI century predictive policing: a methodology that
seems to date back to the divisive penal positivism, however enhanced by infotecnological
advances that characterize contemporary society.

Il paper si concentra sul rapporto tra libera creatività e varie forme di censura nel Cristo si è
fermato a Eboli di Carlo Levi.
Il discorso si articola in tre parti: dapprima riassume la genesi e il contenuto del capolavoro di
Levi; nella seconda parte evidenzia i temi politico-costituzionali che emergono dal romanzo;
infine conclude discutendo il rapporto ambivalente tra i vari tipi di censura che colpirono l'autore
e la genealogia eroica del suo racconto.
La tesi sostenuta è che il cosiddetto problema meridionale è in realtà il problema della comunità
costituzionale italiana. Sottratto alle sue comodità borghesi, e gettato nella peripheral view del
mondo dei contadini e degli emarginati, Levi arrivò a conquistare una visione politica
autenticamente federale.
La presentazione evidenzierà le diverse modalità espressive assunte dal racconto del confino di
Levi: il romanzo originario, la sua trasposizione in sceneggiato televisivo, quindi in film, infine in
lettura radiofonica.
In search of lost federalism: Christ stopped at Eboli
The paper focuses on the relationship between free creativity and various forms of censorship in
Christ Stopped at Eboli by Carlo Levi.
The speech is divided into three parts: it first summarizes the genesis and content of Levi's
masterpiece; in the second part it highlights the political and constitutional issues arising from the
novel; finally it concludes by discussing the ambivalent relationship between the various types of
censorship that affected the author and the heroic genealogy of his tale.
The argument advanced is that the so-called Southern problem is actually the problem of the
Italian Constitutional community. Subtracted to its bourgeois comfort, and thrown in the
peripheral view of the world of the peasants and the marginalized, Levi came to conquer a vision
of an authentically federal polity.
The presentation will highlight the different modes of expression taken by the story Levi’s exile:
the original novel, its transposition into television drama, then the film, finally in a radio reading.
