Response to your request for the official diary of the Chief Minister (as clarified)

I enclose a copy of most of the information you requested.

Whilst our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section 30 (Economy and Commercial Interests) section 32 (Law Enforcement) and section 35 (Conduct of Public Business) of the Act apply to some of the information. The reasons why those exemptions apply are as follows:

Section 30 – Economy and commercial interests

Information has been withheld pursuant to section 30(2)(b) where disclosure would, or would be likely to prejudice the commercial interests of a person (including the public authority holding it).

The nature of the prejudice is such that disclosure could cause speculation concerning a particular business or trade which would be likely to prejudice its commercial interests.

As this is a qualified exemption, we are obliged to determine whether the public interest in disclosing the information outweighs the public interest in withholding the information.

We have identified the following factors in favour of disclosure:

There is a public interest in ensuring that discussions of a commercial nature are conducted in an open and transparent way to protect consumers.

Disclosure may promote both public interest and understanding in commercial activities and decision making.

Disclosure may promote good government in evidencing that the Chief Minister takes an interest in all matters relating to the Isle of Man economy and the commercial interests of local businesses.

We have identified the following factors in favour of maintaining the exemption:

There is a strong public interest in protecting the integrity of discussions within Government which may impact on a business by causing speculation.

Disclosure may cause a loss of confidence in Government and may inhibit businesses liaising with Government, which may have the further consequence of damage being caused to a particular business or industry sector.

Whilst the listing of an appointment in itself does not amount to confidential information, the nature of the discussions therein may amount to being confidential.

In assessing the weight to be attributed to each of the above factors, in addition to the prejudice which would be likely to be caused, the following has also been taken into consideration:

Whilst the likelihood of any prejudice cannot be quantified, it is more than a remote possibility and should it occur, it may impact directly on a business and more widely on a particular business sector.

The information is fairly recent in age and therefore the risk of any detrimental impact occurring is stronger.

Disclosure of the information would not significantly further the public interest arguments identified in disclosing the information, as in itself if does not add to public understanding of the nature of the Chief Minister’s functions.

There is no misinformation in the public domain that needs to be corrected by disclosure and disclosure may act as a catalyst for creating misinformation.

Taking into account the factors in favour of disclosure, the factors in favour of maintaining the exemption and any weight to be ascribed on both sides, the Cabinet Office has determined that the public interest in ensuring that commercial harm does not occur to local businesses/individuals in business outweighs the public interest in disclosing the information.

Section 32 – Law Enforcement

We have applied qualified exemptions under section 32(1)(a) and section 32(1)(c) of the Act where disclosure would or would be likely to prejudice:

Pursuant to s32(1)(a), the prevention or detection of crime; and/or Pursuant to s32(1)(c), the administration of justice.

The prejudice that would be likely to occur is prejudice to any relevant and particular investigation that might be being conducted by the Isle of Man Constabulary. A disclosure in response to a freedom of information request is a disclosure to the world and if the prejudice occurred then the consequences could be that criminals are alerted to the possibility that they are being investigated. This may make individuals and businesses more vulnerable to crime.

Prejudice to the inter-agency relationship between the Chief Minister and the Isle of Man Constabulary would also occur as the Isle of Man Constabulary has been consulted (in accordance with Part 7 of the Freedom of Information Code of Practice) in this regard, and opposes disclosure for the reasons contained herein.

As this is a qualified exemption, we are obliged to determine whether the public interest in disclosing the information outweighs the public interest in withholding the information.

We have identified the following factors in favour of disclosure:

There is a public interest in the functions on the Chief Minister. There is a public interest in the administration of justice and ensuring that Government

proactively works with the Isle of Man Constabulary in the prevention and detection of crime.

There is a public interest in maintaining confidence in law enforcement and the criminal justice system.

We have identified the following factors in favour of withholding the information:

As disclosure may prejudice the prevention and detection of crime, release of the information, in these circumstances may undermine confidence in law enforcement and the criminal justice system by damaging the prospect of criminals being brought to justice.

There is a wider public interest in safeguarding individuals, property and businesses on the Isle of Man.

There is a wider public interest in Government and agencies working together to ensure that the Isle of Man remains a safe place to live and work.

In assessing the weight to be attributed to each of the above factors, in addition to the prejudice which would be likely to be caused, the following has also been taken into consideration:

With any investigatory powers there is a critical timing issue and as the information is recent the chance of the prejudice occurring is significantly increased.

There is a possibility that information disclosed could be combined with other information already in the public domain, which in itself could cause prejudice to the prevention and detection of crime.

The public interest arguments in favour of disclosure, identified above, would not be sufficiently advanced to warrant disclosure.

There is no information in the public domain that warrants being corrected.

Taking into account the factors in favour of disclosure, the factors in favour of maintaining the exemption and any weight to be ascribed on both sides, the Cabinet Office has determined that the

public interest in ensuring that the integrity of the process involved in preventing or detecting crime and the administration of justice outweighs the public interest in disclosing the information.

Section 35 – Conduct of public business

We have applied a qualified exemption under section 35(b)(i) where disclosure would or would be likely to inhibit the free and frank provision of advice. It is in the interests of promoting good government that the Chief Minister seeks advice on matters and that any advice received is not sanitised in any way due to concerns that the details of any meeting may be disclosed in response to a freedom of information request.

Disclosing the information requested, in these circumstances, would be likely to prejudice an individual or business from providing factual and somewhat robust advice to Government and in particular the Chief Minister.

As this is a qualified exemption, we are obliged to determine whether the public interest in disclosing the information outweighs the public interest in withholding the information.

We have identified the following factors in favour of disclosure:

There is a public interest is ensuring activities are conducted in an open and transparent way, as this will lead to a greater understanding of the way Government works.

Knowing who the Chief Minister meets with to obtain knowledge and advice may promote good government and confidence that the Chief Minister seeks the advice of those with particular expertise in certain sectors in order to become better informed on matters which affect the Isle of Man.

Disclosure could allow for a more informed debate, which may increase trust in the quality of any decision making by the Chief Minister.

We have identified the following factors in favour of maintaining the exemption:

There is a public interest in protecting the balance of openness and transparency against the proper and effective functioning of Government, without creating speculation about the subject matter of some meetings.

There is a public interest in the Chief Minister being free to consult a person and/or business on a particular issue without causing speculation, or inferences being drawn just by virtue of the fact that a meeting has been held.

There is a public interest in preventing the disclosure of names of certain individuals and/or businesses where to do so may lead to an individual/business being lobbied, which in itself would be likely to inhibit the free and frank advice that may be given in the future.

In assessing the weight to be attributed to each of the above factors, in addition to the prejudice which would be likely to be caused, the following has also been taken into consideration:

Whilst the public interest in disclosing whom the Chief Minister has met does promote good Government, it may also prejudice good Government by inhibiting the provision of advice moving forward and the ability of the Chief Minister to obtain such advice.

The age of the advice is recent and therefore the chance of prejudice in these circumstances is increased.

Without a safe space for the free and frank provision of advice, in certain circumstances, would prejudice the ability of the Chief Minister and other Ministers from being able to obtain such advice to enable them to fulfil their roles to the best of their ability.

In balancing all of the above factors and additional weighting considerations, the Cabinet Office has determined that the public interest in favour of disclosing the information is outweighed by the public interest in maintaining the exemption and withholding the information.

REQUEST UNDER THE FREEDOM OF INFORMATION ACT 2015 (“the Act”)

I write in reference to your request dated 12th March 2017 for an internal review to be conducted of the response provided to a Freedom of Information request reference number IM76304I. An internal review of the response to your request has now been completed by an independent officer who was not involved with the original request. The findings of the review are:

1. The independent officer was satisfied that all the correct procedures [in accordance with the

Freedom of Information Code of Practice] had been followed and all statutory obligations [in

accordance with the Act] had been met in respect of the processing of request IM76304I.

2. On reviewing the correspondence and associated documents, the independent officer was

satisfied that the exemptions had been applied correctly.

3. The independent officer noted that a further qualified exemption could have been applied to some of the data, namely “Absolutely Exempt Personal Information” section 25(2): S25(2) states that Information is absolutely exempt if it is personal data of a person, who is

not you and the disclosure of this data would contravene any of the Data Protection

principles. The first data protection principle states that “data shall be processed fairly and

lawfully….”

In considering the content of the information it was concluded that disclosure of the same

would not be fair to the data subject, taking into account the consequences of disclosure on

the individual(s) concerned, whether it includes any sensitive personal data, the reasonable

expectations of the data subject, whether the data concerns the data subject’s private or

public life, the nature of the request, the circumstances in which the information was

obtained, whether the information is in the public domain and any assurances of

confidentiality.

If you are dissatisfied with the outcome of this review, under s42(1) of the Act you have the right to

apply to the Isle of Man Information Commissioner for a review of a) our response, or b) any
