MEMORANDUM ORDER NO. 2012-38

AUTHORIZING THE METROPOLITAN WATERWORKS AND SEWERAGESYSTEM (MWSS) TO HIRE NINE (9) CONSULTANTS.

WHEREAS, the MWSS has requested for authority to hire nine (9) consultantsas an exemption from the pertinent provisions of Executive Order (E.O.) No. 366,s.2004, and DBM Circular Letter Nos. 2009-13 and 2011-14;

WHEREAS, the Governance Commission for GOCCs (GCG) pursuant toRepublic Act No. 10149 (R.A. No. 10149) mandates the GCG to "evaluate theperformance and determine the relevance of the GOCC, to ascertain whether suchGOCC should be reorganized, merged, streamlined, abolished or privatized, inconsultation with the department of agency to which a GOCC is attached";

WHEREAS, under Section 53.7 of the Revised Implementing Rules andRegulations of Republic Act No. 9184, "the term of the individual consultants orpartnerships shall, at the most, be on a six month basis, renewable at the option ofthe appointing Head of the Procuring Entity, but in no case shall exceed the term ofthe latter";

WHEREAS, the Commission has determined that it is in the best interest ofthe State and the public to allow the MWSS, in the latter's pursuit of its WaterSecurity Legacy program, to hire the nine (9) consultants as enumeratedhereunder;

NOW, Be it -

RESOLVED, the request of the MWSS to prospectively hire the followingconsultants at the cost of P50,000/month, for a duration of six (6) months, and to beprocured after the issuance of this Order, is hereby APPROVED:

1. Strategic Planning Expert;2. Finance Specialist with Rate Rebasing Experience;3. Organization Plan Review, Formulation, and Implementation

[Specialist];4. People Plan Development [Specialist];5. Compensation Position and Classification System (CPCS)

[Specialist];6. Communications Specialist; and7. Public Relations Specialist.

RESOLVED FURTHER, the request of the MWSS to prospectively hire thefollowing consultants at the cost of P50,000/month, for a duration of three (3)months, and to be procured after the issuance of this Order, is hereby APPROVED:

1. Information Technology Assessment Specialist; and

2. Information Systems Strategic Plan (ISSP) Specialist; and

RESOLVED FINALLY, that the authorization to hire the foregoing consultantsis SUBJECT TO THE FOLLOWING:

I.The provisions of Republic Act No. 9184 and its RevisedImplementing Rules and Regulations are strictly complied with;

2. Funds for the purpose shall be taken fully from the corporatefunds of the MWSS, included in its Corporate Operating Budgetas approved by its Board of Trustees; and

3. The pertinent civil service, budgetary, accounting, auditing andother applicable laws, rules and regulations shall be compliedwith.
