ITEM 4: Presentation of Glenorchy City Council Annual Report 2015-16
Introduction
Under section 72B of the Local Government Act 1993 (the Act), Council is required to hold an Annual General Meeting (AGM).
The primary purpose the AGM is to allow the public to ask questions about the contents of Council’s Annual Report, and to provide an opportunity for the electors present to make any relevant motions for the council to consider at the next ordinary Council meeting. Annual Report – Presentation and Regulatory Compliance
Under section 72 of the Act, Council, at its Special Meeting on 7 November 2016, resolved to adopt the draft Glenorchy City Council Annual Report 2015-16 (Annual Report).
Under section 72(2)(a) of the Act, on 15 November 2016, Council submitted one copy of the Annual Report to the Director of the Local Government Division of the Department of Premier and Cabinet, and one copy to the Director of Public Health.
Under section 72(2)(b) of the Act, on 12 November 2016 Council made copies of the Annual Report available for public inspection on its website and at its offices at 374 Main Road, Glenorchy.
Under section 72(2)(c) of the Act, Council made copies of the Annual Report available free of charge.
Under section 72(2)(d) of the Act, Council published a notice in ‘The Mercury’ on 12 November 2016 advertising the availability of the Annual Report and inviting electors to lodge submissions on the Annual Report for discussion at the AGM (Advertisement).
The Advertisement advised that written notice of motions and/or questions to be put at the AGM would be received until noon on 5 December 2016. Community Submissions Received
Council received a total of four (4) submissions in response to the Advertisement by the closing time of 12:00 noon on 5 December 2016.
The submissions received were as follows:
- a submission containing two (2) questions on notice was received from Mr. Bob Holderness Roddam of Austins Ferry
- two (2) separate notices of motion were received from Mr. Holderness Roddam, and
- a submission containing ten (10) questions on notice was received from Mr. Phil Butler of Glenorchy.
Copies of all the submissions received by the cut-off time are Attachment 1 to this report.
Of the total of fourteen (14) submissions received:
- three (3) were properly made because they related to the contents of the Annual Report (as required under s. 72(2)(d) of the Act), and
- eleven (11) were not properly made because they did not relate to the contents of the Annual Report (as required under s. 72(2)(d) of the Act).
Submissions Not Properly Made
The following submissions were not properly made because they did not relate to the contents of the Annual Report:
- the two (2) questions on notice from Mr. Holderness Roddam (received in a single submission)
- the two (2) notices of motion from Mr. Holderness Roddam (received in separate submissions), and
- questions 1, 4(‘a’ and ‘c’), 5, and 6a) through 10 of the ten (10) questions on notice received from Mr. Butler.
Because the above submissions do not relate to the contents of the Annual Report, it is not appropriate that responses to them are provided at the AGM.
However, as a matter of courtesy, Council will provide Messrs Holderness Roddam and Butler with written answers to all of the non-compliant questions.

Questions received from Mr. Phil Butler, Glenorchy
QUESTIONS FOR THE GLENORCHY CITY COUNCIL
AGM 2015/2016 FY
1. Those of us who have been regular attendees at Council meetings note that
many questions have been asked of the GM in relation to the monthly major projects
brief. Why has the General Manager not provided Council with the required
information in a timely and efficient manner?
2. The Draft Annual Report reports against the Strategic Framework and the high
priority action areas. Why have most of those high priority areas not been completed
to schedule?
3. At the October Council meeting when discussing the Draft Annual Report, the
GM admitted in response to questions that Council had an underlying deficit of
approximately $1.1m.
a) Why can’t we find that reported somewhere in the Annual Report.
b) Has the General Manager misrepresented the true financial position of Council
by stating in his General Manager’s message that Council has a surplus and
has achieved this position one year ahead of schedule?
c) Is it a fact that the surplus shown is only accounting jargon following a
revaluation whereas the real situation is an operating loss?
d) Does the GM consider this Annual Report to be a transparent document
intending to present an accurate picture of Council to Ratepayers?
4. At the last AGM the GM was asked for information relating to the value of
contracts given to CT Management, who it was widely reported had conducted the
restructure program for GCC. The response to those questions was less than
satisfactory and was cloaked in ‘Commercial in Confidence’ reason for non answers.
We note that during the October and November Special Council meeting, when
considering the Draft Annual Report; the Mayor asked a question about whether all
major contracts had been disclosed as required by the regulations. The General
Manager said yes but the Mayor and Ald Stevenson did not seem to agree. They were
adamant that there was something that had not been disclosed.
a) Were they in fact trying to get information about CT Management contracts
with Council? If not, what were the contracts that the Mayor and Ald
Stevenson were referring to?
b) Has the GM disclosed every contract that he is required to under the
regulations?
c) If it is latter found that this was not the case will the GM give an undertaking
to this AGM to resign immediately from his position as GM?
5. During the year in review and in the decision of Blow CJ in the matter
Branch-Allen v Easther and Mason, the Chief Justice noted on a number of occasions
that the General Manager had behaved in an obfuscating manner and called the
Director of Corporate Governance and General Counsel’s behaviour “very strange”?

Questions received from Mr. Phil Butler, Glenorchy
a) Has the Council taken any disciplinary action against the General Manager
and/or the Director of Corporate Governance and General Counsel in the light
of these comments?
b) Has all information sought by the Board of Inquiry from the General Manager:
i) been provided, and
ii) been provided in a timely manner and
iii) been provided in an unequivocal and transparent manner?
6. Did the General Manager get paid a bonus (or as he called it last year – his ‘at
risk component’) in relation to his performance in the 2015 calendar year?
a) Did the GM Performance Review Committee investigate or make any
recommendations to Council in relation to the serious comments of Blow CJ in
the Supreme Court action previously mentioned relating to the performance of
the GM? If not, why not.
7 The General Manager in a meeting earlier in the year threatened to take legal
action against Ald Stevenson because of comments he made on ABC radio relating to
his reasons for asking questions on notice. Has the GM taken legal action against Ald
Stevenson? Has the GM threatened or taken legal action against any other aldermen?
8. We have noted that quarterly reports against the Annual Plan appear to be
presented to Council some months past their due date, sometimes four months past.
How do the aldermen manage and oversee in an efficient and timely manner the
performance of the Council when quarterly reports are presented to them so late?
9. Members of the public have witnessed inaccurately recorded minutes being
passed and minutes with “unusual” commentary in them (usually in disparaging terms
about the Mayor). This appears to a lay person to be a very strange way of minuting
the business of Council.
a) Are not minutes intended to be an accurate account of the decisions of an
organisation?
b) Why does this commentary only appear to be directed against the Mayor?
c) Why does the GM allow this bias to occur?
10. Who represents the Council under the provisions of the Local Government
Act?

Motion for AGM 2016 - Stormwater contaminating sewerage
As a consequence of several recent heavy rainfall periods, the sewerage cover/manhole on the eastern footpath on Main Road, Claremont at the Hilton Road junction has been lifted. The result is that the contents has been spewed out over the footpath and related area of Beedhams Reserve. I propose THAT the Glenorchy City Council and TasWater [Sewerage] investigate what appears to be storm water entering the sewerage pipes and rectifY the situation.

Given that the Tasmanian Fire Services Nearby Safer Places program is regional based, rather than local, I propose that the Glenorchy City Council assess local areas as possible Nearby Safer Places for local use - for example the Shoobridge Park sports ground for Austins Ferry residents.

Explanatory notes:
Local Nearby Safer Places for bushfire refuge Whilst Austins Ferry may be considered to be reasonably safe in bushfire situations, it could be at risk in severe conditions from fires in either Poimena Reserve or the bush near St Virgils College.,
Whilst the Tasmanian Fire Service has a network of Safer Places, these are considered to be regional. The closest to Austins Ferry are at (a) the MYCT speed-boat racing circuit on Lyell Highway north of Granton, and (b) the Abbotsford Park in Claremont.
Neither of these are in close proximity for Austins Ferry residents, particularly . pedestrians.
Example of possible Nearby Safer Place for Austins Ferry:
Shoobridge Park, assessed from Austins Ferry Road via Weston Park, is close to the Derwent River and has toilets and water available at the scout hall. The grass is kept closely mown and watered for sports use during summer.
Access from Weston Park is via the new concrete bridge over Roseneath Rivulet. Whilst there is flammable vegetation along the Rivulet, it is not an excessive quantity. Other vegetation surrounding the sports ground is minimal, and some would not bum easily as it is of northern hemisphere origin, such as crab apple and feral plum trees.
Weston park is also kept watered and the grass is regularly mown.
Alternative pedestrian access to Shoo bridge Park is from Main Road, via Beedhams Reserve.

Questions on notice for AGM, 12 December 2016
1. With reference to the Glenorchy City Council Creek Maintenance Plan,
prepared by Sonya Stallbaum, June 2007.
This report made several recommendations regarding Council’s future
management of creeks and rivulets. These include:
4.1 Weed management - particularly blackberry, cumbungi and crack willow.
4.2 Restoration of native vegetation and protection of remnant vegetation.
4.4 Reduction of runoff from residential developments, etc. by reducing
impervious coverings such as concrete.
4.4.4 Water-sensitive urban design standards for new developments.
4.5 Rubbish / waste management, including stormwater traps.
4.7 Vandalism control
4.7 Public education regarding the value of our waterways.
What steps have been taken to implement these recommendations, and
what work is planned over the coming year?
2. With reference to the Dilapidated building: former Butcher’s shop, l64? Main
Road, Austins Ferry
There is no visible street number on the building, but it is on the northern side of the
Austins Ferry Store at 162 main Road.
I attach a report to the former Claremont, Austins Ferry and Granton Community Precinct meeting, dated 6 February 2014.
Given that over two and a half years have elapsed since Council was
asked to attend to this issue under the Local Government (Miscellaneous
Amendments) Act 2013, why has no apparent action been taken and when
may Austins Ferry residents expect a resolution to this issue?

Claremont, Austins Ferry and Granton Precinct Committee Building
Dilapidated building: former Butcher’s shop, Main Road, Austins Ferry
There is no visible street number on the building, but it is on the northern side of
the Austins Ferry Store at 162 main Road. The photographs below illustrate the
condition of this building, which has been vacant for nearly 20 years.
State Parliament passed an amendment to the Building Act 2000 in late 2013, as a
part of the Local Government (Miscellaneous Amendments) Act 2013.
The explanatory fact sheet stated that this Act gives local councils general
managers "powers to order building owners to carry out building work (or other
work) to remedy the adverse effects of dilapidated buildings on local
communities" .
"A dilapidated building is defined as a building ... that because of neglect,
disrepair, defacement or damage is of an appearance that is prejudicial to the
visual amenity of its surroundings.
"In practical terms, conditions such as broken windows, damaged roofs, peeling
paint, graffiti or other defects may contribute to a general manager deciding that a
building is dilapidated."

Clearly, the former Austins Ferry Butcher’s shop fits all the criteria specified for a
dilapidated building.
Proposed action:
That the Claremont, Austins Ferry and Granton Community Precinct Committee
request the General Manager of the Glenorchy City Council to order the owner of
the former Austins Ferry Butcher’s shop to either remedy the adverse effects of
this building, or demolish said building.

1. WELCOME BY MAYOR
The Mayor declared the Annual General Meeting for 23 November 2015 officially open and welcomed all those in attendance (list attached).
“I would like to welcome you all here today to the Glenorchy City Council Annual General Meeting and I acknowledge and pay respect to the Tasmanian Aboriginal community as the traditional and original owners and continuing custodians of this land.”

The Mayor outlined the purpose of the meeting.

That the Minutes of the Annual General Meeting held on 8 December 2014 be confirmed.

The Mayors presentation included an outline of the Mayor’s Report from the 2014/2015 Annual Report. The Mayor recognised in particular all senior staff who have left Council in the past year: Greg French, David Reeve, Stuart Lovell, Sue Buckland, Narelle Calphy, Sue Bis Winckel, Cindy Woolley, Gary Lawther, Jason Browne and Jo Chandler. 5. QUESTIONS ON NOTICE AND MOTIONS
Mayor ran through all Questions and Answers. Phil Butler queried whether he would be able to query the answers during Mayors’ address – on consultation with General Manager it was decided that the questions would have to be addressed at the next item. 6. GENERAL BUSINESS
Member of Public: Queried whether questions are limited to the Annual Report only?
Mayor: Any question can be asked.
Member of Public: Question regarding the butchers shop on the Main Road in Austin’s Ferry. Two years ago, the precinct asked for action to be taken by Council to have the butchers shop remediated. What has been done? If nothing has been done, why not?
Mayor: Question taken on Notice.
