ABOUT THIS APPLICATION FORM

This form is for the purpose of making an application for an Integrated Pollution Prevention and Control (IPPC) Licence under the Environmental Protection Agency Acts, 1992 and 2003. There are separate application forms for licensees who wish to apply for a review of existing licences and for Pig & Poultry sector applicants.

The Application Form must be completed in accordance with the instructions provided in the IPPC Licensing Application Guidance Note. The Guidance Note gives an overview of IPPC Licensing, outlines the licence application process (including number of copies required) and specifies the information to be submitted in the application. The Guidance Note and application forms are available to download from the IPPC Licensing pages of the EPA’s website at www.eoa.ie. A valid application for an IPPC licence must contain the information prescribed in the Environmental Protection Agency (Licensing) Regulations, 1994 to 2004. Article 10 of the Regulations sets out the statutory requirements for information to accompany a licence application. The application form is designed in such a way as to set out these questions in a structured manner and not necessarily in the order presented in Article 10. I n order to ensure a legally valid application in respect of Article 10 requirements, please complete the Article 10 Checklist provided in Annex 2.

I SECTION A: NON-TECHNICAL SUMMARY I

A non-technical summary of the application is to be included here. The summary should identify all environmental impacts of significance associated with the carrying on of the activity/activities, and describe mitigation measures proposed or existing to address these impacts. This description should also indicate the normal operating hours and days per week of the activity.

The following information must be included in the non-technical summary:

A description of:

the installation and its activities, the raw and auxiliary materials, other substances and the energy used in or generated by the installation, the sources of emissions from the installation, the environmental conditions of the site of the installation (e.g. soil and groundwater, air, noise, surface water), the nature and quantities of foreseeable emissions from the installation into each medium as well as identification of significant effects of the emissions on the e nvi ron men t, the proposed technology and other techniques for preventing or, where this is not possible, reducing emissions from the installation, where necessary, measures for the prevention and recovery of waste generated by the installation, further measures planned to comply with the general principles of the basic obligations of the operator i.e.

(a) all the appropriate preventive measures are taken against pollution, in

(b) no significant pollution is caused; (c) waste production is avoided in accordance with Council Directive 75/442/EEC

of 15 July 1975 on waste; where waste is produced, it is recovered or, where that is technically and economically impossible, it is disposed of while avoiding or reducing any impact on the environment;

(d) energy and other resources are used efficiently; (e) the necessary measures are taken to prevent accidents and limit their

E.1.A. Details of all Doint emissions to atmosphere

Details of all point emissions to atmosphere should be supplied. Complete Table E. l( i) for Boiler Emissions and Table E. l( i i) and E.l(iii) for all other main emission points. Complete Table E. l( iv) for minor emission points.

A summary list of the emission points, together with maps and/or drawings (no larger than A3), and supporting documentation should be included as Attachment NQ E. Plans of emission elevations, relevant roof heights, etc., should also be included, as should detailed descriptions and schematics of all abatement systems.

The applicant should address in particular any emission point where the substances listed in the Schedule of S.I. 394 of 2004 are emitted.

For emissions outside the BAT guidance limit, a full evaluation of the existing abatement/treatment system must be provided. A Dlanned Droaramme of immovement towards meetina uDaraded standards is reauired. This should highlight specific goals and a time scale, together with options for modification, upgrading or replacement as required to bring the emissions within the limits as set out in the BAT guidance note(s). These notes can be found on the EPA website at www.eDa.ie.

E. l .B. Fuaitive and Potential emissions

Give summary details of fugitive and potential emissions in Table E. l(v) .

In relation to activities listed in the Schedule of Council Directive 1999/13/EC on the limitation of emissions of volatile organic compounds due to the use of organic solvents in certain activities and installations;

E.2 Emissions to Surface Waters

The applicant should address in particular any emission point where the substances listed in the Schedule of.S.1. No. 394 of 2004 are emitted.

Details of all List I and List I1 substances listed in the Annex to EU Directive 76/464/EEC (as amended), contained in any emission must be presented. All surface water runoff and storm water drains discharging to surface water bodies must be included. A National Grid References (12 digit, 6E, 6N) must be given for all discharge points. The identity and type of receiving water (river, ditch, estuary, lake, etc.) must be stated.

For emissions outside the BAT guidance limit, a full evaluation of the existing abatement/treatment system must be provided. A Dlanned Droaramme of immovement towards meetina umraded standards is reauired. This should highlight specific goals and

All relevant information on the receiving sewer, including any effluent treatment/abatement systems, not already described, with schematics as appropriate should also be included in Attachment NeE.3.

For emissions outside BAT guidance limit (where given), a full evaluation of the existing abatement/treatment system must be provided. A Dlanned Droqramme of improvement towards meetina uDaraded standards is reauired. This should highlight specific goals and a time scale, together with options for modification, upgrading or replacement as required to bring the emissions within any limits set out in the BAT guidance note(s).

E.4. Emissions to Ground

Describe the existing or proposed arrangements necessary to give effect to Articles 3,4,5,6, and 7 of Council Directive 80/68/EEC of 17 December 1979 on the protection of groundwater against pollution by certain dangerous substances.

Point source monitoring/sampling refers to monitoring from specific emiision points (e.g. from a boiler stack or outlet from a wastewater treatment plant). Examples of ambient monitoring includes monitoring of ambient air quality (e.g. boundary or off-site) or monitoring of river quality upstream/downstream of an effluent discharge.

ANNEX 2: CHECKLIST FOR ARTICLE 10 COMPLIANCE

Attachment D

Article 10 of the Environmental Protection Agency (Licensing) Regulations, 1994 to 2004 sets out the statutory requirements for information to accompany a licence application. The Application Form is designed in such a way as to set out these questions in a structured manner and not necessarily in the order presented in Article 10. In order to ensure a legally valid application in respect of Article 10 requirements, all Applicants should complete the following checklist and submit it with the completed Application Form.

B.9 Seveso I1 Regulations

The European Communities (Control of Major Accident Hazards Involving Dangerous Substances) Regulations gives effect to Council Directives 96/82/EC and 2003/105/EC, hence implementing the Seveso 11 Directive on the control of major hazards involving dangerous substances.

A “dangerous substance” means a substance, mixture or preparation:

specified in the First Schedule of these Regulations (Part 1 of Annex I to the Directive) or

generally considered to fulfil any of the categories laid down in the First Schedule (Part 2 of Annex 1 to the Directive)

and present in the quantities to which Annex 1 (which is set out in the First Schedule) relates.

Castle Paints (Tullamore) Ltd do not store or handle chemical materials listed in Part 1 of Annex I to the Directive.

Castle Paints (Tullamore) Ltd do store solvents at the site and in particular Toluene with a risk phrase R 10. This is a flammable material as defined in the Directive and.a qualifymg quantity of 5,000 tonnes storage is specified in the Directive to‘which Seveso applies. However, Castle Paints typically uses 80 tonnes of this material in a working year and will only store approximately 20 tonnes at any one time. There are other materials stored (resins) of which a percentage is solvent based but these quantities are well below Seveso tresholds.

D.l Operational Information Requirements

The site operates as a paint manufacturing facility for both solvent based and water based paints and also as a retail unit for the paint products manufactured and associated chemicals e.g. solvent thinners. The retail shop also sells various hardware and electrical itemdfittings for the home DIY market. A layout plan is attached (Drawing ref; * * *)

For the purpose of this licence application the following activities occur at the facility.

1. Paint manufacturing operations for both solvent based paints and water based paints (emulsions).

I Description; Solvent and water based paints are manufactured on a batch basis at the facility. Each batch is 1,000 litres at a time and a maximum of 3 batches can be made each working day. A process flow diagram below illustrates the paint manufacturing process. After a batch is finished, the paint is filtered and transferred into smaller containers (20litre and 5 litre drums) and sealed thereafter for sale.

The three most popular solvent based paint products manufactured at the site are:

Fast Dry Gloss, Fast Dry Zinc Phosphate Primer High Build and Fast Dry High Build Micaceous Iron Oxide. ‘These are all solvent based paints for industrial finishing to be applied to metal surfaces. Safety Data Sheets are attached in Appendix 3 for these products.

There are other solvent based paint products manufactured at the site but they are basically the same paint only with different finishing colours (different pigments used).

In addition there are water based paints (emulsions) made at the facility. However, since there are no hazards associated with these products, there is no further information supplied for these in this section.

D.2 Development and Operational History of the Site

Castle Paints (Tullamore) Ltd was set-up at the site in 1992 initially as a unit for warehouse storage and retail. The company first started to manufacture paint in 1999 to 2000 on a small scale. Since then there has been a steady increase in business to present day with a maximum of 3,000 litres of paint being produced. This amount is divided up between solvent and water based paints, the majority of paint being solvent based.

Presently the facility operates as a warehouse, manufacturing area, retail shop and associated offices. The outside area is used for storage of barrels of raw materials. Solvent based paints are manufactured for use as surface coatings .to the machinery and engineering works sector and water based paints are manufactured for use in the domestic sector.

The site was developed as a business from the start and was previously a green field site. There was never any previous waste activity or otherwise at the site. There are no underground storage tanks or otherwise at the site. All raw material storage is above ground either in the outside yard area or within the building unit. There has been no pollution incidents caused from the business to date.

This area is served by a concrete surfaced yard with associated drainage gullies and a warehouse type building. All paint manufacturing operations occurs indoors and no liquids are handled outside.

Management at Castle Paints (Tullamore) Ltd ensures that all waste is handled correctly and placed in containers with covers prior to frequent collections by appointed waste management contractors. There is dailey visual inspections around the site primeter to ensure no windblown litter o c c ~ from the premises.

Treatment, Abatement and Control Systems

F.1.1 Air

Air emissions from the facility will be monitored as detailed in section F.2 below.

Air emission from the one point some will result in VOCs and particulates discharges. The fume extmction system is coupled with a filter unit to trap dustdparticulates from addition of pigment powders during the paint manufacturing process. However, there is no system for VOC treatment at present.

Further control measures may be adopted should the need arise and should ongoing monitoring data show air emission levels to be problematic to local air quality. These may include:

The existing fume extraction system i s maintained as required to keep it working efficiently.

There is no issue of ambient dust emissions from the facility due to the fact that only outside yard storage occzus of barrels, drums and IBCs. There is no dusty material stored or handled outside. All raw materials in powder form are stored inside the building prior to uselsale.

F.1.2 Odour

There will be no dour emissions of any significance itom the Eacility. There may be initial localised adours fiom solvent based paint product during manufacture but this odour is not nuisance causing as distance increases to other neighbouring units. Also, once product is sealed in containers, there is no odour detected from the paint.

F.1.9 Human Beings

Castle Paints (Tullamore) Ltd is located within the Cloncollig Inndustrial Estate off the GeashilYPortarlingtm Road (R420) out of Tullamore Town. The Cloncollg Industrial Estate is a mixed industrial/commercial park, with developments such as Aramount Furniture (Furniture sales to general public), Palfinger (hydraulic lifhfloadjng/hmdling systems), Midland Vetinary (vetinary services), Churchad Motors (car sales), C&QES (Engineering Services and manufacture of machinery for concrete and quarry industries) are some of the varied business located in the vicinity of the paint manufacturing facility.

Traffic movements to the site do not have a negative impact on the traffic volume in the surrounding area. Noise monitoring has shown that noise emissions from the facility do not have a negative impact on the surrounding area epecia!ly at the nearest dwellingslbusinesses to the site. Existing air emissions from the paint manufhcturing process have been monitored and are to be assessed with the threshold levels as defined in the VOC fiom organic solvents regulations 2002. However, Castle Paints (Tullamore) Ltd operations are not expected to have a negative impact on the local community.

The company provides a valuble service in providing paint to the engheerhghndustrial and domestic sectors.

The facility has an overall significant positive human impact. ?lese include the provision of employment and paint product to Tullamore town and the immediate surrounding area.

Potential adverse impacts on neighbours, close businesses and the environment include air emissions, noise and general waste production. These have been addressed in this application.

These impacts will be managed and controlled by Castle Paints (Tullamore) Ltd to reduce the impact on l d residents and m u n d i n g environment. Litter will be controlled by ensuring good house keeping measures at the site, handling waste inside buildings, covering waste areas and daily litter patrols at the site boundary.

F.1.10 Hydrogeology

No significant impacts expected from the facility.

The entire site is covered in concrete with drainage gullies directing all surface water run- off to a fluface water sewer network which serves the industrial estate.

G.2 Energy Efficiency

Castle Paints (Tullamore) Ltd uses electricity for all site machinery and plant and also for inside storage heaten and lighting, The 2006 annual energy consumption was 50,474 kwh for the facility.

The energy in electricity is provided by CH Power, Portlaoise, CO Laois. This company is environmental friendly and approximately 50% of the energy provided is sourced from wind pwer while the remaining 50% is sourced fiom combined heat and p w e r sources (CHP). This energy provider therefore results in a reduced C& emissions for the electricity it provides. Therefore the Castle Paints facility sources its electricity from a ‘Green’ energy provider.

H.l Raw Materials, Intermediates and Product Handling

All raw materials and products are stored within the confines of the site. At present the storage areas on-site are as follows:

Main storage area inside building (426.41m’). This is used for storage of raw materials used in the paint manufacture and also materials for re-sale. In particular all materials that are susceptible to damage from weather conditions are stored inside here. Shop storage area inside building (77.1 lm’). Similarly, finished products are stored here in small containers. Shop area (240.57m’). This area is a retail outlet and there is storage of paint products and associated chemicals here. This area also holds hardware items and home decor items (fixtures and fittings). The yard area around the site (excluding the car park) is used for storage of solvents and chemicals containing solvents in drums (barrels at 200kg) and some IBCs (1,0001itre capacity). These areas area proposed to be bunded using in-situ precast concrete measures. In addition, it is proposed to erect a bund wall around the entire site (excluding the car park) with a concrete ramp appropriate for entry and exiting the storage areas.

There is no issue of ambient dust emissions from the facility due to the fact that only outside yard storage occurs of barrels, drums and IBCs. There is no dusty material stored or handled outside. All raw materials in powder form are stored inside the building prior to usehale.

In relation to air emissions from the fume extraction system, air monitoring did take place in late August 2007 for particulates and VOC emissions including speciated analysis of the total VOC content. Ambient or fugitive VOC monitoring at locations around the site was also conducted.

A complete revision of this attachment will follow as soon as results are received.

Proposed dust mitigation measures and dust monitoring programmes are discussed in Sections F. 1 of this application.

In relation to surface water drainage, the following occurs:

Surface water run-off from yard areas and the roof of the building is all directed via yard gullies to a drain location at the front of the site and this drain flows to the surface water sewer network which serves Cloncollig Industrial Estate. This eventually flows to the Tullamore River north of the site.

A surface water sample was not taken due to dry weather conditions and therefore during the next wet period, a sample will be taken representative of the surface water quality leaving the site.

1.7 Existing Environment - Noise

A noise assessment survey was conducted at the facility as part of this licence application.

There were two primary objectives:

o Asscssmcnt of thc noise missions 6om the Castle Paints Ltd. facility

Noise monitoring was carried out to the International Standard IS0 199611 “Acoustics - Description BE measurement of environmental noise”, using a BrUel Kjaer Type 2250 SLM with outdoor equipment that was fully calibrated prior to the monitoring event.

Noise monitoring was carried out on the 7’ August 2007. Castle Paints Ltd. in the Cloncollig Industrial Park does not operate over night; therefore noise monitoring was not carried out overnight.

Weather conditions during sampling were warm with a cool north westerly breeze and clear skies.

Discussion There are currently no statutory limits for the control of environmental noise in Ireland. However, the EPA has issued a guidance note on noise emissions that states, ‘Ideally, ifthe total noise level from all sources is taken into account, the noise level at sensitive locations should be kept below an value of 55dB(A) by daytime. At night, to avoid disturbance, the noise level at noise sensitive locations should not exceed a T value of 45dB(A).’

Activities at the Castle Paints Ltd. facility occurs during the day. Noise sources arising from the plant were identified as:

. Vehicles enterindleaving the site . Personnel enterindleaving building = Pumps and fans operating to the rear of the plant

Mixers within the shed building . The movement of forklift in the rear yard and shed area

Of these identified sources the noise associated with the pumps, located at the rear of the plant, were the only sources to offer a relatively continuous noise. The pump and ventilation unit were only audible to the rear of the plant, with the main shed building and the boundary wall mitigating against the possible spread of this noise source. The operation of a forklift to the rear of the facility was mostly kept within the shed unit, and as such was only occasionally audible outside. ,,

Due to the small nature of the site, within an industrial unit setting, locations for noise monitoring were few. Two stations were established, one to the front of the unit - within the Castle Paints Ltd. customer car park; and one to the rear of the unit - outside the main rear entrance doors to the mixing shed. The narrow avenues on either side of the industrial unit did not offer a safe location to establish monitoring stations during working hours.

Noise Sensitive Receptors were chosen to the north south east and west of the facility. NSR’s were identified by their proximity to the Castle Paints Ltd. boundary and by their nature (housing, schools and public centres given precedence over industrial units). Five NSR’s were identified in the surrounding area. Two within the industrial estate at empty slots, two within housing estates in the area and one outside a gael school.

The site boundaries were monitored twice during the working day, once each in the morning and once each in the afternoon, to assess if there were any notable alterations in noise levels.

The values for station CP NM 001 for both morning and afternoon were 71 dB (A). As discussed, this station is located outside the primary entrance to the mixing shed to the rear of the 'facility. Noise arising from the mixing of paints and the ventilation of the shed facility were all highly audible at this location. Other noise sources included the movement of a large forklift in a facility to the southwest of Castle Paints Ltd. This station is the furthest removed from other sensitive receivers. The eastern boundary of Castle Paints Ltd. is bounded by a boundary wall into a neighbouring facilities work yard area, to the rear of a neighbouring facility to the south and the turning area and car park area for the industrial units to the north.

Station CP NM 002 show LAeq values of 64 dB (A) during the morning and afternoon monitoring period. Noise sources noted at this station were diffuse and various in nature, ranging from customers arrivingdeparting Castle Paints, delivery/collection truck operating within the industrial park (un related to activities at Castle Paints Ltd.). Vehicle counts were also conducted to assess the number of vehicles passing Castle Paints Ltd. during the monitoring period, these showed a high proportion of cars (over 55 in both cases during the !4 hour period). A general hum of traffic noise arising from these passing vehicles and from the main Church Road was present at this location. Noise arising specifically from Castle Paints was mostly indistinguishable from the activities occurring within the park. Noises arising from the rear of Castle Paints Ltd. facility were not audible at this location.

The closest Noise Sensitive Receiver (NSR) was selected within the Cloncollig Industrial Estate - CP NM 003. This station was established to the north of Castle Paints Ltd on a currently disused site. Due to the positioning of a tractor and trailer outside the Midland Vetinary Facility during the morning station, an evening station was established. Both monitoring events show similar readings with LA^ values of 63 and 62 dB (A) respectively for the morning and evening events. Noise audible at this location had many sources, mostly arising from activities within the Cloncollig Industrial Estate and in relatively close proximity to the monitoring station. Noises earlier sourced to the activities at Castle Paints Ltd. were not audible at this location.

CP NM 004 was located to the northeast of Castle Paints Ltd, situated on disused industrial land in the Industrial Park. This station was positioned to the rear of the industrial park area, with only the repair and services section of Church Road Motors been located beyond the monitoring station on the industrial park road. Noise levels were relatively low. A low hum was occasionally audible from the extraction fan located to the rear of Castle Paints Ltd. Primary noise arose from the passing of vehicles on the road, the movement of vehicles within the industrial park and the operation and reversing alarms from a fork lift in the yard area of C&QEMS. CP NM 004 shows a LAeq value of 52 dB (A).

The green area to the front of a housing estate bounding the south of Church Road was selected as a NSR. The monitor was established approximately equidistant from the main road and the front row of dwelling houses. No noise arising from Castle Paints was audible at this location. Notes detail the primary continuous noise source to be the movement of traffic along Church Road. CP NM 005 shows a LA^ value of 67 dB (A).

A Gael school located to the south west of the Industrial Park was selected as NSR, station CP NM 006. This station was relatively sheltered from Church Road by the school yard boundary walls and hedging and the timber boundary walls located around the proposed site for the Tullamore Sports Complex located across fiom the monitoring station. Noises sourced to Castle Paints Ltd by boundary monitoring stations were not audible at this location. Primary noise arising at this location were sourced to the cleaning of the pavement outside of Church Road Motors located across the main street, traffic on Church Road and the occasional construction noise arising from the Tullamore Sports Complex building site. CP NM 006 shows a LA^ value of 58 dB (A).

A new housing development - Church View Estate, is been developed to the west of the Cloncollig Industrial Estate. Some sections of this estate have been finished and sold. Station CP NM 007 was located beside a young tree planted in a car parking area to the east of a section of finished development within this estate. Primary noise arising at this location was sourced to the construction works still ongoing within the housing estate and to a lesser extent the operation of equipment and machinery at an unidentified facility located along the western boundary of the Cloncollig Industrial Estate. CP NM 007 shows a value of 55 dB (A). No noise arising from the operation of Castle Paints Ltd. was audible at this location.

Overall noise arising from the operation of the Castle Paints Ltd. business within the Cloncollig Industrial Estate is not audible outside of the facility boundaries. Station CP NM 004, located to the east of the facility was the only location to report any noise arising from the site. CP NM 004 had the lowest LA^ value from the day of monitoring.

Octave Band Analysis and Discussion

Octave band analysis of noise is the breakdown of the sound pressure readings, as recorded on site, into specific frequency band widths. This enables a greater understanding of the type of noise evident at a site and can give indications to where tonal noise is present. There are two common forms of octave analysis. ‘Full octave analysis’ groups sound pressure readings into frequency readings that cover a full octave. This type of monitoring gives a good general description of how people will perceive a soundnoise. One third octave analysis, further separates the noise reading into ‘/3 octave frequency groupings. Each frequency reading is given in Hz. The frequency reading is the central frequency for each band that is been monitored (i.e. Frequency band 250 Hz covers all sound pressure readings recorded between 167Hz to 3 3 3 Hz).

The scope of this noise assessment is to evaluate the noise arising from the Caste Paints Ltd. Facility within the Cloncollig Industrial Estate, Tullamore. From the broadband noise results discussed above, it is shown that noise arising from this facility were only audible at 3 locations, CP NM 001,002 & 004.

Monitoring data for the 3 identified stations is summarised below and the discussion will concentrate on the results from these three stations.

Discussion of 1/3 Octave Results Monitoring station CP NM 001 shows a general correspondence between the morning and afternoon levels, though specific peaks at narrowband frequencies in the large differ. At 50 hertz both the morning and afternoon level both show a noted tonal aspect in the noise with Lzq readings of 76 and 77 dB(A) been recorded for the morning and afternoon period respectively. This was approximately 7 dB greater than the 40Hz frequency reading and 12dB higher than the 63Hz reading. The most likely source for this tonal noise source is the extraction fan operating outside the rear wall of the Castle Paints Ltd. facility. This fan is utilised in the removal of solvent fumes from operations within the building. Tonal noises were also identified at 160Hz in the

. morning period and at 25 and 500Hz in the afternoon period. These 3 identified tonal I

frequencies are not recurring in the morning and afternoon stations and are likely to have been once off incidents such as reversing alarms near the facility, movement / banging of metal against metal etc.

Monitoring Station CP NM 002 shows a strong correlation between the morning and afternoon measurements. The only variation is the presence of a tonal aspect in the afternoon at the 50Hz range. The presence of this tonal aspect in the afternoon may indicate the slight increase in the sound pressure from the extraction fan in the afternoon increasing its audibility to the front of the facility. No other tonal aspects were identified in the two monitoring periods at this station.

CP NM 004 was the closest Sensitive Receiver station to have noticed noise arising from the extraction fans to the rear. Analysis of the '/3 octave measurements at this station do not indicate any perceptible tonal increases at the 50 Hz range. 1/3 Octave Analysis at station CP NM 004 does not show any tonal aspects at this monitoring station.

The measurements would indicate that the continual tone arising from the operation of the extraction fan to the rear of the facility occurs around the 50 Hz range. This is highly audible to the rear of the site and shows a notable tonal increase in the measurements obtained at station CP NM 001 (located to the rear of the facility). Other tonal aspects arising from off-site activities were also detected, though the variations in these from the morning and evening would indicate these are of a changeable source. The only noise sensitive station to detect any noise arising from Castle Paints Ltd. does not show any tonal aspects in its recorded measurements.

Environmental Noise monitoring was conducted at and around the Castle Paints Ltd. facility in the Cloncollig Industrial Estate, Tullamore, Co. Offaly on the 7'h August 2007.

Monitoring was conducted at 7 separate locations, 2 boundaries and 5 selected Sensitive Receptors.

Monitoring was carried out fiom 1O:OO to 17:OO during normal working activities.

Noise levels within the Cloncollig Industrial Estate are high with dB (A) recorded.

The highest level of noise arising from the Caste Paints Ltd. Facility arose from the rear of the plant where paints are manufactured. LA^ values of 7 1 dB (A) were recorded to the rear of the facility.

Only 1 SR indicated any audible noise arising fiom operations at Castle Paints Ltd., station CP NM 004, this station showed a LA^ value of 52 dB (A).

Tonal assessment of the noise arising from the rear of the facility shows a notable increase at the 50Hz level. No stations outside of the facility indicate a notable tonal aspect at this frequency range.

The noise survey at Castle Paints Ltd. facility in Tullamore indicates that the maintenance of the mixing plant and operations to the rear of the facility, the enclosure of primary activities, reduces noise audible at potential SR.

Based upon the noise assessment conducted by ENVIROCO Management Ltd on the 7th August 2007, during normal working operations, noise is not a current concern from the activities currently been conducted at the Castle Paints Ltd. facility at Sensitive Receiver's.

J. Contingency Arrangements

1. Fire

Castle Paints, (Tullamore) Ltd propose the following fire preventative and action measures for the site:

Current and hture electrical installations are to be flame proof and installed and tested to the highest international standards. An inventory of fire extinguishers will be located at strategic points throughout the site. These fire extinguishers will be serviced and checked on a scheduled basis. The site will be served by water supply from the existing site and there will be fire

hydrants located around the site where required. The existing emergency response procedure located in the company safety statement will

. be up-dated to include environmental concerns. Emergency contact numbers (including after hours numbers) are to be posted at locations throughout the building in the event of an emergency situation.

In the event of a small localised fire outbreak during working hours, staff would attempt to put out the fire. Should the fire become uncontrollable, staff will call out the fire brigade and evacuate the building.

1.1 Firewater run-off

The water used to extinguish a fire (fire-water), will contain dilute quantities of chemicals affected by the fire. Unless the contaminated fire-water can be retained on site, it can cause pollution to surface water, sewers, soil and groundwater. If a significant risk exists for fire- water to leave a site and cause pollution, then a Risk Management Programme must be implemented. This programme will outline the actions that must be taken in order to reduce the risk of fire-water polluting the environment.

A Risk Management Programme will typically include the implementation of management systems and engineering controls to reduce or eliminate potential hazards or sources of pollution. Engineering techniques to help minimise the spread of fire-water contamination include;

Castle Paints (Tullamore) Ltd propose to install concrete bunding around the entire yard area of the site with concrete ramps for access at the palisade gates of the facility. In addition, covers appropriate to block any water from entering the surface water drainage system will be placed over the surface water grit traps to retain all water above ground in the event of a major spill or fire water generation. 1

These will be handled by employees where they occur using absorbent booms and materials. Employees will be trained in on their use and spill kits will be maintained around strategic locations at the site for use.

3. Emergency Equipment Breakdown

These contingency events will be handled by management as soon as is possible depending on the circumstances.
