Welcome | Bienvenue | P’jilasiWelcome to our Gespisiq magazine. In this issue we focus on the Land & Marine Use Plan, as this is a necessary step for the Mi’gmaq of Gespe’gewa’gi to take. At the last year’s AGA, we showed a presentation on Land Use Planning, describing the process, the benefits that it will bring to the communities and how community members can get involved in telling their story through land use planning.

Also in this issue is an update on the Constitution Commission, information on the Bare Trust and details on the next Mi’gmaq Writers Award.

Land & Marine Use Plan

We’ve provided you with information about the Land and Marine Use Plan (LUP) in the last few issues of the Gespisiq. In this issue, we focus on the Use & Occupancy Study.

Think of the Land & Marine Use Plan as a giant textbook filled with all the knowledge that you need to govern your lands and waters.

Now think of the Use & Occupancy Study as a chapter or the table of contents in this huge textbook. It is a fundamental part of the LUP.

More importantly, the Use and Occupancy Study is the collection of the life stories of the land users (hunters, fishers, gatherers, etc) in Gespe’gewa’gi.

Dans les derniers numéros de Gespisiq, on vous avait fourni de l’information sur le Plan d’aménagement des terres et des eaux. Dans ce numéro, on abordera l’étude sur l’utilisation et l’occupation.

Imaginez le Plan d’aménagement des terres et des eaux comme un grand manuel rempli de connaissances dont vous avez besoin afin de gouverner vos terres et vos eaux.

Maintenant, imaginez l’étude sur l’utilisation et l’occupation comme un chapitre ou une table de matières dans cet immense manuel. Cette dernière forme une partie fondamentale du Plan.

Surtout, l’étude sur l’utilisation et l’occupation est un recueil d’histoires de vie des utilisateurs des terres (chasseurs, pêcheurs, cueilleurs, etc.) en Gespe’gewa’gi.

He and his team will be in our communities to interview the Mi’gmaq land users about their hunting, fishing and traditional activities within our territory. Your story is requested. Gespeg / Mi’gmawei Mawiomi Secretariat2013-2014 Use-and-Occupancy Map Survey

The Mi’gmawei Mawiomi Secretariat (MMS) is undertaking the Mi’gmaweiMawiomi Secretariat 2013-2014 Use-and-Occupancy Map Survey todocument a representative sample of harvesting and fixed cultural sitesused by living members of Gespeg, Gesgapegiag and Listuguj. This mapdisplays the 2,200 sites that were mapped by 16 Gespeg residents duringthe testing of the methodology. Another 110 (and as many as 200) peoplefrom the three communities will be interviewed in January-March, 2014.

The MMS has engaged Tobias and Associates to assist with the design andimplementation of the survey, and GeoPraxis Inc. and PlanLab Ltd. toprocess the data and construct the final maps. The methodologies used tocollect and process the data and present them on maps will be described inmethodology reports, to be drafted in 2014.

Land & Marine Use PlanThe Land & Marine Use Plan (LUP) has so many important uses and functions. One of the more important functions it will have will be with the C&A Unit. The governments will often consult the Mi’gmaq on a location of a certain project (ex: new gravel pit, new quarry, tree cutting allocation).

If we had the information from the Mi’gmaq citizens on their use and occupancy on the territory, we would be much better equipped to provide the leadership with the background information they need to assess these files. Here are some other important FAQ’s about the LUP.

What is a Land Use / Marine Use Plan?

1. It’s a roadmap for how and where development should proceed in our region.

2. It’s a tool to help us minimize impacts from development.

3. It’s a document to make sure Mi’gmaq values influence what happens on our land and waters.

5. It’s a process to help exert our Aboriginal Rights and Title over our lands and waters.

A Mi’gmawei Mawiomi Constitutional Commission: Chicoine-Vicaire-Mitchell Constitutional Commission

The Chicoine-Mitchell-Vicaire Constitutional Commission (CMVCC) was established on March 26, 2013 by the Mi’gmaq Tri-Council, and was given

the mandate of developing a Mi’gmaq Constitution that will support the conceptualization of an independent Mi’gmaq Government for the promotion and protection of the rights, freedoms and well being of the Mi’gmaq of Gespe’gewa’gi.

Shortly after, Clem Bernard of Gesgapegiag, Michel Vezina from Gespeg and Dr. Fred Metallic, PhD of Listuguj were appointed as Commissioners to CMVCC and held their first official meeting on November 13, 2013.

The main focus of the meeting was to explore the objectives stemming from the Tri-Council mandate as well as highlighting the tasks required to fulfill the mission of building a contemporary Mi’gmaq Constitution.

Also, the importance of engaging the community members in the Constitution building process were raised during the meeting and all the Commissioners shared

their perspectives on how best to achieve this.

It was agreed that the Commission would have to go out into the communities with information workshops on the development of a contemporary Mi’gmaq Constitution. Subsequently, in the next few months, the Commission will hold a series of public workshops in order to identify what should be included in the Constitution.

The Commission also addressed the limitations that the Federal Indian Act imposes on traditional forms of Aboriginal governance systems and how it has over the past centuries, taken away from the historical Aboriginal legal and political systems. This confirmed to the CMVCC the appropriateness of their mandate and the need of a Mi’gmaq Constitution in Gespe’gewa’gi.

One must remember that it is under the 7 Mi’gmaq Principles applicable in the Seven districts of Mi’gmagi that led to the negotiations of the Covenant Chain of Peace and Friendship treaties that were agreed to by our Ancestors with the British Crown, and affirmed our right to envision how we live, use and occupy our territory.

Une Commission ConstitutionnelleMi’gmawei Mawiomi: Commission ConstitutionnelleChicoine-Vicaire-Mitchell

La Commission Constitutionnelle Chicoine-Mitchell-Vicaire (CMVCC) a été établie le 26 mars 2013 par les trois Conseils Mi’gmaq et a été confiée le mandat

de développer une constitution Mi’gmaq qui supportera la conceptualisation d’un gouvernement indépendant Mi’gmaq pour la promotion et la protection des droits, libertés et bien-être du peuple Mi’gmaq de Gespe’gewa’gi.

Peu de temps après, Clem Bernard de Gesgapegiag, Michel Vezina de Gespeg et Dr Fred Metallic, PhD de Listuguj ont été nommés commissaires de la CMVCC et ont tenu leur première réunion officielle le 13 novembre 2013.

La concentration principale de la réunion était d’explorer les objectifs qui découlent du mandat des trois Conseils et de souligner les tâches requises pour réaliser la mission de former une constitution Mi’gmaq contemporaine.

De plus, l’importance d’engager les membres des communautés dans le processus constitutionnel a été soulevée durant la réunion. Tous les commissaires ont partagé leurs points de vue sur la meilleure façon de réaliser cet objectif.

Il a été convenu que la Commission devrait visiter les communautés avec des ateliers d’information sur le développement d’une constitution Mi’gmaq contemporaine. Ensuite, dans les prochains mois, la Commission tiendra une série d’ateliers publics dans le but d’identifier ce qui devrait être inclus dans la Constitution.

La Commission a également identifié les limites imposées par la Loi sur les Indiens sur les formes traditionnelles des systèmes de gouvernance autochtone et comment cette Loi, au cours des derniers siècles, a retiré des

systèmes juridique et politique historiques autochtones. Cela a confirmé la pertinence de leur mandat ainsi que le besoin d’une constitution Mi’gmaq Constitution en Gespe’gewa’gi.

Il faut se rappeler des sept principes Mi’gmaq qui s’appliquent dans les sept districts de Mi’gmagi qui ont permis les négociations avec la Chaîne d’alliance des traités de paix et d’amitié acceptés par nos Ancêtres avec la Couronne britannique, et ont affirmé notre droit d’envisager l’occupation et l’utilisation de notre territoire.

FREQUENTLY ASKED QUESTIONS:

✦Where will the wind farm be located? The 150 MW wind farm will be located within the MRC d’Avignon. The project site is located 30 kms up the Escuminac North Road.

✦When will construction start? In the summer of 2015.

✦How many jobs will be created? During construction phase, approximately 300 jobs will be created (1/3 of which will be for Mi’gmaq workers). Over the 20-year operation period, there will be 10 direct and 100 indirect jobs created.

✦Will Mi’gmaq community members receive any revenues from this project? The revenues generated from the sale of electricity will belong to the three communities of Gespeg, Gesgapegiag & Listuguj. The Mi’gmawei Mawiomi will be using a revenue-sharing model called a ‘Bare Trust Model’ to distribute the revenues to communities.

✦When will community members expect to see any revenues? We anticipate having the project integrate into the Hydro Quebec grid by December of 2016, and revenues will be generated from that point forward for the next 20 years (life of the project).

In 2009, the Mi’gmawei Mawiomi directed the Secretariat to engage the Federal and Provincial governments, and the private sector in negotiations to secure a wind farm for the communities of Gesgapegiag, Gespeg & Listuguj.

On May 10, 2013 the wind project, Mesgi’g Ugju’s’n, became a reality. At that time, the Government of Quebec announced the opening of new wind projects totaling 800 MWs, with 150 MWs being set aside for the Mi’gmaq.

Our partner for this project is Innegex Renewable Energy. This company is headquartered in Longueil, Quebec; they have been active in the renewable energy sector for over 20 years.

The long-term goal of the Mesgi’g Ugju’s’n is to bring significant revenues that will fund programs and improve services for the well being of the L’nug.

What is a ‘Bare Trust Model’?

- A ‘Bare Trust Model’ is a corporate structure that will allow the Mi’gmawei Mawiomi to manage and operate future business and for-profit enterprises owned by the three communities of Gesgapegiag, Gespeg and Listuguj.

Anticipated benefits of this project:

• Job creation.

• Strong capacity building in business and governance.

• Revenue generator – Net cash flow to the Mi’gmaq between 150-175 million over the 20 year lifecycle of the project.

• Leverage for new Mi’gmaq business in the natural resources and construction sector.

• Foster relations between the Government of Quebec and the Mi’gmaq Nation.


FOIRE AUX QUESTIONS: En 2009, le Mi’gmawei Mawiomi demande au Secrétariat d’amorcer des négociations éventuelles entre les gouvernements fédéral et provincial et le secteur privé afin d’assurer la création d’un parc éolien pour les collectivités de Gespeg, de Listuguj et de Gesgapegiag.

Le 10 mai 2013, le projet éolien, en l’occurrence, le Mesgi’g Ugju’s’n, se réalise. C’est alors que le gouvernement du Québec annonce des nouveaux projets éoliens totalisant 800 MW dont 150 seront réservés à celui des Mi’gmaq.

Nous avons un partenaire dans ce projet. Il s’agit d’Innergex: une société active dans le domaine de l’énergie renouvelable depuis plus de 20 ans et dont le siège social est à Longueuil.

Le but à long terme du Mesgi’g Ugju’s’n consiste à créer des revenus qui suffiraient à financer les programmes et à améliorer les services pour le mieux-être de L’nug.

Qu’est-ce que c’est que le modèle de la simple fiducie?

- Il s’agit d’une structure corporative qui permettra au Mi’gmawei Mawiomi de gérer d’autres projets et d’exploiter des entreprises à but lucratif qui appartiendront à Gespeg, à Gesgapegiag et à Listuguj.

Les bénéfices attendus:

• Création d’emplois et génération de revenus;

• Forte création des capacités en affaires et en gouvernance;

• Génération de revenus: pour les Mi’gmaq, un flux monétaire de l’ordre de 150 à 175 millions de dollars échelonné sur la durée du projet, soit 20 ans;

• Pour les entreprises Mi’gmaq, une influence accrue dans les secteurs des ressources naturelles et de la construction;

• Consolidation des relations entre le gouvernement du Québec et la Nation Mi’gmaq.

✦Où le parc éolien sera-t-il situé? Le parc de 150 MW s’étendra dans la MRC d’Avignon. Son emplacement est à 30 km en remontant la route Escuminac Nord, à 45 km à l’ouest de Gesgapegiag et à 20 km à l’est de Listuguj, sur la route 132.

✦Quand commencera la construction? Au cours de l’été de 2015.

✦Combien d’emplois seront générés? Durant la phase de construction, qui devrait durer aux alentours de deux ans, environ 300 emplois seront créés dont le tiers sera réservé aux ouvriers Mi’gmaq. Pendant les vingt ans d’opération, 10 emplois directs et 100 emplois indirects y seront générés.

✦Les membres des collectivités Mi’gmaq recevront-ils des revenus de ce projet? Les revenus provenant de la vente d’électricité appartiendront aux trois collectivités de Gespeg, de Gesgapegiag et de Listuguj. Le Mi’gmawei Mawiomi se servira d’un modèle de gouvernance appelé « la simple fiducie » pour les distribuer.

✦Quand ces revenus seront-ils remis aux collectivités membres? Nous nous attendons à ce que l’électricité générée par le projet s’intègre au réseau d’Hydro Québec dès décembre 2016. C’est alors que les revenus seront réalisés; ils devraient s’échelonner sur une vingtaine d’années, soit la durée totale du projet.

The Assembly Chiefs and Councils of Gesgapegiag, Gespeg and Listuguj have decided that there is an urgent need to uncover and reward talented Mi’gmaq writers. It is imperative for the survival of the Mi’gmaq as a people that we can identify members who possess a special aptitude and a keen interest in pursuing writing as a hobby or as a career. We have been an oral people for thousands of years, a number of our ancestors were some of the greatest storytellers. This tradition must continue; however, we must be mindful of the use of the technology inherent in the written word and the benefits this can accrue to future generations of Mi’gmaq.

We felt the need for the MWA to have its own official face and brand. We believe over the years it has certainly earned a life of it’s own. Today, we continue to keep this great initiative alive through the members who are inspired to share their stories, journeys and teachings.

L’identification des membres qui possèdent une aptitude spéciale et un vif intérêt en écriture comme passe-temps ou carrière est essentiel à la survie du peuple et de la culture Mi’gmaq. Depuis des millénaires, la culture Mi’gmaq a suivi une tradition orale, nos ancêtres étaient parmi les meilleurs conteurs. Nous devons perpétuer cette tradition. Par contre, nous devons être conscients de la technologie inhérente de la langue écrite ainsi que ses avantages pour les générations Mi’gmaq futures.

Nous avons senti le besoin pour le Prix d’écrivains Mi’gmaq d’avoir sa propre marque officielle. Au cours des années, nous croyons que le projet s’anime d’une vie qui lui est propre. When making a fire outdoors it’s very important to select a place for a pit where the wood burning is to stay so that it doesn’t spread. These Gesgapegiag youth are very cautious when roasting their snacks.
