EnviroCert International Inc. (ECI) is an International Professional Certificationorganization whose purpose is to ensure that ECI Certified Professionals havesufficientknowledgeandexperience,andhavedemonstratedtechnicalcompetencythrough a rigorous examination. Certified Professionals are required to furtherdevelop and expand their expertise in a variety of professional developmentopportunities.

TheserequirementssetECI(asaProfessionalCertification)apartfrom“certificatesoftraining”programs.Thesedesignationsare frequentlyconfusingbecause theword“certification” is often used interchangeably. It is important for the ProfessionalCertification Applicant to understand and recognize that no single course willadequately prepare them for a Professional Certification exam. Various educationopportunitiesandyearsofexperienceintheprofessionarerequiredtoadequatelypreparesomeoneforProfessionalCertification.

“Certificatesoftraining”aregenerallyclassesthatpresentsupplementaleducationand information,and“certificates”areavailable toallparticipantswhoattend thetraining. In contrast, a Professional Certification requires years of study andexperiencetodevelopsufficientknowledgeandskillsnecessarytobecomeaCertifiedProfessional.Anapplicationdemonstratingthisexperienceandeducationisrequiredto be submitted and accepted by ECI. Once accepted, passing a rigorous test isrequired.Inaddition,allCertifiedProfessionalsarerequiredtoknowandabidebyacodeofethicsandprofessionalconduct,andcompletionofprofessionaldevelopmentunitstodemonstratecontinuedlearningintheeverchangingdynamicenvironmentofstormwater.

A certificate of training is typically a well-defined session where the person sitsthrough the program and may take an exam of the information presented todemonstratealearningprocesshasoccurred.Therearenoprerequisitesandnoothercontinuingrequirementstomaintainthe“certificate”.

ECIwouldliketoprovidethefollowinginformationandadvice:

1. All qualified individuals are expected to possess the necessary education and/orexperienceinthefieldofexpertisewithintheindustryonanationallevel.Theexamswilltesttheminimumdepthandbreadthofthisknowledge.

2. Exam questions are written to be applied to applicants across the U.S. and othercountries.

3. The certification knowledge and exams are not intended to test State specific, butnational level information and general industry knowledge. ECI has left it to theindividualStatestodevelop“local”or“State-Level”testprograms.

4. Everycalculationhasbeencheckedbycommitteesconsistingofleadingexpertsintherespectivefield.Computerspreadsheetsandhandcalculationshavebeendevelopedforeachanalyticalquestion.Questionsaredesignedtotestgeneralandspecificareasofknowledgeandskillsets.Ifanapplicantencountersaquestionthatappearstonotcontaintherequisitefacts,andtesttakerisencouragedtore-examthequestionandfact pattern and should re-assess her/his approach. The necessary information hasbeenprovided.

5. TheReviewManualsprovideageneraloverviewofthenecessaryscopeofpracticethatanApplicantshouldpossess.Thesemanualsareintendedtoprovideanoverviewofthe“generalprinciples”andarenot intendedtobeacomprehensive listof subjectmatter. Every question points to a principle in the reviewmanual, and specificallyaddressesproblemsthataretypicallyencounteredintheindustry.ItistheApplicant’sdutytounderstandthefundamentalprinciplesandapplicationthereof.Theexamisdesigned tohelpECI verify levelofexperience includingdecision-makingandotherskillsthatcomewithprofessionalexperience.

6. Alltestsareanalyzedandresultscompiled,basedon,butnotlimitedto,totalscore,answer per question, and specific answers. This data is being compiled based onhistoric test results and test results based on various thresholds of education andexperience.

7. ECIisanInternationalCertificationbodythatisseekingtobeinconformancewithInternational Accreditation Standards. As such, like Professional Licensingorganizations,doesnotprovideexamscoresorinformationonexamquestions(PolicyPS6006.01).

8. AllexamswillbeadministeredOn-LineorviaapprovedindependentindividualsthathavebeenformallyapprovedbyECI.ApprovalsarelimitedtoindependentindividualsandECIstaffinconformancewithInternationalAccreditationStandards.

ECI test results and records conclusively demonstrate that applicants who 1) obtain theproperexperience,2)preparewithcomprehensivereviewbasedontheCertificationScopeofPractice,and3) implementproperexamtechniques,willhaveahigherdegreeofexamsuccess. Each Applicant should properly prepare and familiarize themselves with testingtechniques in conjunction with exam technical data. This should include familiarity withcalculatoruseandpropertimemanagement.

Integrity – Objectivity – Confidentiality – Competence– Professionalism

PREAMBLECertifiedProfessionals/Individualshavecertainfundamentalobligationstosociety,toclients,totheprofession,andtopeersandcolleagues.ThecornerstoneofethicsandprofessionalconductforEnviroCertInternational,Inc.(ECI)arebuiltonthefollowingfive(5)fundamentalprinciples:

Integrity–AllECICertifiedProfessionals/Individuals,employeesandvolunteersareheldinapositionoftrustbythepublicatlarge.Thepreservationofthattrustisdependentonexhibitingthehighestdegreeofintegrity.

Objectivity–ECICertifiedProfessionals/Individualsshallperformtheirworkwithintegrity,objectivity,andavoidsubordinationoftheirjudgment.

Confidentiality–ECICertifiedProfessionals/Individuals,employees,andvolunteersshallmaintainallconfidentialinformationthattheyareprovided,orbecomeawareof.Thisconfidentialprincipledoesnotextendtosuchactionsthatincludeviolationsofthelaw,violationofadministrationrulesorregulations,orthatmaybehazardoustotheenvironmentasoutlinedinthisCodeofEthicsandProfessionalConduct.

Competence – ECI Certified Professionals/Individuals shall only perform services within their demonstratedexpertise.ItisessentialthatallCertifiedProfessionals/Individualscommittocontinuallearningandprofessionaldevelopment,andshallperformProfessionalDevelopmentHours(PDHs)toreinforceandexpandtheirknowledgebase.

Professionalism–ECICertifiedProfessionals/Individualsshallrepresenttheirrespectiveprofessionsresponsibly,andinamannerthatmaintainsandenhancestheprofessionsandorganization’spublicimageandreputation.The Code of Ethics and Professional Conduct states guidelines and rules for the conduct of CertifiedProfessionals/Individualsinfulfillingthoseobligations.TheCodeisarrangedinthreetiersofstatements:Canons,EthicalStandards,andRulesofConduct.

CanonsarebroadprinciplesofEthicsandConduct.

Ethical Standards aremorespecificgoals,towhichECICertifiedProfessionals/Individualsshouldaspire inprofessionalperformanceandbehavior.

RulesofConduct(Rule)aremandatory.Rules,insomeinstances,implementmorethanonecanonorethicalstandard.ViolationofaRuleisgroundsfordisciplinaryaction,uptoandincludingrevocationofcertification.

The Code applies to the professional activities of all categories of EnviroCert International, Inc. CertifiedProfessionals/Individuals.Certificationthroughone,ormore,oftheEnviroCertInternational,Inc.certificationsisvoluntary. By accepting certification, submittingproofof requiredProfessionalDevelopmentHours andpayingannual dues, Certified Professionals/Individuals assume an obligation of self-discipline above and beyond therequirementsoflawsandregulations.

CompliancewiththeCode,aswithalllawsandrulesinanopensociety,dependsprimarilyuponunderstandingandvoluntarycompliance,secondarilyuponreinforcementbypeerandpublicscrutiny,andfinally,whennecessary,uponenforcementthroughdisciplinaryactionagainstcertifiedindividualswhofailtocomplywiththeRules.TheCode does not; however, exhaust the moral and ethical considerations that should inform CertifiedProfessionals/Individuals,fornoworthwhilehumanactivitycanbecompletelydefinedbylawsorrules.Evenso,the Code iswholly concernedwith ethical constraints for professionalism; the Rules are not compromised byelementsconcerningsocialagendasoractivism,butsimplyprovideamoralandrationalframeworkfortheethicalconductofCertifiedProfessionals/Individuals.

Whereitappears,commentaryismeanttoclarifyorelaboratetheintentofarule.ThecommentaryisnotpartoftheCode,andisincludedtoassistthoseseekingtoconformtheirconducttotheCode.

ThisCodeisintendedtopromotethehighestqualityofpractice,andtostrengthenpublicconfidenceintheprofession.Towardthatend,EnviroCertInternational,Inc.setsforththefollowing.

SECTION1:GENERALOBLIGATIONS

CANON1:

ECICertifiedProfessionals/Individualsshouldmaintainandadvancetheirknowledgeoftheart,craft,andscienceof the practice, and contribute to its growth. Certified Professionals/Individuals should exercise learned anduncompromisedprofessionaljudgmentoveranyothermotiveinthepursuitoftheart,craft,andscienceofthepractice,evenattheexpenseofpersonaladvantage.

Inpracticingdesign,CertifiedProfessionals/Individualsshalldemonstrateaconsistentpatternofreasonablecareandcompetenceandshall,atminimum,applytheprofessionalandtechnicalknowledgeandskill,whichisordinarilyappliedbyCertifiedProfessionals/Individualsofgoodstanding,practicinginthesamelocality.

Commentary:As ignoranceof the lawoffersnomitigationofoffenseorpunishmentunder the law.Therefore,ignoranceoffersnomitigationofthisrule.

RULE2.12:

ECICertifiedProfessionals/Individualsshallneitheroffernormakeanypaymentorgifttoapublicofficialwiththeintentofinfluencingtheofficial'sjudgmentinconnectionwithanexistingorprospectiveproject,inwhichCertifiedProfessionals/Individualsareinterested.

Commentary:This ruledoesnotprohibit campaigncontributionsmade in conformitywithapplicablecampaignfinancinglaws.

RULE2.13:

ECICertifiedProfessionals/Individualsserving inapubliccapacityshallnotacceptpaymentsorgifts,whichareintendedtoinfluencetheirjudgment.

RULE2.14:

ECICertifiedProfessionals/Individualsshallnotknowinglyengageinworkwheretheaimorresultismisleading,deceptive,orfalsebyintentorsubstance.

RULE2.15:

ECICertifiedProfessionals/Individualsshallnotengageinconductinvolvingfraudorwantondisregardoftherightsofothers.Commentary:Thisruleaddressesseriousmisconduct,whetherornotrelatedtoCertifiedProfessionals/Individualsprofessionalpractices.

RULE2.16:

If, in thecourseof theirworkonaproject,ECICertifiedProfessionals/Individualsbecomeawareofadecisionexercisedorprescribedbytheiremployerorclientthatisfraudulentorviolatesanylaworregulation,CertifiedProfessionals/Individualsshall:(1)advisetheiremployerorclientagainstthedecision,(2)refusetoconsenttothedecision,and(3)reportthedecisiontotheappropriateauthority,unlesstheCertifiedProfessionals/Individualsareabletocausethemattertobesatisfactorilyresolvedbyothermeans.

RULE2.17:

ECI Certified Professionals/Individuals shall not counsel or assist a client in conduct that CertifiedProfessionals/Individualsknow,orreasonablyshouldknow,isfraudulentorillegal.

ECICertifiedProfessionals/Individualsshouldbeinvolvedincivicactivitiesascitizensandprofessionals,andshouldstrivetoimprovepublicappreciationandunderstandingofdesignandthefunctionsandresponsibilitiesofCertifiedProfessionals/Individuals.

RULE2.21:

ECICertifiedProfessionals/Individualsmakingpublicstatementsondesignissuesshalldisclosewhentheyarebeingcompensatedformakingsuchstatementsorwhentheyhaveaneconomicinterestintheissue.

RULE2.22:

ECICertifiedProfessionals/Individuals,whileengagedinthepracticeorinstructionofdesign,shallnotknowinglydoanythingthatconstitutesadeliberateorrecklessdisregardforthehealthandsafetyofthecommunitiesinwhichtheyliveandpracticeortheprivacyoftheindividualsandbusinessestherein.

RULE2.23:

ETHICALSTANDARD3.2:CONTRACTS,FEES&BILLING

Project contracts should embody clarity and be functionally comprehensive, and project estimates should bereasonablyspecificandaccurate.RULE3.21:

ECICertifiedProfessionals/Individualsshall intheconductofprofessionalpractice,produceworkonlyasclearlydescribedinamutuallyexecutedcontract(s)thataccountsfortheproject'sscope,deliverables,costs,terms,andtherelevantobligationsofallinvolvedparties.

Commentary:Thisruleisintendedtorequirethatallprofessionallycontractedworkbeperformedaccordingtoabinding scopeof responsibilities, rather thanwithmere verbal agreements or undefined elements. In short, allprofessionaldesignworkmustbeaccomplishedunderclearlydefinedlegal,andmutualconstraints.
