1. Definitions – Article 1

1 .1 T railer

Ren ted caravan, trailer tent, boat trailer or luggage trailer.

1 .2 Nu clear reaction

Ev ery nuclear r eaction which r eleases energy, such a s nuclear fusion, fission, artificial and natural radioactivity.

1 .3 Ca r a nd m otor v ehicle accessories

Roof r a ck, roof luggage box, bicycle rack, car, bicycle and motor vehicle tools, snow chains, car audio and transmission

equ ipment (whether or not built in) with only battery connection, music cassettes and compact disks presen t in the v ehicle,

a s w ell a s spare parts (limited to: Serpentine belts, spark plugs, distributor caps, contact breakers and light bulbs).

1 .4 Lu ggage

Th e items which the insured has taken along for personal use and which, during the period of validity of the c ontract, have

been dispatched to the destination before or a fter departure, a s well a s the g oods which the insured buys during the trip.

Th e following items are n ot considered to be luggage:

a. securities of whatever nature, manuscripts, computer software, notes and drafts;

b. collections (such as stamp and coin collections);

c. tools;

d. objects which have an antiques or artistic v alue;

e. a n imals;

f. v essels (except folding boats, inflatable boats and sailboards), a ircraft (which includes g liders and g liding equipment),

m otor vehicles (including mopeds), campers and other vehicles (except bicycles, prams, pushchairs and wheelchairs)

a s w ell a s the a ccessories and (spare) parts thereto (including tents).

1 .5 Beneficiaries

Th e party or parties to whom damages and/or compensations are payable, excepting all and any authorities.

1 .6 Da m age prevention costs

Th e costs incurred by the insured, in case of immediate th reatening danger and, before or a fter the origin of the ev ent

cov ered by the policy, to avoid or reduce any further damage.

1 .7 Com puter a nd camera equipment

Th e whole of electronic information processing equipment consisting of a central unit with direct mem ories attached

th ereto, power supplies, input and output devices and other peripherals including connection cables. This includes PDA ’s,

ta blet computers, laptops, n otebooks, gaming consoles including games. Camera equipment includes telescopes,

bin oculars and digital cameras. Computer and camera equipment are considered to be part of the category valuables.

1 .8 Cu rrent market value

Th e value of the item immediately prior to the ev ent. To determine the current market value, account is taken of the

or ig inal purchase price or taxable value and the depreciation. The depreciation takes place by deducting an amount due to

a g eing, wear and tear, the average useful life of the items or a s a result of qu ick model changes and technical progress.

1 .9 Ev ent

Ev ery event or series of ev ents which are causally r elated to each other and which caused the damage/loss.

1 .11 Person al jewellery

Jew ellery, including watches, manufactured to be worn on or attached to the body and which whol ly or partly consist of

(pr ecious) metal, stone, mineral, ivory, (red) coral or other similar materials, a s well a s pearls and fur. This definition a lso

cov ers personal jewellery which no longer has its or iginal use, such as personal jewellery which is con sidered to be an

in v estment. Personal jewellery is considered to be part of the category valuables.

(Fou ntain) pens, lighters and spectacles are not cov ered by this definition.

1 .12 Wa r risk

Th e six ty pes of war risk, as well as their definitions, deposited at the Registry of the District Court of The Hague by the

A ssociation of In surers on 2 Nov ember 1981:

a. Armed conflict: any situation in which states or other organised parties fight each other - u sing military force. Ev en

a rmed interventions by a peacekeeping force of the United Nations are cov ered by this definition.

b. Civil w ar: a more or less organised v iolent struggle between inhabitants of a state, in which a significant portion of

th e population is involved.

c. Insurrection: organised violent resistance within a state directed against the public authorities.

d. Civil commotion: more or less organised violent acts occurring in different places within a state.

e. Riots : a more or less organised local violent mov ement directed a gainst the public authorities.

f. Mutiny: a m ore or less organised violent mov ement of members of an armed force, which is directed a gainst the

a u thority under which they are placed.

1 .13 Mot or v ehicle

A m otor vehicle, insofar as:

a. a dr iving licence A B(E) is required;

b. It is fit ted with a Dutch number plate;

c. a n insured is the authorised driver.

1 .14 Replacement value

Th e amount r equired to purchase n ew items of the same type and qu ality.

1 .15 A ccident

A su dden, external, violent ev ent, independent of the will of the insured, which affects the insured immediately, which is

dir ectly and solely responsible for his/her death or physical disability, prov ided that the nature of the injury can be

observ ed objectively by a medical professional.

1 .16 Jou rney

A tr ip to and/or from abroad with a duration of u p to 30 days or a continuous period of travel, for which the ou tward

jou rney and/or the return trip is done via a flight booked with Wizz Air.

1 .17 T ravel documents

Pa ssport, travel t ickets, tickets, vouchers, driving licences, visa, identity papers and tourist cards.

1 .18 Mea ns of t ransport

A m otor vehicle, trailer or side-car.

1 .19 Insu rer

b. Oth er insureds, a s far a s they are mentioned on the certificate of insurance, with a maximum age of 64 years old.

1 .21 Policyholder

Th e individual who concluded the insurance a greement with the insurer and stated a s su ch on the certificate of insurance.

1 .22 Hou se m ates

Th e individuals living with the insured in a long-term family relationship and who are registered a t the same address at the

Reg istry office.

1 .23 Relatives

a. Rela tives by blood or marriage in the 1st degree, i.e.: spouses, parents(-in-law), (foster) children, sons and daughters(-

in -law). Registered cohabitation is put on a par with marriage;

b. Rela tives by blood or marriage in the 2 nd degree, i.e.: brothers and sisters(-in-law), grandparents and g randchildren.

1 .24 Permanent home a ddress and place of residence

Th e address in the Netherlands where y ou or the insured are registered in the population register.

2. Coverage – Article 2

2.1 Definition of cov erage

Th e insurer prov ides cov er for the categories covered a ccording to the certificate of insurance.

Th e coverages are valid for the insured persons stated on the certificate of insurance and up to the maximum amounts

in dicated in the cov er ov erview in article 2.2.

Th e coverage a pplies on ly to the insured whose name is on the certificate of insurance; this insurance is not transferable.

Th e coverage a pplies to Journeys a broad during the Period of In surance that takes place entirely within the Area of Travel

sta ted in the Certificate of In surance, as long a s You have booked a return flight to Your country of or igin before you depart

for Your Journey.

Th e coverage ends when the insured period ends.

Bu sin ess Equ ipment

Wh at is covered

A . Loss, damage or theft

We w ill pay up the amount stated

in the Table of Benefits for the Repair and Replacement Costs of Your business equipment (limited to audio, visual, video,

ph otographic, computer equipment and samples) if it is Lost, stolen or damaged.

B. Bu sin ess equipment h ire

If bu siness equipment (limited to audio, visual, video, photographic, computer equipment and samples) h eld by You for

bu siness reasons is Lost , stolen or damaged, You wi ll be cov ered for the reasonable cost of hiring replacement equipment

u p to the amount stated in the Table of Ben efits.

Special Conditions

1 . For temporary Loss, a s well a s getting an authorised “property irregularity r eport” from the carrier or handling agent,

You must a lso write to them within 21 days of r eceiving Your property back to confirm You had to buy r eplacement items.

2 . If Your business equipment is never found and We agree to pay for permanent Loss, We will take off any amount We

h av e a lready paid for temporary Loss.

3 . You must keep any damaged property so that We can inspect it. When We make a payment for r eplacement of that

pr operty, it will then belong to Us.

2.3 A cceptance criteria

On ly persons who, during the period of insurance, are registered in a Du tch population r egis ter as r esiding a t the a ddress

in the Netherlands are eligible for coverage under this policy. The policyholder needs to be in the Netherlands at the time of

ta king out the insurance policy.

a. Th e insurance prov ides coverage in accordance with the plan ty pe chosen and stated on the certificate of insurance.

b. In th e Netherlands the cov erage will on ly take effect in the case of:

1 ) a jou rney from and/or to a foreign country;

2) a pr e-booked flight with Wizz Air.

3) Th e insurance is n ot valid if the insurer has a lready notified the insured that it no longer wishes to insure

h im/her.

4) For th e cancellation section the insurance is only valid if it is concluded immediately or at the latest within 7

da y s of booking the plane ticket with Wizz Air.

2.4 Cov erage a rea

Th e certificate of insurance specifies the area in which the insurance applies. There are two options. Cov erage for:

• Eu r ope

• th e whole world, except for travels to, from or in Cuba and/or transit in Cuba.

Eu r ope is understood to r efer to:

Eu r ope, including the Azores, the Canary Islands, Ma deira and the whole of Turkey.

Som e European countries have regions located outside Europe. In these regions the insurance does not prov ide cover,

ex cept for the regions mentioned a bov e.

3. Exclusions – Article 3

3.1 General

Th is insurance does not provide entitlement to payment of damages for accidents, damage, loss or costs:

a. w h ich could reasonably have been foreseen before undertaking the journey;

b. stemming from diseases or disorders which existed before the start of the journey. This exclusion does not a pply to

th e section on medical repatriation and ev acuation and personal a ccidents.

c. or ig inated or fa cilitated by the use of n arcotics or st imulants (such as alcohol, soft drugs and hard drugs) ;

d. or ig inated as a criminal a ctivity or participation in a criminal activity by the insured;

e. ca used intentionally or with the consent of the policyholder / in sured or any person with an interest in the

com pensation under this insurance, other than damage prevention costs;

f. ca used or or iginated due to war r isk;

g. ca used by , occurring with or resulting from nuclear reactions, irrespective of how the r eaction originated.

Th is exclusion does not apply to radioactive nuclides that are outside a nuclear facility and that are used or intended

to be u sed for industrial, commercial, agricultural, medical or scientific purposes, prov ided that a license for the

m anufacture, storage and disposal of radioactive substances by the Ministry of Housing, Spatial Planning and the

En v ironment has been issued. Insofar a s under the Nuclear Accidents Liability Act a third party is responsible for the

da mage, the exclusion remains in force;

h. ca used by an earthquake and/or volcanic eruption. In case of damage or iginating either during the t ime in which, or

2 4 hours after the effects of a n earthquake or volcanic eruption revealed themselves in or n ear the building, the

policy holder must prove that the damage is n ot attributable to those phenomena;

i. ca used by or in relation to flooding. This exclusion does not a pply to damage cause d by fire or explosion caused by

flooding. This exclusion does not apply to the a ccident insurance;

j. ca used by non-compliance with the obligations in case of damage or loss. The insurance does not prov ide coverage if

th e insured or an individual with an interest in the benefit has not complied with one or more of the obligations and

th ereby harmed the interests of the insurer;

k. ca used by a false declaration. Any right to payment lapses if the insured or an individual with an interest in the

ben efit makes a false statement and/or misrepresents the events;

l. for in sured parties in the case of a stay a s a n au-pair or during travel and r esidence for study, work or

in ternship purposes.

m. 1 ) r esulting from the use of a ircrafts and during the practice of a ir sports such as hang g liding, parachuting,

ba llooning, gliding, paragliding, hang-gliders and ultralight aviation and paragliding, except as a passenger in an

a ir plane licensed to carry passengers.

2 ) r esulting from sailing other than on inland waterways, in case of solo sailing, races or u sing water scooters

a n d/or vessels which are not suitable or equipped for use at sea

3 ) r esulting from practising martial arts, rugby, cy cling races and horse races.

4 ) r esulting from practising a ll types of winter sports. If the policy states that the winter sports category is covered,

th is exemption will not a pply.

5 ) r esulting from hiking in the mountains, unless this takes place on roads and sites which are also a ccessible

w ithout difficulty to inexperienced hikers, as well as for other h igh-risk sports

6 ) bu ngee jumping, expeditions, fixed climbing r outes a s well a s participating in or preparing speed, r ecord and

r eliability rides/races with motor vehicles and vessels.

n. su icide or a ttempted suicide.

o. Th e insurer is n ot required to make any payment or prov ide any other benefit under this policy if the insured does not

m eet the a cceptance criteria mentioned in article 2.3.

p. Ev ery loss or damage in case of winter sports, except if the insurance is concluded in combination with a winter sports

tr ip and if the policy specifies that winter sports are also insured and the supplementary premium for winter sports

h a s been calculated.

q. Un derwater sports and div ing and you are:

1 ) n ot qu alified to dive, unless you are assisted by an a dequately qualified instructor or,

2) div ing to a depth of more than 30 metres, or

3) div ing alone, or

4) div ing on or in wrecks or at n ight.

A lternatively, seen as y ou are already a qualified diver, not diving under the guidance of a n official diving

m arshal, instructor or guide, diving within the guidelines of the relevant diving or training agency or

or g anisation and not diving alone, coverage applies subject to the following maximum depth a ccording to

y our qualification:

• PA DI Open Water - 18 metres.

• PA DI A dv anced Open Water - 30 metres.

• PA DI Deep Div e Special - 3 0 metres.

• BSA C Ocean Div er - 2 0 metres.

• BSA C Sport Div er - 30 metres.

• BSA C Div e Leader - 3 0 metres.

• SSI Open Water Div er - 18 metres.

• SSI A dv anced Open Water - 30 metres.

• SSA C Sport Div er - 3 0 metres.

r. da mage directly or indirectly related to a (possible) outbreak of an epidemic or pandemic, as defined by the World

Hea lth Organization (WHO), including:

• pr ev entive and/or restrictive measures taken by the authorities, such a s travel restrictions and/or bans and

keeping the insured, his/her family members and/or travelling companions qu arantined;

• th e cost of medical examinations and/or medical treatment of the insured by or on behalf of public authorities.

fr om, r elating to or in any way connected with the Coronavirus Disease 19 (COVID-19) (or any mutation or variation

th ereof) and / or its ou tbreak. To the extent that any term or condition in the Policy may be inconsistent with this

ex clusion, this exclusion shall prevail.

4. Loss – Article 4

4.1 Obligations in ca se of loss

A s soon a s the insured has knowledge of an ev ent which may r esult in an obligation to pay for the insurer, h e/she must:

a. r eport it to the insurer as soon a s possible and submit all relevant information and documents without delay;

b. m a ke ev ery endeavour to limit the damage;

c. n otify the insurer of a ny other policies which may offer full or partial cov er for the damage;

d. in case of (attempted) theft or any other criminal act, file a police r eport a s soon as possible and present written proof

th ereof to the insurer;

e. in case of death of an insured, the beneficiaries must allow the insurer to establish the cause of death and, if

n ecessary, grant permission for an autopsy.

In su red and beneficiaries cannot derive any rights from the policy where the obligations, or in particular the obligations set

ou t in the special terms and conditions, have n ot been met and insofar a s the insurer's interests are harmed a s a

r esult thereof.

4.2 Loss a dju stment

a. Th e loss will be determined by mutual agreement or by an expert appointed by the insurer, unless it is agreed that two

ex perts will determine the loss, in which case the policyholder a nd the insurer each appoint one expert.

b. Th e statements prov ided and/or to be prov ided by the insured (oral and written) will serve to determine the extent of

da mage and the right to compensation.

c. If it a ppears that the damage was n ot correctly assessed, either by incorrect data or by calculation error(s), the parties

h av e the right to demand revision of the loss adjustment.

4.3 Da m ages

a. Th e insurer's obligation to pay damages shall be for a maximum of the amounts stated in the ov erview of cov erage in

a r ticle 2.2.

b. In ca se of damage the policyholder shall hand ov er the insured luggage to the insurer on ly at the request of

th e insurer.

4.4 Ot h er insurance policies

If th e damage which is cov ered by this insurance is a lso covered under on e or more other policies, whether or not of a n

ea r lier date, or would have been cov ered if this insurance did n ot exist, then this insurance serves only an excess cov er on

top of th e cov erage granted or to be granted under the other policy/policies, whether or not the other policy/policies

con tains an ov erlap clause.

Th is does n ot apply to cancellation insurance taken out at Chubb.

4.5 Pa yment of damages

If a r ight of compensation exists under this insurance policy, it w ill be paid within 30 days of r eceipt of a ll data required by

th e insurer.

4.6 Ch u bb Assistance

a. In a ll cases requiring assistance following a covered ev ent, the insured shall immediately contact Chubb Assistance.

Ph on e numbers are stated on the certificate of insurance.

b. Costs in curred without consultation and a pprov al of Chubb Assistance shall never be refunded, with the exception of

da mage prevention costs.

c. Ch ubb Assistance is free to choose the parties it will deploy for the assistance.

d. Ch ubb Assistance has the right to r equest the necessary financial guarantees to the extent that the costs a ssociated

w ith its services are not cov ered by this insurance.

If th ese guarantees are n ot obtained:

• Ch ubb Assistance will n o longer be obliged to prov ide the services required;

• a ny entitlement to a compensation which may exist in this context under a different heading.

e. Ch ubb Assistance accepts, except in case of its own omissions and errors, no liability for damage resulting from errors

or om issions of third parties, without prejudice to the liability of a ny such th ird parties.

4.7 Loss report

Wh en something happens which is covered by the insurance, the insured and/or beneficiary must report this ev ent to the

in surer as soon as reasonably possible. A reasonable term is:

a. If th e insured dies: within 24 h ours (by phone or email)

b. If th e insured is admitted to the hospital for more than 24 hours: within 7 days of a dmission (in writing).

c. In a ll other cases: within 28 days of the end of the validity of the policy (in writing).

4.8 Expiry date

A ny legal claims a gainst the insurer expire 3 years after the day when the beneficiary became aware of the claimability of

th e compensation.

5. Premium – Article 5

5.1 Prem ium payment

a. Th e policyholder shall pay the premium, costs and insurance tax by advance payment.

b. If th e policyholder fails to pay the amount due within 30 days of the first payment request, the cov erage will end on

th e first day of the period for which the amount due must be paid.

c. Un less the insurer has cancelled the insurance in the meantime, the cov er will take effect again on the day following

th e day when the insurer received the amount due.

6. Duration and end of the insurance - Article 6

6.1 V a lidity of ca ncellation cov er

For th e cancellation cover, cov erage starts on the date specified on the certificate of insurance.

Cov erage ends immediately after the end date mentioned on the certificate of insurance or immediately on the date when

th e trip is cancelled or interrupted, whichev er comes first. In case of a return flight booked with Wizz A ir and the insured

h a s a r eturn flight on a date after the date mentioned on the certificate of insurance, and that flight is n ot initiated by Wizz

A ir and/or the consequence of a cov ered cancellation event, the coverage will end on the end date mentioned on the

cer tificate of insurance.

Notw ithstanding the a bov e, if a on e-way flight is booked at Wizz Air the validity ends after the insured passes the security

con trol, passport control and border control a t the destination.

6.2 V a lidity of a ll other covers

a. For a ll cov erage referred to in article 2.2 other than cancellation, the validity of the cover is the number of days the

in surance is in effect (up to 30 days). The certificate of insurance shall state the duration. If the duration is exceeded

because of a n unforeseen delay not caused by the i nsured and/or because of an insured ev ent (except where this ev ent

fa lls under the category Travel Luggage), the insurance will automatically remain v alid until the earliest possible

r eturn of the insured. Where the insurer extends insurance, which has alr eady begun, at the request of the insured,

th is insurance will be considered a new insurance.

7. Final provisions – Article 7

7 .1 Com plaint procedure

Complaint to the management

Com plaints and disputes by the insured related to the establishment and implementation of this insurance policy can be

If th e decision of the insurer is not to the satisfaction of t he insured, he/she can address the Du tch Financial Services

n ot want to u se this complaint handling option, or if the treatment or outcome i s not satisfactory and Kifid did not issue a

Th is insurance does not apply where resolutions of the United Nations or the trade or economic sanctions, laws or

r egulations of the European Union, it’s Member States or the United States prohibit the insurer to provide cov erage,

in cluding - but n ot limited to - the payment of a n indemnification, compensation or any other benefit.

In pa rticular, the insurer will not provide any compensation or any other benefit to or with r espect to an insured with a

permanent establishment or residence in Cuba and/or if the claim r elates to travel to, from, or in Cuba or to a journey

w h ich begins, ends or has a scheduled stopov er in Cuba.

Cancellation

Cov erage for a maximum sum as specified in the ov erview of cov erage in article 2.2 of the g eneral terms and conditions.

1. Coverage – Article 1

1 .1 Definition of cov erage

Th e insurance shall be valid only if it is concluded immediately after or a t the latest within 7 days of booking the flight with

Wizz A ir.

In a ddition to the provisions concerning the validity in article 6.1 of the general terms and conditions, a pplies:

• If a ca ncelled trip does not qualify for compensation, the cov erage for that trip w ill have definitively ended. In that

ca se the right to compensation for ev ents cov ered by the insurance will terminate entirely.

1 .2 Insu red causes of ca ncellation

Th e compensation for cancellation costs will be granted solely if the cancellation and/or premature termination of the trip

is th e result of on e of the causes below:

a. ser ious disease, serious accident or death of a n insured or a family member (1 st or 2nd degree relatives), registered

pa r tner, the partner you are living with a s a family. The insured shall, if the insurer so r equests, present a medical

sta tement attesting to the seriousness of the disease or the accident. This statement, among other elements, will be

con sidered by the insurer when assessing whether or not the cancellation was necessary, or if there was a r easonable

ca use to cancel or prematurely end the trip;

b. being unable, on medical a dvice, to undergo the vaccinations r equired for that country (those countries), if this could

n ot h ave been foreseen at the time of booking the trip;

c. in connection with a proposed stay on the part of an insured with a family abroad: a sudden serious illness, serious

a ccidental injury or the death of on e of the members of the family which makes it impos sible to a ccommodate

th e insured;

d. ser ious damage to one's own trip accommodation or trip accommodation which was made available for free, which

ca uses the planned trip to be cancelled, prov ided that the insured can demonstrate that no comparable alternative is

a v ailable for a similar price;

e. ser ious damage to goods affecting the insured's or h is employ er's property and which urgently r equires the

in sured's presence;

f. u n expected recall for military service;

g. in v oluntary unemploy ment of the insured wage earner following a full or partial closure of the company where the

in sured worked;

h. th e acceptance by an unemploy ed insured person of a job of minimum 20 hours per week, for a term of a t least 1 y ear

or for a n indefinite period of t ime, whereby the signing of the contract of employ ment depends on the presence of the

in sured at the employ er's company during the planned trip period;

i. th e unexpected availability of a rental home during the planned trip period, for which the insured had r egistered 6

m on ths before the booking date of the travel/rental package;

j. com plications in the pregnancy of the insured or the partner living with him/her, prov ided that this was medically

determined by the treating physician/specialist;

k. in sured is required to take an exam resit during the insured trip and postponement of the r esit is not possible. The

con dition is, h owever, that the r e-sit is r equired to complete a multiple-y ear study programme;

l. ir r evocable breakdown of the marriage, r egistered partnership or n otarial cohabitation agreement for which a request

for dissolution was made after booking the trip, prov ided that the partners are no longer registered together at the

sa me address as of sometime a fter booking the trip.

1 .3 Ext ent of cov erage

Su bject to the maximum extent of cov erage as defined in article 2.2 of the g eneral terms and conditions the following will

be r eimbursed:

a. th e costs payable in the case of total cancellation, for which Wizz A ir will charge the insured;

b. if th e cost of the t icket is a lready (partly) paid by the insured: the costs already paid for the ticket insofar a s it is n ot

com pletely r eimbursed to the insured by Wizz Air or can be recovered from third parties through Wizz Air, the by the

a ir port and the authorities imposed passengers taxes will not be reimbursed;

c. th e costs charged by Wizz Air to transfer the booking to a later date, canc elling the need for a full cancellation;

d. th e supplement charged by Wizz Air on top of the initial fare for partial cancellation if not all insured persons cancel,

pr ov ided that the payment never exceeds the full cancellation.

1 .4 People travelling together

a. If on e of the insured is r equired to cancel the trip on the basis of a cause r eferred to in article 1.2 of this section, the

oth er insured persons will a lso have the r ight to cancel.

b. If a t ravel companion not named in the policy is r equired to cancel the tr ip for one of the grounds r eferred to in

A r ticle 2.1 of this section, as a r esult of which the insured person would have to travel a lone, the insured person will

h av e the right to cancel if:

• th e affected travel companion has v alid cancellation cost insuran ce;

• th e ev ent that happened to the a ffected travel companion is covered by his/her cancellation cost insurance and

h is/h er cancellation cost insurance does not grant compensation for the insured companion;

• th e affected travel companion and the insured are supposed to travel there and back together.

1 .5 Ca ncellation of the trip with an early return

You are entitled for compensation If the trip or stay is terminated prematurely due to an ev ent in one of the articles 1.2

m entioned insured causes of cancellation.

Th e insurer will compensate unused accommodation costs (including excursions pre-booked and paid for before leaving

th e Netherlands, which You have paid or are contracted to pay and which cannot be recovered from any other source; and

r ea sonable additional travel and accommodation (room only) costs necessarily incurred in Your returning to Your home in

th e Netherlands.

2. Additional exclusions – Article 2

2.1 A dditional exclusions

In a ddition to the exclusions in article 3.1 of the general terms and conditions, the following a pplies to the

ca ncellation cover:

a. a claim as a r esult of a strike which had started or was announced before this policy was taken out or before you

booked the trip;

b. if th e insured did not check in on t ime;

c. ev ery cancellation claim insofar as the costs are more than the costs of the trip originally booked, or the maximum

a m ount specified in the cov erage ov erview in Article 2.2 of the general terms and conditions, if that is lower.

3. Loss – Article 3

3.1 A dditional obligations in ca se of loss

In a ddition to the obligations set ou t in article 4 of the g eneral terms and conditions, the insured shall:

a. a s soon a s possible, but at the latest within 72h(not counting Sundays and public holidays) inform Wizz Air of the

ev ent which can lead to cancel lation;

b. dem onstrate by means of documents that a trip was booked;

c. pr ov e the claim for compensation v is-a-v is the insurer by means of documents and/or statements such as a medical

cer tificate, a statement from the employ er, a cancellation cost note;

d. if r equested, transfer all claims for compensation or r efunds in respect of a damage or loss to the insurer.

1. Luggage and travel inconvenience – Section 1

1 .1 Lu ggage - Sect ion 1.1

Cov erage to a maximum a s described in article 2.2 of the g eneral terms and conditions.

a. Du r ing the coverage period, a s described in article 6.2 of the g eneral conditions, unexpected material

da mage due to loss, theft, damage or missing luggage will be covered.

b. For th e categories mentioned in article 2.2 of the g eneral terms and conditions th e maximums

specified will apply.

c. Th e costs for the required purchase of r eplacement clothes and toiletries shall on ly be compensated if

th e luggage does not arrive or arrives with a t least 12 hours of delay.

1 .1 .1 .2 Ext ent of cov erage

Th e compensation granted for unexpected material damage due to loss, theft, damage or missing luggage

w ill amount to maximum the sums insured referred to in article 2.2 of the g eneral terms and conditions,

u n less otherwise agreed on the certificate of insurance.

1 .1 .2.1 A dditional exclusions

A ny damage is excluded:

a. w h ere the insured has n ot taken normal care or safety measures.

“ Normal care” has not been exercised when video, computer,

ph otographic, film and sound appliances, ornaments, clocks, fur a nd other v aluable objects, a s well as

ca sh and securities are left unattended (i.e. without direct supervision by an insured) otherwise than

in a n appropriate locked space (which does not include a motor vehicle).

For th e remaining goods, where they are left in a motor vehicle, the right to compensation exists

solely if:

1 ) th e goods are placed in an appropriate locked compartment;

2) m or eov er, these goods are not v isible from the outside.

b. a s a r esult of n ormal u se of the insured object;

c. ca used by wear and tear, own fault, own deterioration and slow acting atmospheric influences;

d. to a n tiquities and objects of artistic or collection value (including coins and stamps);

e. to v essels with accessories;

f. w h ich consists solely of damage to recording appliances, video and au dio heads of a udio a nd

v ideo appliances;

g. to su itcases, unless they are rendered useless, as well as sample collections and tools;

h. to a ircraft (including parachutes, hang gliders and gliding equipment);

i. to m otor vehicles, motorcycles, mopeds, scooters, wheelchairs and similar v ehicles;

j. ca used by seizure or forfeiture other than due to an accident;

k. du e to moths or other pests;

l. for in sured parties in the ev ent of a stay a s an au-pair or during travel and r esidence for study, work

or in ternship purposes;

m. con sisting of scratches, bumps, stains and other deterioration, unless the damaged object has thereby

become unfit for the use for which it was intended;

n. ca used by an exclusion referred to under article 3 of the General Terms and Conditions;

o. w inter sports equipment: own or rented skis including bindings, poles and boots;

p. to or loss of v ehicles and/or trailers, including bicycles, caravans (including tent parts), aircraft,

(in flatable and folding) boats, surfboards and all other means of transport or parts or

a ccessories thereof.

q. Mu sic instruments, pictures, h ousehold articles, contact lenses and hearing aids.

1 .1 .3 Loss – A rticle 1.1.3

1 .1 .3.1 Obligations in ca se of damage t o luggage

Th e In sured must:

a. in case of damage to luggage g ive the insurer the opportunity of examining the item(s) before repair

ta kes place;

b. esta blish the ownership, the value and the age of the insured object(s), or the circumstances which

h av e g iven rise to the request to the insurer for compensation or benefits and to present the receipt

for a ny items sent either before or after departure;

c. ch eck the luggage when it is received in terms of g ood condition and/or loss, if the damage occurred

du r ing the transport of the insured goods by train, boat, airplane or other means of transport. If

som ething is missing and/or is in poor condition, he/she will be required to file a statement with the

tr ansport company and to demand that this transport company make a report on this declaration. In

ca se of a claim, this or iginal r eport must be presented to the insurer.

1 .1 .3.2 Det ermining the extent of damage (luggage)

a. Da m age shall be understood a s the difference between the v alue of the insured items immediately

befor e and immediately after the ev ent or, a t the insurer's discretion, the r epair costs of the items

w h ich in the opinion of the experts can be repaired, as determined immediately after the ev ent.

Fu r thermore, damage also includes the amount of the depreciation caused by the event and not

r emedied by the r epair, if so determined by the experts.

b. Ba sis for the calculation of the compensation to be granted:

• replacement value: for insured items not older than on e year and if or iginal documentary

ev idence is presented;

• current market value: for insured items older than on e year and if n o original documentary

ev idence is presented;

• repair costs up to the current market value: for damaged insured items which cannot

reasonably be repaired. However, the compensation will not be higher in the case of

ir r eparable damage.

c. If th e insurer pays the In sured damages for l ost, stolen or missing g oods, the In sured shall transfer

th e title of ownership of these items to the insurer upon r equest.

d. If th e items are recov ered within three months of the day when they disappeared, the insured must

ta ke them back and return the compensation he/she r eceived to the insurer. If the recovered items

a r e damaged, the compensation will be set in accordance with paragraphs a and b of Article 3.2.

e. Costs in curred will be compensated subject to deduction of sav ings, restitutions, etc.

a. Th e unexpected damage r esulting from delays in flights, missed flights, delayed luggage, loss or theft

of m on ey and travel documents will be compensated.

b. For th e categories mentioned in the cov erage ov erview the maximum amounts specified shall a pply.

c. Delayed flights

Com pensation will be paid for the additional accommodation costs up to the maximum amount

pa y able in relation to delays of flights caused by weather conditions, strikes, work-to-rule, protest,

solidarity actions, bad weather conditions or breakdown of such a nature and scope that the normal

oper ations of flight operators are delayed for more than 12 hours a fter the original departure t ime.

Th ese costs shall not be covered if they can be recov ered from other parties such as airline companies.

Sh ould you choose not to continue your trip a fter a delay of the trip scheduled to depart from the

Netherlands, and that delay is a minimum of 24 hours, then the insurer will r efund unused travel and

a ccommodation costs that you have paid or are held to paying and that y ou cannot recover in any

oth er way.

d. Missed flight

Th is cov er a pplies if the insured arrives at the airport too late because:

1 ) th e public transport used by the insured to travel to the a irport was a ffected by a strike, work-to-

r u le, protest or solidarity action, bad weather conditions or breakdown. In case of strike or other

a ct ion the cov er will apply only if a t the t ime of leaving for the airport it was not known that this

w a s taking place or was g oing to take place;

2) th e motor vehicle in which the insured was travelling to the a irport was damaged in an accident

or br oke down. In case of breakdown n o cov er will apply if the motor v ehicle was n ot in a good

m echanical condition or n ot r eliable due to neglect;

3) th e insured was delayed for longer than 1 h our due to an unexpected congestion. In this case, the

in sured must also have taken into account the check-in t imes recommended by the

a ir line company.

If a claim is filed following an ev ent described under 1, the insured must be able to present a

sta tement from the public transport company which specifies the nature and the reasons of the late

a r rival. For a cause of damage r eferred to under 2, the insured must be able to present, at the time

w h en the claim is filed, a statement by the road a ssistance service or the garage specifying the nature

of th e damage or the reason for the breakdown. If a claim is filed following an ev ent described under

3 , the insured must be able to present a statement from the airline company which specifies the

r ea son for the late arrival.

e. Luggage delay

In su rer reimburses replacement of clothing and toiletries, insofar a s they have to be purchased

du r ing the period of cov erage because the luggage went missing or arrived with a delay. This

r eimbursement will never be h igher than the amount specified on the ov erview of cov erage under the

in surance taken out, which applies besides the sum insured for Luggage. The costs of essential

pu r chases of r eplacement clothes and toiletries shall on ly be reimbursed if the luggage does not arrive

or a rrives with at least 12 hours of delay.

f. Tr avel documents: Passports, travel tickets, tickets, vouchers, driving licences, visa, identity papers

a n d tourist cards.

g. Coin s and banknotes used as a legal currency.

In a ddition to the exclusions mentioned in article 3.1 of the general conditions, the following is excluded:

Loss or th eft of money or securities, when the insured did not take normal precautionary measures. Thus

th ere will be no entitlement to compensation i f (amongst others):

1 ) m on ey was transported by boat, train, bus or plane a s hand luggage.

2 ) m on ey was left unattended in a tent, including the (awning) tent of a caravan or camper.

3 ) m on ey is left unattended in a trailer/(luggage) trailer, folding camper, caravan, motor v ehicle

or v essel.

4 ) da mage is the r esult of misuse by third parties of debit or credit cards.

5 ) da mage was caused by changes in money rates, exchange rates and depr eciation of currencies

or securities.

6 ) da mage is the r esult of a strike that already started or was announced before you had this insurance

or booked the trip.

1 .2.3 Loss – A rticle 1.2.3

1 .2.3.1 Specia l obligations in the event of t ravel inconvenience

A dditional obligations in ca se of loss or theft of m oney

In ca se of loss or theft of m oney the In sured must meet the following additional obligations. If these

r equ irements are n ot met, Chubb will not be required to pay any compensation.

a. Th e ev ent must immediately be reported to the local police department. If n o report can be made on

th e spot, it must be made at the earliest opportunity;

b. In ca se of loss or theft during transport by third parties a report must be made to the carrier

r esponsible (personnel of the a irline company, train conductor, captain of the ship), the hotel

m anagement and the tour operator;

c. Docu mentary ev idence must be presented, including:

• (a copy of) the proof of the report;

• or ig inal proof of A TM transaction or bank withdrawal.

2. Medical - Section 2

Cov erage to a maximum a s described in article 2.2 of the g eneral terms and conditions.

2.1 Repa triation and evacuation – Section 2.1

2.1 .1 Cov erage – A rticle 2.1.1

2.1 .1 .1 Definition of cov erage

Th e costs r eferred to in this article will be compensated provided these had to be demonstrably and

r ea sonably incurred a s an extra during a trip as a r esult of an ev ent or circumstances independent of the

w ill of the insured and the occurrence of which was entirely beyond h is/her control.

a. Death of the insured

1) Dea th during a trip a broad

Th e next of kin can choose between two opt ions:

• Th e costs incurred for the transportation of the mortal r emains to the place of burial or

cr emation in the Netherlands, including the cost of the coffin and the documents;

• th e costs of the burial or the cremation on the spot, up to a maximum amount as referred

to in the ov erview of cov erage in article 2.2 of the general terms and conditions under the

h ea ding 'funeral costs'. The maximum amount a lso includes the travel costs for family

m embers (1st and 2nd degree) and the co-habiting partner, for maximum 3 days.

2) Dea th during a trip in the Netherlands

Th e costs incurred for the transportation of the mortal r emains to the place of burial or

cr emation in the Netherlands.

Besides the a forementioned costs, extra travel and a ccommodation costs of co-insured persons

for the extended stay at the travel destination will a lso be compensated.

b. Transport on medical grounds

Th e following cost will be compensated:

1 ) tr ansport to and within the Netherlands;

2) th e necessary medical assistance.

c. Interruption of or early return from the trip

Th e additional travel and accommodation costs of the insured and the co-insured travel companion

for r eturning to the Netherlands are compensated where the trip must be interrupted or ended as

a r esult of:

1 ) th e death or a situation of mortal danger of a member of the family (1st or 2nd degree) or a

coh abiting partner;

2) a n ev ent which caused serious damage to the property of the insured or the company where

h e/sh e works and which requires h is/her urgent r eturn.

Th e travel and accommodation costs of the insured and the co-insured travel companion to the

or ig inal destination, prov ided these costs are incurred during the period of v alidity of the contract.

d. Other costs in the case of s ickness or accident

Costs stemming from an a ccident or sickness of the insured which will be compensated include:

1 ) th e additional cost of the return journey - in cluding accommodation - of th e insured by the

pu blic means of transport by which the trip is made;

2) th e costs of a n extended stay of the insured past the v alidity period of the insurance, a nd the

ex tra a ccommodation costs incurred during the v alidity period;

3) th e costs r eferred to under 1 and 2 of a ll insured persons travelling together, i.e. family

m embers, members of the same h ousehold or another travel companion if necessary for nursing

a n d assistance of the injured or sick insured person;

4) th e travel expenses for travelling to and from the destination, including accommodation costs of

m aximum two persons for a ssistance of a n insured person who is travelling alone, on the basis

of th e cheapest option by public transport;

5) th e additional costs up to EUR 225 per policy for unexpected expenses which are r easonably the

r esult of or r elated to the admission to a hospital or the death of a n insured.

e. Additional travel and accommodation costs in case of forced delay

If a n insured is forced to stay abroad during the return journey as a result of a strike by transport

com panies, an avalanche, being snowed-in, flooding or other natural disaster, the insurer will

com pensate the additional travel and accommodation costs for two days. The accommodation costs

sh a ll be reduced by 10% due to the savings on normal living expenses. Are a lso compensated, in the

ev ent of medical unfitness of the driver, the extra costs for the r eturn journey (including

a ccommodation) of a n insured by public transport, made in consultation with Chubb Assistance, if

th e driver of the vehicle by which the journey was made can, a fter an a ccident or sickness, on medical

a dv ice, no longer drive the vehicle and will not be a ble to do so ev en a fter 3 travel days, while none of

th e travel companions can take ov er his or h er task.

f. Family members

Th e visit and return travel costs, as well a s the accommodation costs of a maximum of 2 family

m embers (1st or 2nd degree) and/or of the co-habiting partner, to attend in a case of mortal danger of

th e insured if there are no family members on location who can visit. The return travel costs to the

Netherlands are also compensated.

g. Dispatching of medicines, and medical devices

In ca se of a ccident or sickness the cost of dispatching medicines, artificial devices and aids which

ca nnot be found on the spot will be compensated. The purchase costs of the medicines are payable by

th e insured.

h. Search and rescue costs

In th e event that an insured goes missing or has an accident, the costs of the search, r escue and

sa lv age will be compensated if this is done under the supervision of a competent authority. These

costs a re a lso compensated where the competent authorities suspect that an accident occurred.

i. Telecommunication

If en t itlement to damages, compensation or aid exists under the present contract, compensation shall

be g ranted for the necessary telecommunication costs made to:

1 ) con tact Chubb Assistance;

2) con tact others u p to the amount per insured a s specified under the insured package.

j. Administrative support

In ca se of problems as a consequence of the loss of documents, passport or a irplane t icket, Chubb

A ssistance will assist the insured locally by a dvising and intervening at embassies, consulates and

oth er official bodies.

k. Arranging advance payments

Ch ubb Assistance will pay the service fees (including the transfer fees) for the money r equired in

em ergency situations. Advances will be granted if there is sufficient guarantee, a t the discretion of

Ch ubb Assistance, that these will be repaid.

l. Messages

Ch ubb Assistance will take care of passing on urgent messages relating to the ev ents for which this

sect ion prov ides cover.

2.1 .1 .2 Ext ent of cov erage

Th e compensation granted under this section amount to a maximum of the insured sums specified in the

ov erview of cov erage under Article 2.2 of the general terms a nd conditions, unless otherwise a greed on the

cer tificate of insurance.

2.1 .2 A dditional exclusions – A rticle 2.1.2

2.1 .2.1 A dditional exclusions

In a ddition to the exclusions in article 3.1 of the general t erms and con ditions, the following

exclu sions apply:

a. No en titlement to compensation exists where the insured undertook the trip in order to undergo a

(pa ra)medical treatment, insofar as the costs relate to the disease to be treated.

b. In th e event of on e of the exclusions specified in the ‘personal a ccidents’ section 2.2, article 2.2.2.1

th rough 2.2.2.11, the following exceptional costs will not be cov ered:

1 ) cost of special transport for sick and injured persons as referred to under section 2 (Medical)

a r ticle 2.1.1.1 sub b and search, rescue and salvage article 2.1.1.1 sub h;

2) oth er costs in case of sickness or a ccident a s specified in article 2.1 sub d.

2.1 .3.1 Obligations

With regard to the transport of a sick or injured insured person, a written declaration by the treating

ph y sician is r equired, which states:

a. th at transport to a h ospital in the Netherlands or the place of r esidence is justified;

b. w h at method of transportation is required;

c. or w hat type of medical care is r equired during the transport.

2.2 Person al a ccident - Sect ion 2.2

Cov erage to a maximum a s described in article 2.2 of the g eneral terms and conditions.

2.2.1 Cov erage – A rticle 2.2.1

2.2.1.1 Definition of cov erage

a. Th e insurance will pay compensation if the insured, due to an accident described in article 1 .15 of the

g en eral terms and conditions CHUBB-WA-2017-General:

1 ) dies w ithin 12 months a fter the accident or;

2) becomes permanently disabled within 12 months of the accident.

b. A n a ccident as described in article 1 .15 of the g eneral terms and conditions CHUBB-WA-2017-

Gen eral is also understood to be:

1 ) su dden a cute and unintentional ingestion of h armful g ases, vapours or substances (not viruses

a n d bacterial germs), unless these are usual waste and/or discharge products which form part of

th e open a ir a t the place of the accident;

2) in ternal injury to the ey es, if inflicted suddenly and unintentionally by external objects

or su bstances;

3) con tagion or intoxication by g erms, as a r esult of involuntary fall in water or another

(flu id) substance;

4) th e onset of complications and aggravations as a r esult of a treatment, administered by or on

pr escription of a competent physician, insofar as this treatment became necessary due to a n

ev ent covered by this insurance;

5) th e onset of a wound infection and the resulting consequences such a s blood poisoning due to an

ev ent covered under this policy;

6) fr eezing, sunstroke, drowning or suffocation;

7 ) in jury, death or impairment of health, caused intentionally and against the will of the insured by

a th ird party, with the exception of self-mutilation, suicide or attempted suicide, regardless of

w h ether the insured is or is not legally accountable a t the t ime of the ev ent;

8) sta rvation, dehydration, exhaustion and sunburn, caused by flooding, collapse, snowing in,

fr eezing in, emergency landing, sh ipwreck or any other form of unintentional isolation;

9) str aining or rupture of muscles and t issue, dislocation or sprain;

Th e following is not considered to be an a ccident: dislocation a s a result of existing joint

a bn ormalities and/or ov erstrained ligaments.

10) a n thrax, cowpox, foot -and-mouth disease, tricophytosis (v erticiliosis), brucellosis or sarcoptic

m ange.

2.2.1.2 Ext ent of cov erage

Th e com pensation granted under this section amount to a maximum of the sums insured specified in the

ov erview of cov erage under Article 2.2 of the general terms a nd conditions CHUBB-WA-2017-General,

2.2.2 A dditional exclusions – A rticle 2.2.2

2.2.2.1 A dditional exclusions

In a ddition to the exclusions in Article 3.1 of the g eneral terms and conditions, the following exclusions

a pply if an accident:

2.2.2.2 Ha za rdous u ndertaking

occurs where the insured undertakes a risky venture in which life or limb is recklessly jeopardised unless

su ch a r isky v enture was reasonably n ecessary or occurred during lawful self-defence, attempt to save a

per son, animal or items or to avert imminent danger.

2.2.2.3 Fight

occurs where the insured takes part in a fight other than for purposes of self-defence;

2.2.2.4 Ha za rdous works

occurs during works performed by the In sured, insofar a s special r isks are involved in the undertaking;

2.2.2.5 Sport s

occurs when participating in sports as (secondary) occupation;

2.2.2.6 Medicines a nd stimulants

occurs a s the result of u se by the In sured of medicines or any st imulant or narcotic su bstance other than on

m edical prescription;

2.2.2.7 Being under the influence as a driver of a m otor vehicle

is ca used by and results in death or permanent disability because the insured as driver of a motor vehicle is

u n der the influence of any intoxicating, narcotic, stimulant or similar substance, including alcoholic drink

pr ov ided that the percentage of a lcohol in h is/her blood is h igher than permitted according to the law of

th e country in which the accident has taken place.

2.2.2.8 (Pa ra)medical treatment

occurs during a trip which was (partly) undertaken to undergo a (para)medical treatment. In such case, the

follow ing are not covered:

a. costs r elating to the death of the insured;

b. costs for the special transport of sick and injured persons;

c. oth er costs in case of sickness or a ccident.

Th e exclusion mentioned herein does n ot a pply if it can be demonstrated that these costs are n ot r elated to

th e disease or disorder for which the journey was (partly) undertaken.

2.2.2.9 Medica l treatment

In jury or death caused by a medical treatment undergone by the insured, unless this is directly linked with

a n a ccident incurred previously by the insured.

2.2.2.10 Im pa ct of existing disability or sickness

Ca used (partly) by a sick or abnormal physical or mental state of the insured, unless it is the result of an

a ccident cov ered under this insurance.

2.2.2.11 Sev eral insurance policies

If sev eral travel policies were concluded for the insured with the insurer, the liability of the insurer will be

limited as indicated in the ov erview of cov erage. If a higher sum is insured, a proportional part of the

pr emium will be r eturned on request.

2.2.3.1 Obligations in ca se of loss

a. Notification period after an accident

If th e Insured suffers a n accident, the policyholder, the In sured or the beneficiary or beneficiaries

sh a ll report this:

1 ) in the case of death within 48 hours of death a s a result of a n accident, but in any case before the

cr emation or burial;

2) in the event of permanent disablement within 28 days of the end of the validity period. If

n ot ification occurs later, depending on the judgement of the insurer, a r ight to compensation

m ay nev ertheless arise if it can be demonstrated by the Insured that:

• th e In sured has suffered an accident that is cov ered;

• th e permanent disablement is the direct result of this accident;

• th e consequences of this accident have not been aggravated by illness, ailment or infirmity

or a n abnormal physical or mental condition;

• th e In sured has complied with the instructions of the attending physician in all respects.

Th e notification shall be made in writing, by telephone, by fax or by email.

A claim form to be prov ided by the Insurer shall be completed, signed and r eturned as soon

a s possible

b. Obligations after an accident.

1) If th e Insured dies, the beneficiaries are obliged to cooperate in establishing the cause of death.

2) In th e case of (permanent) disablement of the Insured he/she shall:

• immediately place himself/herself under medical treatment;

• do ev erything possible to promote his/her r ecov ery by at least following the directions of

th e treating physician;

• pr ov ide full cooperation in determining the degree of disablement, such a s collaborating in

a m edical examination.

Th e In surer reserves the right to examine the policyholder’s and/or insured's and/or beneficiary's

r ecords, in order to v erify the information prov ided. The In sured may n ot derive any rights from the

policy if they have failed to comply with on e or more of these obligations and insofar a s this has

da maged the interests of the insurer.

2.2.3.2 Specia l obligation in case of a dmission to a hospital

In ca se of a dmission to a hospital, it is necessary to telephone Chubb A ssistance within a week of the

a dmission, so that the latter in agreement with the insured or with his/her representative, together with

th e treating physician and possibly also with the family physician, can take the measures which best ensure

th e interests of the insured involved. The insured shall n ot be treated in a h igher class facility than the class

cor responding to his/her healthcare insurance in the Netherlands, or in the a bsence thereof, the

low est class.

2.2.3.3 Det ermination of the level of com pensation

In th e case of total permanent disablement:

a. th e degree of permanent disablement will need to be confirmed by a physician appointed by the

in surer’s medical a dvisor;

b. in r espect of a n accident, in the case of permanent disablement the maximum total amount disbursed

is th e Insured amount;

c. determination of the compensation for permanent disablement takes place n o later than 2 years after

th e reporting of the a ccident or as soon as a permanent condition of disablement has been

esta blished. However, if two years after r eporting of the accident n o compensation on account of

permanent disablement has been paid, the insurer will pay the statutory interest, starting two years

a fter r eporting of the accident, on the amount u ltimately due in r espect of permanent disablement.

Th e interest will be paid simultaneously with the compensation. However, the a bov e-mentioned

in terest is no longer due once the insurer has paid an a dvance on the compensation in respect of

permanent disablement;

d. in determining the degree of permanent disablement no a ccount i s ev er taken of the psy chological

r ea ction to the accident or to the bodily injury or permanent disablement that it causes, ev en if said

psy chological reaction could in itself result in some degree of permanent disablement;

e. if th e Insured dies within 2 years of the a ccident (but n ot as a r esult of sa id accident or as a r esult of

a n other accident for which compensation will be prov ided by the insurer) while the compensation for

permanent disablement has n ot yet been determined, compensation will be granted on the basis of

th e degree of disablement which, taking into account 2 years after the occurrence of the a ccident,

cou ld r easonably have been expected, had the In sured remained alive;

f. th e degree of permanent disablement will be determined in The Netherlands, ev en if an In sured has

m ov ed a broad after the a ccident or was abroad a t the t ime of the a ccident. In that case the Insured

w ill have to travel or return to The Netherlands at his/her own expense for purposes of determining

th e final degree of permanent disablement. If the Insured does not comply with this, his/her r ight to

com pensation shall lapse, unless it has been agreed otherwise.

2.2.3.4 Pa yment of the compensation

a. In ca se of death

If th e insured dies within 2 years of the a ccident, the insured will pay th e amount for which h e/she

w a s insured. If the insurer has already prov ided compensation on a ccount of permanent disablement

in r espect of the same accident, the latter compensation will be deducted from the compensation on

dea th. However, if the compensation already prov ided on account of permanent disablement is

h igher than the compensation on death, the insurer will not r eclaim the difference.

b. In th e case of permanent disablement

Th e degree of permanent disablement is determined as soon a s medical a sse ssment determines that

th e situation is unchanging, but not more than 2 years a fter r eporting of the accident. After this

per iod the degree of permanent disablement will be determined on the basis of the then existing

disa blement, whereby it is expressly determined that changes occurring afterwards cannot constitute

ca use to claim supplementary compensation.

2.2.3.5 No obligation of t he insurer t o pay the state

If it turns out that in the a bsence of beneficiaries the state may be entitled to compensation, the insurer

sh a ll not have an obligation to pay.

2.2.3.6 Lim itation period

In a ddition to Article 4.8 of the general terms and conditions, section 2.2 (Medical sub Personal Accidents)

w ill not lapse until 5 years a fter the accident.

2.3 Medica l costs - Sect ion 2.3

Cov erage to a maximum a s described in article 2.2 of the g eneral terms and conditions.

2.3.1 Cov erage – A rticle 2.3.1

2.3.1.1 Definition of cov erage

a. In th e event of a medical treatment of an insured which is medically required a s a result of the

a ccident and/or disease that occurred during the journey within the period of the insurance, the

in surer shall compensate on ly costs incurred with regard to:

1 ) a n a dmission to hospital;

2) a n operation;

3) th e tests prescribed by the physician;

4) th e medicines, dressings and massages prescribed by the dentist or physician;

5) tr ansport of the insured from and to doctors and hospitals;

b. A fter-treatment costs

Medical and dental costs incurred as the result of an insured accident, a s described in article 1.15 of

th e general terms and conditions CHUBB-WA-2017-General, are reimbursed if and insofar as they

a r e made in the Netherlands a fter the period during which the insurance was effective, but n ot later

th an 365 days a fter departure.

c. If, du e to the medical treatment, the journey lasts longer than the maximum travel period as

in dicated on the policy scheme, the costs shall only be compensated if transport to the Netherlands

ca nnot be defended on medical grounds. The compensation will be stopped on the 365th day after

depa rture.

d. In su red class

In th e event of a dmission to hospital the compensation will be based on the same class that the

in sured is entitled to in the Netherlands by v irtue of h is or h er healthcare insurance. If the insured

does n ot have healthcare insurance in the Netherlands, the comp ensation will be based on the lowest

cla ss.

e. Ex ist ing coverage in the Netherlands

Th e cover insured under this section shall apply only if a valid primary cover or any other public or

pr iv ate scheme exists in the Netherlands for medical costs (for example p rivate healthcare insurance,

sta ndard package policy and similar).

f. If, du ring the validity period of this insurance, the primary cover disappears, the present cov er shall,

on th e expiry date of the primary cover, also lapse. The insurer must immediately be notified of su ch

cir cumstances. The premium will be adjusted accordingly.

g. Em ergency dental treatment

A ll medically necessary and reasonable cost to provide emergency dental treatment for the relief of

pa in only, outside of the Netherlands.

h. Em ergency dental treatment

A ll medically necessary and reasonable cost to provide emergency dental treatment for the relief of

pa in only, outside of the Netherlands.

Hospitalisation - If You are admitted to a h ospital as an in-patient during a Trip Due To injury or

illness for which You have a valid Claim under Section 2.3.1.1a, We will pay the benefit amount stated

in the Table of Benefits for each complete 24 hours that You remain a h ospital in -patient, up to the

m aximum amount stated in the Table of Benefits. We will on ly pay for time You spend in an

in st itution r ecognised as a hospital in the country of treatment.

2.3.1.2 Ext ent of cov erage

Th e compensations granted under this section amount to a maximum of the sums insured specified in the

ov erview of cov erage under article 2 .2 of the general terms and conditions CHUBB-WA-2017-General,

u n less otherwise agreed on the certificate of insurance.

2.3.2 A dditional exclusions – A rticle 2.3.2

2.3.2.1 A dditional exclusions

In a ddition to the exclusions in article 3.1 of the general t erms and con ditions, the following

exclu sions apply:

A ny damage is excluded:

a. if it r elates to treatments which, without medical risk, can be postponed until the insured r eturns to

th e Netherlands;

b. w h ere the treatment is performed by a non-accredited physician;

c. w h ere on e of the r easons why the insured undertook the trip was to undergo a (para) medical

tr eatment, insofar as the costs r elate to the disease to be treated.

d. If it r elates to a treatment of which it was known before the start of the trip that it would have to take

pla ce during the trip;

e. if th e insured has no primary valid medical healthcare insurance/prov ision in the Netherlands.

f. If th e insurance is concluded and/or took effect while the insured was already under medical

tr eatment, the costs of this continued or prescribed treatment shall not be compensated.

2.3.3 Loss – A rticle 2.3.3

2.3.3.1 Specia l obligations in case of a dmission to a hospital

In th e event of a dmission to a hospital, it is necessary to telephone Chubb Assistance within a week of the

a dmission, so that the latter in agreement with the insured or with his/her representative, together with

th e treating physician and possibly also w ith the family physician, can take the measures which ensure best

3.1 Lega l a ssistance – Sect ion 3.1

3.1 .1 General – A rticle 3.1.1

3.1 .1 .1 Expenses

Ex pen ses refer to the costs incurred for legal a ssi stance or by Chubb Assistance, insofar a s they cannot be

r ecov ered from any third parties, the costs relating to tests and treatments.

3.1 .2 Cov erage – A rticle 3.1.2

3.1 .2.1 Definition of cov erage

Th e insured is entitled to legal assistance and r eimbursement of costs up to the maximum amount

m entioned on the ov erview of cov erage, insofar a s:

a. th e private r ights or interests of the insured are directly compromised, except for damage resulting

fr om the possession, custody or u se of a means of transport;

b. w ithout h owever exceeding the amount stipulated in the ov erview of cov erage, per claim;

c. th e claim refers to:

1 ) th e recovery of the material and immaterial damages sustained by the insured as a consequence

of a phy sical injury received by him /h er for which a third party is liable on the basis of a legal

pr ov ision;

2) th e legal defence of the insured in the event that the insured as a private person is sued in court

for h is/her civil liability, under the laws of the country where he/she is, for damages inflicted on

th ird parties or after involuntary infringement of local laws.

3.1 .2.2 A dvances

Th e insurer prov ides advances against adequate guarantee up to the maximum amount for legal assistance

m entioned on the ov erview of cov erage:

a. pa y ment of the trial costs due w ith the exception of the se curity deposits r equired in r espect of third-

pa r ty liability, fines or personal compensation to be paid by the insured;

b. r eleasing the insured in the unlikely ev ent of h is/her being taken into custody a fter a traffic a ccident.

Su ch a dvance or security deposit will be r egarded as a loan from the insurer to the insured, who will repay

it in full as soon as the security deposit has been repaid to him/her in the ev ent of discontinuation of

cr iminal proceedings, acquittal, or otherwise within 15 days of the date on which the competent court has

pr on ounced judgment. Repayment to the insurer shall follow in all cases no later than 60 days a fter the

a dv ance was made or the security deposit was provided.

a. h e/sh e could have reasonably predicted the n eed for legal assistance at the policy effective date;

b. in case of conditional intent, gross misconduct or negligence.

3.1 .4 Loss – A rticle 3.1.4

3.1 .4.1 Specia l lost adjustments

If th e insured wants to make use of legal assistance, he/she sh ould notify Chubb Assistance thereof a s soon

a s possible.

Th e insured may, a s soon as he/she is entitled to legal a ssistance under this policy, entrust the defence of

h is/h er interests to a lawyer or other legal expert of his choice.

3.1 .4.2 Cost s payable by the insured

Th e costs will be payable by the insured if:

a. m a de without prior consultation with Chubb Assistance;

b. if th e costs are the result of n egligence or errors on the part of the insured with regard to handling

th e case;

c. Fr om the moment when Chubb Assistance has communicated to the insured that further pursuit of

th e case has n o reasonable chance of success, the insured may no longer make any claim for cov erage

ex cept for the settlement of the dispute.

In th e case of a difference of opinion between the insured and Chubb Assistance a s to the result to be

ex pected or on the way to handle the case, the insured may, a fter agreement with Chubb Assistance to

ch arge this to the insurer’s account, submit the case to a lawyer of his /her choice who is expert in the field

in qu estion; this has to be done as quickly as possible and in any case w ithin on e month after Chubb

A ssistance has communicated to the insured its

opin ion, on the r esult to be expected or on the way of handling the case, which is con tested by the insured.

Sh ould that lawyer share Chubb Assistance’s point of v iew, then the insured can on ly proceed with the case

a t h is/her own expense. Should the result show that the insured is wholly or partially vindicated, then the

costs w ill be reimbursed to a maximum of the insured sum. If the case is already being handled by a lawyer

a n d the insured loses confidence in h im or her, then the insured may, at the insurer’s expense, transfer the

ca se to another lawyer, insofar a s Chubb Assistance can reasonably share the point of v iew of the insured.

3.2 Lia bility section – Section 3.2

3.2.1 Cov erage – A rticle 3.2.1

3.2.1.1 Definition of cov erage
