For computing hire charges of truck, the total distance covered will be calculated from the point of loading the stores to the point of unloading the store and no separate payment will be made for return trip. 10. It is important to mention here that layout was also part of the said sale deed. 2) That after taking over the possession my respective clients occupied their respective plots and some of them already constructed their dwelling house, which falls practically in Survey No. 35 but willfully and deliberately they were shown in the sale deed in Survey No. 38 only. 3) That since the date of handing over possession to my clients on the basis of the receipts, my clients are occupying in Survey No. 35 and now Shri Abdul Motin threatening all of them to vacate the said portion and to occupy somewhere else. 4) That my clients also came to know from reliable sources that the land bearing Survey No. 35 where my clients are occupying their respective plots is being negotiated to sale to some other persons and entering in agreement with them by Shri Abdul Motin. 5) That the Survey Numbers 34, 35 & 38 never has been subdivided as per the revenue records and jointly recorded in the name of purchasers including my clients, therefore any transaction in respect of undivided property is absolutely illegal and amount to interference with the occupation of my clients that too with some malafide intention to evict them. 6) That my clients also came to know that Shri Abdul Motin approached the Revenue Authorities for the purpose of obtaining the documents to execute and register sale deed in favour of some other persons in respect of the property, which is in occupation of my clients. If any person entering / entered any type of negotiation / transaction with Shri Abdul Motin in respect of the occupied land of my clients same will be his / her own cost and risk.
