WHEREAS it is provided by section 49 of the Constitution of Malta that whenever the holder of the office of President is absent from Malta the functions conferred upon her by the said Constitution shall be performed by such person as the Prime Minister, after consultation with the Leader of the Opposition, may appoint;

AND WHEREAS the President is absent from Malta;

AND WHEREAS on the 10th day of February, 2019, the Acting Prime Minister appointed me Acting President for such time as the President is absent from Malta;

AND WHEREAS I have duly taken and subscribed the oath of office as prescribed by section 50 of the said Constitution;

NOW, THEREFORE, I, DOLORES CRISTINA, do hereby notify and proclaim that I have this day under the said Constitution assumed the functions of President of Malta.

BIEx ikompli jinkoraġġixxi t-titjib fl-użu tal-enerġija li jipproduċi l-pajjiż, ir-Regolatur għas-Servizzi tal-Enerġija u l-Ilma qiegħed jamministra l-iskema ffinanzjata minn Fondi Nazzjonali li hi mmirata biex tinkoraġġixxi l-użu ta’ sistemi fotovoltajċi għal użu residenzjali li jnaqqsu l-użu ta’ enerġija, jew li jużaw għejun ta’ enerġija li tiġġedded.

1. Għotja li titħallas taħt din l-iskema

L-applikanti jistgħu japplikaw għal għotja għal sistema permezz tal-formola li tista’ timtela minn fuq is-sit elettroniku tar-Regolatur għas-Servizzi tal-Enerġija u l-Ilma (www.rews.org.mt) jew permezz tal-formola li tista’ titniżżel mill-istess sit. L-iskema hija amministrata u suġġetta għal linji gwida li jitniżżlu wkoll minn dak is-sit.

L-applikanti li jkunu rċevew għotja għal sistema simili mill-2006 ʼl hawn mhumiex eliġibbli għal għotja oħra mogħtija taħt din l-Iskema.

REGULATOR FOR ENERGY AND WATER SERVICES

A Grant on the Purchase of Photovoltaic Systemsin the Domestic Sector – Call 2019/PV

IN order to further encourage the better use of the energy being generated by the country, the Regulator for Energy and Water Services is administering the following Nationally funded scheme which aims to encourage the use of photovoltaic systems for residential use that reduce the use of energy, or use renewable sources of energy.

1. Grant payable under this scheme

Applicants may apply for a grant under this scheme for a system by means of an online form from the Regulator for Energy and Water Services website (www.rews.org.mt) or by means of the form downloadable from the same website. The scheme is administered and governed in terms of the guidelines also downloadable from the website.

Applicants who have received a grant for a similar system since 2006 shall not be eligible for another grant issued in terms of this Scheme.

2. Tul tal-iskema

Applikazzjonijiet għal din l-iskema jintlaqgħu b’mod validu mit-8.00 a.m. tat-Tnejn, il-11 ta’ Frar, 2019, sal-aħħar tas-sena. Din l-iskema tista’ tiġi mibdula jew mitmuma qabel dik id-data permezz ta’ avviż fil-Gazzetta tal-Gvern. Din l-iskema tista’ tiġi mġedda kif ir-Regolatur għas-Servizzi tal-Enerġija u l-Ilma jista’ jidhirlu xieraq ukoll permezz ta’ avviż fil-Gazzetta tal-Gvern.

3. Infiq eliġibbli

Ir-Regolatur jirriżerva d-dritt li jirrifjuta l-għotja u/jew li jieħu azzjoni legali biex jirkupra l-ammont mogħti bl-interessi u bi spejjeż oħra li setgħu saru, fil-każ ta’ applikant li jkun eżerċita d-dritt li jikseb jew li kiseb xi skont ta’ taxxa, tnaqqis inkluż tnaqqis ta’ kreditu ta’ input tax mill-output tax skont l-Att dwar Taxxa fuq il-Valur Miżjud (Kap. 406), jew xi rifużjoni ta’ taxxa jkun kif ikun mfisser, għar-rigward tal-infiq eliġibbli li jsir għax-xiri tal-installazzjoni fotovoltajka.

4. Emendi għall-iskema

Ir-Regolatur għas-Servizzi tal-Energija u l-Ilma għandu jkollu f’kull waqt id-dritt li jagħmel kull emenda għal din l-iskema permezz ta’ avviż ippubblikat fil-Gazzetta tal-Gvern li jkun jinkludi dawk l-emendi.

Lista ta’ perċentwali ta’ għajnuna:

Sistemi fotovoltajċi: 50% tal-infiq eliġibbli sa massimu ta’ 2300 ewro kull sistema u Ewro 757 kull kWp u (kWp multiplikat bi €3800) u naqqas l-infiq eliġibbli.


2. Duration of the scheme

Applications for this call may be validly received as from 8.00 a.m. of Monday, 11th February, 2019, until the end of the year. The scheme may be modified or terminated before that date by means of a notice in the Government Gazette. This scheme may be renewed as may be deemed necessary by the Regulator for Energy and Water Services also by means of a notice in the Government Gazette.

3. Eligible expenditure

The Regulator reserves the right to refuse the grant and/or take legal action to recover the amount granted with interests and any other costs incurred, in case of any applicant having exercised the right to obtain or who has obtained any tax rebate, deduction including deductions of input tax credit from the output tax in terms of the Value Added Tax Act (Cap. 406), or other tax refund however so described, with regard to the eligible expenditure made in relation to the purchase of the photovoltaic installation.

4. Amendments to the scheme

The Regulator for Energy and Water Services shall at all times have the right to make any amendments to this scheme by means of a notice published in the Government Gazette containing such amendments.

PV systems: 50% of eligible costs up to a maximum of euro 2300 per system and Euro 757/kWp and (kWp times €3800) minus eligible cost.

THE PRESIDENT’S FOUNDATION FOR THE WELLBEING OF SOCIETy

Call for Rapporteur

The President’s Foundation for the Wellbeing of Society and the Ministry for the Family, Children’s Rights and Social Solidarity are seeking the services of a Rapporteur in relation to the implementation phase of the Child Participation Assessment Tool (CPAT). The Council of Europe has developed this tool with ten specific and measurable indicators to measure progress in the area of children’s participation.

The service provider must:

(i) possess a minimum Masters level qualification in any related subject;

(ii) have excellent report writing skills; and(iii) be competent in both Maltese and English.

Preference will be given to applicants who:

(i) have experience working in the children’s rights sector.

The Rapporteur will be required to dedicate approximately 200 hours of work over a period of eight (8) months and deliver a written report by not later than 1st September, 2019.

Notice on Brexit to all Economic Operatorsby Malta Customs

From 30th March, 2019, at midnight Central European Time (CET), the United Kingdom will become a ‘third country’, that is a country not member of the European Union, and as such all imports from, and exports to, the United Kingdom will need to be covered by a Customs declaration in the electronic systems.

In this regard, the Customs Department is calling on those economic operators who either solely trade with the United Kingdom, or who trade exclusively with the United Kingdom and the European Union, to:

(a) register with the Customs Department to obtain

an Economic Operator Registration Identification (EORI number) by sending an email to ([email protected]) or call on telephone number 2568 5121.

Further details may be obtained from (https://customs.gov.mt/bus/economic-operators-registration-identification).

(b) apply for training on use of the National Import System, and the National Export System, by filling in the form/s on pages 1508 and 1509 and forward it by email to the Customs Training Unit on ([email protected]).

Applications must be received by Monday, 18th February, 2019.

ii. As for the contract dated 26th November, 1955, the shop number 4 at the annual rent of Lm250; and

iii. As for the contract dated 6th April, 1957, the room number 20 at the annual rent in the amount of Lm65;

These premises/rooms above mentioned are all found in Kingsway Palace, Triq ir-Repubblika, Valletta;

Amongst the conditions of the lease of the premises/rooms above mentioned, the sub-lease of the property subject matter of the relative contracts is expressly prohibited and/or subject to obtaining in advance the written consent of the owner and namely of the applicant company, according to each case;

That on the 15th February, 2007, members of the Vella family transferred all the shares which they had in Pearl’s Gowns Limited, previously Pearl’s Gowns, to V.F. Group Ltd, as shown in document Form T attached and marked as Doc. KWP5. The transfer of the shares was made without the knowledge of the applicant company, and this because it was never communicated to the applicant company. Accordingly, the applicant company never gave its permission in advance, where this was required. The applicant company learnt of the transfer of the shares years later and in fact stopped accepting the rent;

That this transfer of all the shares constitutes a sub-lease of the leases in terms of article 1614 of Cap. 16 of the Laws of Malta and is also in breach of the terms of the agreements subject of this case;

Although the respondent company was informed about the breach of the conditions of the relative agreements and was solicited to vacate the premises, by means of two judicial letters dated 26th March, 2018, and 17th April, 2018, respectively attached and marked as Doc. KWP 6 and Doc. KWP 7, the respondent company remained in default, and that it is still occupying the said premises without any valid title at law;

Accordingly, this law suit had to be made so that the applicant company takes back the possession of the leased premises.

Thus, the applicant company requests this Honourable Board with respect for the reasons above mentioned:

The interpellant company formally informs you that you did not abide with the conditions of the insurance policy issued on the vehicle in question when you failed to inform the interpellant company about the transfer that occured between you and the said Joseph Vella, the person who was driving the car at the time of the accident, and for this reason, the interpellant is not giving any insurance cover.

The interpellant informs you as from now such that if it is obliged to pay any damages, interests, judicial costs and VAT caused to third parties as a consequence of this accident, because of the provisions of Cap. 104 of the Laws of Malta, it is going to request the full refund from you of any disbursment it will have to make on the basis of its rights of refund against you.
