The ride through the tunnel under the river, wben
one of tbe bridges was up and the street blocked with

and I had tt confess to a feeling of relief wben I saw
the faint streak of daylight at tbe further end, andbegan tu emerge. Tbe more so, as in some places Icould see tiny streams of water trickling down thearched stone sides.
The streets of Chicago where the private residencesare built, both on the South and West sides (so far asI have seen), are very beautiful, some of them pala-tial, and building is continually going oq. The churches of Chicago are ele-

The worshippers seem elegant, too, indress and manners, but at a church wcleome given inthe church parlors to their new pastor and his wife.Mr. and Airs. YanJervecr, it seemed to a strangerlooking on. that half the people present were stran-gers to each other, and for easy c rdiality and socialintercourse the simple little chureh parlors in Hono-lulu are ahead. out dbt. After a few days in Chicago, your corre-spondent left for a visit tu a brother in the northernpart of Wisconsin. So far north in fact, that tbeplace is not laid down on tbe maps. Tbe railroadterminates it Cbinpewa Falls, a thriving litt'e townon t e Chippewa river, and then followed a long stageride of 14 miles to Rlosmer. The first ground of exception is that tbe de-
fendant had judgment at this term of the Courtin another action in which the plaintiff claimed as a m ot inouey, being halt of thn proceeds of anawa crop, said to belong to him and tbe deceasedman Aniuni as partners.
This suit was in the nature of an action for theconversion of partnership goods, over which theplaintiff averred that he had a right as a partner.He might have claimed the whole goods, is well
as a half of ihem, if he bad cbosen. Tbe wholequestion raised was partnership or no partnership.Under the allegations and proofs, if he were apartner be was entitled to recover without abate-
ment and would bare been entitled to recover,if he bad claimed tbe whole of the crop. If bedid not ebow himself to lie a partner under tbeallegations and proofs in tho first actiun. hewould not be eutitled to recover anything. Tbejury was so instructed aud fouud thai be was nota partner.
In this action tbe plaintiff accep'.s the first verdiet as conclusive, and brings bis aclioo claiminga quantom meruit for work and labor done by
him for the beoefit of Aniani and bis estate.This is clearly a different cause of action cer-
tainly not adjudicated in the first suit. There-fore tbe first exception is overruled.
Do the second point of exception we are of
opinion that Ali's testimony of what be was pay-ing on a rice plantation was admissible.
The plaotiog of rice as well as of mi is anoperation and required a like kind of hi
bur. One might as well say that hoeing cornand mowing grass, or planting potatoes and plant-ing wheal were not similar employments.
Upon tbe third exception, the concluding in-
struction of tbe court to wit : That tbe jurywould fiud for the Bide on which the evidencepreponderated, was all that tbe defendant couldrcqaire.
With regard to tbe last exception, namely tbeintroduction of the Chinese account book, tobow what bad been done with some money
which appeared daring tbe trial to have beenreceived by tbe plaintiff for the sale of some awa.
It is sufficient to say that there was no noticeof let off given by tbe defendant, and tbe wholequestion of the money received for awa wastherefore not in issue. It having traospired inthe course of tbe testimony tbat a sum of moneybad been received, it neither harmed norbenefitted one side or the other to continue tobow what had become of it.
Exception overruled and plaintiff may havejudgment pn tbe verdict.

Shall Prisoners Testify- ?A bill fixing rales of practice in regard toeridenee,
and which includes a provision allowing parties to
testify in both civil and criminal cases has been in-
troduced in the Legislative Assembly and is now un-
der discussion. In lS72abill with a similar provis-
ion was defeated probably on sccoant of the proposedreform in criminal practice. There is but little doubtbut thai a hill for allowing parties in civil cases to
testify would have parsed if it had been offered by it-
self. Arain are these two somewhat distinct andradical reforms proposed in one bill. It may be saidthat the principles of hjth kinds of eases are the same,yet although this is largely true, the circumstances oftbe application of these principles are so widely differ-
ent io criminal eases from wbst they are in civil cases,that it is impossible to do justice to tbe question ofthe proposed change in either case when combinedwith the other in one motion.
The question of altowiog a prisoner to be a witnessfor himself, is one of great importance, not only to thepublic but to parties themselves, aud cannotbe safrlyleft to follow the settlemaut of the similar question incivil esses.
The bill provides for the prisoner to be a witnessfoff himself or not, as he or bisccuusel decides is mo.lprudent, and contains a warning clause thsthis refas-- I
at to testify shill nol be d against him. Tnisplan has at first sight the appearance of great plausibility, but on examination vve hnd strong reasons todoubt its policy. It is hardly a practical matter tomake a witness in his own Bass, out of a prisoner. Asa rule, the majority of prisoners are guilty of Ihe of-

I agree with those who favor this change, that thopresent system is imperfect and nods modification,but not in the way proposed. Unprofessional think-ers wi-- easily see the hardship of sealing the tonguesof those who of all others are best informed and mostnbto to clear up the apparent contradictions of evi-dence frequent in criminal cases. fuse to go onto the stand to save himself from beingcompelled to testily on other points, aud su the wholeof his information is lo.t. It seems a reasonable andhumane method to allow ono charged with an offenceagainst the laws, an oppurtanity of explaining
suspicion which tho evidence has thrownaroand him. Such a system is strongly analogous tothe practico inequity courts, where tho defendant isallowed tu file his answer replying to each nnd ercryitem of tbe bill of complaint and to add other explan-atory matter in evidence of the complaint withoutbeing exposed to tbo misconstructions of tho witnessstand anil is just as necessary for the proper iccuiityof the prisoner as that is for tho proper defence ofherespondent. - II.
