ANNEXURE - I INSTRUCTIONS TO BIDDERS

SUB: TENDER NO. GAIL/VL/08/M206/ ELECT FOR SUPPLY OF MEASURING INSTRUMENTS FOR LPG &

TOWNSHIP ELECTRICAL AT VIJAIPUR. 1.0 GAIL (India) Limited invites sealed bids from eligible bidders for subject items. 2.0 Bid document is non-transferable. Bids received from bidders in whose name bid document has been issued

shall only be considered. In addition, the bid from prospective bidders who download the tender document from GAIL website shall also be considered acceptable.

3.0 CONTENT OF BIDDING DOCUMENTS 3.1 The bidding documents are those stated below and should be read in conjunction with any addenda issued:

(i) Instructions to Bidders (ITB) & Format (ii) General Purchase Conditions (GPC-Indigenous) (iii) Special Conditions of Contract (SCC), If any (iv) Technical Specifications & Drawings, if any

3.2 Failure to furnish all information required by the bidding documents or to submit a bid not substantially

responsive to the bidding documents in every respect will be at the Bidder’s risk and may result in the rejection of its bid.

4.0 BID / OFFER SUBMISSION 4.1 Bid shall be submitted under two bid system [ Price bid & Unprice bid alongwith EMD] in the following

manner in separate sealed envelopes duly superscribed as below: 4.1.1 ENVELOPE -1: SUPER SCRIBING TECHNO-COMMERCIAL UN-PRICED BID (PART-I)

Part-I: Techno-commercial /Un-priced Bid (to be furnished in original and one copy) and shall contain the following:

i) A confirmation that prices in requisite formats, strictly complying with the requirement, with prices

blanked out (similar to the Priced Bid kept in Envelope no. II) / Blanked out SOR. ii) Documentary evidence to substantiate Bidder’s Eligibility Criteria. Specific Experience /

credential and other details as called for in Bidder’s Eligibility Criteria. iii) Confirmation to terms & conditions, taxes and duty. iv) Any other information/details required as per bid document.

Note: All pages of the bid to be signed and sealed by authorized person of the bidder.

4.1.2 ENVELOPE II : SUPER SCRIBING “PRICE BID- NOT TO OPEN”– PART-II Part-II shall contain original of Price Schedule duly filled in, in separate sealed envelopes duly signed and

stamped on each page super scribing on the sealed envelope “Price – Do Not Open” and no conditions what so ever. In case of any correction, the bidders shall put his signature and his stamp.

4.1.3 ENVELOPE III ; SUPER SCRIBING “ EMD / BID SECURITY”- PART-III

Part-III shall contain original Bid security in separate sealed envelope. All three envelopes containing Techno-Commercial un-priced Bids, Price Bids and Bid security shall further

be sealed in one outer envelope super scribing “Bid for “Procurement of subject item”, Bidding Document Number and shall be addressed to G.M. (C&P) at address mentioned below.

5.0 BID PRICES

5.1 Prices must be filled in format for "Schedule of Rates [SOR]" enclosed as part of "RFQ". If quoted in separate typed sheets and any variation in item description, unit or quantity is noticed; the Bid is liable to be rejected.

5.2 GAIL shall issue concessional Form /Form "C" [for item sl.no. 1 to 4] and GAIL shall not issue

concessional Form /Form "C” [for item sl.no. 5, 6 & 7] for this purchase, please quote sales tax accordingly.

5.3 The Bidder shall quote the prices both in 'figures' as well as in 'words'. There should not be any

discrepancies between the price indicated in 'figures' and the price indicated in 'words'. 5.4 Discount, if any, must be included in "SOR" only. Conditional discount, if offered, shall not be considered for

evaluation. 6.0 BID CURRENCIES 6.1 Bidders shall submit bid only in Indian Rupees. 7.0 PRICE BASIS: FOT site - GAIL (India) Ltd., 8.0 BID VALIDITY: 8.1 Bids shall be kept valid for 'three [03] months' from the final 'Bid Due Date'. A bid valid for a shorter period

may be rejected by GAIL as 'non-responsive'. 8.2 In exceptional circumstances, prior to expiry of the original 'Bid Validity Period', the Employer may request

that the Bidders extend the 'Period of Bid Validity' for a specified additional period. 9.0 EMD/ BID SECURITY 9.1 Bids must be accompanied with 'Earnest Money / Bid Security' for Rs. 10,000.00 (Ten Thousand Only) in

the form of 'Demand Draft' [in favor of GAIL (India) Limited, payable at State Bank of India {Branch: GAIL Complex, Vijaipur; Code: 06635}] or 'Banker's Cheque' or 'Bank Guarantee'. Bidders shall ensure that 'Bid Security', having a validity of 'five [05] months' from the final 'Bid Due Date', must accompany the Bid in the format(s) made available in the Bid Document. Bid not accompanied with 'EMD/ Bid Security', or ' EMD/Bid Security' not in requisite form shall be summarily rejected.

10.0 DELIVERY / COMPLETION PERIOD & TERM 10.1 For supply: Within 06 [Six] weeks from the date of issue of Purchase Order. 10.2 Through road transport (preferably by TCI /ETO who have their offices in GUNA, M.P.). Transit insurance

shall be arranged by GAIL. 10.3 Date of L.R. shall be considered as date of delivery. 11.0 TERMS OF PAYMENT 11.1 100% payment shall be released within 15 days after receipt and acceptance of material at site on

submission of contract cum performance bank guarantee of 10% of total order value. 11.2 Payment shall be released directly to your bank account through e-banking only. Please provide your

bank account no. in any branch of SBI/ HDFC/ ICICI bank, which has e-banking facility. 12.0 PRICE REDUCTION SCHEDULE/ CONTRACT PERFORMANCE SECURITY / SECURITY DEPOSIT/

14.0 TECHNICAL AND COMMERCIAL QUERIES TQ/CQ), if required may be issued to only those bidders

whose bids are found prima-facie responsive, for seeking clarification only. The request for such clarifications and the response shall be in writing and no change in the price or substance of bids shall be sought offered or permitted. The substance of the bid includes but not limited to price, delivery/completion, scope, specification etc.

15.0 BID OPENING 15.1 Un-priced Bid Opening: GAIL will open the un-price bids in the presence of Bidders' representatives, who

choose to attend on the date, time and location stipulated in the "RFQ". 15.2 Price Bid Opening: GAIL will open 'Price Bids' of those Bidders who meet the Bidder’s Eligibility Criteria

and whose Bids are determined to be 'technically and commercially responsive'. Bidders selected for opening of their 'Price Bids' shall be informed about the 'Date of Price Bid Opening' through e-mail/fax. Bidders may depute their 'authorized representative(s)' to attend the opening. The Bidders' representative(s), who are present, shall sign a register evidencing their attendance.

16.0 EXAMINATION OF BIDS AND DETERMINATION OF RESPONSIVENESS 16.1 Prior to the detailed evaluation of Bids, the Employer will determine whether each Bid,

(a) Meets the "BEC" / 'techno-commercial requirements' of the Bidding Documents; (b) Accompanied by the required 'Earnest Money / Bid Security; (c) Substantially responsive to the requirements of the Bidding Documents.

17.0 CORRECTION OF ERRORS 17.1 Bids determined to be substantially responsive will be checked by the Employer for any 'arithmetic errors'.

Errors will be corrected by the Employer as follows:

(a) Where there is a discrepancy between the 'amount in words' and the 'amount in figures', the 'amount in words' will govern.

(b) If there is a discrepancy between the 'unit price' and the 'total price' that is obtained by multiplying the 'unit price' and the 'quantity', the 'unit price' shall prevail and the 'total price' will be corrected.

(c) If there is a discrepancy between the 'total amount' and the 'sum of total prices', the 'sum of total prices' shall prevail and the 'total Bid amount' will be corrected.

17.2 The amount stated in the Bid will be adjusted by the Employer in accordance with the above procedure for

the correction of errors and, with the concurrence of the Bidder, shall be considered as binding upon the Bidder. If the Bidder does not accept the corrected amount of Bid, its Bid will be rejected, and the 'Bid Security' shall be forfeited.

18.0 EVALUATION AND COMPARISON OF BIDS
