    Introduction The purpose of this document is to lay the groundwork for why fees are charged, and to discuss pricing philosophy and how cost recovery is related to the core services model. It is the intent of this document to provide transparency to policy makers and the public on the subject of fees and charges and to ensure the sustainability of parks and recreation programs by providing a logical, justifiable fee schedule that is directly linked to these factors:

    • Financial viability of the program • Thorough understanding of both direct and indirect costs • City’s civic responsibility to provide some services without recovering all costs • Community values • Core services model

    Why does Parks and Recreation offer programs and services for a fee? • The Parks and Recreation Department is expected to expand existing service or retain services which

    are not totally supported through public funds. • Recreation facilities and programs are expected to cover operating costs due to limited funding

    support available through the general fund. A variety of services. The Parks and Recreation Department’s mission is to provide a wide variety of services and programs that serve individuals, groups, people of all ages with a continuum of activities that range from self-directed to highly structured, and from those that are “basic” and 100% subsidized to those that are “highly individual” and 100% covered through fees that meet specific citizen demand. Premise: As services and programs become more specialized, and the placement within the continuum becomes more discretionary, fees increase accordingly. Basic services such as the provision of safely maintained parks, recreation center and senior center buildings, facility planning, the provision of basic equipment/furniture for general use are offered at no charge. Premise: Services that are highly individualized and/or discretionary for the individual or group will have fees that cover all direct costs and a portion of the cost to coordinate the program. Examples include leisure interest classes (aerobics, ceramics, karate, etc.), sports leagues, shelter rentals, swim teams. Pricing of services is based on the level of use over and above the basic services. Fees are charged when:

    • Reservations are desired versus general public “non-guaranteed” access • The program or service uses consumable materials • Programs or services require preparation, set-up/clean-up that is outside normal operations. • Programs or services require the payment of overtime to staff. • Programs or services require the use of contract labor. • Programs or services require specialized equipment.

    The Core Services Model Parks and recreation programs are based upon a broad supporting base of core services, and enhanced with more specialized services as resources allow. This philosophy can be graphically represented by a pyramid. BASIC Community Benefit – The foundational level of the pyramid includes those programs, facilities and services that benefit the community as a whole. These programs, facilities and services can increase property values, provide safety, address social needs and enhance quality of life for residents. The community generally pays for these basic services through taxes. These services are offered to residents at no fee. Example: park maintenance, open gym. MERIT Community Individual Benefit – The second and smaller level of the pyramid represents programs, facilities and services that provide recreation skill development and promote individual physical and mental well-being primarily in a group setting. They are generally the more traditionally expected services and beginner instructional levels that are self-paced and where everyone plays. These programs, services and facilities are typically assigned fees based on the specified percentage of direct and program coordinator costs. These costs are typically and partially offset by both tax subsidy to account fort the community benefit and participant fees to account for the individual benefit. Example: weight rooms, recreation/senior center operations, afterschool program. ENHANCED Individual Community Benefit – This level of the pyramid represents services that promote individual physical and mental well-being, and provides an intermediate level of recreational skill development. This level provides more individual benefit and less community benefit and should be priced accordingly. The individual fee is higher than for programs and services that fall in the lower pyramid levels. Example: Senior dances, swim lessons, Club Rec Summer Program. SPECIALIZED Mostly Individual Benefit – The fourth level of the pyramid represents specialized services generally for specific individuals and groups, and may have a competitive focus. In this level, and in a more individualized group setting, programs and services may be priced to recover full cost, including all direct and program coordinator expenses. Example: Leisure Interest classes, adult sports leagues. ENTERPRISE Highly Individual Benefit – At the top of the pyramid, this level represents activities that have a profit center potential, and may even fall outside of the core mission. In this level programs and services should be priced to recover full cost plus a support other programs. Example: Shelter rentals, private swim teams, daycare.

    EXHIBIT A

    Explanation of Terms and Implementation Guide Administration Fee. A non-refundable fee charged for costs incurred in processing certain program registration and facility reservation requests. (Not applicable to “no fee” classification facility reservations, authorized reciprocal uses as defined in approved Inter-Local Agreements, and other “no fee” permit activities defined in the El Paso Municipal Code, Section 13.24.) Alcohol. Alcohol is allowed in accordance with 13.24.120 through 13.24.180 of the El Paso Municipal Code. Any person wishing to have alcohol at their event must obtain proper permits and be at least 21 years of age. Cancellation Policy (Facility Rentals). It is intended that facilities not be reserved “just in case”, and then be released too late for use by others. • Fees paid to-date will be refunded, except for the administration fee, for cancellation of a facility use

    permit thirty days or more in advance of the use date. • Fees paid to-date will be forfeited for cancellation of a facility use permit less than thirty days of the

    permit use date. NOTE: The reservation may be transferred to an alternate date at the same facility or a different but comparable facility (if available) within 3 months of the original date. A $7 administration fee will apply to the new permit. Community Organizations or Non-Public Entity. Four or more residents that are engaged in self-directed activities taking place inside a recreation or senior center during normal operating hours. Activities may include but not be limited to: social clubs, crafts, or sewing groups. Concessions. Food concessions are provided at various outdoor sports and park facilities during organized activities. Concessions are obtained through the City’s procurement process and are categorized by the size and scope of the service area. Regional and community level parks are categorized as “large” concession areas; neighborhood parks as “medium” areas; and other areas with a minimal amount of facilities and activity are categorized as “small” areas. Credit Card Fee. A percentage will be charged to participants using credit cards to pay for program fees and facility charges to offset the City’s cost to process credit card transactions. Daily Use Fee. An admission fee is available for one time, single use only. Daily use fees may be used to participate in a leisure class to introduce the participant to the class (see Leisure Interest Daily Use fee). Daily use is only applicable if the activity has capacity for single use participants. Daily fees are used in conjunction with programs, activities and classes, not facility rentals. Drop-in. Refers to casual, unregimented recreational activities without charge on a first come, first served basis, without having reserved the facility or space in advance. Advance reservations, however, have a higher priority and displace drop-in uses. • Commercial use (as defined in Exhibit “B”) is not permitted on a drop-in basis. • Facilities unavailable for drop-in use are shelters, public swimming pools, kitchen facilities,

    designated game fields, and other facilities.

    Facility Use Permit Payment. Payment for rooms, shelters, plazas, gymnasiums and other facilities are due on the following schedule: • Reservations made 31 days or more in advance require the payment of no less than 50% of the total

    cost to hold the reservation. The balance is due no later than 30 days in advance of the reservation. Any balance must be paid in full with either cash, check or credit card or the reservation will be cancelled.

    • Reservations made 30 days or less prior to the reservation date require the payment of 100% of the total cost to obtain the reservation, or the reservation will not be taken. No personal checks are accepted less than 30 days prior to the reservation.

    • For requests outside of normal operating hours, no reservations will be taken under two weeks in advance of the reservation date. No personal checks will be accepted and no security services are available for requests made less than two weeks in advance of the reservation date.

    • Sports practice permits (see Sports practice permits)

    Game Field (Sports). Sports fields that are used exclusively for competitive events or activities. These outdoor fields receive a higher level of maintenance and are intended to be used for events that may result in a positive economic impact to the City. Local activities, such as league games, may take place on the game fields, but permits are not issued for practice activities or informal play. Designated game fields: Marty Robbins Sports Complex, Northeast Regional Complex, Blackie Chesher Sports Complex, Westside Sports Complex. Gymnasium Categories. These specialty facilities are classified by general size to be consistent citywide and to match the fee to the quality of the amenity. Small Gyms: Square footage – 1800-2499 – Seville, Leona Ford Washington, Auxiliary gyms at Galatzan, Veterans, and Pavo Real. Medium Gyms: Square footage – 2500-3999 – Armijo, Multipurpose, Nolan Richardson, San Juan Recreation Center, Auxiliary Gyms at Gary del Palacio and Westside. Large Gyms: Square footage – 4000-5999 – Pavo Real, Auxiliary gyms at Nations Tobin and Acosta Extra Large Gyms: Square footage – 6000+ – Carolina, Gary del Palacio, Veterans, Westside, Galatzan and Marty Robbins. Late Fee. Late fees are primarily applied in the daycare program. Any late fees that are applicable to facility reservations will be clearly indicated on a facility use permit. Leisure Interest Class. A structured program with a qualified instructor that is compensated commensurate with qualifications through an independent contract. Participants must register and pay for the class prior to its start, and minimal enrollment must be achieved, or the class may be subject to cancellation by the City. Classes may vary in frequency and length as needed and fees will vary accordingly, set by approved formula. Leisure Interest Class Daily Use Fee. Daily use fees may be used to participate in a leisure class to introduce the participant to the class. The daily use fee is only applicable if the activity has capacity for single use participants. The daily use fee for classes may be applied to the class registration fee only if there is capacity in the class. No class proration is available with the application of the daily use fee. No administration fee is charged with daily use fees. No refunds are issued to daily users. Multiple Child Program Discount. For families with more than 1 child participating in the same Parks and Recreation program, a 10% discount will be applied to each child within that family that registers for the program. Only siblings within the same family are eligible for the discount. Example: The Smith family has 4 children registering for a karate class. Standard fee is $20/month per child. Total standard fee for the family would be $80. Discounted fee would be $72 for the family, equivalent to $18/month per child. This discount does not apply to daycare services and afterschool program.

    Non-Profit. Applies to an organization or group that is registered with the city’s charitable solicitation committee and to any person, group or organization, recognized as a non-profit organization under the laws of the State of Texas, or which has been given tax exempt status under section 501(c)(3) of the United States Internal Revenue Service, or both. Proof of non-profit status or intent may be required by the City for the completion of a facility reservation use permit. Non-profit classifications receive a 20% discount on rentals. Out of Pocket Costs. Refers to expenses caused by a rental or use that require additional funds not budgeted by the department for the specific use. These may include but are not limited to additional staff costs, additional security, janitorial, or equipment costs not necessarily included in the program or facility fee. Permittee. Any person over the age of 18 may be granted a facility use permit providing that all contractual stipulations are met and appropriate fees are paid. For uses that will have alcohol present, the permittee must be 21 years of age. Prime Time Reservation Hours. Refers to “high use” time in the facilities. Prime time is Monday through Friday 5PM-1AM and Saturdays, Sundays and Holidays. Higher fees may be charged during prime times. Priority Use. City programs, activities, leagues, tournaments, and City operated events take priority at all Parks and Recreation parks and facilities. Others wishing to use or rent Department facilities shall follow the use priorities set in Section 13.24 of the El Paso Municipal Code. Proof of Residency. Proof of residency may be required to determine program eligibility and/or applicable fee: (See also “resident” below.) • Residency for class and activity registration may be established by a City of El Paso water bill, in the

    name of the applicant to confirm residential trash collection, or a bank check with a residential City of El Paso address.

    • Residency for a facility reservation is established when the following conditions are satisfied, and verified with the City’s database system:

    1. An El Paso resident initiates the reservation request; and 2. The check for payment has the address of the person responsible for initiating the request,

    including driver's or business license verification with payment; or 3. City service (i.e., residential trash collection) or property tax payment verification is provided

    by the permittee. Rates: • No fee will be applied when the permittee does not pay for the program, service or facility. A facility

    use permit shall be issued indicating any terms and conditions required by the use. No fees will be charged for the permit. Administrative fees do not apply.

    • Standard rate will be applied when the permittee is not charging a fee or requiring a donation for admission to the event or program in question.

    • Non-profit will be applied when the permittee is registered with the city’s charitable solicitation committee, as outlined in Section 5.24.030, El Paso City Code, and is not charging a fee or requires a donation for admission to the event or program in question. Also applies to any registered person, group or organization, recognized as a non-profit organization under the laws of the State of Texas, or which has been given tax exempt status under section 501(c)(3) of the United States Internal Revenue Service, or both.

    • Non Resident Fee. A fee which is charged to a non-resident for reservation and use of El Paso Parks and Recreation Department facilities and services.

    • Commercial rate means an individual, organization or group that charges a fee or requires a donation for admission to the event or program in question.

    Refund Policy (Program). Once a participant has begun participation in a program, no refunds will be given. Refunds will only be issued when the cause of the program cancellation was initiated by the City.

    Regular Use. Applied to an indoor facility reservation request during normal operating hours at a facility. It is intended that facilities allow for a balanced "mix of uses", and that one group not monopolize facility space with multiple uses. Guidelines for regular use customers are: • Booking limits for standard, non-profit, and non-resident uses will be 10 uses in a 12 month period,

    twelve months in advance. • Booking limits for commercial use will be 5 uses, in a 12 month period, six months in advance. • Booking limits for free use are not in effect except that groups desiring free use of indoor facilities

    must comply with the El Paso Municipal Code section 13.24. Rental Day - Gymnasium. A day is defined as more than a 12 hour period. Any use less than 13 hours will be charged at the hourly rate. A rental day is used in conjunction with a gymnasium, not a program or activity. Rental Day – Shelter/Reserve/Pavilion/Skate Park. A day is defined as more than an 8 hour period. A rental day is used in conjunction with a Shelter, Reserve, Pavilion, or Skate Park, not a program or activity. Rental Day – Sports Fields. A day is defined as more than a 10 hour period. Any use less than 11 hours will be charged at the hourly rate. A rental day is used in conjunction with a sports field, not a program or activity. Resident. A person is considered a resident of El Paso by maintaining a residence, or owning property or a business within the city limits of the City of El Paso. Residency may need to be established during the facility reservation process. See also “proof of residency”. Sports Practice Permits. Permits for practice activities on sports fields are available through the City’s Sports Office. Permits are issued for a period of 90 minutes and are limited to reservations 2 weeks in advance. Individuals are limited to 4 practices on one field within the 2 week period. Senior Citizen. A senior citizen is defined as an individual 60 years and older for parks and recreation fees and charges policies. Senior citizens may be eligible for certain discounts and may be required to show proof of age. A 50% discount will be applied to leisure interest programs provided by the Parks and Recreation Department, and admission to City weight rooms, billiards, and boxing (except daily fee). The Senior discount does not apply to facility rental, adult sports leagues (including senior leagues), swim programs, or special community events. Weight Room Categories. These specialty facilities are classified by general size to be consistent citywide and to match the fee to the quality of the amenity. Small Weight Rooms: 4 or less pieces of equipment in one room. - Eastside Senior Center, Leona Ford Washington. Medium Weight Rooms: Weight machines, free weights cardiovascular, other miscellaneous equipment located in one room. – Armijo, Carolina, Galatzan, Hilos de Plata Senior Center, Multipurpose, San Juan Recreation Center. Large Weight Rooms: Cardiovascular, weight equipment, and free weights in room(s) designed for this use. - Gary del Palacio, Marty Robbins, Westside, Veterans. Youth. A youth is defined as an individual 17 years and younger. Youth may be required to show proof of age.

    Charge Classifications for Indoor and Outdoor Facilities

    Standard Rental Rate Classification The standard rental rate classification is the “base” fee for a facility. Other fee classifications are based on the standard fee. The standard fee is based on the square footage of the room or area. A $.20 per square foot divided by 8 hours calculation is used. Exceptions to the calculation: • Gymnasiums and auxiliary gymnasiums • Shelters, reserves, pavilions, and skate parks • Weight rooms • Pools • General admission or flat rate charges, i.e. fee for lap swim, boxing room, kitchen rental, and sports

    field practice. Non-Profit Rental Rate Classification Applies to an organization or group that is registered with the city’s charitable solicitation committee and to any person, group or organization, recognized as a non-profit organization under the laws of the State of Texas, or which has been given tax exempt status under section 501(c)(3) of the United States Internal Revenue Service, or both. Proof of non-profit status or intent may be required by the City for the completion of a facility reservation use permit. Non-profit classifications receive a 20% discount on rentals. Non Resident Rental Rate Classification A request to reserve or use an El Paso Parks and Recreation facility or equipment is subject to a Non-Resident rate charge as shown in Exhibit “A”, unless the No Fee or Commercial Fee classification is more appropriate. A person is considered a resident of El Paso by maintaining a residence, or owning property within the city limits of the City of El Paso. Residency may need to be established during the facility reservation or program registration process. The non-resident rate calculation is 25% more than the standard rate. Commercial Rental Rate Classification The commercial rental rate (including adherence to City of El Paso permit requirements) applies to requests for use by any person, group or organization whose intent is to conduct business or an activity for economic profit in or upon the facility, whether or not income is realized, directly or indirectly, such as but not limited to: • An event encouraging public participation for which a fee is charged. • A fund raising activity for profit (i.e., an auction, corporate sports challenge, etc.). • An activity, with or without an entry fee, allowing for immediate or future profit (i.e., estate planning,

    investment education or counseling, sales promotion, personal trainer and instructor, etc.). • An event managed or administered by a promoter (i.e., concert, competition activity, etc.). For City swimming pools, boxing rooms, gymnasiums, and other facilities, commercial use can only be scheduled outside of normal public operating hours. Commercial rates are calculated at four times the standard rate.

    No Fee Classification Applies only to meeting rooms at Parks and Recreation facilities and does not include staffing, or other “out-of-pocket” costs. A no fee permit shall be issued. The administrative fee does not apply. • City funded activity or event. • Public meetings with Federal and State Congressional Representatives. • Recognized Neighborhood Association. The activity must be for association business and be held

    during regular facility operating hours. • Reciprocal use or benefit provided for in an Inter-Local or in a City authorized agreement. • Community organizations or non-public entities using facilities during normal operating hours as

    defined by Section 13.24 of the El Paso Municipal Code. • Drop-in use of facilities on a first come, first served basis.

    Formula Schedule for Programming, Activity and Event Fees The formulas indicated below specify how fees are to be determined for programs and activities offered that are not specifically listed on Schedule C. The formulas relate directly to the City’s costs for providing the activities. Program staff costs include related benefit costs. The factor to recover the cost of the program coordinator varies with the type of program and is consistent with the core services model (pages 4-5). Three cost recovery factors are used. (1) A factor of zero is used with the merit, core programs that benefit the general community. Examples include community special events and “mini-sports” programs for youth ages 4-7. (2) A factor of 25 is used with the programs that have mostly community benefit, but some individual benefit. Examples include learn-to-swim classes and Leisure Interest classes. (3) A factor of fifty is used with enhanced and specialized programs that have more benefit to the individual. Examples include adult sports leagues and off-site excursions. Aquatics - Class. Learn-to-Swim, Water Aerobics, Junior Lifeguard. • Total cost for the program staff, lifeguard, instructor, supplies and equipment, plus a 25% factor to

    recover program coordinator costs, divided by the minimum number of expected registrations. Administration costs are included in the per person registration fee.

    Community Special Event Entry. Entry fees for special community events, or other periodic events are based on event’s expenses and expected number of participants.

    Dances/Entertainment (on-site). • Total cost for the program staff, contracted service, supplies, equipment, plus a 50% factor to recover

    program coordinator costs, divided by the projected number of participants. EXAMPLE (Senior Dance)

    Sports – Adult Leagues. Governing body fees are charged per team annually. For adult sports leagues, officials are paid by teams on the field/court. All Adult Sports programs will be allocated a 50% factor to recover program coordinator costs. Adult softball, basketball, volleyball, indoor soccer, flag football, in-line hockey, kickball, and other organized sports: cost for a site specialist, recreation leaders, balls and awards, plus 50% factor to recover program coordinator costs, divided by the number of expected team registrations for a division.
