It is recalled, however, that on 1 January 2018, the IB’s telecommunication service provider ceased to provide analogue lines, and the IB was obliged to move to Fax Over Internet Protocol (FoIP) technology (see PCT Newsletter No. 12/2017). Unfortunately, this technology carries the possibility of partial or total loss of the transmission while still indicating success to the sender. It should also be noted that some IP Offices have either ceased to accept fax transmissions, or have indicated that they intend to do so in the near future. Consequently, the IB has consulted 1 with Offices in their capacity as receiving Office (RO), International Searching Authority (ISA) and International Preliminary Examining Authority (IPEA) and/or designated or elected Office, as well as certain non-governmental organizations representing users of the PCT System, to propose that the IB cease accepting PCT-related documents submitted by fax, as well as cease sending communications by fax. The responses received generally acknowledged the need to close down the fax service. However, a concern was expressed by users that no longer accepting fax transmission would result in the loss of an alternative communication means that is not reliant on an internet connection. In this regard, the IB will continue to work with PCT Contracting States towards ensuring that appropriate safeguards are available to users in the case of outages in electronic filing servers and unavailability of internet services. In order to give users more time to transition to using the ePCT system, the IB will continue to operate fax services, at least until the end of February 2019. The exact date from which fax documents will no longer be accepted will be notified before the end of January 2019. A document upload service will also be deployed shortly that will allow the upload of PDF documents, including new international applications or post-filing documents, without having to sign in to a WIPO Account. Unlike fax services, it will provide secure transmission of documents, though without any of the additional benefits and validations offered by the ePCT system. This document upload service has been developed primarily as a contingency service in the event that the ePCT system is not available. Future Decommissioning of Fax Transmission at the International Bureau and Transition to Using the ePCT System The International Bureau (IB) currently accepts the filing of documents by fax. The new document upload service will be deployed in demo mode during the second half of November 2018; a production version is expected to be available at the beginning of December 2018.

It is recommended that applicants keep themselves updated with the latest information on communications services with all the Offices that they use. Information on what form(s) of telecommunications an Office will accept is included in the relevant part of Annex B of the PCT Applicant’s Guide.

Electronic Filing and Processing of International Applications

Registry of Industrial Property (Costa Rica) to begin receiving and processing international applications in electronic form

The Registry of Industrial Property (Costa Rica), in its capacity as receiving Office, has notified the International Bureau (IB) under PCT Rule 89bis.1(d) that it is prepared to receive and process international applications in electronic form with effect from 1 December 2018.

The Office will accept international applications filed in electronic form using ePCT-Filing. The applicable electronic filing fee reductions listed in item 4 of the Schedule of Fees are indicated in Fee Table I(a).

The notification containing the requirements and practices of the Office with regard to the filing of international applications in electronic form will be published in the Official Notices (PCT Gazette) shortly at:

PCT Patent Prosecution Highway (PCT-PPH) Pilots

New two-way PCT-PPH pilot program (Chile and United States of America)

A new PCT-PPH pilot program began on 1 November 2018 between the National Institute of Industrial Property of Chile (INAPI) and the United States Patent and Trademark Office (USPTO). Under this pilot, accelerated processing in the national phase in Chile and/or the United States of America is available on the basis of a PCT application with a positive written opinion from either the International Searching Authority (ISA) or the International Preliminary Examining Authority (IPEA), or a positive international preliminary report on patentability (IPRP) (Chapter II), issued by the other participating Office in its capacity as ISA/IPEA. Note that the program is also available on the basis of national work products.

New one-way PCT-PPH pilot program (Eurasian Patent Office and the Republic of Korea)

On 1 January 2019, a new one-way PCT-PPH pilot program will start between the Eurasian Patent Office and the Korean Intellectual Property Office (KIPO). Under this program, accelerated processing in the regional phase before the Eurasian Patent Organization is available on the basis of a PCT application with a positive written opinion from either the ISA or the IPEA, or a positive international preliminary report on patentability (IPRP) (Chapter II), issued by KIPO in its capacity as ISA/IPEA. Note that the program is also available on the basis of national work products.

WIPO Digital Access Service for Priority Documents

European Patent Office

On 1 November 2018, the European Patent Office (EPO) started participating in the WIPO Digital Access Service for Priority Documents (DAS) as both a depositing Office and an accessing Office. However, for the time being, DAS is available at the EPO only for European patent applications and for international applications entering the European phase before the EPO as designated or elected Office. Note that while DAS is not currently available for international applications, the EPO intends to implement DAS in respect of international applications in the near future.

Non-Working Days at the International Bureau and Publication Schedule at the End of this Year The non-working days at the International Bureau (IB) during December 2018 and January 2019, in addition to the weekends, will be:

Publication schedule

During the forthcoming holiday period, there will be no changes to the publication schedule for PCT applications. They will be published, as usual, on Thursdays (that is, on Thursday, 27 December 2018 and Thursday, 3 January 2019), and there will be no change to the deadlines for receipt of changes which should be taken into account for the purposes of international publication (which will be at midnight (CET) on, respectively, Tuesday, 11 December 2018 and Tuesday, 18 December 2018).

Uganda Registration Services Bureau to Act as Receiving Office On 24 October 2018, the Uganda Registration Services Bureau (URSB) notified the International Bureau (IB) that it now acts as receiving Office for nationals and residents of Uganda. This means that nationals and residents of Uganda now have the choice of filing with URSB, the African Regional Intellectual Property Organization (ARIPO) or the IB as receiving Office. Information on the requirements of the Office in its capacity as receiving Office will be published in Annex C of the PCT Applicant’s Guide as soon as the relevant information is available.

Practical Advice

Translation of the written opinion/IPRP Chapter I

Q: I have filed an international application in Chinese, and have already received the written opinion established in Chinese by the National Intellectual Property Administration, PRC (CNIPA) as International Searching Authority, and will not be filing a demand for international preliminary examination. I am trying to prepare the international application for early entry into the national phase before a number of designated Offices and would like to know whether I will receive a translation of the written opinion of the International Searching Authority into English, and if so, when?

A: It is recalled that, unless the applicant has filed a demand for international preliminary examination and an international preliminary examination report (IPER) has been or is to be established, the International Bureau (IB) establishes, in accordance with PCT Rule 44bis.1, a report containing the same contents as the written opinion of the International Searching Authority (ISA), entitled the “international preliminary report on patentability (Chapter I of the Patent Cooperation Treaty)”, or IPRP Chapter I. Normally, the IB communicates that report to each designated Office (in accordance with PCT Rule 93bis.1), but not before the expiration of 30 months from the priority date. However, where the applicant makes an express request to a designated Office (under PCT Article 23(2)) to enter the national phase early, the IB communicates a copy of the written opinion established by the ISA under Rule 43bis.1 to that Office upon the request of the designated Office or of the applicant.

According to PCT Rule 44bis.3(a), any designated State may, where an IPRP Chapter I has been issued in a language other than the official language, or one of the official languages of its national Office, require a translation of that report into English. In your case, given that the written opinion that has been established in respect of your international application is in Chinese, any designated Office where Chinese is not an official language may require a translation into English. If such a translation is required, it will be prepared by, or under the responsibility of the IB (PCT Rule 44bis.3(b)), upon request of the designated Office concerned. There is no extra fee payable to the IB for the translation of the written opinion into English, as the costs for this service are covered by the international filing fee.

Under normal circumstances, a copy of the translation of the IPRP Chapter I is transmitted to any interested designated Office (and to the applicant) at the same time as the IB communicates the IPRP Chapter I in its original language to the Office(s) concerned, that is, not before the expiration of 30 months from the priority date. However, if you are going to make an express request to a designated Office or designated Offices for early entry into the national phase under PCT Article 23(2), the written opinion will, upon request of a designated Office, be translated into English by or under the responsibility of the IB (PCT Rule 44bis.3(d)). Please note that there is no provision for you, as applicant, to request such an early translation of the written opinion directly from the IB.

The IB will transmit a copy of the translation to the designated Office(s) concerned within two months from the date of receipt of the request for translation (PCT Rule 44bis.3(d)), and you will receive a copy of that translation at the same time, together with Form PCT/IB/310 (“Notification concerning documents transmitted”).

For information on translations of the IPER or written opinion of the ISA where a demand for international preliminary examination has been filed, please refer to PCT Rule 72.

PCT Fee Tables(amounts on 1 November 2018, unless otherwise indicated)

The following Tables show the amounts and currencies of the main PCT fees which are payable to the receiving Offices (ROs) and the International Preliminary Examining Authorities (IPEAs) during the international phase under Chapter I (Tables I(a) and I(b)) and under Chapter II (Table II). Fees which are payable only in particular circumstances are not shown; nor are details of certain reductions and refunds which may be available; such information can be found in the PCT Applicant’s Guide, Annexes C, D and E. Note that all amounts are subject to change due to variations in the fees themselves or fluctuations in exchange rates. The international filing fee may be reduced by CHF 100, 200 or 300 where the international application, or part of the international application, is filed in electronic form, as prescribed under Item 4(a), (b) and (c) of the Schedule of Fees (annexed to the Regulations under the PCT) and the PCT Applicant’s Guide, paragraph 5.189. A 90% reduction in the international filing fee (including the fee per sheet over 30), the supplementary search handling fee and the handling fee, as well as an exemption from the transmittal fee payable to the International Bureau as receiving Office, is also available to applicants from certain States—see footnotes 2 and 15. (Note that if the CHF 100, 200 or 300 reduction, as the case may be, and the 90% reduction are applicable, the 90% reduction is calculated after the CHF 100, 200 or 300 reduction.) The footnotes to the Fee Tables follow Table II.
