1 Subject Land

This control applies to land on and adjacent to Foxhow Road, Foxhow as shown on the attached alignment and drainage plans 591209 and 591208.

2 Control

Despite the provisions of Clause 52.29 of the Corangamite Planning Scheme, no permit is required to create or alter access to Foxhow Road if the access is associated with the Foxhow Road Re-alignment Project.

3 Foxhow Road Re-alignment Project

The Foxhow Road Re-alignment Project comprises:

• Clearing of site, stripping and stockpiling of topsoils within the construction area for use in final landscaping works.

• Construction of approximately 1200m of new road and pavement commencing at the bridge over Gnarkeet Chain of Ponds Creek, Foxhow

• Installation of culverts and related drainage works • Minor widening and realignment of Robertson Street to improve junctions with Foxhow Road

and Collins Lane • Truncation and closure of Collins Lane just north of where it intersects with the new alignment

of Foxhow Road. • Any associated works.

4 Expiry

This control expires if the development allowed by the control is not commenced within 2 years of the approval of this document.
