    In an effort to answer a FOIA request, I am requesting that all TICTU employees and contractors immediately do a word search of their e-mail system (active and archived records) for the term "DCS-3000" and "DCS 3000" and "pCS3000'' (variations of the same term).     I realized Friday night that there was an error in the numbers I provided you last week.     Last week the Office of Management and Budget (OMB) released a DRAFT of it's Fiscal Year 2008 OMB Circular A-11, Section 300.     Last week the Office of Management and Budget (OMB) released a DRAFT of it's Fiscal Year 2008 OMB Circular A-11, Section 300. It contains OMB's DRAFT instructions for completing the FY08 OMB Exhibit 300. While this is not the final/approved A-11 update for FY08, it will give you an idea of what OMB will be looking for this year.

    According to DOJ, the next OMB update will be released the week of 29 May 06. DOJ expects this update to include the 99% solution for both the FY08 OMB Exhibit 300 as well as the FY08 OMB Circular A-11. As soon as we receive these materials we will send them on to you.

    After consultation with AUSA Ko, I have confirmed that in light of the below complications/issues he will not be calling any witnesses in any way connected to the Tech Program. So we can stand down. Sorry for all the controversy, upheaval, and/or confusion.

    Just to clarify though, the AUSA was not, as the below email suggested, seeking "an expert witness from ITD-ERF to testify about the DCS-3000 network" and all it's features, bell and whistles, etc. That was not the intention. No testimony of such was going to be elicited. He was merely seeking a way to establish/substantiate a foundation in open court, through a lay witness if possible, that the FBI intercepted the proper celt phones pursuant to the court orders, so that the intercepted conversations could be authenticated in court as "accurate" and lawful.

TTf\ Jrgfluest is reasonable and the decision of whether or not ronave the circuit installed is a decision to be madejn ind IDivision. TICTU has been working on a dial up connection for| pivision whereby the data from] Iwould get to thd I office via a daily dump. Check with TTAI t>n theslatus of that. A dial up daily dump is proDably the least expensive means of getting the data into the TA at the] pffice. I recommend that your Technical Advisor discuss the merits of paying for a more expensive circuit with the Supervisor of the squad with the case on which the pen is running. The decision to build, and pay for, a special circuit for this type matter should take into account the seriousness of the case involved, the target, etc., and is usually a joint decision made between the Case Agent, Supervisor and the TTA. Costs of a circuit of this type are typically paid from Division case funds. Hope this answer helps.
