FIRST NATIONS YOUTH INQUEST:
Why We’re Late with the Two Year Report Card
1. The parties agreed to file their annual progress report by the endof June. Canada did not provide us their report until late July,
and Ontario not until August 14th.
2. The delay in getting responses pushed our process into the fall,and we were very busy with other matters in late September and October.
3. As we were getting ready to present the report card in lateNovember, we became aware that the OIPRD Report on the
Thunder Bay Police Service would be released in early December -we felt it was best to wait.
4. Once the OIPRD Report came out, we needed to speak with ourclients to get their comments and instructions.
If parties meet their deadlines for filing their Year 3 progressreports by the end of June, we will issue a Year 3 Report Card in
August or September this year.

GRADING SYSTEM OVERVIEW
Purpose: Purpose is to quantify the progress of each organization.
Each organization will receive a % based on the actual progress
compared to the expected progress of each project.
Percentages will be found using a points system to compare the recommendedduration with the actual progress of assigned projects.

THUNDER BAY POLICE SERVICE
There were 10 recommendations directed to the TBPS, some hadmultiple sub-recommendations.
TBPS has been very diligent in addressing the recommendations.
In December 2018, the Office of the Independent Police ReviewDirector (OIPRD) released Broken Trust - Indigenous People
and the Thunder Bay Police Service.
The report specifically looked at the TBPS’ investigation of four ofthe deaths examined at the inquest:
Jethro Anderson (M.N. in the report)OIPRD Concluded:
“We do not know how M.N. came to his death. We do know that wecannot solely rely on the investigation that has been conducted to date
in determining how he came to his death or an evaluation wethercriminal charges are warranted. A reinvestigation is necessary.” (p. 142)
Curran Strang (O.P. in the report)OIPRD Concluded:
“The requirements laid out in the Adequacy Standards of Ontario forthe investigation of suspicious deaths were not fulfilled here.” (p. 145)
Kyle Morrisseau (Q.R. in the report)OIPRD Concluded:
“Many investigative steps called for in this ‘suspicious death’ investigationwere not completed as mandated by Adequacy Standards and best practice.
As such, TBPS is not in a position to rule out foul play in this death.Therefore, it should be reinvestigated.” (p. 148)
Jordan Wabasse (S.T. in the report)OIPRD Concluded:
“Based on Police Adequacy Standards for the Province of Ontario,including the requirements of the Criminal Investigation Management
Plan, this investigation was incomplete and should be reinvestigated.” (p.151)
More generally, the OIPRD concluded:
“The failure to conduct adequate investigations and thepremature conclusions drawn in these cases is, at least in part,attributable to racist attitudes and racial stereotyping.” (p. 182)
The jury at the inquest was not able to look at the adequacy of theinvestigations into the deaths of the seven youth, nor was it able to probe
into the extent to which racism - direct and systemic - had an impacton the work of the TBPS. If they had known then what we know now,it is obvious that they would have made additional recommendations
involving the TBPS.
Under these circumstances, we have decided to not give a grade to theTBPS with regard to its work on addressing the jury’s recommendations.
We are keeping track of their progress and it is contained in the supporting documents that are available on our website. We have also considered the work of the TBPS when calculating the overall grade for all the parties in
meeting the jury’s recommendations.
When the Thunder Bay Police Service has completed its work ingaining the trust of the Indigenous community in Thunder Bay,
we will return to provide a grade for the work of the Service.
