Motiva’s Life Saving Rules aim to prevent harm to people. These rules are applicable to everyone that enters a Motiva facility and are mandatory. Failure to comply will result in disciplinary action up to and including removal from site and disqualification from loading at any Motiva terminal.

Life-Saving Rules – Truck Drivers

While all the Life-Saving Rules apply and are mandatory, truck drivers must pay particular attention to the following rules.

SAFETY PROCEDURES

The handling of petroleum products presents potential dangers and risks. These products can be handled safely and without incident. This is proven thousands of times daily. Never forget safety. Never get careless or indifferent while loading, transporting and unloading these potentially hazardous products. Please abide by the safety rules and keep them constantly in mind. Please note these are the minimum requirements for all Motiva terminals and refer to site-specific guidelines for additional requirements.

1. DO NOT proceed to a loading position until it is vacated. Wait at the STOP LINE.

NOTE: Trucks blocking fire lanes will be directed out of the loading area. Before proceeding to a vacant spot at the loading rack, truck operator will be sure all lights, radios, cellular phones, pagers, heaters and other accessories and electrical equipment are turned off.

2. All units/trailers must be in a "ready to load" status before being spotted under the loading

rack. Motiva Terminals do not allow drivers to perform any kind of work to a delivery unit while under the loading rack. If problems with a delivery unit are detected while under a Motiva loading rack, such as issues with a sensor, dome cover, or any other defect that requires immediate attention, the delivery unit must be moved away from the loading rack before an attempt is made to correct the situation. When this cannot be done in a safe manner or creates the potential for a release by moving the unit the driver must contact a local Motiva representative for guidance.

3. If resolution of a specific problem requires going on top of the tank/trailer, exit the rack and

contact a Motiva operator. Under no circumstances are you allowed to access tops of the tank/trailer without proper fall protection at a Motiva facility.

4. Smoking, discarding, or carrying pipes, cigars or cigarettes in your hand, lighted or not, is

strictly prohibited outside the designated smoking area.

5. Carrying "strike anywhere" matches or lighters on terminal property is strictly prohibited.

6. Only approved flashlights for use around flammable petroleum products may be used.

7. Objects should not be carried in a shirt or jacket pocket since there is always the possibility that such objects will fall out when you lean over during loading or unloading of products.

8. Never use gasoline for cleaning purposes of any kind. Use only approved solvents or

washing and cleaning powders, soaps or detergents. NOTE: The servicing or cleaning of the truck while under the rack or while waiting is strictly forbidden.

9. Gasoline should not come in contact with the skin. Take special care while loading and

unloading to see that gasoline does not get on the hands or other parts of the body. If it does, wash it off immediately with soap and water. Check the SDS for proper Personal Protective Equipment.

10. All fire extinguishers must be kept fully charged and in good working order. If a fire

extinguisher has been used or partially used, it should be recharged or replaced.

Every incident involving injury, death, product release, loss of or damage to property, adverse effect on Motiva’s public image or reputation, or suspicious activity that occurs at a Motiva facility or in connection with your Company’s performance associated with Motiva must be reported to Motiva management as soon as feasibly possible. For incidents that occur after normal business hours, refer to the Terminal Emergency Contact List and notify the appropriate Motiva personnel or contact the Help Desk @ (844)577-5632. This notification is in additional to your Company’s internal reporting guidelines.

11. See local procedures for shutting down the rack in the event of an emergency (including fire).

12. All DOT requirements for transportation of hazardous materials and all other applicable

laws, rules, regulations must be met, before any vehicle is permitted to load.

13. Each unit loading in this facility is subject to a safety inspection, without notice.

Personal Protection Equipment Implementation

Motiva’s first core value is “Value and Respect All People.” One of the most fundamental ways to demonstrate this is to provide an environment that promotes safe work practices and protects all people from injuries. Our Personal Protective Equipment (PPE) policy is an important part of creating that environment. The policy serves two purposes:

• To prevent injuries, and • To enhance safety awareness for employees, carriers, contractors, and visitors.

Fall Protection No person will be allowed to climb on top of a truck tank/trailer without proper fall protection.

Head Protection

The minimum head protection at the load rack is a bump cap or a hard- plastic baseball cap liner. ANSI-approved hard hats are required in all other areas of the terminal except offices and parking lots. Note: Some sites may require additional head protection – refer to site specific rules. Eye Protection

ANSI Z87.1 approved safety glasses with side shields are required in all areas of the terminal except offices and parking lots. Brow guards are strongly recommended but are not required. Contact lenses are allowed in all areas but should not be viewed as providing any eye protection. Foot Protection Substantial footwear is required at all times. Substantial is defined as:

Leather material covering the entire foot A defined heel A non-slip, oil-resistant sole

Steel-toes are recommended but not required.

Hand Protection Personnel must wear appropriate hand protection. Chemical resistant gloves are required for handling fuel. Recommended nitrile or nitrile blends are the most resistant to gasoline and last longest before degrading.

In addition, appropriate work attire will also be required.

MOTIVA ENTERPRISES LLC LOADING INSTRUCTIONS/PROCEDURES

1. At entry gate STOP (card in). Seatbelts must be worn on Motiva property at all times while the truck is in motion.

2. Do not allow other vehicles to enter the facility behind your vehicle (no piggy backing).

3. Maximum speed in the Terminal – 5 MPH.

4. Turn off all electronics (CB radios, cell phones, Bluetooth devices, GPS, radios, etc.) before

entering the Terminal.

5. No use of cellular phones (including Bluetooth devices) or pagers under or near the loading rack, at any time. Refer to site-specific rules for additional guidance.

6. Be alert for any warning lights or alarms before entering the Terminal.

7. When staging to load, stop; turn off all lights (except daytime running lights BEFORE

entering the loading area. No Idling truck. Turn engine OFF when rack is occupied.

8. Do not start or move vehicle to loading position if there is evidence of a product release.

9. When rack is clear, start engine, pull forward and spot truck for loading.

10. Never, back into the loading rack beyond designated backing signs. Back, ONLY, with assistance.

• Applicable to Providence terminal only: Partially backing into Tractor-Trailer loading lanes is the only practical means to safely spot a Tractor-Trailer unit and may be done without assistance. This is accomplished by pulling the Tractor-Trailer Unit approximately 1/2 to 3/4 the length of the unit past the center of the lane, then moving the unit back at a slow rate of speed to align the unit with the loading rack devices.

11. Set parking brake and shut engine off.

12. Proper PPE (refer to page 6) must be worn at all times while in designated areas.

13. Under no circumstances should the driver leave the loading area unless due to an

emergency. No one other than the driver is to be in the loading rack area except.

- An authorized instructor training that driver. - Persons authorized by Motiva Enterprises LLC who have a legitimate reason to be in

that area during the loading process.

14. No driver while loading should allow his attention to be diverted. Activities which unnecessarily divert attention from the loading procedure are:

- Eating and Drinking - Reading or Writing - Engaging in conversation which is not necessary to the loading process - Changing placards, bumping tires, cleaning windows, etc.

15. Cab doors must be closed while loading.

16. Connect independent ground, if one exists.

17. Connect Scully cable to trailer. Check for permissive green light. If green light does not come on, stop the loading process. See local instructions or check with terminal operator.

18. Connect vapor recovery hose. Close both Cam-lock levers (ears) completely on the hose.

19. Connect the appropriate loading arms. When connecting a loading arm coupler to the

trailer piping, slide the collar onto the adapter before actuating the lever that locks the collar and opens the poppet valve. Do not force the collar on with the lever cam. This damages the lever arm and shear pin.

20. Clear registers and set pre-sets for proper gallons for each compartment. The pre-set

counter must never be set to an amount greater than the legal/safe fill capacity of the compartment being filled.

21. Open internal valves only on compartment(s) being loaded.

22. “Card in” according to local instructions.

23. At each meter:

- Verify product, preset gallon amount and loading arm connection to the correct

compartment. - Actuate start mechanism. - Verify that the preset meter countdown is working properly. - Verify there are no leaks.

24. Observe slow-flow shutdown of all meters. If slow-flow does not engage, stop flow

immediately by pressing stop button on pre-set. Do not bypass slow-flow. Report any malfunction to terminal operator.

25. Close the internal valve after loading each compartment.

26. If compartment is overloaded you must immediately contact the terminal operator for site-specific instructions.

27. Report any spills or loading rack equipment malfunctions to terminal operator.

28. If any product or vapors from a release are evident DO NOT start or move your truck until

the spill is washed down. Terminal personnel MUST be notified.

29. If severe lightening is threatening the terminal’s immediate area, drivers who are currently loading will be allowed to complete their loads. No other loading shall begin until the severe lightening threat is over.

30. After loading is completed:

- Card out according to local procedure. - Disconnect loading arms and stow properly. - Disconnect vapor hose and secure to holder and lock both Cam-lock (ears). - Remove and stow Scully cable. - Remove and stow independent ground, if one exists. - Immediately look down right side of delivery unit to ensure that all loading equipment has

been disconnected and stowed in its proper position.

31. Move unit from loading rack, (Do not leave unit under rack area after loading.) Set parking brake and shut engine off.

32. Collect Bill of Lading and verify the accuracy. Sign B.O.L. and leave proper copies.

33. Use driver’s card to exit, even if gate is open.

EMERGENCY REPORTING

In case of spill or other emergency:

1. Stop flow of product by using the Emergency STOP and closing valves (if safe to do so).

Warn all drivers near loading area not to start engines.

2. If a spill occurs, contain it if possible and contact terminal operator. Any materials used

to soak-up spilled product must be disposed of properly.

DO NOT start engine or switch on lights until tank has been washed off with water and spill beneath truck is thoroughly flushed away and made safe.

DO NOT use cellular telephones

3. Report to Motiva terminal management or appropriate terminal personnel, and your Supervisor.

4. IMPORTANT TELEPHONE NUMBERS:

Meters have an emergency stop button for shut-down purposes. Also, complete rack shut-down emergency stop buttons are located at convenient positions such as the loading rack, the office and the BOL printer building.

Your supervisor may provide additional emergency numbers.

QUALITY CONTROL

A carrier's vehicle, loading distillates at a Motiva Enterprises terminal, must be guaranteed to meet certain requirements.

Prior to coming into the Motiva facility to load product, the compartments receiving product must be thoroughly drained.

GASOLINE Gasoline should not be loaded into systems equipped with manifolds.

Constant precautions are required to protect the integrity of fuels and prevent contamination with other grades of petroleum products.

MIDDLE DISTILLATES

Loading distillates into compartments that previously contained gasoline can be done safely if the necessary precautions are taken. Compartments that last contained gasoline must only load distillates using bottom loading with slow flow start and only if the vapors are controlled through a vapor recovery or vapor combustion system. Some facilities may have more stringent local regulations that may require that a compartment that last contained gasoline be cleaned or flushed with a middle distillate prior to loading diesel fuels or home heating oil. Check with the local facility management to determine the required method for switch loading at their facility.

GUIDELINES FOR TRUCK LOADING SEQUENCE

These are guidelines and the use does not guarantee products will stay free from contamination from the previous cargo.

The following chart does not address safety issues.

Trucks must meet all API RP 2003 and any applicable Shell/Motiva loading requirements.

Drivers must comply with any terminal loading agreement requirements

These guidelines do not cover all steps in the process as terminal configurations and trailer design may vary.

Carriers and drivers still have the responsibility to protect their cargos during transport from any type of cross contamination.

The following chart was generated as a result of Ultra Low Sulfur Diesel (ULSD) but also covers other product quality concerns.

The chart assumes that ULSD at the terminal will be at 14 ppm Sulfur

Empty is normally done at the location where the previous cargo was delivered.

Trailers must be empty before arriving at terminal.

While empty is acceptable for EPA Tier 2 gasoline before ULSD, Drain Dry is preferred and encouraged to protect flash.

QUALITY ASSURANCE

AVIATION FUELS – SPECIAL PROCEDURES

This Section only applies to carriers hauling aviation fuels. Aviation fuels can only be loaded on trucks meeting certain specific requirements. Only transports that meet all DOT requirements can load at Motiva terminals. It is the sincere hope that all Common Carrier and Customer vehicles loading aviation fuel at a Motiva terminal will be dedicated to Aviation Service. Any transport previously loaded with Dyed diesel, kerosene, home heating oil etc. must never load aviation products at a Motiva terminal, without first being thoroughly cleaned and dry before arriving at a Motiva terminal.

Loading more than one grade of Aviation fuel into a transport is not permitted. Loading procedures must be followed as posted or as instructed. Transports will remain under the load rack (unless otherwise instructed) with internal valves open for ten (10) minutes after loading for product settling, before performing a white bucket test.

Common Carriers are responsible for:

- Providing trucks that meet all DOT Requirements - Providing trucks in proper mechanical condition for use. - Tank cleanliness, including draining and flushing prior to arrival at the terminal. - Ensuring drivers thoroughly drain:

• Tank compartments • Lines • Meters • Air eliminators • Pumps • Hoses

Customers who arrange for their own transportation of product must fulfill all of the above responsibilities before sending a vehicle to be loaded at a Motiva load rack. In addition it is the drivers responsibility to inspect tanks for accumulations of water and other products and, if necessary, to drain and flush before arriving. Terminal operators will also check for compliance.

White bucket / Q A Test after loading Jet Fuel or Aviation Gasoline:

1. Make sure bucket is clean. Wipe out if necessary with a lint free rag.

2. Ensure driver has closed all internal valves before proceeding.

3. Fill bucket ½ to 2/3 full from compartment unloading line and let stand for about one minute.

4. Swirl the fuel gently to concentrate possible contamination.

5. Inspect the fuel for:

a. Color

• Avjet: Clear or Straw • Avgas: Blue

b. Clarity

Fuel should be clear and bright (no haze) with the bottom of the bucket clearly visible.

c. Solid particles

When concentrated by swirling should cover an area smaller than a dime.

d. Water

Should be no more than two or three very small droplets.

6. If fuel from each compartment meets requirements of step 5 the truck may depart.

7. If fuel does not meet all requirements of step 5, make another white bucket check on

the compartment.

8. If fuel is not satisfactory on third check advise terminal management. Do not proceed.

9. Product used for this test must be properly disposed of according to local

requirements.

Information about Ethanol Blended Gasoline This Section only applies to carriers hauling ethanol-blended gasoline.

Warning: It is unlawful and dangerous to dispense gasoline into unapproved containers

Gasoline is extremely flammable – Vapors may explode – Keep away from heat, sparks and flame.

Prolonged high level exposure may cause serious health problems Long term exposure to vapors has caused cancer in laboratory animals

Avoid prolonged breathing of vapors Never siphon by mouth Keep face away from nozzle and gas tank Keep away from eyes and skin Do not use as a solvent or cleaning agent Keep away from children

Gasoline available at this location contains up to 10 percent, by volume, ethanol. Review Safety Data Sheet (SDS) for more details.

Keep gasoline containers tightly closed and handle them gently to avoid spills. Check with your local government or hazardous waste disposal center to determine the proper avenues for disposing of spilled gasoline. Never dispose of spilled gasoline or cleaning materials on the ground or into your garbage, drains, toilets or sewers. If you do, it might cause a fire, or seep into streams, bays, lakes or your groundwater. (American Petroleum Institute, “Tips for Safe Storage and Disposal of Gasoline.”)

• Large ethanol releases into surface waters, such as streams, bays, or lakes could harm

or kill aquatic life, such as fish.

• If gasoline with ethanol is released into groundwater, gasoline components could spread faster and further than if ethanol were not present.

High dose animal studies have demonstrated nervous system, fetal development, systemic (i.e., generalized adverse health effects) and carcinogenic responses after repeated high level oral (i.e., drinking) or inhalation (i.e., breathing) exposures to ethanol.

• According to the New England Interstate Water Pollution Control Commission (NEIWPCC),

low-level ethanol contamination of groundwater is not expected to cause a significant health risk.

• According to the Northeast States for Coordinated Air Use Management (NESCAUM), inhalation of ethanol vapors from gasoline has little public health significance. Data suggests a greater than two orders of magnitude (100 times) safety factor between the worst case exposure in humans from inhalation of ethanol vapors from gasoline and the lowest threshold for a toxic effect in humans.

Increased use of ethanol in gasoline may result in increased exhaust emissions of PAN (peroxyacetyl nitrate), acetaldehyde, and Volatile Organic Compounds (VOCs) although the extent of such increase is unknown. PAN, which has been shown to be mutagenic in cellular research, is a known toxin to plant life and a respiratory irritant to humans. Acetaldehyde is a respiratory irritant at high levels of human exposure and is currently classified by EPA as a probable human carcinogen. VOC emissions contribute to the formation of smog. (Achieving Clean Air and Clean Water: The Report of the Blue Ribbon Panel on Oxygenates in Gasoline (9/99).

Storage Tank Water Management

According to the Renewable Fuels Association, “ethanol is infinitely soluble in water and the sensitivity of gasoline/ethanol blends to water requires certain precautionary steps to prevent phase separation. These steps include drying out storage tanks and proper preparation of retail storage tanks and dispensers. In addition, transport drivers should exercise proper precautions when making deliveries.” (Source: Fuel Ethanol, Industry Guidelines Specifications, and Procedures, Renewable Fuels Association, 12/03 update)

Handling and Receipt of Ethanol Deliveries

The Renewable Fuels Association’s document entitled: “Fuel Ethanol Industry Guidelines Specifications, and Procedures (12/03 update) provides a brief overview of considerations regarding the procedures for delivery of ethanol by barge, rail, and transport truck. The RFA advises that:

The most common method of ethanol delivery for a number of terminals is by transport truck (typically 7800-8200 gallons). While equipment suitable for transportation of gasoline is acceptable for handling ethanol, a few extra precautionary steps should be taken. Truck compartment(s) should be clean and dry before loading. Avoid contamination from water, leaded fuels such as racing gasoline/AV gas, or diesel, etc. Always ground the truck during loading and unloading operations. Hoses must be purged. It is best to have pumped ethanol or unleaded gasoline prior to pumping ethanol. Before the first delivery to the ethanol storage system, make certain that lines and pump are clean. Ethanol is a flammable liquid. Handle with the same safety precautions as gasoline. Avoid sparks and flames. It is advisable to wear safety goggles when handling ethanol. If ethanol contacts the body or face, flush with water. Use good ventilation. Avoid breathing vapors, because they can cause headaches, dizziness, and nausea. If you are delivering to a terminal not within your control, you should contact the terminal manager to verify their unloading hours and procedures. Please refer to the FUEL ETHANOL, Industry Guidelines Specifications, and Procedures, Renewable Fuels Association, 12/03 update for recommendations regarding placarding of transports. Safety glasses or goggles must be worn when handling Ethanol or Ethanol-blended products in Motiva Terminals. Motiva’s safe loading procedures must also be followed. Material Safety Data Sheets (MSDS) should also be consulted for more information. MSDSs are also available from ethanol suppliers. Since there are many MSDS’s available related to ethanol, the most recent versions should be considered. In addition, MSDS’s have been developed for both neat ethanol and ethanol/gasoline blends. Model MSDSs are available on the American Coalition for Ethanol’s website at www.ethanol.org

Fire Fighting Procedures

The Renewable Fuels Association advises:

Ethanol: Spills (less than one inch deep) can be controlled and extinguished by dilution with water but are more quickly extinguished by ‘alcohol type’ foams or dry chemical applications. Tank fires can only be controlled and extinguished by the use of ‘alcohol type’ foams.

Spill Fires: Preferred foams are polymeric ‘alcohol type’, fluoroprotein, and AFFF, in that order, for performance of blanket and security of the area. ‘Alcohol type’ and AFFF will produce most rapid fire knockdown, while the ‘alcohol type’ and fluroprotein will give the best protection against reflash. Small spill fires can be extinguished with BC extinguishers.

Tank Fires: For over the top application use ‘alcohol type’ foam or Light Water AFFF. For subsurface application, the ‘alcohol type’ foam is the preferred agent.

Burn back resistance in these applications is sometimes lowered and therefore, additional foam application after fire extinguishment is recommended. (Source: FUEL ETHANOL, Industry Guidelines Specifications, and Procedures, Renewable Fuels Association, 12/03 update.)

If possible, contaminated water runoff into surface water bodies should be prevented by containment and recovery to prevent reduced oxygen levels that could adversely affect aquatic life. In order to prevent unacceptable exposure during firefighting, Dupont (MSDS) recommends the following:

Wear full protective equipment. Wear self-contained breathing apparatus.
