N.B. Family tradition holds that this portrait shows the Archduke Joseph of Austria during his reign as King of Hungary (1687-90). The young man wears Hungarian dress, the chivalric Order of the Golden Fleece, and behind him is an idealized representation of the Crown of Saint Stephen. N.B. There is little scholarly information on James Tissot after he left London and returned to Paris in 1882. Except for the 1885-6 series of the Women of Paris, he was thought to have focused on religious works. However, in L’Artiste, 1889, reviewer F. Courboin wrote, “M. Tissot a envoyé des aquarelles très serrées et deux jolies études d’après le Fifres de Coldstream Guards.”1 This brief reference indicates that The Coldstream Guards had indeed been a subject for Tissot at some point, and he was exhibiting them in Paris in the late 1880s. N.B. The vessel pictured here was built for R.D. Shepherd in Medford, Massachusetts, in 1834. It is named for the owner’s daughter, Ellen Shepherd Brooks, whose portrait by Thomas Sully is offered in this auction as Lot 382.

This popular composition might be called a “bon voyage” image. The Ellen Brooks, having safely left Liverpool seventy miles astern, is seen off Holyhead Mountain preparing to alter course by almost ninety degrees toward the South Stack Lighthouse seen on the right. The stern view of the vessel on the right indicates she has made the change of course and is well on her way to a clear run down to Tuskar Lighthouse and the safety of the open sea.

N.B. Salmon was born in Whitehaven, but little is known about him before his move to Liverpool in 1806. It has been surmised that given his knowledge of sailing and rigging, Salmon may have spent some of his early years at sea. Although a number of paintings, all showing Salmon’s mature style, predate the 1806 move, it was at this time that the artist began the formal inventory of his paintings.

Most of the English harbor views were completed before Salmon moved to America in 1828—Salmon was driven to painting truthfully and without embellishment from life—although there are several English views from the 1840s.$8,000-12,000

N.B. The gracious home shown in this watercolor was the residence of Dr. Joseph Lowe Stevens, Sr., in Castine, Maine. The watercolor was dedicated by Fitz Henry Lane to Dr. Stevens’s son, Joseph Lowe Stevens, Jr. (1823-1908). The younger Stevens, who moved from Castine to Gloucester in 1840, became a close friend of Lane, most likely meeting the artist through the Gloucester Lyceum library, where both men were members. The friendship blossomed as Lane spent more time in Gloucester, especially after he moved into his stone house on the hill.1 In 1848, Stevens invited Lane to visit his family in Castine, a trip that would mark Lane’s first visit to the Maine coast. A new friendship blossomed between Lane and Dr. and Mrs. Stevens, Sr., and they enjoyed visits together in Gloucester and Castine. John Wilmerding writes, “During subsequent visits he [Lane] would paint many pictures of the vicinity as well as small oils of the family house and views done especially for presentation to the Stevens family.”2 Lane spent a number of summers in the 1850s in Castine, staying at the “Old Homestead,” as the Stevens’s residence was known. From the house there was a good view down to the waterfront and the bay. Joseph Stevens, Jr., would row or sail Lane to various locations in the Penobscot Bay where Lane would sketch scenes he would later turn into oils in his Gloucester studio. In 1851 Lane sketched the Old Homestead, including two watercolors of the house for Stevens, Jr.3 Lane later based an oil painting on the watercolor, including in the oil a view of Dr. Stevens approaching the house on horseback. N.B. The landscape at hand is a late work by Stephen Parrish. It is described by his grandson, Maxfield Parrish, Jr., in the inventory referenced above as, “One of his best but needs repair...Possibly Beaver Brook Road and brook north of Plainfield, north on Rte. 12A.”

By the 1920s, Stephen Parrish had stopped sending paintings to exhibitions. He sold works from home, sometimes right off the easel, but would not release them to the new owners until the paint was dry. Maxfield Parrish, Jr., went on to write that he knew of no Stephen Parrish paintings dated after 1923. The frame on the work appears to be original; it matches the one in the photograph in the inventory and bears a pencil inscription “Ann Dunn” as noted in the inventory description.

Although John Joseph Enneking was born in Ohio, he is most associated with New York and New England, where he painted evocative landscapes that combined elements of many different styles, including the Barbizon School, Hudson River School, Impressionism, and Tonalism. After serving in the army during the Civil War, Enneking came to Boston and began his studies in art before moving abroad in 1874. In France he worked with Barbizon and Impressionist masters, including Claude Monet. He returned to Boston in 1876, where he enjoyed a successful career and was best known for his plein-air woodland views.$4,000-6,000

The present work is one of several Paul Henry paintings collected by Henry Lee Shattuck (1879-1971), which includes The Bog at Evening, 1922-3, and Mountain Village, 1926-9, currently in the permanent collection of the Museum of Fine Arts, Boston. Shattuck was a notable business and non-profit leader and philanthropist active in Boston during the early to mid-20th century. He was a New Englander of part Irish descent, and supported Irish cultural exchange through his activities

with the Charitable Irish Society of Boston.1 He was also a treasurer and senior fellow of the board of Harvard University from 1929 to 1952, a member of the Massachusetts House of Representatives from 1920 to 1930, and from 1943 to 1948, and a member of the Boston City Council from 1933 to 1938.2 Today, he is perhaps best remembered as both the namesake of a public service award that honors employees of the City of Boston, and for his 300-acre woodland bequest in Medfield to the Trustees of Reservations.

N.B. According to the artist’s great-granddaughter, Frederick Judd Waugh carved this fanciful Tudor-style castle for her mother (his granddaughter). It descended in the Waugh family until 1998, when it was purchased by a collector of Waugh’s paintings. The lot is accompanied by a copy of the email correspondence that describes the provenance.

In his book Frederick J. Waugh, American Marine Painter, George R. Havens describes Waugh’s fascination with wood. Around 1914, the artist became intrigued by twisted roots and fantastic tree shapes he discovered on Monhegan. These found sculptures inspired him to create the Munes, characters in a series of children’s books that Waugh wrote and illustrated.1

The appendix of Havens’s book lists two castles made by Waugh that belonged to the family. One of cardboard and papier-mâché was made in London as a Christmas present for his children in 1904. The second was a small carved castle, 12 inches high, created about 1919.2 The castle at hand, standing 14 1/4 inches high, is presumably a third version made at a later date for his grandchild. Its design closely follows the description of the 1904 castle, with paths winding up to the buildings at the top.

N.B. Anna Hyatt Huntington was known for her works depicting animals, and she sculpted a number of Great Danes throughout her career, both in stone and in bronze. Granite versions included a pair for John Hayes Hammond, of Gloucester, presently in the collection of Brookgreen Gardens, the South Carolina sculpture garden founded by the Huntingtons in the 1930s.

The dogs presented here were recast in the 1930s without their bases. In February 1907, Hyatt traveled to France, and took a studio in Auvers-sur-Oise, north of Paris. She remained primarily in France until 1910. In 1911 she exhibited two Great Dane bronzes at the Paris Salon.$125,000-175,000

N.B. The sculpture depicts Sergeant Edgar M. Hallyburton, who was reportedly the first American soldier captured in World War I on November 3, 1917. Dallin was commissioned by the Publicity Committee of the Liberty Loan Committee of New England to create a statuette to fund the Third and Fourth Liberty Loan Campaigns. This plaster edition was “displayed in show windows of merchants throughout New England with a card reading--‘FIRST American soldier captured by the Germans. How long shall we allow him to remain a prisoner? Buy Liberty Bonds and set him free.’”1 The plasters were manufactured by P.P. Caproni & Brother of Boston, and a limited number were cast in bronze by Gorham.2

N.B. The present, enigmatic work dates to Picabia’s time in the south of France, which was an experimental and highly innovative period spanning nearly two decades.

By 1925, Picabia felt that the Dada movement no longer packed the anti-establishment punch that it once had, and he left Paris for Mougins, near Cannes, where he would remain until 1945. Picabia found a renewed vigor on the Côte d’Azur. In a letter dated February 27, 1926 to the French fashion designer Jacques Doucet, he notes, “This country which seems…to make some lazy, stimulates me to work…I have more and more pleasure in the resumption of painting.”1

Picabia experimented with several bodies of work in Mougins through 1927—including Espagnoles (depicting archetypal Spanish women), Les monstres (depicting grotesque

figures in heavy black outlines) and mixed-media collages—before creating one of his most important series known as Les Transparences.2 Les Transparences, which he developed through the early 1930s, comprised of superimposed classical, Romanesque and Renaissance silhouettes over figures and landscapes, and the effect was described by Marcel Duchamp as an impression of “the third dimension without the aid of perspective.”3

In the mid- to late 1930s, Picabia often referenced and juxtaposed the motifs and methods developed in these earlier bodies of work, some of which he overpainted.4 A notable example of a reworked amalgamation is Le Beau Charcutier [The Handsome Pork-Butcher] in the Tate Modern permanent collection. The work was first conceived ca. 1924-6 as a mixed-media collage painting of a man, thought by some to be of the French politician Raymond Poincaré, and re-conceived ca. 1929-35 with the profile of a glamorous woman superimposed over the male portrait.5

While scholarship on the present work is in its nascent stage, infrared reflectography (IRR) reveals the existence of a previous composition depicting a bust in profile of at least one figure (facing right), superimposed over a repetitive solar or floral motif in the background, with a signature reading “Francis Picabia” at lower center.

The work is registered as no. 3299 with the Comité Picabia, and will be included in their forthcoming Catalogue Raisonné de l’Oeuvre de Francis Picabia. A photo-certificate from the Comité Picabia accompanies the lot, and we wish to thank them for their kind assistance. A copy of the IRR report, conducted by the Worcester Art Museum Conservation Department, Worcester, Massachusetts, with recommendations for further imaging and analysis, also accompanies the lot.

N.B. Sonsini is best known for his work depicting Latino day laborers in his

neighborhood, the Pico-Union district in Los Angeles. In the present work, the portrait’s frontal and tightly cropped frame evokes a reference to an ID portrait, raising the politically charged issue of immigration and legal documentation. Through his tactile and visceral brushwork, however, Sonsini diffuses the overt politics of this series, focusing on the humanity of his sitters. According to Sonsini, “The information on cards in wallets is of little help to me. For me painting the portrait is about recreating the sensation of presence, the experience of having the sitter in my studio.”1

Conditions of Sale1. Some of the lots in this sale are offered subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Skinner, Inc. below which the lot will not be sold. In most cases, the reserve will be set below the estimated range, but in no case will it exceed the estimates listed. A representative of Skinner, Inc. will execute such reserves by bidding for the consignor. In any event and whether or not a lot is subject to a reserve, the auctioneer may reject any bid or raise not commensurate with the value of such lot.

2. All property is sold “as is,” and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.

3. Except as provided in paragraph 1 above, the highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or reoffer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. Any bidder that plans on spending in excess of $100,000 should make arrangements with the accounting department at least five (5) days in advance of the sale, as a deposit may be required to participate.

4. All merchandise purchased must be paid for and removed from the premises the day of the auction. Skinner Inc. may impose, and the purchaser agrees to pay, a monthly interest charge of 1.5% of the purchase price of any lot or item lot not paid for within thirty-five (35) days of the date of sale.

Skinner, Inc. shall have no liability for any damage or loss to property left on its premises for more than three (3) days from the date of sale. If any property has not been removed within three (3) days from the date of sale, at the option of Skinner, Inc. (a) Skinner Inc., may impose, and the purchaser agrees to pay, a monthly storage charge of 1.5% of the purchase price of any lot or portion of a lot not removed within the three days, and/or (b) Skinner Inc. may place the merchandise in a subsequent auction, without Reserve, to be sold to the highest bidder, and after deducting the standard commission and any additional charges that may apply, remit the proceeds to the purchaser.

5. Skinner accepts cash or check for payment. Personal checks will be acceptable only if credit has been established with Skinner, Inc. or if a bank authorization has been received guaranteeing a personal check. Skinner, Inc. reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. The purchaser agrees to pay Skinner, Inc. a handling charge of $25.00 for any check dishonored by the drawee. Please contact Accounting for additional payment methods. 6. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Skinner Inc. may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser’s breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale.

7. In no event will the liability of Skinner, Inc. to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.

8. Shipping is the responsibility of the purchaser. Upon request, our staff will provide the list of shippers who deliver to destinations within the United States and overseas. Some property that is sold at auction can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots.

9. All purchases are subject to the Massachusetts 6.25% sales tax unless the purchaser possesses a Massachusetts sales tax exemption number. Exemption numbers from other states are accepted in Massachusetts if presented with a business card or letterhead. Dealers, museums, and other qualifying parties can apply for a Massachusetts exemption number prior to the auction by contacting the Massachusetts Department of Corporations and Taxation at 100 Cambridge Street in Boston.

10. Except for property purchased via On-line Auctions, a premium equal to 20% of the final bid price up to and including $500,000, plus 12% of the final bid over $500,000, will be applied to each lot sold, to be paid by the Buyer as part of the purchase price. The buyer’s premium on property purchased via On-line Auctions will be in an amount up to 23% of the final bid price.

11. Bidding on any item indicates your acceptance of these terms and all other terms printed within, posted, and announced at the time of sale whether bidding in person, through a representative, by phone, by Internet, or other absentee bid.

12. Skinner, Inc. and its consignors make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. Skinner, Inc. expressly reserves the right to reproduce any image of the lots sold in this catalogue. The copyright in all images, illustrations and written material produced by or for Skinner, Inc. relating to a lot, including the contents of this catalogue, is, and shall remain at all times, the property of Skinner, Inc. and shall not be used by the purchaser, nor by anyone else, without our prior written consent.

13. These conditions of sale shall be governed by the laws of the Commonwealth of Massachusetts (excluding the laws applicable to conflicts or choice of law). The buyer/bidder agrees that any suit for the enforcement of this agreement may be brought, and any action against Skinner in connection with the transactions contemplated by this agreement shall be brought, in the courts of the Commonwealth of Massachusetts or any federal court sitting therein. The bidder/buyer consents to the nonexclusive jurisdiction of such courts and waives objections that it may now or hereafter have to the venue of any such suit.
