Recommendations for Council action, pursuant to Motion (Buscaino - Martinez): 1. MODIFY the Streamlined City Street Vacation Process (Accelerated Review) as set forth under Council File No. 01-1459, as indicated below. 2. Dl RECT the Bureau of Engineering to: a. I nitiate street vacation proceedings upon the submission of a petitioners application for a requested street vacation and upon payment of required fees (pursuant to California Streets and Highways Code, Division 9, Part 3, Public Streets, Highways and Service Easements Vacation Law) by submitting a report directly to Council through the Accelerated File Process. b. Notify the City Clerk in a timely manner of a requested street vacation proceeding and to establish an appropriate date for a public hearing to be held in Council. c. Expeditiously investigate the feasibility of the requested street vacation. 3. Dl RECT the City Clerk, with the assistance of the Bureau of Engineering, to amend the list of approved actions for accelerated processing where routine or administrative actions are sent directly to Council for approval, by adding a new category entitled Initiate Requested Street Vacations Proceedings when the petitioner has submitted a street vacation request and paid required City fees. Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report. Community I mpact Statement: None submitted. Motion movers recommend that Council streamline this process. In lieu of the above, and in a manner that further accelerates routine and administrative street vacation requests, upon

receiving a petitioner’s vacation application and payment of required fees, the Bureau should report directly to Council, with recommendations that reflect the information that would have been obtained through the adoption of a Rule 16 Motion, including instructions for the Bureau to initiate requested street vacation proceedings pursuant to State law, and investigate the feasibility of the requested vacation request.

Motion movers believe that these modifications will allow the Bureau of Engineering to expeditiously review, report, and submit recommendations directly to Council regarding street vacation requests when a petitioner has filed a street vacation application and has submitted a fee deposit. Council referred Motion to the Public Works and Gang Reduction Committee for consideration.

At its meeting held January 23, 2017, the Public Works and Gang Reduction Committee recommended that Council approve Motion.
