2. The quotation tbnns conrplete in all aspects should be submitted in sealed envelope along withtender fbe of Rs. 500/- in the form of dernand draft drawn in favour of the Registrar, IIT (BHU),payable at Varanasi.

3. EMD: t 10,000.00 in the form of Demand Draft drawn in favour of the Registrar lfT'(BHu)payable at Varanasi.

1. Institute reserves the right to reject any quotation or all quotation without prejudice, assigning anyreason or giving any explanation.

5. If quotation is submitted without clearly writing the rates then quotation in the given fbrmat maybe rejected as non responsive.

6. Quotation not signed by the bidder or his legally authorized agent will be considered invatid.

7. The Empanelment and Rate Contract will be valid for a period of ONE year from the date ofaward.

8. The Rate contract will be terminated, if the firm f'ails to abide by the terms and conditions of thecontract or fail to supply the goods in time or supply substandarcl goods or make any f'alsedeclaration or fails to provide satisf-actory after sale service to the Institute. [n such situation. thepenalty will be imposed on the f-rrms by an expert committee and penalty amount will be deductedfiom the Security Deposits/bills submitted by the firm.

9. IIT (BHU), Varanasi reserves the right to keep a number of firms in Rate contract fbr the supply ofabove iterns.

10. IIT(BHU), Varanasi also reserves the right to procure above iterns fronr other vendors also whoare not empanelled in the rate contract.

I l. If the quality of product and service provided is not found satisf-actory" IIT (BHU), Varanasireserves the right to cancel or amend the contract.

l2 The Empanelled supplier will abide by all the Terms & Conditions of the Tender.

l3 IIT (BHU), Varanasi reserves the right to cancel any category fiom the rate contract and cgntinuewith other categories.

14. Document to bg submitted \yith the bid:(i) OEM should submit an undertaking that they are Original Equiprnent Manufacture of the

item quoted by them on their letter head.

(ii) Authorized Dealers should submit a certificate fiorn the OEM on the letter head of the OEMthat they are the authorized dealers fbr the items quoted by them and also mention thedealership vali dity period.

15. Bid PTices: MUST BE SUBMITTED IN PRICE BID FORM given in tencler only and duly signedand starnped by the bidder.

16. lf the price is not quoted in Price Bid Form provided in tender document then, IIT (BHU),Varanasi will reiect bid along with forfbiting Earnest Money Deposit. lf the supplier wishes to giveseparate pricing details they may be attached in separate sheet along with the duly filled price bidfbrmat only.

Institute Works Departmentt7 Any new taxes and duties liable on the subject contract due to change in legislation during the

contract period shall be reirnbursed sub.ject to the applicability of the said act to the satisf'action ofthe purchaser and the production of documentary evidence after availing of statutory concession,benefits etc.

The supplier shall pay and bear all other liabilities, taxes and duties not specifically agreed by thePurchaser in the contract.

Fall clause:

(i) The price quoted by the supplier should not be higher than the maximum retails price if any,for the stores and the same shall not be higher than the price usually charged by the supplierfor stores of the same nature, class or description to any other purchaser.

(ii) The price charged for the stores supplied under the contract by the supplier shall in no evenrexceed the lowest price at which the supplier sells the stores of identical description to anyother person during the period till performance of all supply orders placed during thecurrency of the contract is completed. If at any time during the period the supplier reducesthe sale price of such stores or sells such stores to any other person including his dealers at aprice lower than the price chargeable under the contract" he shall fbrthwith notify suchreduction or sale to the purchaser and the price payable under the contract for these items ofstores supplied after the date of coming into force of such reduction or sale shall standconespondingly reduced.

(iii) If it is disproved that the supplier has contravened the above conditions, then withoutprejudice to any other action which might be taken against hirn, it shall be lawfirl for thepurchase to (a) revise the price at any stage so as to bring it in confornrity with sub-clause(i)above, or (b) to terminate the contract and purchase the items of- stores at the risk and cost ofthe supplier and in the even the provisions of Clause 28 of General Conditions of Contractshall, as fbr as possible, be applicable or recover the loss.

Bid evaluation Criterie:(i) The bids will be opened and comparative staternents of cluoted items will be prepared in

respect of'responsive bids only.

(ii) Lowest rate for each itent will be decided based on L-l in respect of each item. (ltem wiseL-l rate will be decided).

(iii) The item wise L-l rates will be considered as empanelled rates for each item and all agreeingwill be empanelled for supply.

(iv) All the participating bidders who agree to supply on the L-l rates shall submit an undertakingthat they agree to supply the items on the lowest evaluated rates approved by the lnstitute.

Terms of payment:

22. Payment within 30 days fi'om the date of delivery and & Acceptance Certificate of concernedDepartment / Section / Materials Management Division. Advance payrnent will be made onlyagainst Bank Guarantee.
