Dear Mr. Welch and Mr. Comorre:

Environmental Intelligence, LLC (EI) has been retained by the City of Beverly Hills (COBH) and the Los

Angeles County Metropolitan Transportation Authority (Metro) to serve as the independent compliance

monitor (ICM) during construction of the Purple Line Extension Project. Monitoring is required to ensure

that construction is in compliance with (1) the Memorandum of Agreement (MOA) for Southern California

Edison’s (SCE’s) Advance Utilities Relocation Phase of the Purple Line Extension Project – Segment 2 –

Between the City of Beverly Hills and the Los Angeles Metropolitan Transportation Authority (City

Agreement No. 384-17), (2) the MOA for the Third Party Advance Utility Relocation Phase of the Purple

Line Extension Project – Section 2 - Between the City of Beverly Hills and the Los Angeles Metropolitan

Transportation Authority (City Agreement No. 648-17) and (3) the Agreement titled "Demolition and

Public Right-of-Way Use Permit for the Los Angeles County Metropolitan Transportation Authority and

its Contractor to Clear All Buildings and Existing Improvements at 9430 Wilshire Boulevard, Install Noise

Monitoring Equipment and Sound Walls for Future Construction and a Laydown Area for the

Wilshire/Rodeo Station of Section Two of the Purple Line Extension Project" (Agreement dated June 5th,

2018). The following information summarizes the ICM monitoring activities that occurred at the Segment

2 site (Rodeo Station site) during the week of February 17, 2019 – February 23, 2019. Construction

activities were not conducted on February 17 or 18.

Construction activities during the week included installing the track beam on the sound wall and building

the gates at the Ace Gallery yard, assembling scaffolding on the Wilshire perimeter of the North Canon

yard, setting up fencing with sound blankets along the alley perimeter of the North Canon yard, excavating

sewage lines, and fault investigation boring. EI ICMs were present during all construction activities and

conducted routine noise measurements at selected noise monitoring locations as well as compliance checks

in accordance with the MOAs and associated attachments, exhibits, traffic closure notifications, and traffic

management plans. At the conclusion of each work shift, daily monitoring reports were prepared by each

ICM. Attachment B (Daily Monitoring Reports) provides detailed daily monitoring reports and photographs

of construction activities.

VIOLATION SUMMARY

During the week, EI ICMs identified one (1) violation during construction activities. Table I provides a

summary of the violation identified during the week of February 17, 2019 – February 23, 2019 and Exhibit

1 provides a location map for the submitted violation. Details for the violation are included as Attachment

CONCLUSION

To date, 48 violations have been issued, four (4) of which have been rescinded since the beginning of

construction of the Purple Line Extension Project – Segment 2. Project construction activities are ongoing

and EI ICMs continue to monitor all construction activities applicable to the MOA on a daily basis.

A noise reading was done outside of the North Canon Drive yard in order to determine the sound levels of the generator within the yard. Throughout the evening the condition of the canopy lights (on/off) were also monitored.
