FARM PERSONAL LIABILITY & PERSONAL LIABILITY Farm Personal Liability (NS-710) and Personal Liability (NS-700) may be written separately as a Farm Personal Liability policy or Personal Liability policy, or may be attached to a Farmowners or Dwelling Fire policy. The following coverages apply:

PRINCIPAL COVERAGES

Coverage L - Personal Liability - Pays for damages for which the insured is liable by law if the bodily injury or property damage is caused by an occurrence arising out of the insured’s premises or personal/farming activities.

Coverage M - Medical Payments to Others - Pays for medical expenses incurred by persons, who are not insureds, if the bodily injury arises out of the insured’s premises or personal/farming activities.

NOTE: When a Personal Liability policy is written, farming is excluded.

DAMAGE TO PROPERTY OF OTHERS

Provides up to $1,000 coverage for damage to property of others by the insured without the need for negligence.

The following apply only when Farm Personal Liability is written.

1. This coverage also provides for: a. damage to property of others by animals owned by or in the care of the insured; and b. damage done to farm machinery in the care, custody or control of the insured (subject to a $100 deductible). 2. The limit may be increased to $2,000, $3,000, $4,000, $5,000, $6,000, $7,000, $8,000, $9,000, or $10,000.

These increased limits may not be available when insured does custom farming. 3. The rates for higher limits are shown in the Rate Pages - Farm Personal Liability.

UNDERWRITING PROCEDURE AND RISK SELECTION

1. Farm Personal Liability must be written when: a. there are more than 40 acres; b. the insured has farming operations; or c. there are horses or other livestock.

2. When writing Farm Personal Liability or Personal Liability, the coverage must apply at the principal residence premises of the insured (the dwelling where he/she lives). If there is other property to be covered, the policy should be extended to these other locations or premises or a business liability policy written.

3. Be sure to list any business pursuits conducted at the premises and whether or not the premises contain an incidental office.

4. Be sure to complete in detail the short inspection report found on the application. 5. Do not write coverage where similar insurance has been cancelled or refused by another company. 6. Be sure to list previous loss history and whether we have other policies for the same insured. 7. When writing Farm Personal Liability Coverage, the following types of risks should not be submitted:

a. Farmers who are careless in their operations. b. Farmers who do not maintain their buildings or fences in good condition. c. Farmers who employ large numbers of youths in seasonal farm work. d. Farms which have attractive nuisances such as unprotected gravel pits, quarries, etc. e. Farms which hold public attractions such as: hay rides, swimming beaches, riding stables, horse racing,

boat renting, dude ranches, summer homes, etc. f. Farmers who have had more than 2 losses in the previous 3 years. g. Risks with wild animals or pets that show aggressive or vicious tendencies. h. Risks with Dobermans, Rottweilers, Presa Canarios (also known as Canary Island Cattledog), Pit Bulls

(including, but not limited to, American Pit Bull Terriers, American Staffordshire Terriers, or Staffordshire Bull Terriers), Chows, or dogs with aggressive tendencies.

i. Risks with swimming pools, unless prior approval has been received from a North Star underwriter.

UNDERWRITING RULES FOR RECREATIONAL VEHICLES & WATERCRAFT

1. Snowmobiles, ATV’s, personal watercraft, golf carts, boats and motors are not acceptable: a. If licensed for road use (Does not apply to CF-1849 – form used for licensed ATVs). b. If used for business purposes. c. If used for racing competition or similar contest purposes or any stunting activity. d. If rented to others. e. If the engine or gear ratio has been modified for speed or acceleration purposes. f. If there are 2 or more chargeable accidents or traffic violations in the past 3 years or if there have been any

accidents or violations when written on a Tenant's Contents policy. g. Where there has been a conviction for driving under the influence, open bottle violation, careless or reckless

driving, hit and run, or leaving the scene of an accident in the past 3 years. h. Where the principal operator is under 18 years of age.

2. Dirt bikes, mini bikes, mopeds, cabin cruisers, yachts, or houseboats are not acceptable. 3. Snowmobiles are not acceptable if written on a Tenant's Contents policy. 4. Submit any other type of recreational vehicles to Home Office before binding. 5. Submit the drivers license number and the date of birth of all operators. 6. Submit a completed Form, CF-775 - Recreational Vehicle/Watercraft Questionnaire.

POLICY TERM

When attached to a Farm Package or Dwelling Fire policy, the term and payment plan of that policy applies.

When written as a separate contract, the policy will be written for a term of 1 year. The policy will be automatically renewed each year with an updated declarations page. A completed renewal application is required at the end of 5 years. Policyholders will initially receive copies of all policy forms. Upon renewal they will receive only an updated declarations and forms that are new or revised. Policyholders may receive all policy forms upon request – a statement notifying the insured of this will be on each annual declarations. The policy will be subject to the premiums, rules and forms in effect at the time of renewal. Optional billing procedures are available - see the Billing Information section of this Agent's Manual.

PREMIUM DETERMINATION

Personal Liability (NS-700) - A base charge must be made for the residence the insured occupies (determined by number of families). If the following exposures exist a charge is required: all additional residence premises of the insured and all domestic employees (in excess of 2) of the insured not covered or required to be covered by workers' compensation coverage.

Farm Personal Liability (NS-710) - A base charge must be made for all farm land owned or rented by the insured, including the insured's residence (determined by the total number of acres owned and rented). If there is no active farming/making of hay and 5 or fewer head of horses/other livestock a non-farming discount can be applied to the base charge. If the following exposures exist a charge is required: all additional residence premises of the insured, all additional farm premises with buildings, livestock (see Livestock Liability Exposure Charge), all domestic employees (in excess of 2) of the insured not covered or required to be covered by workers' compensation coverage, and all farm employees of the insured working over 40 days per year not covered or required to be covered by workers' compensation coverage.

The premium or charges for any other mandatory or optional coverages that apply would be in addition to those described above.

NOTE: Any domestic employee earning $1,000 or more in cash in a 3 month period from a single private home or household must be covered by Workers' Compensation insurance. Also, if the domestic employee has earned $1,000 or more from his/her present employer in a 3 month period within the previous year, he/she must be covered by Workers' Compensation insurance regardless of whether or not the $1,000 was earned in the present quarter.

ADDITIONAL INSUREDS – NS-315A (CPP Only), GL-70, GL-72, ML-416, CF-2209 Additional insureds may be added to protect the interest of a person or organization that does not significantly add to the liability exposure of the named insureds. Please provide the reason and financial interest of the additional insured.

Listed below are some of the most commonly added additional insured exposures and the premium charged:

FARM PERSONAL LIABILITY ONLY:

1. Landlord, renting farmland to insured, no buildings - Partnership charge. 2. Co-owner of land, machinery, livestock - No charge. 3. Leasing company, leasing machinery to insured - No charge. 4. Farm manager - No charge.

FARM PERSONAL LIABILITY OR PERSONAL LIABILITY:

1. Executors, administrators, trustees, or beneficiaries - No charge. 2. Other Residents of the Named Insured's Household - A policy can be endorsed to provide coverage to a

person who lives with the named insured and is a member of the named insured’s household but who is not an insured as defined by the policy, provided that such person is not a guest, domestic employee, tenant, or roomer or boarder – see rate pages.

3. Colleges, universities, and management companies requiring proof of insurance for students. (CF-2209)

BABYSITTING – NS-157A (CPP Only), FL-157M Liability and Medical Payments may be extended to provide coverage for Babysitting in the insured’s home subject to the Underwriting Rules below. Apply the rates shown in the Rate Pages.

Underwriting Rules for Babysitting:

1. If the insured babysits 5 children or fewer, we can write the Personal/Farm Personal Liability policy and also provide liability for babysitting.

2. If the insured babysits more than 5 children, we can write the Personal/Farm Personal Liability policy only if we receive a copy of a daycare liability policy that has been purchased elsewhere. NO liability coverage will be provided under the Personal/Farm Personal Liability policy for daycare operations.

BUSINESS ACTIVITIES – NS-71 Coverage may be provided for the liability of an insured arising out of business activities, other than a business of which the insured is sole owner or a partner. Classify as shown below, and apply the premium shown in the Rate Pages to each person insured.

A - Clerical Office Employees Salesmen, Collectors or Messengers - No installation, demonstration or servicing. B - Salesmen, Collectors or Messengers - Installation, demonstration or servicing operations. C - Teachers - Athletic, laboratory, manual training, physical training and swimming instruction, excluding corporal

punishment. D - Teachers - Not otherwise classified, excluding corporal punishment. E - Teachers - Liability for Corporal Punishment. Additional premium for this coverage must be added to premium

for classifications C or D.

CONTRACT GROWERS LIMITED LIABILITY – CF-2026 (Farm Personal Liability Only)

The Contract Growers Limited Liability Coverage CF-2026 provides liability coverage for death or injury to livestock in the insured’s care, custody, or control caused by suffocation, asphyxiation, hyperthermia, or hypothermia. Coverage is limited to the limit stated on the declarations under coverage L – Personal Liability and is intended to compliment the named perils of the policy and any optional suffocation coverage applying to the custom fed livestock

Rating is based on a growers total livestock capacity.

A copy of the custom feeding contract must be made available upon request.

CUSTOM FARMING (Farm Personal Liability Only) The policy extends to cover farm operations performed by the named insured for another if gross receipts from custom farming is less than $5,000 annually. This coverage removes the Care, Custody and Control exclusion for work performed during custom farming operations. However, it excludes: Raising of Livestock, property damage to structures (including buildings), farm machinery and equipment, or animals, property damage arising out of the failure of seed to germinate, and property damage to property rented to an insured

If gross receipts from custom farming is in excess of $5,000, a premium charge must be made. Premium charge applies to gross receipts in excess of $5,000. This coverage is acceptable only when the custom work is done locally and is strictly incidental to insureds farming operations.

NOTE: 1. When custom farming is done we will not increase the $1,000 limit for Damage to Property of Others. 2. The custom farming endorsement does not provide coverage for claims arising out of pesticide or

herbicide application. However, the regular custom farming rate applies to farmers doing custom spraying to cover other exposures involved with operating farm equipment.

3. When custom farming is done and Farm Personal Liability is added to a Farm Package policy we will not write Special Form on Farm Machinery, Equipment and Tools.

EMPLOYER’S LIABILITY - FARM EMPLOYEES (Farm Personal Liability Only)

Farm Employee coverage for part time farm employees working 40 days or less per year is automatically included on all North Star Farm Personal Liability policies at no additional charge. A charge must be made for each farm employee that works (a) over 40 days but less than 180 days per year or (b) 180 days per year or more.

Employers Liability covers the policyholder's legal liability to employees and includes all employees on or away from premises, providing such employee or employees are engaged in farm work for the policyholder. It also pays medical payments for each accidentally injured employee regardless of legal liability of a policyholder, providing the employee is engaged in farm work for a policyholder when the injury occurs.

The policy does not respond in any case if a policyholder has or should have had a workers’ compensation policy covering the injury or if benefits are payable or required to be provided by a policyholder under a workers’ compensation, non-occupational disability, occupational disease or like law.

The following may be helpful in determining what coverage a policyholder may need:

1. If the wages the policyholder paid for the preceding calendar year were below $8,000, the policyholder may: • purchase Workers' Compensation insurance; or • carry Employer's Liability insurance. 2. If the wages the policyholder paid for the preceding calendar year were $8,000 or more, but below the amount

required by the Minnesota Employers' Liability Compensation Law for Workers' Compensation, the policyholder must:

• purchase Workers' Compensation insurance; or • purchase Employer's Liability insurance with minimum limits of $300,000 per occurrence for Personal

Liability Coverage and $5,000 per person per occurrence for Medical Payments to Others. 3. If the wages the policyholder paid for the preceding calendar year were the same as or above the amount

required by the Minnesota Compensation Law for Workers' Compensation or coverage amounts stated above are not met, the policyholder must:

• purchase Workers' Compensation insurance.

The Minnesota Department of Labor and Industry (DLI) computes the statewide average annual wage (amount required by the Minnesota Compensation Law for Workers' Compensation) once each year in "early-mid fall". Contact the DLI to obtain an updated statewide average annual wage or go to https://www.dli.mn.gov/business/workers-compensation/work-comp-compact-newsletter-archive and scroll down to the December newsletter, click on it and then scroll down to Workers’ compensation coverage for farms.

It is important that the policyholder understands that there are major differences in the protection and payments provided under workers' compensation as compared to farm personal liability.

EXCHANGE LABOR (Farm Personal Liability Only)

One of the areas of the Farm Personal Liability that causes questions and misunderstanding is that of Exchange Labor. The base policy covers friendly exchange of labor. This means the policy pays for legal liability sustained while another farmer is on the premises performing a friendly exchange of labor for which the insured is not obligated to pay any monetary consideration. The policy also provides medical payments coverage for another farmer and his employees while on your premises performing a friendly exchange of labor.

FAMILY CORPORATIONS – NS-506A (CPP Only), FL-506 (Farm Pers. Liab. Only)

Corporations may be written under Farm Personal Liability when they involve family members actively engaged in the farming operation. An example of a Family Corporation would be a farmer, his wife, and their children forming a corporation where they are the corporate officers and majority owners.

The family corporation should be listed as the named insured on the policy. Each member would then be listed on the “Corporation as Named Insured” endorsement.

The base Farm Personal Liability charge covers the corporation named. Each member of the corporation (in different households) is then charged the same rates as we use for partnerships.

FARM POLLUTION & CLEAN UP COVERAGE (Limited Coverage) (Farm Pers. Liab. Only)

Coverage is provided for heat, smoke or fumes of a hostile fire or reduced visibility from smoke.

Coverage is provided up to $50,000 for the discharge, dispersal, seepage, migration, spill, release or escape of agricultural chemicals, liquids and gases. Coverage applies as long as the discharge, dispersal, seepage, migration, spill, release or escape occurs quickly and abruptly and is accidental. This coverage is subject to a $1,000 deductible in all cases and is excess coverage over any funds available through any local, state or federal agency.

$50,000 is an aggregate limit and is the most we will pay for the sum of the above in any one policy year.

Application by aircraft for the above is excluded. Coverage does not apply to custom spraying done by the insured or any employee of the insured.

FARMER'S MEDICAL PAYMENTS – NS-507 (Farm Personal Liability Only)

The policy may be endorsed to cover Medical Payments for each accidentally injured person named. This coverage may apply only to the named insured, and, if residents of the named insured's household, the spouse and relatives of either between the ages of 12 and 65, and extends on or away from the premises providing the accident occurs while engaged in farming operations. A $100 Deductible applies for each occurrence.

Each person to be covered must be specifically named and a premium charge made for each.

This coverage should not be written as a substitute for health and accident insurance, nor should it be written for those in the family who fall under the Worker's Compensation Act or coverage.

FIRE LEGAL LIABILITY (Rented Farms) (Farm Personal Liability Only)

The North Star Farm Personal Liability has been broadened to provide legal liability coverage for fire, explosion and smoke up to the Limit of Liability for Coverage L - Personal Liability for property damage to premises used, rented or operated by the Named Insured as a farm. This does not cover property damage to premises owned by the Named Insured. The property damage must result from: (1) fire, (2) explosion, or (3) smoke.

HORSES (Farm Personal Liability Only)

Liability and Medical Payments may be extended to provide coverage for horses used for the insured's own pleasure.

Underwriting Rules for Liability Coverage on Horses

1. Horses must be for insured's own pleasure. 2. We must be notified if horses are in any horse shows or parades. 3. The following situations are not acceptable: a. Insured permits extensive use by friends or relatives. b. Insured gives riding lessons. c. Insured rents horses out. d. Insured is involved in the boarding or training of horses.

To rate this use the following procedure: Base Charge plus Livestock Exposure Charge plus Horse Charge. See Rate Pages - Farm Personal Liability.

HUNTING ON INSURED PREMISES – GL-90

If an insured allows people to hunt on premises, the FPL policy provides liability protection as long as no charge is made. If the insured does charge the hunters a fee, it is considered operating a business other than farming and is not covered. The liability coverage can be extended from the farm liability for an additional charge if the:

1. insured makes no use of employees or does not employ hired help in the activity; 2. receipts do not exceed $25,000: 3. insured does not operate a guest ranch, hunting lodge, or provide any type of lodging for any hunters; 4. insured does not release game for the hunters to shoot; 5. insured provides no guide service; and 6. insured has no sales, service, repair, or furnishing of any hunting or sporting equipment.

Please provide the following information:

1. total annual receipts; 2. charge per hunter; 3. type of hunting; 4. how long the insured has been doing this; 5. if blinds are provided; 6. if any game is released for the hunters; 7. if the insured provides any lodging for the hunters; and 8. months that hunting is allowed.

For receipts over $25,000 refer to Commercial Underwriting Department.

INBOARD, INBOARD-OUTBOARD MOTOR BOATS, SAILBOATS AND PERSONAL WATERCRAFT – NS-75

Inboards or inboards/outboards require this endorsement and a premium charge for each boat.

Coverage is automatically provided for sailboats less than 26 feet. Sailboats 26 to 40 feet inclusive, equipped with auxiliary power are classed as inboard motor boats. A sailboat without auxiliary power but over 26 feet long requires this endorsement and a premium charge.

Personal watercraft are classed as inboard motor boats. They require this endorsement and a premium charge for each personal watercraft.

Coverage must be written to expiration of the policy. In Minnesota the normal navigational period for an inboard, inboard-outboard motor boat, sailboat or personal watercraft is 6 months. (It is not permissible to stipulate a navigational period for outboard motors.) The premiums shown in the Rate Pages are for a 6 month navigational period. Premiums for this coverage are annual retained premiums unless the entire policy is cancelled.

INCIDENTAL OFFICE – NS-42A (CPP Only), FL-42

When the insured maintains an incidental office, professional, private school or studio use in the dwelling, which otherwise meets the eligibility requirements, the charge shown in the Rate Pages must be made.

NOTE: This type of coverage and its rates do not apply to Day Care or Babysitting. Refer to Babysitting paragraph for rules and limitations when writing Day Care or Babysitting.

LIVESTOCK LIABILITY EXPOSURE CHARGE (Farm Personal Liability Only)

A livestock liability exposure charge is made whenever the insured owns livestock or has livestock in his/her care. This charge is made for the extra liability exposure that livestock create. In no way does this charge limit or add any coverage; it is strictly a rating criteria. Refer to Rate Pages - Farm Personal Liability for rates.

NON-FARMING DISCOUNT

This discount applies only when the insured does not operate the farm land, there is no making of hay, and there are 5 or fewer head of horses/other livestock. It will apply to the base acres premiums and the Livestock Liability Exposure Charge. Example would be a retired farmer.

OUTBOARD MOTORS – NS-75

Coverage is automatically provided for outboard motors 50 HP or less.

When 2 or more outboards are regularly used together with any single watercraft owned by the insured, the horsepower of all such outboards shall be accumulated for rating purposes. Outboards totaling over 50 HP require this endorsement and premium charge. Premiums for this coverage are annual retained premiums unless the entire policy is cancelled.

Coverage must be written to the expiration of the policy.

NOTE: The CPP "Delux Dwelling Plus" program automatically provides coverage for outboard motors 100 H.P. and less.

PARTNERSHIPS – NS-316A (CPP Only), FL-316 (Farm Personal Liability Only)

If 2 or more individuals are actively participating co-owners and/or operators of a farm and maintain separate households, a single policy may be issued in the name of all partners. For example, John Doe, Joe Farmer, and Jack Smith or John Doe, Joe Farmer and Jack Smith dba: Triple J Farms.

Rate the policy in the normal fashion and then add the proper partnership charge for each of the additional partners. For Example: My son and I farm two places together. Each of us has a set of buildings. I own all the land, but we

own machinery in partnership. What would be the best way to handle this and how would you rate it?

Answer: Issue 1 policy in the name of both father and son. Rate as if only the father was the named insured and then add the proper partnership charge for the son. Please remember that an additional charge needs to be made for an additional set of farm buildings.

PERSONAL INJURY – FL-46

Coverage is available on an optional basis for “Personal Injury”. This is designed for protection from legal suits arising out of false arrest, false imprisonment, wrongful eviction, wrongful detention, malicious prosecution, misrepresentation, libel, slander, defamation of character or invasion of privacy. The limit of liability for this endorsement must be the same as the base liability limit of the policy. Refer to Rate Pages for rates.

RECREATIONAL VEHICLES – NS-704 OR CF-1849

Liability and Medical Payments may be extended to provide off premises coverage for Snowmobiles and unlicensed All Terrain Vehicles at the premium charge shown in the Rate Pages. This does not provide coverage for (1) any Recreational Motor Vehicle licensed for road use or (2) motorcycles, trail bikes, dirt bikes, mini bikes or similar two-wheel type vehicles.

NOTE: Golf Carts - Coverage is included in the base policy while golf cart is being used for golfing purposes away from premises.

Liability and Medical Payments may be extended to provide on and off premises coverage for licensed ATV’s at the per unit premium charge shown in the Rate Pages.

Premiums for these coverages are annual retained premiums unless the entire policy is cancelled.

Snowmobile Auxiliary Hazard Warning Lighting System Discount - A 5% discount will be applied to the above premiums if a snowmobile has an "auxiliary hazard warning lighting system" that is installed by the manufacturer of a snowmobile as original equipment or installed in a snowmobile by the manufacturer or an authorized dealer of that manufacturer as an after market system that does the following when activated:

1. a yellow light emitting diode (L.E.D.) light on the front of the snowmobile that flashes at least once per second and is visible at least one-half mile in front of the snowmobile; and

2. a red light emitting diode (L.E.D.) light on the rear of the snowmobile that flashes at least once per second and is visible at least one-half mile from behind the snowmobile.

Golf Carts - Coverage is included in the base policy while golf cart is being used for golfing purposes away from premises. Coverage for liability and medical payments arising out of the off-premises use of golf carts, not subject to motor vehicle registration, for purposes other than golfing may be available - please call a Home Office underwriter.

RESIDENCE RENTED TO OTHERS – NS-70

Liability coverage can be added to the PL/FPL for 4 or fewer rental dwellings (1 to 4 family) owned by the Named Insured. When the insured has more than 4 rental dwellings, please use the NS-800 form and rates. See the NS-800 Rate Pages for premiums that apply.

SECONDARY RESIDENCE - SEASONAL DWELLINGS

All additional premises where the insured maintains a residence must be declared and a premium charged. See Rate Pages.

SEPARATE POLICY SURCHARGE

Property Damage liability is available for sudden and accidental spray drift of agricultural chemicals for up to $100,000 when an insured is applying agricultural chemicals under contract for others. Application by aircraft is excluded. The $100,000 is an aggregate limit. The care, custody, and control exclusion applies. There is no coverage provided by this endorsement for the insured's product or work. This coverage is intended for those insureds doing Agricultural Custom Spraying on a limited basis, typically $25,000 or less in gross receipts.

COMMERCIAL LIABILITY COVERAGE (NS-810) (Farm Premises and Operations)

Commercial Liability Coverage (Farm Premises and Operations) (NS-810) may be attached to a Farm or Dwelling Fire Policy.

Covers the commercial liability exposures that arise out of farming activities on the insured premises and related operations.

The coverage part states the complete conditions. The following is a general description of the coverages provided.

Coverage L (Bodily Injury Liability and Property Damage Liability) pays on behalf of the insured for damages due to bodily injury or property damage caused by an occurrence that involves the insured premises or related operations.

Coverage M (Medical Payments) pays medical expenses, incurred by persons who are not insureds, if bodily injury occurs in connection with the insured premises or related operations.

Premium Determination. A base charge must be made for all farm land owned or rented by the insured (determined by the total number of acres owned and rented). If the following exposures exist a charge is required: all additional farm premises with buildings and livestock (Livestock Liability Exposure Charge). If other exposures exist, please call our Farm Underwriting Department to discuss the risk as there may be additional charges that apply.

A combined single limit applies to the sum of all losses payable for each occurrence under the commercial liability coverage provided (Coverage L and M combined). Subject to Each Occurrence Limit, the Per Person Limit for Coverage M is $5,000.

The commercial liability coverage provided is subject to the General Aggregate Limit described below.

General Aggregate

The General Aggregate Limit is the most that will be paid during a 12-month policy period for all damages under Coverage L and all medical expenses under Coverage M.

The General Aggregate Limit is Equal to Twice the Each Occurrence Limit.

Accidental Spray Drift Coverage When Limited Farm Pollution coverage is purchased then Accidental Spray Drift coverage is included for $100,000 (aggregate limit).

If the farm operations consist mainly of livestock rather than farming of land, refer to Home Office for acceptability and rating.

NOTE: If the farmland is rented to 1 party and the dwelling is rented to a 2nd party, then both a Base Charge and a Dwelling for Rent charge need to be made. If the same party rents both the farmland and the dwelling then just a base charge needs to be made.
