PAYMENT – Orders consisting of only bare root material require a 10% deposit to reserve plants. Orders for container grown material or a mix of bare root and container grown material require a 25% deposit to reserve inventory. Receipt of deposit payment acknowledges acceptance of “NFN Sales Terms and Conditions”. The remaining balance after receipt of deposit is due prior to shipment unless Net 30 terms have been established. Creditapplications are available upon request. Credit cards are accepted for payment but will be assessed a 3% credit card processing fee. Overdue accounts will be assessed a service charge of 2.5% per month on the remaining balance due. Any accounts 60 days or more overdue will be moved to collections and buyer will then be responsible for all collection’s agency fees, attorney’s fees, court fees and any other fees related to collecting the overdue balance from buyer.

CANCELLATIONS - Orders cancelled between September 1 and December 1 will be charged 25% of the order amount. Orders cancelled after December 1 but before February 1 of the following year will be charged 50% of the order amount. For orders cancelled on or after February 1, the customer shall be liable for payment in full.

CLAIMS - All products will be true to the name, product description and quantities stated on order. All claims to the contrary must be made in writing within 5 business days of receipt of shipment. In no case will our liability exceed the purchase price of the order. All claims will be settled under the laws of the state of Georgia and buyer agrees to jurisdiction in the state of Georgia.

LIMITATION OF LIABILITY – Seller makes no claim or implied warranty of the growth performance, fitness for a specific use, survivability or any other purpose other then those set forth in the “Claims” section of these terms. Seller shall have no liability for failing to deliver any or all plant material on order in the event of fire, flood, war, adverse weather, labor shortages, inventory errors and other causes beyond the seller’s reasonable control. During any period where a shortage of plant material occurs due to such events, seller may allocate its plant material in any manner deemed fair and reasonable by seller. Sellers sole liability under such an event is limited to a pro rata refund of the plant material paid for that is unable to be supplied.

SHIPPING - Bareroot seedling products must be shipped when the seedlings are dormant. Our seedlings are shipped from December 1 through April 30 of any given year. All pricing is FOB Native Forest Nursery. Seller may arrange shipping for buyer, but unless agreed upon in writing by both parties, buyer will reimburse seller for the full amount of anyshipping costs paid by seller on buyer’s behalf. For all orders and shipping arrangements, seller’s liability for damages ceases upon delivery to motor carrier. Seller assumes no liability for damage after plants are loaded on truck for shipment.
