2. गैस िसल डर िनयम, 2016 (िजसे इसम इसके पI चात् उ= त िनयम कहा गया हH) के िनयम 48 के उपिनयम (3) के ) थान पर िन� निलिखत रखा जाएगा, अथाNत:– “(3) उप िनयम (1) के अधीन “अनापि4 "माण पE” क/ अपे?ा, िन� निलिखत के िलए लागू नहZ होगी,- (क) P वलनशील या िवषैली या सं?ारक गैस के भंडारण के िलए, जो भरण संयंE का भाग ह,ै हतुे "#प “च” म अनु[ि\; और (ख) िसल डर म 'िवत पे]ोिलयम गैस के भंडारण के िलए "#प “च” म अनु[ि\, बशत̂ "अनापि4 "माणपE" )थानीय िनकाय स,े जैसे �क `ाम पंचायत या संबंिधत शहरी )थानीय िनकाय से "ा\ �कया जाएगा ।" 3. उ= त िनयम के िनयम 57 म , खa ड (4) के पI चात, िनbिलिखत खa ड अंतः) थािपत �कया जाएगा, अथाNतः- "(5) उ= त िनयम के अधीन अनुदX त "X येक अनु[ि\ या अनुमोदन रd माना जाएगा य�द अनु[ि\धारी, अनु[U त साइट या अनुमो�दत पeरसर का कोई अिधकार नहZ रखता ह।ै” 4. उ= त िनयम के "#प “ग” म , "#प ““““ड””””, "#प ““““च” ” ” ” और "#प ““““छ”””” म अनु[ि\ के िलए इस आवेदन के साथ ") तुत करने के िलए अपेि?त द) तावेज शीषN के अधीन:- (क) मद (iv) म , शGद "पgा करार" का लोप �कया जाएगा। (ख) मद (vi) के ) थान पर िन� निलिखत मद रखा जाएगा, अथाNत्: "(vi) संपीिडत "ाकृितक गैस/ संपीिडत बायो गैस ऑटोमोeटव kधन के #प म िवतeरत करने के िलए "#प 'छ' म या िबl/ और :ापार हेतु िवषा5 गैस या सं?ारक गैस या P वलनशील गैस के भंडारण के िलए "#प ‘च’ म अनु[ि\ के िलए आवेदन क/ दशा म िनयम 48 के अधीन, िजला "ािधकारी से अनापि4 "माणपE।: पर&तु यह P वलनशील या िवषैली या स?ंारक गैस के भंडारण के िलए, जो भरण संयंE का भाग ह,ै हतुे "#प “च” म अनु[ि\ या 'िवत पे]ोिलयम गैस के भंडारण के िलए "#प “च” म अनु[ि\ के िलए आवेदन के मामले म , िजला "ािधकारी स ेअनापि4 "माणपE क/ आवI यकता, लागू नहZ होगी। पर&तु यह और �क, िसल डर म 'िवत पे]ोिलयम गैस के भंडारण के िलए "#प “च” म अनु[ि\ के िलए, )थानीय िनकाय से, जैसे �क `ाम पंचायत या संबंिधत शहरी )थानीय िनकाय से "अनापि4 "माणपE" आवI यक होगा।"। 5. उ= त िनयम म , "#प छ क/ शतN सं.1 क/ उप-शतN (ख) म , "अनु[ि\ क/ शतN 6" शGद और अंक के ) थान पर, ""#प छ म अनु[ि\, क/ शतN 7 क/ सारणी II" शGद और अंक रखे जाएंगे। [फा. सं.17(20)2017-िव) फो] शैले& ' oसंह, अपर सिचव नोटनोटनोटनोट::::———— भारत का राजपE, असाधारण, भाग II, खंड 3, उपखंड (i) म अिधसूचना संpया सा.का.िन. 1081(अ), तारीख 22 नवंबर, 2016 म मूल िनयम "कािशत �कए गए थे और बाद म सा.का.िन. 886(अ) तारीख 17 जुलाई, 2017 3ारा संशोधन �कया गया। MINISTRY OF COMMERCE AND INDUSTRY

NOTIFICATION

New Delhi, the 3rd January, 2018

G.S.R 09(E).—The draft of the following rules further to amend the Gas Cylinders Rules, 2016 which the

Central Government proposes to make in exercise of the powers conferred by section 5 and 7 of the Explosives Act, 1884

(4 of 1884) is hereby published as required by sub-section (1) of section 18 of the said Act for information of all persons

likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after

thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available

to the public;

Objections or suggestions, if any, to these draft rules may be sent to the Additional Secretary (Explosives),

Department of Industrial Policy and Promotion, Ministry of Commerce and Industry, Room No. 259, Udyog Bhawan,

New Delhi-110 107 (Email: singh.shailen@nic.in), within the period specified above ;

The objection or suggestions which may be received from any person with respect to the said draft rules, within

the period so specified will be considered by the Central Government.

Draft Rules

1. Short title and commencement- (1) These rules may be called the Gas Cylinders (Amendment) Rules, 2018.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Gas Cylinders Rules, 2016 (hereinafter referred to as said rules), in rule 48, for sub-rule (3), the following

shall be substituted, namely:-

“(3) The requirement of the “No Objection Certificate” under sub-rule (1) shall not be applicable for,-

(a) a licence in form “F” for storage of flammable or toxic or corrosive gases forming

part of cylinder filling plant; and

(b) a licence in form “F” for storage of Liquefied Petroleum Gas in cylinders; provided

“No Objection Certificate” shall be obtained from the local body such as Gram

Panchayat or the urban local body concerned.”

3. In the said rules, in rule 57, after clause (4), the following clause shall be inserted, namely:-

“(5) Every licence or approval granted under these rules shall stand cancelled, if the licensee ceases to

have any right to the site of the licensed or approved premises.”

4. In the said rules, in form ‘C’, under the heading DOCUMENTS REQUIRED TO BE SUBMITTED WITH

THIS APPLICATION FOR A LICENCE IN FORM ‘E’, ‘F’ AND ‘G’,-

(a) in item (iv), the words “lease agreement” shall be omitted;

(b) for item (vi), following item shall be substituted, namely :-

“(vi) No Objection Certificate from the District Authority under rule 48 in the case of application for a

licence in Form “G” to dispense Compressed Natural gas /Compressed Bio Gas as automotive fuel or a Licence

in Form “F” to store flammable or toxic or corrosive gases for the purpose of sale or trading :

Provided that the requirement of “No Objection Certificate” from the District Authority shall not be

applicable for a licence in form “F” for storage of flammable or toxic or corrosive gases forming part

of cylinder filling plant or licence in form “F” for storage of Liquefied Petroleum Gas in cylinders.

Provided further that, for a licence in form “F” for storage of Liquefied Petroleum Gas in cylinders,

“No Objection Certificate” shall be required from the local body such as Gram Panchayat or the

Urban local Body concerned.”.

5. In the said rules, in Form “G”, in condition no. 1, in sub-condition (b), for the words and figure “condition 6 of

the licence”, the words and figures, “Table II of condition 7 of the licence in Form G” shall be substituted.
