The Importance of retakaful

• Protecting the Takaful operator from the threat of insolvency, underwriting and interest of the participants,forging co-operation among the participants andinvesting the accumulated fund in an Islamic way;

• Providing underwriting flexibility and further consolidatingthe financial stability of the Takaful operator in order tocompete with conventional insurance companies inaccepting risks.

• Possibly allowing the Takaful operator to utilize theretained deposit reserves of the retakaful fund in the

• From the Sharia‟ah point of view, Takaful companies are

obliged to comply with all the Sharia‟ah requirements,

including the retakaful

•  At the early stage of the Takaful industry in Malaysia, the

• The principle of al-Darurah tubih al-Mahzurat isaccepted among the jurists as a leeway in a

situation when the Muslims cannot abide to the

general rule because of darurah• This principle allows Muslims to do what is

prohibited on the condition of darurah that is a

situation when someone is afraid that harm will

fall on him if he did not undertake the prohibitedaction

prohibited in the situation of “darurah” is

eating meat of animals that are alreadydead or consumption of alcohol.

Mahzurat ” ( )

• He has forbidden you only the maitah (deadanimals), and blood, and the flesh of swine, andthat which is slaughtered as a sacrifice for othersthan Allah (or has been slaughtered for idols, onwhich Allah‟s name has not been mentionedwhile slaughtering). But if one is forced bynecessity without willful disobedience nor transgressing due limits, then there is no sin on

him. Truly, Allah is Oft-Forgiving, Most Merciful.

others, Allah says that if one is in the condition

of necessity he is not considered guilty if he hasto eat what is prohibited.

allows Muslims to eat what is prohibited when

there is no halal food available or in other wordswhen it is considered as darurah

• Since prohibited or non-halal food isallowed to be eaten in the situation of darurah, it has led scholars to relate a

qiyas with another situation that allowsmuslim to do what is forbidden in thedarurah situation.

• Darurah is a situation when muslim arefacing risk which can harm his life, aql andhis (mal) property.

Principle of “ma ubiha li al-darurah yataqaddaru biqadariha ” (

)

• This principle is a guideline in practicing theprinciple of .

• This means that even though a jurist allowsdoing what is prohibited, it should not be

excessive in the situation of darurat.• Takaful operators can take conventional

reinsurance to manage the risk for the amountthat cannot be retakaful by a retakaful company.

• For example if a retakaful company can retakaful50 % of the risk then they should only reinsure itwith a conventional reinsurance company for theother 50%.

• This principle is related to the previously mentionedprinciple which indicates that when the condition of “darurah” is gone then the permission to do what isprohibited is not valid anymore

• In the situation when there are many retakafulcompanies which can retakaful all the takaful insured byTakaful companies then there is no need for reinsuranceanymore.

• Thus, the situation of “darurah” is not exist anymore, the

law will revert back to the original hukum which is“reinsurance with the conventional companies is notpermitted.
