Preface Purpose of Manual The purpose of this Manual is to assist Ministry of Forests and Range personnel with the creation of Exhibit A mapping for tenure administration purposes. It refers to legal requirements and also provides advice and suggestions that are neither legal requirements nor government policy. Content suggestions, corrections, and questions should be submitted to Lew Greentree, Regional Geomatics Coordinator, Coast Forest Region ([email protected]).

The Manual will be updated as required to reflect new legislation, policy changes, and user requirements for additional content. The current version will be available via these links:

1.0 Introduction

1.1 Overview Resource Tenures and Engineering Branch is the custodian of the tenure layers in the Land and Resource Data Warehouse (LRDW), and GeoBC is the data steward for administrative boundaries. Ministry of Forest and Range (MFR) Geomatics Services staff who use the tools in the Forest Tenure Administration (FTA) system, including Spatial Capture Tools and the Electronic Submission Framework (ESF), are responsible for maintaining the LRDW layers that provide the spatial database for all Forest and Range tenures, agreements, and administrative boundaries.

1.2 Integrated Land and Resource Registry (ILRR)

ILRR is a single source of reliable information on 262 different legal interests on Crown Land—tenures, regulated use, land and resource use restrictions and reservations—that is visually represented on a map and available to the public using a standard web browser. ILRR also contains information on Crown Land parcels, private land parcels (when available), administration boundaries (Forest Districts, electoral boundaries, etc.), and base map information (topography, grid, etc.). Interest Types and Abbreviations, a comprehensive list and description of the legal interests registered in ILRR, is available at http://ilmbwww.gov.bc.ca/ilrr/interests.html. ILRR uses a real-time process, usually within 30 minutes, to register Crown Land, Forest, Range, oil and gas, and mineral interest requests in ILRR, thereby enabling the immediate viewing and statusing of those interests. Some interests that change less frequently (e.g., Guide Outfitter areas) are batch-loaded on a scheduled basis. Additional real-time processes are being developed to capture Crown Land data that is currently batch-loaded. Private land information will be added as it becomes available from the Integrated Cadastral Information Society or municipalities. GeoBC’s Geographic Data Discovery Service provides metadata for each type of record in ILRR—description, custodian, data date, update cycle, purpose (intended use), and presentation form.

1.3 Land and Resource Data Warehouse (LRDW)

LRDW is the corporate repository for integrated land, resource, and geographic data that supports a variety of business requirements for other government agencies, the natural resource sector, industry, and the public.

2.0 Clearances 2.1 Overview

Clearance is an adjudication of whether pre-existing rights are in conflict with a proposed granting of rights to an applicant. A full clearance is required for all new tenures. The process of determining the status of a parcel or area of land proposed for an agreement under the Forest Act is referred to as “statusing.” See Appendix J for a complete list of Forest Act Forms of Agreements. The appropriate statusing procedure varies with the tenure type and the needs of the Ministry. Individual tenures covered by specific agreements under the Forest Act are statused using clearance procedures. These tenures include, but are not limited to, Timber Sale Licences (Major), Timber Sale Licences (Minor), Road Permits, Forest Service Roads, Forest Service Maps, Notations, Special Use Permits, and Woodlot Licences. Statusing is research carried out by using and accessing various records and documents to determine the answers to three questions:

1. Is the “resource” Crown Land?

2. Is the access to the “resource” on Crown Land?

3. Are there existing prior rights to the “resource” or on the land? If so, are they legally and logically compatible with the application?

Statusing is carried out prior to the granting of permits and agreements, and for status enquiry purposes. Situations that require statusing and a clearance include:

The identification of existing interests or rights on a pre-determined area or parcel of land.

The elimination or protection of the prior rights or interests of other parties before the issuing of agreements as permitted under the Forest Act.

The establishment of priority in the Integrated Land and Resource Registry (ILRR) over lands cleared under specific Forest Agreements.

Note: "Status" and "Clearance" processes are restricted to documented rights and do not address asserted rights by First Nations.

2.2 Tenure Conflict Descriptors

Refer to the Clearance Advice Matrix (Appendix M) for standardized tenure conflict descriptor advice to apply to various tenure types.

Note: The following lists are a guide only. There will be circumstances where the suggested usage of the individual processes will not be applicable due to the various purposes that some tenures can be issued for. To ensure the correct process for resolving conflicts is used refer to the source documents for the conflicts and determine their compatibility both operationally and legally. If in doubt contact the status group at ILMB, Crown Registry and Geographic Base Branch for guidance and advice.

2.2.1 Exclusions An Exclusion is an area within an application request that is covered by titled, reserved, or occupied land that is incompatible, under the provisions of the Forest Act, with the conditions of a proposed Agreement or Permit. Exclusions can be done in 2 ways: a. Physical Exclusion: Used where the polygon/line would be divided into multiple

parts (drawing around the area to be excluded with a bold black line on the Ex A). b. Verbal Exclusion: No spatial change for any area or right of way that are too

small to show in the boundary. As an example, the words "Excluding thereout: Highway 16 may be used on the Exhibit A."

Examples of Physical Exclusions:

Private Land – Crown Grants, Dominion Patents Mineral Claim District Lots – if applicant and legal land title owner are not the

same = Exclude, otherwise parcel is considered Crown for the business of mining only, Surface rights are Crown resources. Check Grant for wording as to their rights, do they pay mineral tax? Undersurface = Referral.

Applications for Crown Grants Indian Reserves Residential/Recreational Leases Agriculture Leases with Purchase Option Industrial Leases (ie. Licence of Occupation Light Industrial and Lease for

Note: Verbal Exclusions are also referred to as Exclusions – By Notation and no

spatial modification is required. 2.2.2 Save and Excepting prior rights

Where an area within an application request is covered by occupied or reserved land that is, under the provisions of the Forest Act, compatible with the terms of the proposed Agreement or Permit, prior rights are to be "Saved and Excepting Thereout” This entails consultation between the two parties to acknowledge the rights of the first tenure by the second. No changes to the application boundary are necessary.

LRDW of an interest in Crown land for forest use within a Provincial Forest, which requires long term or continuous consideration. “Notation of Interest” means a recording made by BC Lands in the LRDW of an interest in Crown land by a provincial agency or ministry, which requires that the interested agency be given the opportunity to comment on any Land Act disposition or reserve proposal made over the subject Crown land.

2.2.3 Referrals

Referral letters are prepared and distributed to agencies and tenure holders who have an interest in the area covered by the application. Sometimes, the applicant may be required to undertake the referral to stakeholders prior to making an application.

The referral letter recipient is usually given 30 days to respond that conflicts exist which the applicant needs to be aware of. For example, the agency or tenure holder may require protection of improvement that have been made in the area of interest. No reply generally means that no conflicts exist. Examples that require a referrals:

2.2.4 Comments Comments may be added to the adjudication report to document information that affects the adjudication of the application (due diligence).

2.3 Standard Clearance and Issuance Process Figure 3 shows the Ministry of Forests and Range computer applications used in the tenure clearance and issuance process.

completing statusing when the District Geomatics Technician has discovered as much as possible with the available resources;

providing further research in consultation with Districts;

using research resources in Victoria that are not available in the Districts, including historical registers and maps, legal documents, and old files;

protecting District Offices from errors and unnecessary legal costs;

assisting in determining the availability of land;

assisting in the issuance of permits (the District is responsible for all approvals once Victoria has completed the status work); and

reporting inconsistent data to the appropriate Ministries. 2.4.2 Special Requirements

1. Forest Service Roads: An FSR always requires full statusing and clearance, and is

always excluded from other tenures. All interests within 37.5 metres on either side of a Forest Service Road (75-metre wide buffer zone) are called up in geographical order from Point of Commencement to Point of Termination, Branch by Branch.

2. BC Timber Sales Roads: A BCTS Road should be designated as such in FTA. However, the Exhibit A map need not indicate BCTS as the licensee.

3. Grazing Licences and Permits:

(Note: Woodlot licences may only be issued over existing grazing leases to the grazing lessee. When a woodlot licence is the intended timber tenure, its management and working plan will be coordinated with the grazing lease management plan to protect the interests of the lessee and minimize resource conflicts.)

4. Woodlot Licence Roads and CPs: For Roads and CPs that fall completely within a Woodlot Licence and for which the applicant is the Woodlot Licence tenure holder, the Woodlot Licence status report may be used for the clearance ( “Refer to…”).

5. Provincial Forests: See Appendix P for a list of land uses that are authorized within a Provincial Forest.

2.4.3 Request for Adjudication Report

An adjudication report lists all conflicts and their resolution as recorded in the FTA database. If MFR staff cannot resolve all conflicts and adjudication by GeoBC staff is required, MFR requests adjudication from GeoBC as outlined below. On the FTA Inbox screen, the MFR user clicks on the <Currently Assigned To> button to request adjudication assistance from GeoBC staff. This submits an e-mail to the GeoBC adjudication e-mail address with the submission record flagged for display in the GeoBC user's inbox. The adjudication report is used by the district manager to decide whether a tenure should be issued. It has no contractual role with the tenure applicant. FTA uses a Spatial Overlay Engine (SOE) to create the Adjudication Report. The LRDW layers that are reported against are listed in Appendix I Note: Everything that is quoted in the Clearance report MUST be shown on the Exhibit A map Buffers used to determine map report layers When features are reported against, the feature itself is used to generate conflicts. For roads, this is half the width on either side of the line. For road permits and FSR’s that is 37.5m, but for SUP roads it is variable. In addition to conflicts, adjacencies are generated as well. In order to generate adjacencies, the features are buffered, new conflicts determined and marked as adjacent (meaning they are close). All file types are buffered by 20m for adjacency, except that linear features are 20m on either side.

2.5 Amendments and Re-Engineering

For Amendments, the permit is re-submitted by the licensee via ESF as an “Amended” tenure. The permit is processed in the same way as a new permit.

N - No, there are no unresolved conflicts in the submission.

2.7 Deleting a Tenure This is the act of entirely removing tenures from FTA that were “Entered in Error.” These are tenures that were never issued.

2.8 Retiring a Tenure

This is the act of moving a portion of a tenure or the entire tenure from being an active tenure to becoming an historical one. Retired map features are flagged with a retirement date and then do not present as conflicts against future applications.

Note: Retirement can be done on the FTA133 screen or via an ESF submission.

2.9 Transferring a Tenure

This is the act of moving an entire tenure or portions thereof to another client or from one tenure to another. The tenures on both sides of the transfer transaction require new Exhibit A maps.

2.10 Re-Labelling a Tenure

This is the act of changing the legal identifier (i.e., Business Key identifier) for a tenure. A new Exhibit A map is required after a tenure is re-labelled.

3.0 Exhibit A Maps 3.1 Definition and Purpose of Exhibit A

The term “Exhibit A” generally refers to the maps that depict the location and description of all Forest and Range tenures. An Exhibit A provides a graphical representation of a legal description of a parcel of land, whether it is a metes and bounds description and/or a legal (surveyed) description. It shows the area of application in relation to agreements issued by various Ministries and in relation to topographical and cadastral surveys. The Exhibit A serves as the source document for clearance and statusing1

purposes, and provides a legal identification of a Forest Agreement area when used as an addendum to the Agreement as a site-specific legal description.

3.2 Minimum Requirements for Exhibit A Maps2

The following are the absolute minimum Exhibit A requirements because they are essential to the business needs of the Ministry and tenure holders:

1. The boundaries of Forest Act tenures must be clearly described. Although other methods are available, the best method is by way of a map or plan that clearly shows the boundaries.

2. The descriptions of Forest Act tenures must contain sufficient information to enable the boundaries of the tenure to be located relatively easily on the ground within required tolerances.

3. If a trespass or other infraction occurs and prosecution or litigation commences, it must be possible to survey the boundaries accurately for evidentiary purposes.

4. All Exhibit A maps should have similar informational content, irrespective of the scale at which the map is plotted. The required information includes:

surveyed boundaries previously alienated areas inside and adjacent to the area of concern pertinent conflicts raised in the FTA Map Report topographical features

3.3.1 Automatically Generated Maps

The primary output product of the electronic tenure update process is the Exhibit A map created for a new or amended tenure. The map is automatically generated by the FTA electronic submission process, and must be evaluated for content and clarity before it is attached to the tenure document. During this evaluation, it is important to determine whether or not it is possible to easily define the tenure boundary on the ground (within required traversing tolerances) from the information on the Exhibit A map. Tip: The quality of the automatically generated maps created in FTA varies. If the map

quality is poor, try using the Regenerate Map function in FTA before spending time making a replacement map.

3.3.2 Replacement Maps

Sometimes the automatically generated map is not satisfactory for the Ministry’s legal purposes (see Section 3.2). Under these circumstances, a replacement map must be produced and uploaded into FTA. A replacement map can be created while the tenure application is in the FTA Inbox or, with additional security access, it can be uploaded into FTA when the tenure application is not in the FTA Inbox.

3.3.3 Regenerate Exhibit A Map

FTA provides functionality for regenerating the Exhibit A map because the state of Exhibit A and its related features are dependent on one another. Changes to an Exhibit A will require a refresh of its respective feature images, while changes to a feature image will require a refresh of its Exhibit A.

As such, the regeneration function is available at the application level within FTA. A request for image regeneration will result in both the regeneration of the applications Exhibit A image, and all its feature images.

When regenerating the Exhibit A map with FTA, the output map size, orientation, and scale must be specified as part of the image regeneration request. Valid values for each of these parameters are listed in data model changes section.

3.4 Composition

An Exhibit A map is created using field information, traverse notes or Global Positioning System (GPS) data, and the appropriate custodial layers from the LRDW (see Appendix I). Reference information may include the original cadastral survey information (official plans, field notes, etc.) and, when necessary, orthophotos. The map must be drawn clearly to prevent errors in interpretation.

3.5 Inset Map An Exhibit A map for a small application area (e.g., Repeater Site, Special Use Permit, or Lookout Project) should include both an inset map indicating pertinent surrounding information and a large-scale, detailed map (blow-up) indicating bearings and distances. When more than one scale is used in the creation of the Exhibit A map, indicate the scale of the drawing. The Scale field notation should be “See below.”

3.6 Preparation of Exhibit A To determine the scale at which the Exhibit A map is to be drawn, consider the size of the area and the amount of information that already exists on the ground—previous applications and topographic and surveyed information—and then choose a metric scale that is a multiple of 5,000, as follows:

1:5000, 1:10000, 1:15000, 1:20000, 1:30000, 1:50000, etc.

3.6.1 Conflicts Before creating an Exhibit A map, identify and resolve each pre-existing conflict in one of two ways—Excluding thereout or Save and Excepting Prior Rights. Section 2 has detailed information about the use of clearance conflict descriptors.

Where possible, Exclusions should be outlined with a boundary line that is the same as the application boundary line to indicate its exclusion from the area. Where an area in conflict is located on or across the boundary of the application, the boundary of the application must be amended to exclude the conflicting area from the application.

For areas or rights-of-way that are too small to show a boundary, the notation “Excluding thereout (type of tenure)” is to be made on the Exhibit A (see yellow highlighted text in Figure 1).

3.6.3 Point of Commencement (POC)

All Exhibit A maps must include a Point of Commencement (POC), which represents the starting point of the metes and bounds description. The POC provides a known point from which the metes and bounds description defines the location of the area of concern shown in the Exhibit A map. All measurements from the POC are to be stated with bearings or coordinates (UTM\Latitude Longitude) and distances in metres If practical, the same reference point used for the POC should be used for all tie points. The POC should be—or be taken from—the nearest of the following points, which are listed in order of preference:

Surveyed corner of a Lot, Block, SubLot, Section, Legal Subdivision, Indian Reserve, or Mile Posts of a survey boundary. Corners of Timber Licences or other old temporary tenures are not acceptable.

Triangulation Stations (Horizon Control Points) must be defined by longitudinal and latitudinal ties.

UTM or Lat/Long GPS coordinates may identify the first point along the GPS polygon or the start point of a linear feature as POC.

Note: Under no circumstances is any area to be tied to the corner latitude and longitude

junction of a map.

3.6.4 Dimensioning Dimensions must follow a clockwise or counter-clockwise rotation, but never a combination of the two. The boundary of the subject area on the Exhibit A must be defined by:

bearings and distance cardinal direction and distance (where the bearing is North, South, East, or

West, there is no need to label it) following a surveyed line (when following a boundary from surveyed point

to surveyed point, bearings and dimensions need not be included) a natural boundary (river, creek, height of land, lake shore, ocean shore) man-made features such as roads (man-made features like timber type lines,

red painted lines, and fences are not definable boundaries) traversing

Note: The stated distance of a boundary may be ± (more or less) only if the boundary

3.6.5 Tie Points Where a boundary leaves a natural or man-made feature, the point of departure must be defined. This point is identified as a “Tie Point” and is identical to the POC in its constraints. Note: Tie Points are not required when GPS or traverse notes are used for boundary

identification.

3.6.6 Point of Termination (POT) The last defined location point is the Point of Termination (POT). It is used only for Road and Recreation Trail Exhibit A maps. The POT has the same restrictions and tolerances as the POC.

3.6.7 North Arrow All Exhibit A maps must include a simple North Arrow.

3.7 Preparation of Exhibit A for Forest Service Roads

Exhibit A maps for Forest Service Roads (FSRs) should be prepared in accordance with the requirements and procedures outlined above and those listed below:

1. All Branches of a Forest Service Road must include a Point of Commencement (POC) and a Point of Termination (POT) as outlined above in Section 3.6.3 and Section 3.6.6, respectively.

2. POCs and POTs must use UTM Coordinates in metres as established by GPS.

3. The base may indicate all natural and man-made features within one kilometre of the centreline on either side of the Forest Service Road. Whenever possible, all designated public roads should be named and/or numbered. All existing Forest Act, Range Act, and Land Act tenures must be included on the Exhibit A map.

4. A table containing specific information on individual Branches may be included. Example of Branch information table:

5. When an additional Branch will not fit on an existing Exhibit A map, a new map of the entire tenure is required, and the Branch number and name must be shown on the new map. The new Branch must include a POC and POT.

6. When an existing Exhibit A map is amended, the title block must be changed to include the new Branch numbers. The date of revision must also be included. The location of the new Branch must be indicated with a bold black line.

7. When one or more Branches of a previously cleared FSR network are to become part of another FSR network, they are transferred. For the transferred Branch, the District will prepare an Exhibit A map and clearance covering the establishment of the new FSR network.

Note: A forest service road dedication in itself, is not a forest service road, it is land purchased by MOFR for the purpose of building an FSR. Even if the FSR is discontinued and closed the land is still under the administration of MOFR until such time that it is either returned to the land owner or transferred to MOT under the Forest Act or transferred to another agency under the Land Act. For that reason the dedication should reside in the FTEN layer in the LRDW until it is disposed of under one of the options above.

3.8 Preparation of Exhibit A for Cutting Permits Exhibit A maps for Cutting Permits (CPs) should be prepared in accordance with the requirements and procedures outlined above and those listed below:

1. For all CP Blocks, boundary identification must use GPS or closed traverse, with a station established at least every 100 metres. Stations must be numbered.

2. The maximum acceptable closing error for the uncorrected final closed traverse is one percent (1%).

3. When the area within a CP must be amended, an amended ESF submission and a new Exhibit A map are required.

3.9 Preparation of Exhibit A for Timber Licences

A bold black outline for the active portion of the Timber Licence block is acceptable but the external boundary of the Timber Licence block must still be indicated, using the same line weight as the background information. The Exhibit A title block must include the notation “Active Portion” in the Shown As field. When calculating the area of the Timber Licence, water area (lakes and double line rivers) is to be calculated as an Elimination but not shown as an Elimination.

Appendix J: Forest Act Forms of Agreements

(1) A district manager, a regional manager or the minister may enter on behalf of the

government into an agreement granting rights to harvest Crown timber in the form of a

(a) forest licence,

(b) [Repealed 2004-36-4.]

(c) timber licence,

(d) tree farm licence,

(e) community forest agreement,

(f) community salvage licence,

(g) woodlot licence,

(h) licence to cut,

(i) free use permit,

(j) Christmas tree permit, or

(k) road permit.

(2) A timber sales manager may enter on behalf of the government into an agreement

(a) timber sale licence,

(b) forestry licence to cut, or
