Memorandum

TO: Chief Criminal Deputy Chadwick FROM: Undersheriff Jeff Parks DATE: 5/12/2011 SUBJECT: Review of counseling concern Regarding the administrative review that you forwarded concerning the actions of Deputy Murphy on or about the weekend of April 30, 2011, I find that there are several aspects of serious concern. I concur that you should further discuss the incident with and counsel Deputy Murphy regarding his decision-making and communications with Planning and Development personnel. In addition the Sheriff has received prior notice from the Deputy Sheriff’s Guild that violations of the FLSA are “likely to result in grievance or federal suit”. You are to also specifically order Deputy Murphy that he is not to conduct official business of the Sheriff’s Office, and is not to conduct nor participate in any investigation under authority of his commission, on off duty time. If he is in a situation where action is necessary he is to obtain proper authorization to work and is required to submit the appropriate claim for the time worked. If he is in a situation where immediate action is necessary to protect life or property from imminent threat he is to follow the established procedures of the Sheriff’s Office. We have no discretion in this matter as it is a clearly settled area of law as pointed out by the bargaining unit that represents Deputy Murphy.
