The School Board of Miami-Dade County, Florida has approved the Contractor Prequalification Certification application for EPIC Construction, Inc. This certification authorizes the company to bid as a general contractor, on a single construction project not to exceed $2,000,000.00 (Two Million), and an aggregated amount not to exceed $10,000,000.00 (Ten Million).

The' certification is valid for one year and will expire on July 12, 2007. Should you so desire, you may at any time duri~g this period request to increase the company's bid limit. This request must be in writing, and must be accompanied by petiinent documentation supporting the application for increase. The submitted documents must include, but not be limited to, evaluations for completed projects, bonding capacity for the amount requested, as well as a formal letter addressed to this writer requesting the increase.

SUBJECT: PREQUALIFICATION OF CONTRACTORS FOR EDUCATIONAL FACILITIES CONSTRUCTION

COMMITTEE: FACILITIES & CONSTRUCTION REFORM

On December 9, 1998, The School Board of Miami-Dade County, Florida, adopted School Board Rule 6Gx13-7D-1.05, Prequalification of Contractors for Educational Facilities Construction. This rule was created pursuant to Section 1013.46 Florida Statutes and State Requirements for Educational Facilities (1997 [SREF]), and requires school districts to prequalify contractors prior to bidding construction contracts. The statute became effective July 1,1998,

As a part of reengineering the prequalification process, the rule was amended in May 2004, which sets forth operating procedures that ensure full compliance with Florida Statutes and SREF. Moreover, the rule delineates the duties and responsibilities of staff to ensure that appropriate documentation is provided to the Prequalification Review Committee for the initiation of delinquency proceedings to revoke or suspend the certificate or invoke contractual remedies. The Office of Construction will collect information such as inspection and plan reviews, punch list data, schedule and quality information, quarterly evaluations and any other pertinent documentation deemed necessary, pursuant to the prequalification Board Rule. Furthermore, Construction is also developing a formal training program to assist staff in documenting and compiling evidence to support the non-performance of contractors. The District believes that upon the continued implementation of the enhanced policies and procedures, contractors deemed non-responsible will be ineligible to perform District work.

The Contractor Prequalification Review Committee (Committee) evaluated applications from four (4) companies that applied for contractor prequalification certification and from twenty-one (21 ), to either increase a Prequalification Certification limit, or to renew a Contractor Prequalification Certificate. This item also includes project information for each company that has performed work as a prime contractor for the District.

ARTICLE 13. CONTRACT PERIOD The Contract period for the award shall be for 12 months from the time of Board Award or the point at which the maximum contract amount is reached, whichever occurs first. Upon mutual agreement between the Board and Contractor, the Contract may be renewed twice for an additional twelve (12} month period each. (Total 36 months-see General Conditions, Provision 14)

ARTICLE 14. BOARD'S RIGHT TO REJECT SUBCONTRACTORS The Contractor shall submit with each Proposal the names of the subcontractors the Contractor proposes to utilize for the performance of all subdivisions of work Including design services, together with the division of work, if applicable. The Board reserves the right to reject the Contractor's use of any subcontractors under this Contract.

ARTICLE 15. CONTRACT AMOUNT A. The minimum contract amount for JOC13-C1 and JOC13-C2 for the 12-month period Is

$50,000.

B. The maximum contract amount for the 12-month period shall be $2,000,000 for JOC13-C1 and JOC13-C2, except that if the maximum Is reached prior to expiration of the contract period the Contract may be extended twice for an additional $2,000,000 for JOC13-C1 and JOC13-C2 each at the direction of the Superintendent or his designee, provided the performance and payment bond is extended accordingly. If the two extensions are exercised, this will result in a potential contract amount of $6,000,000 for JOC13-C1 and JOC13-C2 for a 12-month period. · · ·

ARTICLE 16. QUALIFICATIONS OF CONTRACTOR
