SYNOPSIS

A resolution is requested authorizing execution of a preconstruction services agreement for the Downers Grove Police Department and Village Hall between the Village of Downers Grove and Leopardo Companies, Inc. ("Leopardo") in the amount of $600,107.

STRATEGIC PLAN ALIGNMENT

The goals for 2017-2019 include Exceptional Municipal Services.

FISCAL IMPACT

The FY19 budget does not include funding for the Village facilities project. However, funds for this contract are available in the Major Buildings Fund and Asset Forfeiture Fund. An amendment to the FY19 budget will be required.

RECOMMENDATION

Approval on the February 12, 2019 Active Agenda.

BACKGROUND

On December 18, 2018, the Village Council approved a motion to direct staff to implement key terms of the Facilities Sustainability Plan. In order to continue to meet the timeline outlined in the key terms, staff is recommending the authorization of a preconstruction services agreement with Leopardo for schematic design; reimbursable expenses for various services, including geotechnical testing, telecommunication tower consultant and utility locates and coordination; and for a revised program budget.

The schematic design phase includes: The exploration of various design and planning alternatives, including, site and open

space considerations, environmental impact, functional layout and efficiencies, accommodation of security systems, technology systems, circulation analysis, energy conservation, massing, design vocabulary, growth, flexibility and capital costs.

The development of a site plan, floor plans, and elevations, and basic wall sections. Site related factors such as site access, security zoning, risk assessments, parking, drainage, solar orientation, and context will be studied to develop the design options including preliminary floor plans.

RESOLUTION NO.

A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF DOWNERS GROVE

AND LEOPARDO COMPANIES, INC.

BE IT RESOLVED by the Village Council of the Village of Downers Grove, DuPage County,

Illinois, as follows:

1. The Village of Downers Grove, DuPage County, IL (the "Village") is a home rule

municipality pursuant to Section 6(a), Article VII of the 1970 Constitution of the State of Illinois, and as

such may exercise any power and perform any function pertaining to its government and affairs (the

"Home Rule Powers").

2. The Village Council of the Village has the authority to adopt ordinances and to

promulgate rules and regulations that pertain to its government and affairs and protect the public health,

safety and welfare of its citizens.

3. The Village has enacted certain procedural requirements for obtaining bids and proposals

for projects and services.

4. That pursuant to its Home Rule Powers, the Village has the authority to waive the bid

and proposals requirements.

5. That the Village Council finds it is in the best interests of the Village to waive the bid and

proposal requirements for the services included in this Agreement; and therefore, hereby waives any

applicable public bidding or proposal requirements imposed by state statute or Downers Grove ordinances

or policies.

6. That the form and substance of a certain Agreement (the "Agreement"), between the

Village of Downers Grove (the "Village") and Leopardo Companies, Inc. (the "Consultant"), for

preconstruction services (schematic design) for the Downers Grove Police Department and Village Hall,

as set forth in the form of the Agreement submitted to this meeting with the recommendation of the

Village Manager, is hereby approved.

7. That the Village Manager and Village Clerk are hereby respectively authorized and

directed for and on behalf of the Village to execute, attest, seal and deliver the Agreement, substantially in

the form approved in the foregoing paragraph of this Resolution, together with such changes as the

Manager shall deem necessary.

8. That the proper officials, agents and employees of the Village are hereby authorized and

directed to take such further action as they may deem necessary or appropriate to perform all obligations

and commitments of the Village in accordance with the provisions of the Agreement.

9. That all resolutions or parts of resolutions in conflict with the provisions of this

Resolution are hereby repealed.

10. That this Resolution shall be in full force and effect from and after its passage as

provided by law.
