Re: Response to Alleged Infringement of Seriously Awesome Stuff’s Intellectual Property
Dear Mr. Clunk:
We represent Highley Holdings, LLC in connection with their trademark matters and are
in receipt of your letter dated October 20, 2020 and sent on November 16, 2020, regarding your
client, Seriously Awesome Stuff, LLC, and its United States Trademark Registration No. 5,881,321
for the mark “DAILY DOSE” for “hair care preparations” in International Class 003.
While we do not agree that our client’s use of the mark as proposed would be likely to
cause confusion with your client’s use of the mark for “hair care preparations” as our client’s
goods are unrelated and are sold in different marketing channels, Highley Holdings, LLC respects
your client’s intellectual property, and as a sign of good faith has deleted International Class 003
in its entirety from its pending trademark application, United States Trademark Serial No.
90169403. The amendment has been accepted by the USPTO as shown in the enclosed
Trademark Snap Shot Amendment & Mail Processing Stylesheet. We did not, however, withdraw
the application as requested, as we believe the remaining goods and services are very clearly
unrelated to your client’s “hair care preparations,” are sold in different marketing channels, and
would not be considered to be within a reasonable zone of expansion. As such, there is no risk
that our client’s use of the mark with the remaining goods and services will cause confusion.
We believe this resolves all outstanding issues and we thank you for your cooperation.
