EX10 APPLICATION FOR PERMITS UNDER ONTARIO REGULATION 166/06 Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Information has been received and reviewed by staff for the following Scheduled Errata items. The recommendations within the staff reports should be amended to include the following: ERRATA ITEMS (MAJOR) EX10.13 MILLWOOD VALLEY DEVELOPMENTS INC.

Letter of Undertaking for Topsoil Stripping, prepared by Schaeffers Consulting Engineers, dated November 6, 2015, received by TRCA on November 12, 2015. AND MUST COMPLY WITH THE FOLLOWING CONDITIONS IMPOSED BY THE EXECUTIVE COMMITTEE: The Owner will notify TRCA Enforcement staff 48 hours prior to the commencement of works and within 48 hours upon completion of works. The Owner will grant access to the property to TRCA, its employees, or other persons as required by TRCA for the purpose of compliance inspections, obtaining information, and/or monitoring all works, activities and/or development pursuant to the approved drawings, reports and conditions specified herein. The Owner acknowledges that permits granted by TRCA are non-transferrable and are issued to the current owner(s) of the property. The Owner further acknowledges that a new permit is required should the property be sold, or otherwise transferred into different ownership. The Owner acknowledges that: (1) permits granted by TRCA are valid for a period of two years from the date of issue unless otherwise specified on the permit; (2) it is the responsibility of the Owner to ensure a valid permit is in effect at the time works are occurring; and (3) if it is anticipated that works will not be completed within the allotted time, the Owner will notify TRCA Planning and Development staff 60 days prior to the expiry date in order to re-establish a valid permit. The Owner will ensure all excess fill (soil or otherwise) generated from the development will not be stockpiled and/or disposed of within any area regulated by TRCA (on or off-site) pursuant to Ontario Regulation 166/06 without a permit from TRCA. The Owner will install effective erosion and sediment control measures prior to

the commencement of works and maintain such measures in good working order throughout all phases of development to the satisfaction of TRCA. The Owner acknowledges that the erosion and sediment control strategies outlined on the approved drawings are not static and that the Owner will upgrade and amend the erosion and sediment control strategies as site conditions change to prevent sediment releases to the natural environment to the satisfaction of TRCA. The Owner will permanently stabilize all disturbed areas immediately following the completion of development and remove/dispose of sediment controls from the site to the satisfaction of TRCA.

The Owner will strictly adhere to the approved design drawings and reports, including TRCA redline revisions, to the satisfaction of TRCA. The Owner acknowledges that all proposed revisions to the design of this project must be submitted for review and approval by TRCA prior to implementation of the redesigned works. That topsoil stripping work will only take up to the limit of the double environment fencing shown on Drawing No. SC-1 (Siltation Control Plan), prepared by Schaeffers Consulting Engineers, Revision No. 1 (revise dated November 5, 2015). The Owner will coordinate a pre-construction meeting with the agent, contractor, engineer, inspector, TRCA, municipality and any other regulatory agencies prior to the commencement of works to the satisfaction of TRCA. The Owner will retain a qualified and/or certified (e.g., CISEC) professional third party (individual or company) to conduct all erosion and sediment control inspections to the satisfaction of TRCA. The Owner will ensure erosion and sediment control inspection reports are submitted to TRCA by a qualified and/or certified (e.g., CISEC) professional to the satisfaction of TRCA: (1) weekly; (2) after every significant rainfall and significant snow melt event; (3) daily during periods of extended rain or snow melt; and, (4) monthly during inactive development periods, where the site is left alone for 30 days or longer. The Owner will ensure that any stockpile of material does not exceed 3m in height and that any side slopes are no steeper than 3H:1V. If the stockpile stays longer than 30 days, the piling area is be stabilized. Stockpiles are to be located away from the buffer and no closer than 15 from the top of slope to minimize adverse effects. The Owner will repair any breaches of the erosion and sediment control measures within 48 hours of the breach to the satisfaction of TRCA. The Owner will repair on and off-site erosion and/or sediment damage resulting from ineffective and/or failed erosion and/or sediment control measures within a period of time agreed to by TRCA to the satisfaction of TRCA. The Owner will report any spills, including but not limited to sediment, to the Ontario Ministry of the Environment Spills Action Centre at 1-800-268-6060 in accordance with the Ministry’s reporting guidelines. Within 60 days of the completion of the approved works, the Owner must demonstrate to the satisfaction of TRCA that the works approved under this permit have been implemented pursuant to the approved drawings, reports and conditions. This will include, but is not limited to the submission of as-built drawings and written certification by the consulting engineer and/or other professionals as deemed necessary by TRCA to the satisfaction of TRCA. The Owner agrees to pay any additional fees requested by TRCA in accordance with the TRCA Administrative Fee Schedule for Permitting Services (May 2014), as may be amended, within 15 days of being advised of such in writing by TRCA, for staff time allocated to the project regarding issues of non-compliance and/or additional technical review, consultation and site visits beyond TRCA’s standard compliance inspections. The Owner will control all activities, including maintenance procedures, to prevent the entry of petroleum products, debris, rubble, concrete or other deleterious substances into watercourses or other natural features to the satisfaction of TRCA. Furthermore, the Owner will conduct vehicular refueling and maintenance 30 metres from watercourses to the satisfaction of TRCA.

The Owner will stabilize all disturbed areas within 30 days of the date the areas become inactive to the satisfaction of TRCA.The Owner will permanently stabilize all disturbed areas within 30 days following the completion of development and remove/dispose of sediment controls from the site to the satisfaction of TRCA.

RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this permit application is to alter the alignment of a portion of a headwater drainage feature associated with Pomona Creek and the reconstruction of an existing on-line stormwater management facility and the reconstruction of an existing on-line stormwater management facility within a TRCA Regulated Area of the Don River Watershed,. The realignment of the feature is required to facilitate the implementation of the next phase of funeral services for the Archdiocese of Toronto, including the construction of a second Mausoleum for the Holy Cross Cemetery, the construction of a network of service and access roads, and the reconfiguration of an existing on-site stormwater management pond, associated with a site plan control application and a municipal building permit. The subject property is located south of Highway 407, east of Langstaff Road, and west of Bayview Avenue. The existing feature is a remnant of a dendritic headwater drainage feature, of which many sections of the feature has been removed over the years through site alteration and grading works within the cemetery lands. The remaining feature conveys surface flows from the Langstaff Secondary Plan Area, surface drainage from the cemetery lands, and drains into an online wetland stormwater management facility, but does not support fish habitat. The facility drains to an outfall which is piped south of the cemetery, into an existing residential community, which outlets into Pomona Creeks further downstream. The existing stormwater facility is subject to drainage easements in favour of the City of Markham. The proposed redesigned pond will be constructed to the satisfaction of the TRCA and City and will require a permit from the Ministry of the Environment and Climate Change (MOECC). The easement documents will be adjusted to reflect the changes to the facility from a wetland stormwater facility to a symmetrical, open water stormwater management pond and the easements will remain in favour of the City of Markham. The realignment of the drainage feature will remain open and continue to convey existing flows. The new channel will be seeded and planted to provide thermal mitigation. Any future development plans which may further require amendments to the channel will be subject to a separate permit upon application of the third phase of development of the Cemetery. The proposed works are located on tableland, and is not within the Regional Floodplain. As such, there are no flood related concerns, geotechnical issues, or ecology related concerns with this application. Control of Flooding: The subject property is not located within the Regulatory Flood Plain. There will be no anticipated impacts on the storage and conveyance of flood waters. Pollution: Appropriate Sediment and Erosion control measures will be put in place and maintained during all construction phases. Dynamic Beaches: Not applicable

Erosion: There are no anticipated impacts identified to slope stability or erosion as a result of the proposed works. Conservation of Land: The existing feature is currently in a constrained and in a degraded state. The realigned channel will be restored and all disturbed areas will to be stabilized with seed and restored with native, non-invasive plantings. Plantings

A restoration planting plan is included as part of the proposed works which is composed of native, non-invasive plantings consistent with TRCA guidelines.

Proposal: The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate site alteration, grading and construction of residential townhouses and the construction of an outfall. All proposed works are associated with a municipal building permit. The subject property is adjacent to a watercourse known as Tributary B within the Cornell Community. This tributary within the Rouge River Watershed was reconstructed under Ontario Regulation 158 (Fill, Construction and Alteration to Waterways) Permit No. C-05109, which was issued on May 6, 2005. It is noted that the potential loss of fish habitat within Tributary B was authorized by the Department of Fisheries and Oceans Canada (DFO) as part of Fisheries Act Authorization # 525-1342 (1999). This authorization was provided for the above previously approved works to construct a new tributary channel and to allow for the development of the triple-box culvert under Highway 7. The proposed works are located within the Cornell Centre Community, located on the south side of Highway 7 East, north of Highway 407, and east of 9th Line, in the City of Markham. The plan of subdivision (19TM-06012) formed the block on the draft plan, which was approved with TRCA conditions by the Town of Markham in 2007. The approval of the draft plan has been subject to multiple extensions over the years. The proposed works implement an approved site plan application which was reviewed and approved by TRCA staff, and include the construction of an outfall to the channel block. The setbacks to the natural heritage system were established through the original draft plan of subdivision approval. The proposed works are setback from the constructed top of bank and Regional Floodplain limit as established through the original draft plan of subdivision approval, and as such, there are no flood related concerns, geotechnical issues, or ecology related concerns with this application. Control of Flooding: The residential construction works are located on tableland, while the outfall is to be constructed on the slope of the realigned channel within Cornell Centre. The location of the outfall is set back from the tributary, and as such, staff do not anticipate the proposed works will impact the storage of conveyance of flood waters. Pollution: Appropriate sediment and erosion controls will be installed and maintained throughout the construction phase in order to prevent construction generated sediment from entering the adjacent tributary. Dynamic Beaches: Not applicable Erosion: There are no anticipated impacts identified to slope stability or erosion as a result of the proposed works. Conservation of Land: All disturbed areas and areas to be graded will to be isolated from the channel and will be restored with native, non-invasive plantings. Proposal: The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate site alteration and grading, the construction of temporary stormwater management ponds, and reinforced construction access to the site in support of the 2015 OMB and municipally approved draft plan of subdivision, associated with a municipal permit. The subject property is located north of Elgin Mills Road East, east of Leslie Street, west of Highway 404, and south of 19th Avenue, in the Town of Richmond Hill. Located in the North Leslie Secondary Plan Area, the Master Environmental Servicing Plan (MESP) for North Leslie (East of Leslie) was reviewed and approved by TRCA staff on August 15, 2015 for the subject lands, and subsequently approved by the Town of Richmond Hill. The works includes establishing the rough grades for the overall draft plan of subdivision and includes temporary stormwater management control ponds to treat construction generated sediment prior to discharging to the adjacent natural features. The temporary sediment and erosion controls will remain in place until the subdivision is completed, at which time the temporary pond will be removed and the permanent stormwater management ponds will implemented, and will be subject to separate TRCA permits. Engineering staff have confirmed that the proposed temporary stormwater management and mitigation plan are consistent with the principles of the approved MESP, and a comprehensive monitoring plan will be completed to TRCA's satisfaction. Staff have further reviewed the details associated with the temporary outlet structure which will discharge to wetland associated with the tributary and wetlands, and are satisfied with the level of controls. Through the MESP review process, the sensitive aquatic communities including wetlands and watercourses traversing the property, as well as a rookery containing over 60 heron nests, to the north of the property (considered as provincially significant habitat) were identified. These areas have been protected through the Secondary Plan policies with respect to the natural heritage system. As a result, development is to be phased to minimize impacts to these habitats to the greatest possible extent. The tributaries and wetlands have been protected through the policies by enforcing a 30 metre buffer from the features while the heron habitat is protected and preserved through the secondary plan policies and supporting MESP recommendation, including the prohibition of heavy equipment construction activity during the nesting season (March 15 - July 31). As such, in accordance with the approved MESP, heavy construction works are prohibited within 500 metres of the heronry from March 15 to June 31, and for the month July, heavy construction activity is prohibited within 300 metres. The remainder of the works adjacent to the heronry will be required to occur after July 31. Due to this restriction, to respect this heronry timing window, an additional construction access is required. As a result, this permit includes utilizing an existing culvert crossing to the south, which was previously used to access the lands for farming activities. The crossing is to be reinforced with concrete and steel plates to facilitate heavy truck access to the site, and will also be isolated from the creek with jersey barriers wrapped in filter cloth and coir logs in order to prevent construction generated sediment from entering the watercourse. As a precautionary measure, a contingency plan has been created in case of an accidental spill into the watercourse. With this contingency plan in place, TRCA staff have no anticipated flooding, ecology or geotechnical related concerns with this proposal. Control of Flooding: The proposed works are predominantly located on tableland, and the proposed crossing utilizes and existing culvert. As such, there are no impacts anticipated related to flood control or flood conveyance as a result of these works.

As the subdivision works will be staged. this permit does not include the planting and restoration of the environmental buffers at this time. All planting and restoration works will be included in subsequent stages of the overall construction works for the plan of subdivision and the permanent stormwater management facilities.

As the North Leslie Secondary Plan also provides for greater buffers to the natural heritage features, the OMB approved plan of subdivision provides for an overall net gain to the natural system, and as such, the works are considered acceptable. Control of Flooding: The proposed works includes the filling of the 23 cubic metres of the Regional Storm Floodplain. The works are considered to be minor, and is not anticipated that the works will create any new hazard. As all the remaining lands associated with the Floodplain will be conveyed into public ownership, there no further anticipated impacts related to flood control or flood conveyance associated with these works. The subject property is partially within a stream corridor associated with a tributary to the East Humber River. The rear portion of the property is within the Estimated Regional Storm Flood Plain associated with the watercourse. The Estimated Regional Storm Flood Plain extends to an elevation of 258.2 metres above sea level (masl) on the property. The proposed works are located within the Estimated Regional Storm Flood Plain. Based on the location of the Estimated Regional Flood Plain, there was no opportunity to locate the proposed swimming pool outside of the Regional Storm Flood Plain. TRCA staff are satisfied that the proposed swimming pool and landscaping, involving placement of patio stones, has been appropriately designed such that it will not impact flood storage and conveyance. Furthermore, the location of the proposed swimming pool is generally flat and is void of any significant natural features. As such, there are no geotechnical or ecology related concerns anticipated with this project. Control of Flooding: The proposed works will be located within the Regional Storm Flood Plain. TRCA staff are satisfied that the proposed inground swimming pool and patio stone landscaping will not impact flood storage and conveyance. Pollution: Sediment control fencing will be erected and maintained for the duration of construction to prevent the transportation of sediment from the property. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns associated with this project. Conservation of Land: The location of the proposed works is void of any significant vegetation.
