This Offset Strategy has been prepared by Biosis on behalf of Alliance Business Park Pty Ltd to comply with Condition 2 of the approval for EPBC 2017/7930.

As per condition 1 of the approval for EPBC 2017/7930, the industrial development of 165–195 O’Herns Road, Epping will be restricted to the loss of:

• 20.53 hectares of Golden Sun Moth (GSM) habitat (Figure 1)

• 9.89 hectares of Matted Flax-lily (MFL) habitat (Figure 2)

• 1.608 hectares of Natural Temperate Grassland of the Victorian Volcanic Plain (NTGVVP) (Figure 3)

These impacts will be offset as prescribed under the EPBC Act Offset Policy (DSEWPaC 2012).

The offset areas provided amount to:

• 123.60 hectares of Golden Sun Moth (GSM) habitat (6.02 times the impact)

• 24.05 hectares of Matted Flax-lily (MFL) habitat (2.43 times the impact)

• 9.50 hectares of Natural Temperate Grassland of the Victorian Volcanic Plain (NTGVVP) (5.9 times the impact)

1. Proposed Offset Areas

Three sites totalling 147.65 hectares will provide the offsets required for the development of Alliance Business Park at 165–195 O’Herns Road Epping as follows:

• Portions of Lots 1–4, Sievers Lane, Glenhope, Victoria 3444 (Figure 4) will provide 114.10 hectares of the offset required for GSM.

• The site at Lot 4 Hamilton Road, New Gisborne, Victoria 3438 (Figure 5) will provide the 24.05 hectares of offset required for MFL.

• A portion of Lot 4 Shelford – Mt Mercer Road, Shelford, Victoria 3329 (Figure 6) will provide the 9.50 hectares of offset required for NTGVVP and concurrently contribute 9.50 hectares of the offset required for GSM.

Condition 3 of the EPBC Act approval for 2017/7930 requires that offset management plans be prepared for approved offset areas. Those management plans will include a more detailed description of the offset area, current condition, proposed management actions and arrangements for monitoring, reviewing and implementing the plan (including risk management).

A description of each offset site and the associated MNES follows:

Siever Lane, Glenhope

The offset site is located in central Victoria near the locality of Glenhope, approximately 87 kilometres north-north-west of the Melbourne central business district. It is within the Mitchell Shire and Parish of Glenhope and is otherwise identified as being within Lots 1–4 of PS 727973.

The property is on the eastern bank of Pipers Creek, largely south of its confluence with the Campaspe River (Figure 7).

The condition of vegetation within this GSM offset site is detailed in Biosis (2018a) which is provided as additional information supporting this offset strategy.

The occurrence of GSM within the offset area is documented by Hamilton Environmental Services (2014, 2017) which are provided as additional information supporting this offset strategy.

Hamilton Road, New Gisborne

The offset area is located within the Shire of Macedon Ranges at Lot 4 Hamilton Road, New Gisborne, on the western margin of Govans Lane. The site is approximately 48 kilometres north of the Melbourne central business district and 4 kilometres north of Gisborne (Figure 8).

The condition of vegetation and distribution of MFL within this offset site are detailed by Biosis (2017a) which is provided as additional information supporting this offset strategy.

Thurgona, Shelford – Mt Mercer Road, Shelford

This offset site is located near Shelford, approximately 40 kilometres south of the City of Ballarat, is within the Parish of Shelford and is identified as part of Lot 4 LP4563. It is on the south-east corner of the Shelford – Mt Mercer Road and Gundies Road intersection, Shelford (Figure 9).

The condition of vegetation within this NTGVVP offset site is detailed by Biosis (2018b) which is provided as additional information supporting this offset strategy. Records of GSM within this site are documented by Biosis (2017b) which is also provided as additional information supporting this offset strategy.

Golden Sun Moth (Critically Endangered)

Impacts associated with the loss of 20.53 hectares of Golden Sun Moth (GSM) habitat will be offset by securing and managing a 123.60 hectare offset area. The offset area will consist of 114.10 hectares of habitat at Sievers Lane and 9.50 hectares of habitat at Shelford.

The development site supports only small localised areas of native vegetation but is otherwise dominated by a wide range of environmental and noxious weeds including Toowoomba Canary-grass Phalaris aquatica, Spanish Artichoke Cynara cardunculus, Spear Thistle Cirsium vulgare, Paterson's Curse Echium plantagineum, Brown-top Bent Agrostis capillaris, Sweet Briar Rosa rubiginosa, Hawthorn Crataegus monogyna, African Boxthorn Lycium ferocissimum and four Needle-grass species Nassella spp.. The site is not grazed by domestic stock although Eastern Grey Kangaroos are present. Ground cover biomass is generally dense in areas dominated by pasture grasses and noxious weeds.

The site is currently isolated (i.e. it is not within 200 metres of other habitat) by development and other approved developments (i.e. the residential subdivision of Aurora to the north, an approved industrial development to the east associated with 135 O’Herns Road (EPBC 2017/7865) and existing industrial subdivisions to the south). The habitat is also impacted by a number of features and disturbances including Edgars Creek, the recent construction of the Yarra Valley Water Epping Branch Sewer Stage 4B (EPBC 2015/7528) which bisects the site, two houses and associated infrastructure, two farm dams, planted introduced tree shelter belts and horse training tracks. These produce considerable edge impacts for the GSM habitat present by dividing it into a dozen irregularly shaped areas.

The site supports a relatively large population of GSM (276 individuals) recorded within 26.6 ha of confirmed habitat. The density of individuals is therefore calculated at just under 10.4 animals per hectare.

Given the agricultural environment associated with such habitat, there is potential for a significant decline in condition within a relatively short period of time under a business as usual scenario. Potential changes which could readily influence the population include overgrazing, a change in the type of livestock (changing from sheep to cattle), the application of superphosphate which would significantly alter the ground cover species composition and the expansion of existing weed (non-GSM food) populations in the absence of targeted control works. BAU in this environment actively discourages the presence of GSM food plants (native grasses) while actively encouraging the expansion of non-food plants such as Phalaris, Cocksfoot and Rye-grass. While these species have already been introduced into this environment, only significant changes to the BAU management would prevent ongoing decline in the abundance of GSM food plants and an expansion in the cover of favoured pasture species. This would result in an ongoing decline in food resources and a subsequent decline in GSM abundance.

An elevated level of weed control and permanent application of targeted management to improve the habitat for GSM (i.e. establish and maintain a consistent presence of inter-tussock spaces at about 20%) is expected to provide an improvement by elevating the site condition of Sievers Lane to habitat providing between 20% and 40% cover of known food source plant. Removal of perennial agricultural grasses which don’t provide habitat for GSM while allowing native food plants to set seed and spread provides a reverse scenario to BAU.

Matted Flax-lily (Endangered)

Impacts associated with the loss of 9.89 hectares of MFL habitat will be offset by securing and managing for conservation 24.05 hectares of occupied MFL habitat.

The species is known from numerous sites within the local area although the nearest population occurs about 1.5 kilometres to the north-east. It is likely that Matted Flax-lily was a common species in this environment prior to its development for agriculture and subsequently for residential and industrial purposes. Few plants recorded within the development site occur in areas identified as native vegetation but most persist in close association with the noxious weed Briar Rose Rosa rubiginosa. The spiny nature of this weed provides protection from disturbance by domestic and pest animals such as sheep and rabbits but leaves plants vulnerable to inadvertent loss during weed control works. While the population is considered significant, the habitat is also in a very poor context as land to the north is approved for residential development while all other surrounding land has been approved for industrial development. The site has also been recently impacted by the construction of the Epping Branch Sewer Stage 4B (EPBC 2015/7528). The habitat is also divided into three discrete areas separated by dense weed infestations.

The New Gisborne offset site is part of a remnant of native vegetation covering about 27 ha of the Victorian Volcanic Plain bioregion. The surrounding landscape is largely cleared with larger remnants of native vegetation only present about 800 metres to the north east where the landscape changes as the plains give way to the Central Victorian Uplands bioregion. The offset site is dominated by moderate quality native vegetation with most of the site (about 20 ha) having a site condition score of either 49 (habitat zone 1A) or 54 (habitat zone 2A) (Biosis 2017b). The balance of the site (about 5 ha) supports poor to moderate quality vegetation. While the ground cover present across much of the site is relatively diverse, the presence of a

relatively high cover of woody and grassy weeds provides a significant threat to the medium to long term condition of this habitat.

The condition of such vegetation can deteriorate significantly under an agricultural BAU scenario without targeted ecological management. Intensive ecological management is also expected to provide substantial improvements to the condition of this vegetation.

Natural Temperate Grassland (Critically Endangered)

Impacts associated with the loss of 1.608 hectares NTGVVP will be offset by securing and managing for conservation 9.50 hectares of NTGVVP.

The quality of these patches of NTGVVP was assessed by using the Victorian Government’s habitat hectare assessment protocols developed by DELWP (DSE 2004). The habitat hectare assessment considers a number of factors including weed cover, organic matter, recruitment and species richness to define a score for vegetation which is then provided as a score out of 100.

The quality of areas such as the identified offset site can deteriorate very quickly when managed in a manner with little or no consideration for the biodiversity values. In Victoria, there are no restrictions to practices such as the application of fertiliser, high stocking rates, seeding areas with exotic pasture or changing the type of animal traditionally raised on a property (i.e. changing from sheep to cattle or horses). All of such practices are considered as of right uses associated with farming land, whether or not such areas support native vegetation. While remnants of NTGVVP within an agricultural setting may have survived the development of agricultural land around them, the gradual increase in weed cover, the number of weed species, nutrient loads etc. can result in the rapid loss of vegetation quality in response to changes or disturbances (i.e. fire and drought).

Experience based on firsthand observations of the management of other grassland and grassy woodland offsets in Victoria’s Volcanic Plain bioregion indicates that vegetation/habitat not managed as an offset will decline in condition over time and such a decline is readily observed over a period of ten years or less. Conversely vegetation/habitat that is actively managed for its ecological values will improve over time.

2. EPBC Act Environmental Offsets Policy

The three offset sites are nominated to provide an outcome in accordance with the EPBC Act Environmental Offsets Policy. Gains will be delivered in the form of improving and securing existing habitat, and reducing threats to each MNES in the offset area through active ecological management.

Each offset site will improve the viability of the MNES protected in comparison to a situation where these area remain unprotected and with management otherwise focused on outcomes other than conservation.

The location of the offsets are also considered to provide a conservation gain for these MNES as the Melbourne Strategic Assessment (DSE 2009) (MSA) and associated Biodiversity Conservation Strategy (DEPI 2013) (BCS) provides for significant conservation benefits for all three of the MNES impacted by Alliance Business Park. The protection and management of these MNES outside the Melbourne region delivers a more state-wide outcome for the conservation of these MNES.

Compliance with Condition 2(b) of the approval is outlined in Table 1.

3. Legal Mechanisms & Timing

All three offset sites will be legally protected for conservation purposes in perpetuity by applying a conservation covenant as to part Section 3A of the Victorian Conservation Trust Act 1972 managed by Trust for Nature (TfN).

1. Deliver an overall conservation outcome that improves or maintains the viability of the protected matter

The Offset Strategy will: improve or maintain the viability of the protected matter/s compared to what would have occurred under the status quo

(i.e. no action and no offset). In every instance the offset sites selected will provide future quality (in 10 years) with offset greater than the quality of the impact site.

conservation covenant under part Section 3A of the Victorian Conservation Trust Act 1972, managed by Trust for Nature. provide a direct offset of approximately 100% of the offset requirements of the EPBC Act Environmental Offset Policy. by implementing offset management plans, address key threats and priority actions in relevant Recovery Plans, Threat

Abatement Plans, Conservation/Listing Advice. Key threats and priority actions for all relevant MNES include the protection of known populations on private land (i.e. Objective 3.2 of defined Recovery Actions for MFL in Carter 2010, GSM 2013 Approved EPBC Act Conservation advice under Regional/Local Priority Actions), significant management inputs at the offset sites to manage weeds (DSEWPaC 2011: Nationally threatened ecological communities of the VVP: Table 3, Carter 2010: Recovery Actions, GSM Conservation Advice: under threats).

3. Be in proportion to the level of statutory protection that applies to the protected matter

The Offset Strategy addresses the level of statutory protection that applies to the protected matter/s. This is through selection of the appropriate ‘EPBC Act status’ when using the Offset Assessment Guide being ‘critically endangered’ status for GSM and NTGVVP, and ‘endangered’ status for MFL.

4. Be of a size and scale proportionate to the residual impacts on the protected matter

The Offset Strategy specifies offsets of a suitable size and scale. This is through use of the Offset Assessment Guide, and by considering the attributes of the protected matter being impacted, the quality or importance of those attributes (regarding the protected matter’s ongoing viability), permanent/temporary nature of the impacts, threats to the offset site, time to yield a conservation gain for the protected matter, and the risk of the conservation gain not being realised.

5. Effectively account for and manage the risks of the offset not succeeding

The Offset Strategy accounts for and manages risks of the offset not succeeding. This is by specifying the residual impact, providing at least 100% direct offsets, the timing of the conservation gain (10 years), the nature and location of the offset sites and, a ‘precautionary’ estimate of the size of the proposed offset (following DoEE’s use of the Offset Assessment Guide).

6. Be additional to what is already required, determined by law or planning regulations, or agreed to under other schemes or programs

The Offset Strategy and supporting offset management plans: ensure offset areas, which are all currently subject to BAU farming activities, will be managed to enhance MNES values in

accordance with proposed future quality objectives; do not apply to offset areas subject to conservation and/or covenanting programs (i.e. other portions of the Shelford

NTGVVP offset have been secured under Victorian biodiversity offset requirements); securing the nominated offset sites under Trust for Nature covenants and management of these areas under approved

offset management plans (OMP) provides a significant conservation gain under existing BAU rights. 7. Be efficient, effective, timely,

transparent, scientifically robust and reasonable

The Offset Strategy and/or supporting offset management plans will maintain or improve the viability of the protected matter through sound allocation of resources, be implemented before or at the same time as the impact, and be based on scientifically robust and verifiable information. Implementation of all OMPs will commence prior to commencement of development of 165 O’Herns Road Epping. Details of the above will be described in the approved OMP.

8. Have transparent governance arrangements including being able to be readily measured, monitored, audited and enforced

The Offset Strategy and/or supporting offset management plans will: measure and monitor offset success/failure (to be detailed in the OMP), which will be reported annually to the DoEE; support the supply of spatial information for the offset area (to the DoEE, as part of meeting EPBC Act conditions of

approval); and as appropriate, be delivered through contractual arrangements with a third party. Where these arrangements are used the

approval holder will ensure the arrangements are made with suitably qualified persons with a sound understanding of the purpose and management requirements for the offset sites.

The process of establishing each covenant has already been initiated by Alliance Business Park Pty Ltd and is well advanced. Final offset management plans, approved by the Minister as part of the post approvals process for EPBC 2017/7930, are required to complete the covenanting process. Trust for Nature will complete this process upon receipt of approved plans from Biosis.

Approved plans are anticipated to be in place by early April 2019. Covenant documents would be with the relevant Victorian Government Ministers office for signature within two weeks of the approval of each OMP. At this stage Alliance Business Park Pty Ltd will complete the all financial transactions required to finalise the security and ongoing management of each offset.

Alliance Business Park will not commence works until all three plans and associated covenants have been submitted to the Victorian Minister for signature and all other conditions of approval have been complied with. Once the covenants have been submitted to the Victorian Minister for signature, the process to legally secure these parcels of land under a Trust for Nature covenant is considered irreversible even though the document may not actually be signed for a month or so depending on ministerial priorities.
