PROJECT DESCRIPTION(Group ll. C.5. olher power planls and power facilities)

The project basically involves the development of a wind power facility with an outputcapacity of 15 megawatt (MW). lt will be implemented wrthin the awarded service contractarea particularly along Pilao - Langsayan Ridge covering both the Municipalities of Besaoand Sagada in Mt. Province. The facility will require. among others, the erection of ten (10)wind towers and facilities having an individual capacity of 1.5 MW, construction of projectaccess roads. the construction of a power station and office facilities. and/or, as described inthe submined documents. Wind Turbine No. 1 is located approximately in the intersectionof geographical coordinates 1 7"6'1 .0" North Latitude and 1 20'53'02 3" East Longitude.

Thrs ECC is issued rn compliance to the requirements of Presidential Decree No.1586 in accordance to Department Adminiskative Order No 2003-30. EMB, DENR -CAR, however, is not precluded from reevaluating, adding, removing and correcting anydeficiencies or errors that may be found to be inconsistent with the Revised ProceduralManual for DAO 2003-30 after issuance of this Certificate

Annex ACONDITIONS

ENVIRONMENTAL MANAGEMENT

The proponent shall strictly implemenucomply the following mitigating, enhancementand rehabil i tat ing measures:

1. The proponent shall ensure that all commitments, mitigating/enhancementmeasures described in the EIA documents and other submissions shall beinstituted and strictly implemented throughout the project implementation,

2. Earth materials and other construction spoils shall be disposed-off properlyin a designated disposal site and to be maintained in a stable and non-pollutive condition. The same shall be prevented from deposition to andalong public roads, natural water ways, water bodies/sources and other areasconsidered environmentally sensitive;

3. The proponent shall, during project construction, effect solid wastemanagement at source encompassing, the segregation, recycling andcomposting of biodegradable wastes. The proponent shall provide andmaintain at least two (2) receptacles for biodegradable and non -biodegradable wastes;

4. Formulate and implement a Social Development Plan in coordrnation with theLG U's/Government Agencies concemed; and

5. The proponent shall submit to EMB-CAR one (1) year pnor to the finalshutdown of the pOect a comprehensive abandonment plan. In relation, theEMB shall first review and approve the environmental aspects/components ofthe plan consistent with EMB functions prior to abandonment.

GENERAL CONDITIONS

Further administrative conditions for the grant of this Certificate shall be strictlycomplied.

1. The legal requirements pursuant to RA 6969 also known as the ToxicSubstances and Hazardous and Nuclear Waste Control Act of 1990, RA 9275or the Philippine Clean Water Act of 2004 and, RA 8749 or the PhilippineClean Air Act of 1999, where applicable, shall be secured consistent to theoperation of the project. Compliance to said requirements shall becoordinated with the EMB-CAR;

2. Secure the necessary permit(s)/clearances relative the projectimplementation/operation to cover the appurtenant facilities/structures asrequired by other concemed agencies/LcU's prior to project implementation;

3. The proponent shall allow entry of EMB-CAR field personnel into the projectsite at all times to conduct tangible monitonng and to validate project'scompliance to the ECC conditions stipulated therein, the impactsmanagement plan and, proposed mitigating measures;

4. The proponent shall cause the implementation of any undertaking which ma,be imposed by EMB-CAR as a result of Technical Conference/s calledrelatrve to environmental issues arising from the implementation of theorotect:(OW-

For the information of the public, a billboard of appropriate size containing thismessage "Notice to the Public, This project (title of the project) of (Name ofthe proponent) has been issued an Environmental Compliance Certificate(ECC Number) by the Environmental Management Bureau of the Departmentof Environment and Natural Resources - Cordillera Administrative Region on(date)" shall be installed along places visible to the public;

6 An Environmental Unit (EU) or its equivalent shall be established tocompetently handle environment related aspects of the project. In addition tothe monitoring requirements as specified in the Environmental/lmpactsManagement Plan/Environmental Monitoring Plan, the EU shall.

6.1 Monitor actual project impacts vis-d-vis the described predictedimpacts and management measures: and

6.2 The proponent shal l submit semi-annually to EMB - CAR aCompliance Monitoring Report (CMR) within one (1) month after everysemester. Compliance to the said requirements shall be coordinatedwrth EMB- CAR.

7. Submit an updated Project Environmental Risk Categorization prior toimplementation or as soon as the final siting and design of facilities havebeen decided, whichever comes earlier; and

8. The proponent shall undergo the requirements of DENR includrng, but notlimited to, those under PD 705 otherwise known as the Forestry Code of thePhilippines and the latest issuances relative thereto with regard to the trees tobe affected, and to other applicable laws and regulations. Replacement ofaffected/cuurelocated trees shall be in accordance with Memorandum OrderNo. 2012 - 02 on the uniform reolacement ratio for cut or relocated trees orwith any relevant rssuances.

RESTRICTIONS:

The proponent is strictly subjected to the following restrictions.

1 . Project development shall be in accordance with the submitted documents.Major modifications and/or expansion shall be subject to the Environmentallmpact Statement (ElS) System requirement;

2. Any transfer of project proprietorship carries the same conditions andrestnction in this ECC for which a written notification to the EMB-CAR shall bemade by the transferee within fifteen (15) days from such transfer, and

3. This Certificate shall be considered automatically expired if the developmentof the project has not commenced within a period of five (5) years from theissuance thereof or has stopped operation for about five years.

PROJECT ASSESSMENT PLANNING TOOL

For the assistance of the Proponent, other DENR Divisions/Bureaus, otherconcerned government agencies and LGUs in the management of the project and forbetter coordination in the mitigation of the impact(s) of the project on its surroundingareas and to the environment.

By way of recommendation, the following have been taken notice of jn theassessment of the application and are forwarding these recommendations to the partiesand authorities concerned for proper appreciation and action, and integration into theirdecision - making process.

1 Priority employment of qualified local residents durrng the developmentand operation of the project;

2. Observe waste management at source during proiect operation (i.e. wastesegregation, re-use ancyor composting) consistent with the EcologicalSolid Waste Management Act of 2000 (RA 9003) and the Ecological SolidWaste Managemeni Program of the host LGU;

3. The project should be undertaken properly during reasonable time periodsso as not to cause undue disturbance,

4 Tight supervision of the development of the project by competent technicalpersonnel to ensure that standards and requirements of soundengineering, safety and health practices are strictly followed;

5. Device and implement an appropriate monitoring scheme in coordinationwith the concerned government agencies pertaining the noise emanatingfrom the wind turbines:

6. The proponent should coordinate with the concerned governmentagencies for the development and implementation of a doable forestresource management program to maintain and enhance the hydrologicaland ecological system of the service area, and

7. Locating the proposed access road to areas which will lessen its overalleffect to the vegetations and water resources thereat.
