BRIEF HISTORY OF CCRCsHistoryAsearlyasthe1900ssomereligiousorganizationsintheUnitedStatesofferedaprecursortotoday’sCCRCs.Theconceptgrewinthe1960sandsincethe1990shasexpandedthroughoutmuchoftheU.S.A.StatessuchasPennsylvania,California,Florida,NewJerseyandVirginiahaveahigherconcentrationofthisformofretirementliving.InConnecticut,wehaveseveralcommunitiesthathaveprovidedthiskindoflivingformorethan40years.StateofCTDefinitionofaCCRCContinuingCareRetirementCommunities(CCRCs)arealsosometimesreferredtoas“LifePlan”communities.Throughcontractualagreements,continuing-carecommunitiesprovideresidentswithavarietyoflivingaccommodationsandmanyservices,includinglong-termhealthandnursingservices.Variouslevelsofcare,generallystartingatIndependentLivinginresidentialapart-mentsorcottageswiththeavailabilityofAssistedLiving(offeringhelpwithdailyactivities)andSkilledNursing,asneededareprovided,onthecampus.Eachresidentmustenterintoacontinuing-carecontractwithaCCRCinordertoobtainresidency.Everyresidentisrequiredtopayasubstantial,lump-sumentrancefeeandmonthlyfeesinexchangeforhousingandhealth-relatedservices.Thesefeesvarydependinguponthecommunity,thetypeoflivingunitchosenandwhetheroneortwoindividualsoccupytheunit.

Continuing-carecommunitieshavedifferentpoliciesregardingtheavailabilityandtermsofentrance-feerefunds.Housingunitscanbeapartmentsinhigh-riseorlow-risebuildings,townhouses,gardenapartments,cottagesorfree-standinghomes.Unitscanrangeinsizefromstudiostothreebedrooms.Residentsaregenerallynotentitledtohaveequityintheirunits;instead,theyareentitledtouseoftheirunitsinexchangeforthefeestheypay.CCRCsarenotlicensedinConnecticut,buttheymustregisterwiththeConnecticutDepartmentofSocialServices(DSS).AndadheretoChapter319hhofConnecticutGeneralStatutes,ManagementofContinuing-CareFacilities.Variouscomponentsofhealth-carepackages,however,arelicensedbytheStateofConnecticut.A2015provisionnowallowsCCRCsresidentstoformanelectedResidentCouncil.NEWTRENDS...• Moreflexiblemealplansarebeingofferedinsomecommunities.Soask.

• Secondoccupantsofunitsmaybeotherthanaspouse.Askaboutthisondayoneandinlateryears,couldadifferentsecondpersonmovein?

• SomecommunitiesareexperimentingwithwaystobridgethejumpfromyourcurrenthometoIndependentLivinginacontinuingcarecommunity.Inthis“model”participationstartsinyourownhomewithsomeservicesprovided.Andyouhavelimitedprivilegestocometothecampusforuseofcertainfacilities.Ortodineoccasionallyorattendevents,forexample.Allforafeeofcourse.Twomembercommunitiesareofferingthisoption.

FINANCIAL FACTORS ThisIsAnInvestmentDecision!Signingthecontracttoenteracontinuingcarecommunityisaninvestmentdecision,notjustahousingorhealthcaredecision.ThisconcepthasbeeninConnecticutformorethan40years.AllCCRCsinConnecticuthavesurvivedtheupsanddownsofbusinesscycles,butinotherpartsofthecountry,afewhavefailed.Youwanttolearnaboutthefinancial“health”ofcommunitiesyouareconsidering.Investigatethecommunityusingtipsprovidedhereandfromyourowntrustedsources.Aprospectivecontractsignerisadvisedtofirstconsultanattorneyorotherprofessionalexperiencedinmattersrelatingtoinvestmentsincontinuingcarecommunities!WhoOwnsTheCommunity? Whoownsthefacilityisimportanttoknowbeforeyousignthecontract.Isthecommunitythatinterestsyouownedbyasingleentityorpartofachainofplacesinotherstates?Isitownedbya“for-profit”entityora“non-profit?”Isitownedbyareligious-affiliatedentity?AmongthefacilitiesinConnecticutmorearenon-profits,butsomehaveconvertedtofor-profitstatusandnewfor-profitonesmayopeninourstate.

Non-ProfitorFor-Profit? Thisfactorreallyshouldnotmatter,butitdoeshavesometaximplicationsyoushouldbeawareof.Forinstance,forprofitspaypropertytaxesinthecommunity.Non-profitsdealwithobligationstothecommunityunderdifferentlaws.This“for-profitornon-profit”statusmayimpactyourowntaxfilings.LearningtheactualownershipofaforprofitmaybehardtodeterminebecauseownershipmaybebyRealEstateInvestmentTrusts,calledREITsbytheinvestmentcommunity.For-profitcommunitiesatpresenthavenoresidentsonOwner’sBoardofDirectorswhilesomenon-profitsdo.Thismatterofresidentrepresentationattheverytopofacommunity’smanagementiscurrentlyadiscussiontopicamongresidentsofsuchcommunitiesacrossthecountry.InitialInvestmentvs.MonthlyFeesThecontractyouwillsignwillhavethreebigparts:1)Theinitialcashpaymentdetailsthatwillbeabiggerorsmalleramountbasedonthesize/floorplanofthelivingunityouchooseANDareyouonepersonmovinginortwo?2)Thehealthcareplanyouselect;3)Thescheduleofmonthlyfeesthatwillinclude(forexample)feesforusingacommunitycartotakeyoutothedoctoretc.Thefeesmaygoupbyapercentagemostyears,generallyinJanuary.Bylawyourcommunitymustprovide30daysnoticebeforefeesareincreasedalongwithanexplanationandanopportunityfordialogueandcomment.Thelump-sumentrancefeecannotgoupordown,becausethatdollaramountissomethingyouandmanagementagreedtowhenyoubothsignedthecontract.

AFFORDABLE? WhatManagementWillAskofYouWhenyoudecidetosignacontract,youwillbequestionedaboutyourpersonalfinancestodeterminewhetheryouhavesufficientassetstoputdownplustocontinuetomeetthemonthlyservicefee.Yourassetsandliabilitiesaswellasyourinvestmentportfolio,annuityandretirementincomemustbedisclosed.Generally,youwillberequiredtopresentcopiesofrecentincometaxreturnsandrecentbankandinvestmentaccountstatements.Ifyouhavelong-termcareinsurance,disclosethat.Youwillberequiredtomakeadepositwhenyousignthecontract.Manypeoplerelyonthesaleoftheirpresenthometomeettheoutlayrequiredbythetotalentryfee.Beforemovingin,anybalancewillbedue.Somecommunitiesmayofferabridgeloansoyoucanpaythebalancepriortothesaleofyourprevioushomeorcondominium.Notalldo. WhatIfIRunOutofMoneyLaterOn?CCRC/LifePlanCommunitiesdonotwanttoacceptanyonewhomightrunoutofmoney.Basedonyourfinancialdisclo-sures,Managementgenerallyhastheexperiencetojudgeifyoumightrunoutofmoney.Butrunningoutofmoneydoeshappen.Managementdoesworktofindasolutionwithresidentswhofindthemselvesinthispredicament.SomepeopledomoveawaytoalessexpensiveplaceormoveinwithafamilymemberoutsideofthecommunitywhentheynolongercanaffordtheCCRC.Youshouldaskwhatsolutionstothisproblemareavailablebeforeyousignthecontract.

WhatAreSomeSolutions?Somecommunitiesoffercontractsthatpromisetoneverstopprovidingsafehousingifmoneyrunsout.Thismayeitherbeinthecommunityitselforinasisterfacilitynearbythatislessexpensive.Ifthecontractinvolvestherighttoarefundofaportionofyourentrancefee,somecommunitiesmaypermittheuseoftherefundamounttopayyourmonthlybills.Notallrefundablecontractspermitthis.Somecommunitieshavean“aid”programthatcanpayaportionofthemonthlybill,butnot100percent.Youmustapplytoseeifyouqualifyandtolearnhowmuchwillbeoffered.Donotbeembarrassedtoaskaboutthesebeforesigningthecontract.WhatIfINeedAssistedLivingOr???MostofuscannotpredictifwewillneedlevelsofhealthcarethataremorecostlythanIndependentLiving.Youmustaskaboutthesecostsbeforeyousignthecontract.KeepinmindthatMedicareplusyourMedigapinsuranceandmedicaldeductionsmaylightentheburdeninasmallway.Butundermostcontractshigherlevelsofhealthcarecomewithsignificantlyhighercosts.(SeeContractTypes.)Yourfinancialexpertshouldcloselyreviewthisaspectofthecontract.AskifaidprogramsofferassistanceonceyouleaveIndependentLivingforahigherlevelofcare.

CONTRACT TYPES ContractsVary,SoStudyThem!MostcontinuingcarecommunitiesrequireyoutoenterattheIndependentLivinglevelandthen,asneeded,youmaytransitiontoAssistedLivingServicesorothercaresuchasaMemoryServicesorSkilledNursing.Noteveryoneusesallthreelevelsofcareduringone’syearsinthecommunity.AcurrenttrendistoencourageresidentstoremainattheIndependentlevelmadepossiblebyhiringextradutyaideswhenneeded.TheIndependentLivingsettinggenerallyisthemostaffordablelevelinaCCRC,dependingperhapsonthesizeoftheunityouhaveselected.IntroductiontoContractsMostcontractscoverfivemajortopicsandcommunitiesmayofferyouuptothreehealthcare“typesofcontracts.”Typesofhealthcarecontractsarediscussedindetailonanotherpage.Thisfactdemon-strateswhyreadingthecontractandgettingfinancialadviceisimportant.FiveKeyContractTopicsfollow:1. HEALTH CONTRACTS ThereAreThreeTypesBealerttothebigdifferencesinhealthcoveragebeingofferedbythecom-munitiesyouareconsidering.Areyoucomparing“applestoapples“or“applestooranges”?Yourout-of-pocketcostsmightbesignificantlydifferentdependingonwhatyouchooseandwhatactuallyhappensasyouageinplace.Thisdecisionisagamble.TypeAThisisoftencalledalife-carecontract.Youmaypayahigherentrancefeeandahighermonthlyfee.Inexchangeforthis,youcanliveinthecommunityfortherestofyourlifeandpaythesamemonthlyfeeevenifyoumovetothenursinglevel.Inshort,youareself-insuringagainstwhatitmaycostifyouneedhighermedicalservicesinAssistedLiving,MemoryCareorSkilledNursing.Notallcontinuingcarefacilitiesofferthiscontracttype.Generally,thecommunitiesthatdorequirea90percentrefundablecomponent.Shouldyourunoutofmoney,Managementmaybeabletoapplyfundsfromtherefundableamounttocoverwhatyounolongercanpay.YourcommunitylikelywillofferataxadvisoryletterinMarchforyoutosharewithyourtaxpreparerwhowillhelpdeterminewhat
