GENERAL PROVISIONS The Agreement shall govern the administration and

implementation of the Fire Code of the Philippines in PEZA-administered Economic zones in the country, including Information Technology (IT) Centers, inclusive of the buildings, structures and facilities of the PEZA-registered enterprises

However, for non-PEZA registered entities they are to undergo the regular process of securing permits prescribed by the LGU, the Business Permits Licensing Offices, and Office of the Building Officials.

PEZA shall coordinate, collaborate and cooperate with the BFP to strengthen fire prevention, fire response, fire investigation and conduct of fire prevention education and training for PEZA fire safety practitioners/firefighters including those from PEZA-registered enterprises and volunteer fire brigades from communities within the immediate periphery of the Economic zones and the conduct of information dissemination and other activities necessary for the implementation of R.A. No. 9514.

5. The Fire Safety Evaluation Clearance (FSEC) shall be a pre-requisite for the issuance of Building Permits; and the Fire Safety Inspection Certificate (FSIC) shall be a pre-requisite in the issuance of Occupancy Permits, Certificate of Annual Inspection and Permits to Operate by PEZA.

ONE-STOP-SHOP FOR BUILDING PERMIT

PROCESSING A. STANDARDS IN PROCESSING BUILDING PERMIT APPLICATIONS

Application Form. A preformatted form for building permit applications shall be prescribed for all PEZA-registered enterprises (refer to Annex 1). Four (4) copies of the application form for building permit, duly notarized, shall be submitted with the required documents.

Documentary Requirements. In applying for a building permit, the applicant shall be required to submit the following documents together with the application form:

a) Four (4) sets of the proposed building plans and other documents prepared, signed and sealed over the

printed names of duly licensed and registered professionals, as stipulated under Section 302 (3) of the IRR of the NBCP:

(i) Architectural Documents (ix) Technical Specifications (ii) Civil/Structural Documents (x) Fire Protection Plan (if applicable) (iii)Electrical Documents (iv)Mechanical Documents (v) Sanitary Documents (vi)Plumbing Documents (vii)Electronics Documents (viii)Detailed Project Cost Estimate

b. Softcopy of proposed building plans including the documents enumerated in the preceding paragraph.

c. Three (3) photocopies of valid licenses of all involved professionals (e.g. Professional Tax Receipt and the Professional Regulation Commission identification card);

3. The BFP shall detail BFP liaison personnel, plan evaluators, fire safety inspectors, assessors and collectors at one-stop-shop co-location sites at the offices of PEZA building officials.

Steps in Securing Building Permit. On the client’s perspective, they are to perform the following four (4) steps only in their transactions.

Step1: Submission of Application Forms and Documentary

Requirements;

Step 2: Receipt of the Order of Payment;

Step 3: Payment of Fees and Charges; and

Step 4: Claiming of the Building Permit.

Processing Time. PEZA and BFP shall evaluate building permit applications, with complete documentary requirements, within a maximum period of five (5) working days. The BFP shall process the application for Fire Safety Evaluation Clearance (FSEC) within a maximum period of three (3) working days from receipt of the endorsement from PEZA.

NOTE:

For application that complies with the requirements of NBCP, FCP, and its

referral codes, PEZA shall release the Building Permit with the FSEC after

payment of appropriate fees and charges.

For application with deficiencies, Building Permit shall still be issued subject to

the applicant’s compliance during construction with the requirements as

prescribed in the building permit evaluation checklist and fire safety checklist

on Building Plans issued by PEZA and BFP, respectively, after payment of

appropriate fees and charges.

Assessment of Fees. After the evaluation of the building permit application, the PEZA and the BFP, shall simultaneously prepare an Order of Payment that will be issued to the applicant at the same time, specifying the fees that the applicant is obligated to pay in accordance with the provisions of the NBCP and the FCP. The PEZA and the BFP shall put in place the necessary measures to implement a one-time assessment of building-related fees and charges.

The fire code fees for the issuance of FSEC shall be based on the estimated value of the building or structure declared by the owner or applicant as stated in the application form duly notarized.

Payment of Fees. The PEZA and the BFP shall jointly implement a one-time payment of fees and charges related to building permit applications. All related fees shall be paid by the applicant in a designated PEZA co-location site.

The PEZA and BFP are enjoined to establish a system of online payment of fees and related charges and other electronic payment scheme to facilitate the one-time assessment and payment of building permit-related fees and charges.

B. STANDARDS IN SECURING CERTIFICATE OF OCCUPANCY

Application Form. A preformatted form for certificates of occupancy applications shall be prescribed for all PEZA-registered enterprises (Annex 5). Three (3) copies of the application form shall be submitted with the required documents.

Documentary Requirements. In applying for a certificate of occupancy, the applicant shall be required to submit the following documents: a. Three (3) copies of duly notarized Certificate of Completion using the form in Annex

6, signed by the owner/applicant and signed and sealed by the duly licensed Architect or Civil Engineer in-charge of construction, together with approved plan and specifications and one copy of the construction logbook. If the construction was undertaken through a contract, the Certificate of Completion shall be signed by the contractor/Authorized Managing Officer;

b. One (1) photocopy of the issued Building Permit and the issued ancillary permits; c. Owner’s photocopy of Fire Safety Checklist and its corresponding FSEC;

d. Three (3) photocopies of the valid licenses of all involved professionals (e.g. Professional Tax Receipt and the Professional Regulation Commission identification card); and

e. Photograph of the completed structure showing front, sides, and rear areas.

3. In cases when there are changes in the approved building plans, three (3) sets of As-Built Plan are required to be submitted to the PEZA, reflecting all the changes/modifications/alterations/amendments made as an additional document.

4. The applicant, if required, shall secure clearances or certificates from utility companies,

independently and after the issuance of the Certificate of Occupancy. Such clearances therefore shall not be considered requirements for the issuance of said certificate.

Assessment of Fees. After final inspection by the PEZA and receipt of the BFP after inspection report, the PEZA and the BFP shall simultaneously prepare an Order of Payment for applications that pass their requirements, specifying the fees that the applicant is obligated to pay in accordance with the provisions of the NBCP and the FCP. The two orders of payment shall be issued to the applicant at the same time. For this purpose, the BFP shall assign a staff who shall be co-located at PEZA one-stop-shop co-location site.

and charges related to applications for certificates of occupancy. As provided under item 1.11 above, PEZA and the BFP are also encouraged to establish a system of online payment of fees and related charges and other electronic payment schemes.

NOTE:

FSIC issued for Occupancy Permit shall be valid for the issuance of FSIC for

Certificate of Annual Inspection if application of the later is made within nine (9)

months from the issuance of the FSIC for Occupancy. This is in lined with the

JMC 2016-001 on Business Permit Processing.

Enterprises required by the LGU’s to secure business permit shall likewise

secure a separate FSIC for Business Permit separate from the FSIC for

Certificate of Annual Inspection.

C. ISSUANCE OF CERTIFICATE OF ANNUAL INSPECTION AND FIRE SAFETY INSPECTION CERTIFICATE

1. No certificate of annual inspection shall be issued by PEZA without a valid FSIC issued by the BFP.

2. PEZA and the BFP are required to form a joint inspection team for the conduct of

inspection of the structure. PEZA shall take charge of organizing the inspection team, preparing and synchronizing the schedules of the inspection team members and providing the logistics for the inspection team. In the event that the joint inspection is not feasible, each party may conduct their own inspection. In such case, the inspecting party shall, prior to inspection, notify the other party of the schedule of said inspection.

For the purpose of conducting initial joint inspection, PEZA shall endorse to the BFP the list of PEZA registered entities to be inspected within fifteen (15) days from signing of this Memorandum of Agreement together with the schedule of joint inspection. For PEZA-registered entities that complies with the fire safety requirements of the FCP, FSIC shall be issued within two (2) days from inspection. For non-compliant PEZA-registered entities, the procedure for administrative courses of action prescribed in the FCP shall be followed.

3. Assessment of Fees. Fee charged for the conduct of fire safety inspection shall be equivalent to ten percent (10%) of all fees charged by PEZA OBO for the issuance of certificate of annual inspection.

4. Payment of Fees. The PEZA and the BFP shall jointly implement a one-time payment of fees and charges related to the issuance of certificate of annual inspection and FSIC. As provided under item 1.11 above, PEZA and the BFP are also encouraged to establish a system of online payment of fees and related charges and other electronic payment schemes.

D. ONE-STOP-SHOP CO-LOCATION SITE

1. There shall be established one-stop-shop co-location site in all PEZA’s OBO known as the BFP-PEZA Central Liaison Unit (CLU)

3. The PEZA shall provide working space and provisions for BFP personnel

co-located at PEZA one-stop-shop co-location sites.
