BWC Activated at Cordata Station contact

On 11-4-16, I responded to WHATCOM TRANSPORTATION AUTHORITY TERMINAL (R1) on an assault complaint.

On my arrival, I contacted supervisor GEOFFREY BEAUMONT (C1) and learned the following. He stated that an elderly rider was kicked in the head last night by an unknown passenger. He said this was captured on their bus video surveillance system. He told me that the elderly victim was identified as JOSE QUINTANA (V1) last night and he did not want the police involved. The male who kicked him departed right after the incident and fled on foot - his identity is unknown at this time.

I was told that this occurred on 11-3-16 just before 9pm on bus #881. I was further told that the bus driver last night was Kelly McKay.

GEOFFREY BEAUMONT (C1) played the video for me and as the bus stopped and as the unknown male was leaving he kicked the elderly male in the face/head area while he was seated. The elderly male was sitting directly behind the suspect and there did not appear to be any interaction prior to the unprovoked attack.

GEOFFREY BEAUMONT (C1) provided me with a copy of their video surveillance and a still photograph of the suspect. I will impound the thumb drive and turn in the picture for scanning. As a result of this suspect's actions GEOFFREY BEAUMONT (C1) requested that he be trespassed from their property if we can identify him. I cleared the scene and responded to the police station.

While I was writing this report, Dispatch advised that the suspect in this assault was now at the WTA Cordata Station.

I responded to this location and contacted supervisor GEOFFREY BEAUMONT (C1). He showed me where the suspect was and I contacted him on a bus. My BWC was activated and I asked him I could speak with him outside. He agreed to this and I advised him why I was here. The male was identified as MANUEL GONZALEZ (S1).

I asked MANUEL GONZALEZ (S1) about kicking an elderly male on the bus last night and he admitted that he did do this. He said the reason he did this is because the elderly male "passed" a sandal by his head when he got onto the bus. MANUEL GONZALEZ (S1) said he felt this elderly male disrespected him by "passing" a sandal by his face. We discussed this further and I could not really grasp the sandal "passing" and how this was threatening, intentional, or disrespectful for that matter.

At the request of GEOFFREY BEAUMONT (C1) and WTA I advised MANUEL GONZALEZ (S1) of the lifetime trespass. I advised him that if he returned to their property he could be subject to an arrest. I did not have him sign the trespass notice as he was flagged officer safety and thus created a risk for those involved. I further told MANUEL GONZALEZ (S1) that he may get a citation in the mail for assaulting the elderly male. I provided him with a copy of the trespass and we broke contact with him.

I later tried to call JOSE QUINTANA (V1) and found that he spoke very little English. I will attempt to find a translator that can assist me with an interview.

On 11-4-16, Intelligence Analyst Kat Sattarov assisted me with some Spanish translation.

We called JOSE QUINTANA (V2) and discussed the incident the previous night. We were told that an unknown male struck him for no reason and JOSE QUINTANA (V2) does not know why this happened. JOSE QUINTANA (V2) did not want anything done and was reluctant to provide us with information as to where he lived or other information. At the beginning of the conversation, JOSE QUINTANA (V2) was told that he was not in any trouble and we just wanted to know what happened.

JOSE QUINTANA (V2) said he did not really have any injuries to his face and did not really want us to take photographs.

After reviewing these case facts, I have determined there is probable cause to arrest MANUEL GONZALEZ (A1) for assault 4th.

Through investigation which included video surveillance it showed that he kicked JOSE QUINTANA (V2) in the face/head area while JOSE QUINTANA (V2) was seated on a bus. This attack appeared to be unprovoked and JOSE QUINTANA (V2) is in his mid 70's.

I've cited MANUEL GONZALEZ (A1) by summons for Assault 4, CB095462.

Nothing further.
