ELECTRONIC PUBLICATIONS—LICENSE AGREEMENT FOR INSTITUTIONAL SUBSCRIBER By purchasing a subscription to an electronic publication hosted on Philosophy Documentation Center’s website, the Subscribing Institution accepts the Terms and Conditions set out in this document. All reasonable efforts should be made to ensure that Authorized Users at the Subscribing Institution are aware of, and abide by, these conditions. Philosophy Documentation Center reserves the right to amend these Terms and Conditions, however, no modification or claimed waiver of any provision shall be valid except by written amendment signed by authorized representatives of the Subscribing Institution and Philosophy Documentation Center. send one copy of any item in the Licensed Material by e-mail, hard copy, or fax to one person in the subscriber’s campus/institutional network at another location for that individual’s personal OFFLINE scholarly use. Under no circumstances shall such personal use include the posting of any item from the electronic publication to any personal website.

distribute a copy of individual items from the Licensed Material in print or electronic form to Authorized Users, including the distribution of a copy for noncommercial educational purposes to each individual student (Authorized User) in a class at a Subscriber’s institution.

use a persistent URL, or durable URL, to the Licensed Material, including full-text articles, for courses of instruction offered by the Subscribing Institution, where access is restricted to students enrolled in the course, to instructors, and to library staff maintaining the link, and such access is limited to the duration of the course. Each item should carry an appropriate acknowledgment of the source, copyright, and publisher, and the links to such items shall be deleted by the Subscriber when they are no longer required for such purpose.

place selected listings and notices on the campus network to inform users of availability of the Licensed Material.

display, download, or print portions of the Licensed Material for the purpose of internal marketing or testing or for training of Authorized Users or groups of Authorized Users.

THE SUBSCRIBING INSTITUTION AND ITS AUTHORIZED USERS MAY NOT:

use robots or intelligent agents to access, search, and/or systematically download any portion of the Licensed Material.

transmit, disseminate, or otherwise make the Licensed Material or any components thereof available to any persons or entities who have not been authorized by Philosophy Documentation Center to use and access the site.

disassemble, decompile, or in any way attempt to reverse engineer any content or software provided on this site.

make ANY commercial use of ANY content on this site without the express written and prior permission of Philosophy Documentation Center.

INTERLIBRARY LOAN

Institutions may make copies of single documents from the Licensed Material for the purpose of inter-library loan, with the same limitations that apply to copies for that purpose made from traditional print editions. Specifically, copies must be made in compliance with Section 108 of the U.S. Copyright Act, or applicable Copyright Laws, and be within the CONTU guidelines. Authorized Users who print items from the Licensed Material must maintain any copyright and other notices on the printed items. In addition, the Institutional Subscriber may, using secure means fill inter-library loan requests for limited portions of the Licensed Material using software such as Ariel, Odyssey, ILLiad, and/or some other secure transmission system.

COPYRIGHT AND PERMISSIONS

Unless otherwise noted, the publishers of the Licensed Materials hold the copyright, both as a compilation and as individual articles, on all journals, series, or other materials available on Philosophy Documentation Center’s website. In the event of a dispute between a publisher and any contributor with respect to the electronic distribution of any article or other item on Philosophy Documentation Center’s website, Philosophy

Documentation Center shall have the right to remove such items from the Licensed Material, and will do so upon the publisher’s request.

ACCESS AND AUTHENTICATION

Philosophy Documentation Center’s file server permits authorized entry by recognizing the authorized IP addresses. Distance learners and alumni who access the Internet via campus IP accounts or a secure proxy server may use Philosophy Documentation Center’s website, but access is not available through independent service providers. At the time the order is placed, the Subscriber provides IP addresses for the computers that require access to the electronic database. No credit is given for the submission of incorrect or incomplete IP ranges, or for IP information submitted late.

Philosophy Documentation Center will make the Licensed Material available to the Subscriber and its Authorized Users on a twenty-four hour basis, except for routine maintenance (which will be scheduled in advance whenever possible) and will restore access to the Licensed Material as soon as possible in the event of an interruption or suspension of service.

The Institutional Subscriber will make reasonable efforts to create and maintain appropriate security measures to ensure that only Authorized Users can access Licensed Material online. The Institutional Subscriber also affirms that all IP addresses provided for use of online Journals are controlled by its institution exclusively for Internet access by Authorized Users. Valid IP addresses must not include those of publicly accessible proxy or cache servers.

USER PRIVACY

To maintain and improve this electronic service, and to protect each publication included on the site, Philosophy Documentation Center monitors all use of its website. Philosophy Documentation Center agrees not to share information about Authorized Users with any third parties, for any reason, except as required by a court of appropriate jurisdiction.

ARCHIVING OF CURRENT CONTENT / POST-CANCELLATION ACCESS

Approximately 90 days after the expiration of an annual subscription term for full text content, Philosophy Documentation Center can provide, upon request, an archival (non-searchable) file on DVD-ROM or other appropriate media as determined by Philosophy Documentation Center, containing the content of all current issues of the Licensed Material published online during the 12-month subscription term. The cost of providing this archival file shall be paid by the Subscribing Institution. This archiving provision does not apply to discontinued journals or series provided on this website, or to collections of back issues or volumes of continuing publications.

Philosophy Documentation Center has also arranged for post-cancellation access to current content through PORTICO. This arrangement is subject to permission from the publishers of the Licensed Material on our site. Philosophy Documentation Center is working to secure the necessary permission from each publisher.

SUBSCRIPTION ACTIVATION AND RENEWAL

For online access to the Licensed Material to be enabled, the Subscribing Institution must provide Philosophy Documentation Center with necessary technical and administrative data about its campus or institution network. Any changes by the Subscribing Institution to this information during the subscription period to the Licensed Material must be communicated to Philosophy Documentation Center to ensure continuity of service.

Before the end of September each calendar year Philosophy Documentation Center will provide the Subscribing Institution with pricing information for the following year. Before the end of December, Philosophy

Philosophy Documentation Center hosts an electronic research database on its website known as the INTERNATIONAL DIRECTORY OF PHILOSOPHY. This research database does not contain fulltext content.

Accordingly, provisions in the Agreement for Archiving of Current Content / Post-Cancellation Access, for archiving and accessing subscribed fulltext content, do not apply to institutional subscriptions to the INTERNATIONAL DIRECTORY OF PHILOSOPHY. All other terms in this Agreement apply to institutional subscriptions to this electronic database.
