JOINT MINUTES

INTRODUCTION

The first meeting of the Sub-committee on Justice, Freedom and Security under the Stabilisation and Association Agreement took place in Pristina on 25-26 January 2017. The meeting was co-chaired by David Cullen, Head of Unit DG NEAR/D.3, and the Secretary General of the Ministry of European Integration, Demush Shasha. For a detailed list of participants, see Annex II.

The meeting discussed a large range of topics related to the judiciary, home affairs, human rights and fundamental freedoms and the protection of minorities. Below is a list of agreed action points and recommendations, some with short term deadlines, some referring to a need for a more regular reporting. The implementation of these conclusions will be monitored closely and will be taken into account on assessing Kosovo’s progress on its path towards EU integration.

I. JUDICIARY

The Commission welcomed the recently adopted amendments of the Constitution which enable the election of the majority of judges to the Kosovo Judicial Council by their peers. Kosovo confirmed its intention to carry out a rule of law sector review and committed to involve the EU in the discussions, both at technical and steering board level as all the elements needs to be compatible with EU's rule of law standards and with the EU acquis. On institutional capacities, the Commission welcomed the recent transfer of judges in Serious Crime Departments within the Basic Courts. The EU urged Kosovo to appoint the remaining judges. The Commission expressed concern about the change of procedure during the recent selection of new judges and that such practice seriously undermines the trust in the selections process, in the institution and the overall justice system. The EU welcomed the adoption of the remaining secondary legislation from the 2015 Justice Package associated with the Prosecutorial Council, as well as the adoption of the law on the Justice Academy. The importance of having a clear overview of the overall budget for the whole judiciary system was noted. The Commission encouraged Kosovo to ensure that a fully functioning electronic case management system is in place to enable the tracking of cases from the investigation, indictment up to final court rulings, and ensuring that cases are only registered once. The EU encouraged further efforts to set-up a centralised criminal registry. The Ministry of Justice should expedite the adoption of the Law on the Office of the Disciplinary Counsel (ODC) and make sure that all the safeguards that guarantee the independence and efficiency of the ODC are put in place.

The Commission encouraged Kosovo to continue its efforts to enter into negotiations of new bilateral agreements on international legal cooperation in criminal matters during 2017.

Overall / General recommendations:

Continue efforts to adopt and implement the laws and by-laws attached to the 2015 Justice Package and ensure the involvement of the EU in this and all other process aimed at enhancing the efficiency, independence, accountability of the judiciary and the quality of justice.

Ensure sufficient and appropriate numbers of judges and support staff in all courts and that the Judicial and Prosecutorial Councils are staffed to their full composition and that recruitment procedures are undertaken according to the laws and regulations.

Keep promoting the use of alternative dispute resolution, increasing the number of cases resolved by way of mediation, as well as continue to allocate all required resources to ensure robust and continued operation of mediation centres.

Action points:

Policy and legislation The Government should involve the EU in the functional rule of law review process with a view

to aligning Kosovo laws and institutional framework with the EU acquis as well as European standards and best practices. (MoJ).

Fully implement the Justice Package, including adopting all necessary secondary legislation, and send information on /draft/ secondary legislation by June 2017. (KJC)

Management bodies KPC should publish its 2015 report and KJC and KPC should timely publish their reports for

2016 by the end of March 2017. (KPC, KJC) Ministry of Justice to amend the Law on KJC and KPC in an open, inclusive and consultative

manner, with a view to preparing amendments which will ensure statutory and full composition of both councils .

KPC should ensure that its members whose mandates expired are replaced without delay and send to the Commission information about these replacements by the end of April 2017. (KPC)

Evaluate the situation regarding the December 2016 process of selection of judges and to send a written explanation by the mid-March 2017. (KJC)

Independence, impartiality and accountability Approve the new Law on the Disciplinary Liability of Judges and Prosecutors, compliant with

international standards and EU best practices concerning the independence of the judiciary and autonomy of the prosecution. (MoJ)

Send the latest draft of the Law on the Disciplinary Liability of Judges and Prosecutors (Law on the ODC). (MoJ)

Irrespective of the introduction of the new Law on Disciplinary Liability of Judges and Prosecutors The Office of the Disciplinary Counsel (ODC) should complete, without further delay, all pending disciplinary investigations by the end of 2017. (ODC)

Irrespective of the introduction of the new Law on Disciplinary Liability of Judges and Prosecutors, KPC and KJC should complete, without further delay, all disciplinary cases pending before their Disciplinary Committees by the end of 2017 and introduce mechanism to swiftly clear all cases submitted by the ODC. Quality of justice Introduce an Initial Training Program for the judges, similar to that for the prosecutors. (KJC) Send the amounts allocated in the budget for the last three years for the entire justice sector,

including on the judiciary, KJC, prosecution, KPC, Correctional Service and mediation. (MoF) to enable determining of trends, send on a yearly basis, figures of the budget, comparable between years. (MoF)

Step up efforts with the aim of establishing a fully operational centralised criminal record registry. (KJC, KPC)Send data on cases on civil and criminal cases, separately, referred to for mediation (MoJ)

Efficiency Review case registration procedures, including on existing cases, to prevent the repeated

registration of one and the same case, and so as to have a clear and real overview of the situation regarding backlog of cases. ( KJC)

Send information and statistics for 2014, 2015 and 2016 on the average disposition time for criminal and civil cases, separately, in Kosovo courts. (KJC)

Send a report on the state of play with regard to the electronic case management system. (KJC) Send, as per the agreement under the European Reform Agenda, information regarding the

fulfilment of action point 1.8 of the European Reform Agenda, including on the reinforcement of the Economic Department and Fiscal Division of the Pristina Basic Court and a ratio of cases per judge in comparison to the situation from 2016. (KJC)

International judicial cooperation in civil and criminal matters Pursue efforts to implement the 1961 Hague Convention on Abolishing the Requirement of

Legalisation for Foreign Public Documents ("Apostille Convention"). (MFA, MIA) Inform regularly on projects to accede to other instruments of the Hague Conference on Private

International Law. Pursue efforts to negotiate new bilateral agreements on international legal cooperation in

criminal matters. (MoJ, MFA)

II. FIGHT AGAINST CORRUPTION

On the fight against corruption, progress in building a track record of investigations, prosecutions and convictions in the field of corruption, including on high-level cases has been made. The Special Prosecutor Office established a database containing information on top targeted cases of organized crime and high level corruption. Up to date, the database encloses data submitted by the Coordinators established team for 34 high profile organised crime and corruption cases. In total 26 indictments have been filed so far, out of which: 3 cases received final verdict; 3 cases were adjudicated at first instance; 11 cases are at the main hearing stage; 3 cases have the first hearing scheduled; 3 cases have the second hearing scheduled and 2 cases will have the first hearing scheduled soon. The Commission raised concern about the understaffing of the SPRK as one of the weaknesses in the system of combating corruption and organized crime. The criminal legal framework on corruption is generally in line with relevant European standards, however, there are areas that require urgent rectification such as provisions on confiscations, which are too cumbersome and complex to use, and the unreasonably short deadlines for investigations. The Commission informed that the track record of corruption and organised crime cases is an important priority in the context of the enlargement process and is strictly monitored in all enlargement

countries. The Commission urged Kosovo to include in the track record all high-level corruption and organised crime cases for better coordination and progress monitoring. The EU called on Kosovo to strengthen financial investigations in corruption cases. The law on the prevention of conflict of interest still remains to be amended to clearly define categories of public officials and adopt measures to prevent and sanction conflicts of interest, including the regulation of the "revolving doors". The EU took positive note of the adoption of the new Law on Public Procurement; and called upon Kosovo to implement the decision on the roll out of e-procurement in line with the government decision.

Overall / General recommendations:

Continue the sound implementation of ongoing strategies by strengthening monitoring and reporting capacities, including the allocation of appropriate financial and human resources for the implementation of the action plans. (Government, ACA, MOJ, MIA, MoF)

Continue steps to strengthen inter-institutional cooperation in fighting corruption, with particular focus on prevention measures. (Government, ACA, HSA, SPRK, KP, FIU)

Work towards increasing the track-record of convictions in corruption cases, including final confiscations in corruption cases. (ACA, SPRK, KP, Courts)

The relevant law enforcement and judicial bodies to utilise the resources of the Special Prosecutor Office of Kosovo (SPRK). Central Coordinator and his team to prioritise handling of high-level corruption and organised crime cases. (SPRK, KP)

Action points:

Track record Start exploring necessary changes to the Law on Financing of Political Parties in an open,

inclusive and consultative manner, with a view to preparing amendments by the end of 2017 which will strengthen transparency, accountability, effective enforcement and sanctions. (Assembly, CEC, OPM)

Send a formal letter to political parties, asking them to publish their complete annual financial reports and campaign financing disclosure reports on their websites with a deadline. In case of further failure, the CEC will thereafter immediately publish the submitted, unaudited reports on its own website. (CEC, Political Parties)

Political parties to publish reports on their party and campaign finances and the Assembly of Kosovo ensure effective and credible audits of political party finances. (Political parties, Assembly)

Institutional framework and inter-institutional cooperation Prepare a new anti-corruption strategy in an open, inclusive and consultative manner involving

all relevant stakeholders, with the government in the lead to set the main priorities. (Government MOJ, MIA, ACA)

Amend, by the end of 2017, the ACA law and the law on assets declaration taking into consideration EU-funded PECK II project recommendations, including elements to strengthen the verification power of the ACA, and robust mechanisms/tools enabling the Anti-Corruption Agency (ACA) to verify the veracity of the declaration of assets. (ACA, MoJ, Assembly)

Developments on legal and strategic framework Adopt, by mid-2017, amendments to the law on prevention of conflict of interest, especially to

clearly define categories of public officials, including measures to prevent and sanction conflicts of interest, including the regulation on the "revolving doors". (Assembly, MoJ)

III. HOME AFFAIRS AND FIGHT AGAINST ORGANISED CRIME

Although the lack of final convictions in serious crime cases and the low number of cases of asset confiscations remain of concern, during this meeting the progress achieved in relation to the database following top organized crime and high level corruption cases was acclaimed. The established multi-disciplinary team, under the central coordinator/SPRK Prosecutor, as well as the new database for monitoring high profile organised crime and corruption cases facilitates coordination between law enforcement bodies and offers a clearer picture of the process from investigation through to final convictions. The well-functioning database already has 34 targeted cases registered, which are being monitored and treated with high priority from all relevant institutions. Kosovo needs to continue the sound implementation of ongoing strategies by strengthening monitoring and reporting capacities, including the allocation of appropriate financial and human resources for the implementation of the action plans. The authorities also need to draft new strategies due to expire in 2017. Inter-institutional cooperation needs to strengthened, by increasing the capacity of the existing IT system to all organised crime and corruption cases towards building an initial track record of proactive investigation, prosecution, final convictions and criminal assets confiscations, with a view to delivering results on the track record. Readmission from Kosovo generally functions well. Kosovo has improved the processing of requests and signed new readmission agreements. The concluded readmission agreements with EU Member States are being implemented, but Kosovo needs to continue with sustainable reintegration. The Directorate for Witness Protection adopted its’ internal structure, this way meeting all necessary criteria for this department including human resources. Moreover the legal framework covering this field is also complete; however the programme does not have currently any witnesses under protection, due to lack of trust in the system.

Overall / General recommendations:

The Kosovo authorities to continue the sound implementation of ongoing strategies by strengthening monitoring and reporting capacities, including the allocation of appropriate financial and human resources for the implementation of the action plans. The authorities to prepare a new strategy in the case the current one is expiring in 2017. (MIA, KP, SPRK, MoF)

Strengthen inter-institutional cooperation by increasing the capacity of the existing IT system to all organised crime and corruption cases. (KP, SPRK, FIU, Courts)

Action points:

Legal and irregular migration, visa, asylum Continue taking concrete steps in dealing with irregular migration from Kosovo, such as targeted

awareness-raising on the consequences of irregular migration to be launched by mid-2017. (MIA)

Review and adopt the Contingency Plan for the Management of migratory flows by end 2017. (MIA)

Adopt amendments to the Law on Foreigners and the Law on Asylum by mid-2017, in line with EU and international standards. (MIA)

Gradually increase the staffing of relevant institutions in the migration and asylum area, with additional positions by the end of 2017. (MIA, MoF)

Continue to programmes in support to the reintegration of Kosovo nationals. (MIA)

Integrated Border Management (IBM) Adopt by mid-2017 the law on border control and surveillance in line with EU acquis and ensure

sound implementation. (MIA, Assembly) Continue to implement the intelligence-led policing approach and make full use of the potential

of the National Centre for Border Management, including by fully utilising the Kosovo police information system, and capacity to collect, harmonise, analyse and use relevant criminal statistics and data. (MIA)

Trafficking in human beings, smuggling of migrants Allocate sufficient resources for the compensation for victims of human trafficking, pursuant to

the Law on the Compensation of Crime Victims. (MOJ, MoF)

Civil registry, document security Continue working towards the roll-out of the civil registry system, including the completion of

the digitalisation process (data verification and data linking/matching), in line with the agreed timelines under the EU assistance programmes. (MIA, CRA)

Continue working towards the roll-out the address system in line with the agreed timelines under the EU assistance programmes. (MIA, KCA)

Ensure that civil registration offices in northern municipalities are fully functional and that citizens from northern Kosovo are provided with the possibility to apply for all Kosovo documents (CRA)

Police reform, fight against organised crime and cybercrime Continue efforts to sustain the achievements reached in building a professional, independent and

specialised police service throughout the country, including the provision of regular specialised trainings (part of initial and continuous trainings of the police training centre) and relevant resources for specialised equipment and staff. (MIA, MoF)

Take all necessary measures (including budgetary shifts, legal changes, staff relocation) to substantially increase the number of the prosecutors at the SPRK by the end of December 2017, and to provide them with the appropriate training, including on organised crime. (KPC, MOJ, MoF)

Prepare, by the end of 2017, draft amendments to the Criminal Code and Criminal procedure Code with the view to improve the efficiency of investigations, in particular to remove obstacles linked to investigation timeframes and related to seizure and confiscation of proceeds of crime. (MOJ)

Continue awareness-raising activities, trainings and specialisation of police and prosecution services to enhance their capacities to fight cybercrime. (KP, MIA, MEST)

Fight against drugs Undertake relevant follow-up measures to tackle the findings of the peer review mission on

handling, storage and destruction of drugs. (MIA, Ministry of Environment) Start, by the end of 2017, the preparations of a protocol or SPO for handling, storage and

destruction of drug precursors. The destruction process must be revised taking into account the Waste Law No 02/L-30, the Administrative Instructions No 10/2015 and the Law on Narcotic medicaments, psychotropic substances and precursors. (MIA)

Fight against economic crimes, money-laundering and confiscation of assets Continue good efforts to strengthen capacities of the Financial Intelligence Unit (FIU), including

inter-institutional cooperation with the law enforcement authorities and reporting entities, particularly in the area of handling suspicious financial transactions. (MIA, KPC, KJC, FIU)

Further align the legal framework to EU acquis, including by preparing relevant draft amendments to the law on money laundering and terrorism financing by the end of 2017. (MOJ)

The relevant law enforcement bodies to systematically apply tools for financial investigation and asset confiscation, with a view to increasing the overall value of confiscated assets in 2017, compared to 2016. (MIA, SPRK)

Fight against terrorism, counter violent extremism and radicalisation Continue the steady implementation of the Anti-Terrorism Strategy and Strategy on Prevention

of Violent Extremism and Radicalisation Leading to Terrorism, in particular actions pertaining to the Ministry of Education in order to strengthen prevention measures. (MIA, Ministry of Education, OPM)

Trafficking of weapons and collection of Small Arms and Light Weapons (SALW) Adopt the Law on Legalisation of Weapons and surrender of small arms and light weapons,

ammunition and explosive materials. (MIA, Assembly) Adopt the new Strategy on Weapon Control and Collection of Small Arms and Light Weapons.

IV. HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS

The Commission welcomed the fact that the Ombudsperson moved into adequate premises and that all secondary legislation now has been adopted, thereby further strengthening the protection of fundamental rights. There is a lack of progress on developing a unified umbrella human rights strategy by the Prime Minister's Office of Good Governance. The Commission presented the new Regulation on Data Protection and emphasised that the amendments to the law on data protection should take account of SAA requirements and the new EU acquis and proceed to adoption without further delay. It was reiterated that the EU should be included in the consultation process for all drafting of legislation and policies. The Commission welcomed the recent appointment of focal points within the prosecution and judiciary to the advisory group on LGBTI and encouraged Kosovo to continue raising awareness. Moving forward with the proposal for a sustainable financial solution for the public broadcaster RTK in line with the current RTK law and EU best practices should be a priority. The Commission welcomed the recent adoption of the National Strategy for Protection from Domestic Violence and its 2016-2020 action plan. Transitional justice is considered a crucial element of the democratisation process and it remains a challenge. The Commission noted with disappointment the absence of interlocutors at the meeting to discuss the Government’s political and strategic approach to the issue of persons missing from the war and noted that this showed a continued lack of high-level commitment to tackle this issue.

Overall / General recommendations:

Continue implementing the laws related to the Human Rights Law Package, including the adoption of the remaining secondary legislation.

Further strengthen inter-institutional coordination at central level, and between the central and municipal bodies, and ensure that a sustainable budget is set aside at both levels for proper implementation of human rights policies.

Thoroughly investigate attacks on journalists, cases of sexual and domestic violence, hate crime, hate speech and discrimination and attacks against LGBTI persons and ensuring timely and thorough investigation and adjudication of such cases.

Ensure sustainable funding of the institutions covered under the Kosovo Property Agency and Kosovo Property Comparison and Verification Agency laws, and for providing adequate funding for the implementation of judicial and constitutional decisions, and for the compensation scheme.

Agreed action points:

Ombudsperson Ensure proper monitoring of follow-up on reports, including on the annual report, and

recommendations by the Ombudsperson, with a view to successively raising the implementation rate. (OPM/OGG, Assembly)

Amend the Rules of Procedures to ensure full debate on the annual report/recommendations of the Ombudsperson Institution. (Assembly)

Policy, implementation, institutional set-up, budget Advance the work of the Inter-Ministerial Coordination Group for Human Rights and start

regular meetings as of 6 February 2017. (PMO) Develop a comprehensive Human Rights Strategy and action plan, a unified policy plan that will

enable the coordination and implementation of sectorial policies in field of human rights. (OPM, Inter-Ministerial Coordination Group for Human Rights, Ombudsperson)

Prison system and Kosovo Correctional Services (KCS) Select and appoint, without further delay, the director of the Kosovo Correctional Service, on the

basis of a merit-based and transparent selection process and in line with the law. (MoJ) Send detailed information, by end of June 2017, on inspection and the implementation rate on

recommendations from inspections carried out in 2015 and 2016. (KCS)

Protection of personal data Adopt without further delay the amendments to the laws on data protection and access to public

information (including the appointment of the commissioner), their implementation and sufficient allocation of human and financial resources, in line with EU recommendations, with a view to operationalizing the NAPPD and effectively strengthening data protection in Kosovo. (Assembly)

Freedom of expression Send to the Commission detailed data, by the end of February 2017, on cases of threats and

attacks against journalists, including classification and type of violations (KP). Finalise by end of June 2017 a financing model for RTK in line with the current RTK law, EU

standards and best practices, based on proper consultation with civil society and all stakeholders. (Assembly)

Share with the Commission the draft law on the RTK. (Assembly) The Assembly should follow up on recommendations of the Auditor General from the 2015

performance audit report (Assembly) Take initiative to regulate the media ownership and transparency. (Independent Media

Commission)

Property rights, including enforcement Extend the implementation of Administrative Instructions on regulating the registration of joint

immovable property in the name of both spouses beyond March 2017. (AGE)

Non-discrimination; Equality between women and men and violence against women; Rights of the child; Rights of persons with disabilities; Rights of LGBTI persons Make operational the Commission dealing with survivors of sexual violence during the war.

(MLSW) Align the draft Law on Child Protection, with international standards and secure sufficient

budget and clear institutional ownership. (Assembly) Develop a concept in 2017 for an umbrella Law on people with disabilities. (MLSW) Continue with awareness-raising campaigns within institutions and with the general public on

LGBTI rights. (OPM/OGG, Assembly)

Transitional justice and missing persons The Inter-Ministerial Working Group on Dealing with the Past to develop and implement a

concrete plan on how to structure and approach the consultation process, particularly with non-majority communities.

IV. RESPECT FOR AND PROTECTION OF MINORITY COMMUNITIES

The underlined the importance of ensuring adequate competence, support and resources to the Office of the Language Commissioner for the implementation of the Law on official languages. Kosovo confirmed that the new policy commitments/strategy on the integration of Roma, Ashkali and Egyptian communities 2017-2021 has been finalised. Kosovo confirmed that the new strategy, in its current form with provisions on the Egyptian communities having been removed, has been consulted with stakeholders. The Commission reiterated its concerns that the decision to remove those provisions might result in changes with regard to eligibility of future support.

Overall / General recommendations:

The Office of the Prime Minister should enhance the involvement the Office for Community Affairs (OCA) on minority policies and support projects deriving directly from these policies.

Relevant institutions of the government should adequately and seriously consider and implement recommendations issued by the Consultative Council for Communities.

The Office of the Prime Minister should politically support the Consultative Council for Communities.

Apply more consistently Article 74 of the Criminal Code. (KPC) Ensure inter-institutional coordination and allocating sufficient funds at local level to ensure

proper implementation of the new strategy.

Agreed action points:
