On behalf of more than 11 million in our states, the Chiefs for Change support the important reforms advanced by Race to the Top. This competition challenged states to set ambitious goals, rethink many existing laws and regulations, and forge new and important partnerships.

By insisting that states set ambitious goals, you ensured that funds were awarded to support states implementing rigorous standards and strong accountability systems. As the Department works with states to implement Race to the Top, we want to express our concern about potential changes to state plans that threaten to weaken its accountability provisions. We understand that implementation plans and scope of work may require adjustments, such as with the timelines. However, these revisions must not come at the expense of holding districts and schools accountable for improving the academic achievement of all students

Race to the Top will serve as an important catalyst for not only state reforms, but also for providing models that can help inform the reauthorization of the Elementary and Secondary Education Act (ESEA). We look forward to continue working with you and your staff in furthering the education reform our country needs and our students deserve.

Wanted to mention two things:

1. We are making our SIG awards public this week. We advised applicants we would strongly favor "turnaround" submissions- and it worked!. All are "turnaround" or "transformation," and most are the former. We are also pioneering something that may bubble up to you: We are imposing District-wide conditions on SIG awards, such as a plan to implement formative assessments or a new teacher eval system. In other words, if a district wants to get SIG $$ for one of its schools, it needs to agree to spend some of its OTHER resources on RttT type programs or systems across the board ..

2. I have been charged by Chiefs for Change to set up a meeting with Eric Smith, Deb Gist and you to share views on how to handle requests from RttT winners to delay implementation. Strong sentiment in the group that this is problematic. In any event, wanted your ok to try to schedule a call or meeting in mid August.

Thanks for your quick response. I've attached the letter. We are on a bit of a tight turn-around, hoping to get sign-ons by the end of the day next Thursday (7/21 ). The development of this letter grew out of a meeting hosted by Marian Wright Edelman with a number of education advocates to discuss concerns about the accountability issue in ESEA reauthorization. Given that a number of leaders in the education reform, civil rights, and business communities have already commented on accountability, our goal is to bring together a diverse group of organizations to sign on.

You'll see that the letter is short and to the point, delivering the message that a revised accountability framework in ESEA reauthorization must include all schools and all students, and that proposals limiting accountability to the lowest-performing schools are unacceptable. As I mentioned already, we think the letter is very much consistent with the principles for ESEA reauthorization that Chiefs for Change released in May.

Sign-ens so far include the Children's Defense Fund, ACLU, Center for American Progress, the Education Trust, the Leadership Conference on Civil and Human Rights, and the NAACP Legal Defense Fund. As Congress works to reauthorize the Elementary and Secondary Education Act (ESEA), we write to express our concern about potential changes to the law that threaten to weaken its accountability provisions. A reauthorized ESEA must ensure that all schools are held accountable for the achievement and progress of all students.

Like you, we believe that ESEA is in serious need of revision to incorporate the lessons learned from No Child Left Behind, including the need for drastically improved supports and interventions for states, districts, and schools that fall short of performance targets. However, these revisions must not come at the expense of holding districts and schools accountable for improving the academic achievement of all students.

More than 60 percent of public school students in the fourth, eighth, and twelfth grades can neither read nor do math at grade level. Low-income students, minority students, students with disabilities, and English-language learners lag even further behind. These struggling students attend all types of schools, not just the very worst.

Despite this reality, many policymakers seem prepared to craft a law that eliminates federal accountability for the vast majority of schools in our country. We urge policymakers to ensure states set high standards for all students, establish aggressive but achievable goals for ensuring that all students in all schools meet those standards, take prompt meaningful action when those goals are not met by students overall or any one or more student groups, and continue to collect and report data on student outcomes for all students and all schools. To do anything less - such

as focusing simply on the bottom five or ten percent of schools, as some have proposed -would be to turn back the clock on a vital civil rights protection for our most vulnerable children. This is unacceptable.

We urge you to ensure that all schools are held accountable for the achievement and progress of all students. Don't let "95-percent-left-behind" be the answer to No Child Left Behind.

The best interests of our children, their ability to do college-level work after high school and be prepared for the rigors of the 21st century workforce must be job number one in education reform.

As state education leaders, we strongly believe that the creation of consistent education goals- or education standards- shared by states provides an unprecedented opportunity for our young people, their parents, and teachers to have a clear understanding about what students need to know in order to be successful after high school, whether they live in Indiana or New Mexico.

Our states have adopted the Common Core State Standards in English and mathematics. These new standards were created by state education leaders, school chiefs, and governors from 48 states. In doing so, states have tapped the expertise of a diverse group of professionals, including teachers, academics, and researchers. Although 44 states and the District of Columbia have adopted the standards-provisionally or whole-cloth-we each own them in ways unique to our states.

We are currently working to bring the best minds and resources together to help our teachers decide how to effectively deliver instruction, ensuring that students master the standards and receive an academically rigorous and globally competitive education.

In Indiana, 'Essential Maps' are being created for teachers that align the state's current English and math curriculum to the new standards-connecting what they are used to teaching as they write lesson units and plans and allowing them to make adjustments while maintaining their flexibility and creativity in the classroom.

In Warwick, Rhode Island, teachers are rebuilding· the math curriculum, and they have already determined the new "scope and sequence" -which topics should be studied when. Their next step is to begin writing lesson units and plans, and parts will be implemented in September.

In Hillsborough County, Florida, teachers are bringing the standards into the classroom as part of a pilot program that will also retrain teachers and utilize new assessments. Professional development around the standards is also underway in Utah, where this summer, the state will conduct nearly 40 workshops to prepare teachers to implement the new standards in the fall. And, workshops designed to share effective ideas and lessons learned from past trainings are already happening in Columbus, Ohio.

These examples illustrate that how our new standards will be a powerful tool that defines what students need to learn, but do not dictate how teachers should teach. We are all striving to achieve the same goals that the standards demand: excellent teaching, high-quality professional development, rigorous curricula, and authentic assessments.

Parents, policymakers, and advocates should be engaged in a frank and robust discussion about how their states and local educators intend to meet the expectations set by these standards. That discussion must be respectful of different points of view, but it must also be an informed one. Right now, we're seeing too much misinformation and mischaracterization of the standards by those who, it appears, do not know much about them.

To be clear, these new standards are high, rigorous, and state-led. They do not represent a movement to create a national curriculum controlled by the federal government, and they are not being driven by special interests.

It's time we all acknowledge this work is the critical next step in the state-led standards movement that began more than two decades ago. Today's students must be competitive, both nationally and internationally. Too many are not, and our society is suffering as a result.

We, as state education leaders, will not allow this to continue. Our economy demands innovative thinking, a collaborative spirit, and higher expectations for our young people. These new standards, once met, hit the right marks. This is why we are firmly committed to their successful implementation.

These standards are a promise, not a silver bullet. This work is hard, but states have shown they can come together to create consistent, high standards all students can master for career and college success- regardless of who they are or where they live.

We reached out to Carmel Martin, Secty Duncan's point person on ESEA reauthorization regarding the AASA and NSBA resolution for blanket waiver. We asked if a statement from Chiefs for Change pushing back on the blanket waiver resolution would be helpful to Secty Duncan.

• They do believe a statement would be helpful. The AASAINSBA statement is generating a lot of attention.

• Chiefs for Change's statement would be the only "major'' counter statement to the calls for just flexibility without any additional reform requirements which would be helpful.

• They were ok with both the tone and substance of the draft statement and had no suggested edits.

Attached is a revised statement from the chiefs with edits based upon your comments on the last call. We will send to your comm. directors also.

Chiefs for Change Statement on AASA/NSBA Call for Blanket Waivers

As an organization dedicated to putting students first through visionary education reform, Chiefs for

Change opposes the recent petition by the American Association of School Administrators and the

National School Board Association to suspend the accountability provisions of the Elementary and

Secondary Education Act (ESEA) and the interventions provided to students.

We support the swift reauthorization of ESEA. Chiefs for Change has outlined principles to guide

Congress as it works to improve federal policy. Providing a blanket waiver to all states will bring

negotiations on reauthorization to a standstill, creating uncertainty for states and potentially

threatening the progress that has been made by many states to improve the quality of education for

students across America.

We support more federal flexibility, including the use of targeted waivers, but only when such flexibility

supports education reform and when it is earned based upon state actions that have produced greater

student achievement. Blanket regulatory relief would weaken accountability and more importantly,

deny students critical educational services and options.

Reauthorization provides an opportunity to improve ESEA, renew our commitment to America's children

and transform education for the 21st century without rolling back our expectations for students and the

adults who educate them. State and education leaders should seize the moment to be innovative in

improving the quality of education in America.

Memorandum to Chiefs for Change From: Townsend McNitt Re: Discussion draft for Talent Bench project Date: December 7, 2011

Preliminary overview of the talent bench project:

The education reform movement needs more leaders prepared to take on the critical task of reforming our nation's schools through state education agencies. Many members of Chiefs for Change entered their state departments to find a lack of like-minded leadership personnel or vacancies in critical positions. Additionally, since the formation of Chiefs of Change, the Foundation for Excellence in Education is increasingly asked to identify qualified candidates to fill open state education chief positions. At the Chiefs for Change meeting in October in San Francisco members discussed the creation of a Talent Bench whereby the staffwould identify individuals ready to assume senior education leadership roles at the state level, including potential State Chiefs, Deputy Chiefs, Choice Office and Assessment Directors. This list of qualified individuals would be available to current Chiefs, incoming Chiefs, and Governors to fill existing openings and to help fill key education leadership positions after the 2012 elections. Additionally, Chiefs discussed the Foundation becoming a resource to assist with administering formal searches for specific high level vacancies needed by Chiefs.

Getting Started:

1. Identify the key positions for which candidates are being sought. 2. Determine the core education reform principles that all candidates must share (ie. annual

testing, rigorous and transparent accountability, high standards for all children, viable school options).

Developing the List:

• Use existing networks- To start this list, gather and categorize relevant names and recommendations from within this group (Chiefs, Education Excellence). This can be done via telephone conversation and email and names will be cataloged for key positions.

• Partner with like-minded organizations- Success in developing and maintaining a list of individuals ready to take on key jobs will be greatly enhanced by partnering with like minded organizations who are willing to share their recommendations. Reach out to key reform organizations such as Teach for America, New Leaders for New Schools, Democrats for Education Reform, The Broad Superintendent Academy, Education Trust, Center for Education Reform, etc. and ask if they would be interested in partnering together on this important work.

• Create an education reform group on a social media site --To encourage people to selfidentify as reformers and give them a place to (virtually) meet other reformers, create an open group on a social media site, such as Linkedln. Such a group would be open to all and could serve as the basis for a large, virtual gathering of self-identified reformers.

Townsend McNitt has developed and implemented successful federal public policy and legislative strategies over fifteen years of service in the U.S. executive and legislative branches and as a consultant to state and national political campaigns, nonprofit organizations and schools. As an attorney, legislative advisor and public policy expert, McNitt has worked on education initiatives as a senior staff member in the U.S. Congress, the White House and the U.S. Department of Education and has served as an education policy advisor in the last four U.S. Presidential elections.

McNitt has extensive expertise in national education policy, having participated in the reauthorization of every significant piece of federal education legislation between 1995 and 2008. A graduate of Gordon College and Notre Dame Law School, she presently provides strategic advice to state and local education leaders, public policy and nonprofit organizations and schools. McNitt serves on the Board of Directors of the Henry Ford Learning Institute and provides educational advice to foster children and community organizations serving at risk children.

The Wrong Fix for No Child Left Behind Published: October 26, 2011

The revised No Child Left Behind Act that passed out of the Senate education committee last

week goes too far in relaxing state accountability and federal oversight of student achievement.

The business community, civil rights groups and advocates of disabled children are rightly

worried that the rewrite of the law would particularly hurt underprivileged children.

for states that agree to several reforms, like creating new programs to overhaul the worst schools and comprehensive teacher evaluation systems.

The waiver plan would allow states to be rated on student growth on math and reading tests

instead of simply counting up the percentages of students who reach proficiency on those tests. It would also require states to set goals for all schools and plan for closing achievement gaps

and end the pass-fail system under which high-performing schools are rated as needing

improvement if one racial or economic subgroup fails to reach the achievement target.

The plan encourages state~ to embrace data-driven systems and teacher-evaluation systems that take student achievement into account. But it has not been well received in the Senate,

where some lawmakers seem to feel as if it usurps legislative power.

The Harkin-Enzi bill lowers the bar for reform and reduces federal pressure on the states. It

focuses only on the bottom 5 percent of schools, essentially allowing states to do as they please

with the rest. It backs away from requiring states to have clear student achievement targets for all schools, and does not require most schools to evaluate teachers rigorously.

Lawmakers are right that No Child Left Behind needs to be overhauled. But Congress needs to

do this carefully, without retreating from core provisions that require states to do better by children in return for federal aid.

During the Chiefs for Change conference call of Friday, August 19, the attendees agreed

to host a call on Monday, August 22 to further develop the "flexibility for reform framework."

The framework is based on the letter that the Chiefs sent Sec. Duncan on July 28. In it,

the Chiefs outline key reform priorities and discuss needed flexibility from current federal

requirements. The document is the basis of ongoing discussions with the Secretary of Education

regarding the ESEA waivers.

The Chiefs for Change have a remarkable opportunity to emerge as a national leader for

education reform. To capitalize on the opportunity, the Chiefs need to present a clear vision for

the group while also supporting the unique challenges that each chief faces. To do that, we

need to better understand what is and what is not a priority/feasible for each chief.

This document begins to collect that information. It organizes the reform framework

(from the July 28 letter) into six categories. Within each category there are more specific issues.

For each of these issues, we are collecting responses - brief responses- to five questions. The

questions are designed to help us think through these issues priorities relative to the reform

framework and the waiver request. It should provide more clarity on where we agree, where we

don't, and how we can work together.

Accountability:

o What is the state's key policy objective? This is maybe the highest priority of all

for IN. We want the waiver process to help us raise the bar on our state

accountability system, so that we can reach more schools (and maybe districts

as well for the first time). We'd like ED to tell us we need to reach approximately

the bottom 5% of schools with our state system in order to substitute it for AYP.

back the bill last year. If ED can hold us to a higher bar, we may finally be able

to make our accountability system stronger as we want to. We can "blame" it

on the feds.

(AYP flexibility is suggested). In return for allowing state to sub their own state

accountability systems for AYP, state must address approximately the bottom

5% of schools.

During the Chiefs for Change conference call of Friday, August 19, the attendees agreed

to host a call on Monday, August 22 to further develop the "flexibility for reform framework."

The framework is based on the letter that the Chiefs sent Sec. Duncan on July 28. In it,

the Chiefs outline key reform priorities and discuss needed flexibility from current federal

requirements. The document is the basis of ongoing discussions with the Secretary of Education

regarding the ESEA waivers.

The Chiefs for Change he~ve a remarkable opportunity to emerge as a national leader for

education reform. To capitalize on the opportunity, the Chiefs need to present a clear vision for

the group while also supporting the unique challenges that each chief faces. To do that, we

need to better understand what is and what is not a priority/feasible for each chief.

This document begins to collect that information. It organizes the reform framework

(from the July 28 letter) into six categories. Within each category there are more specific issues.

For each of these issues, we are collecting responses - brief responses- to five questions. The

questions are designed to help us think through these issues priorities relative to the reform

framework and the waiver request. It should provide more clarity on where we agree, where we

don't, and how we can work together.

State Sovereignty in Education Act

Section 1. {Legislative Intent}

(A) The Legislature finds the following:

(1) In 2009 and 2010, the State was offered the chance to compete for education funding through the "Race to the Top" program created by the U.S. Department of Education ("DOE").

(2) The only way the State could achieve a score in the competition sufficient to qualify for funding was to agree to "participation in a consortium of States that ... [i]s working toward jointly developing and adopting a common set ofK-12 standards ... that are supported by evidence that they are internationally benchmarked and build toward college and career readiness by the time of high school graduation .... "

(3) The only such "common set ofK-12 standards" existent at that time, or since, is known as the Common Core Standards Initiative ("CCSI") and was developed by special interest groups without a grant of authority from any state. The first official public draft of these standards was released in March 2010.

(4) To meet the deadline imposed by the DOE, the State had only two months to evaluate the CCSI standards and agree to adopt them. There was little or no opportunity to solicit input from the Legislature, from schools, from teachers, or from parents.

(5) Adoption of the CCSI standards would necessitate tremendous expenditure of money and effort by the State to ensure that curricula, textbooks, teacher training, digital media, and assessments are aligned with the standards.

(6) The CCSI standards have been criticized by many evaluators as inferior to standards currently in place in some States. Moreover under the Race to the Top application process, DOE decreed that States may not supplement the CCSI standards except to an extremely limited extent.

(7) The CCSI standards have not been field-tested.

(8) Despite these problems, under the point system devised by DOE to tally scores and award funding, any State that declined to adopt the CCSI standards could not receive Race to the Top funding.

(9) There is also concern that future Federal education funding may be made contingent on the State's adoption and implementation of the CCSI standards.

(10)Through this process, DOE has usurped the power of the State to control the curriculum and the methods of instruction and assessment in its public-education system, in violation of Federal law prohibiting DOE from directing a State's curriculum and of Amendment X to the United States Constitution.

(11) It is the intent of the Legislature to protect from Federal encroachment the State's sovereignty in matters of education policy and to therefore nullify the State's commitment to the CCSI standards.

Section 2. {Short Title}

This Act shall be known as the "State Sovereignty in Education Act."

Section 3.

The State Board of Education may not adopt, and the State Department of Education may not implement, the Common Core State Standards developed by the Common Core Standards Initiative. Any actions taken to adopt or implement the Common Core State Standards as of the effective date of this section are void ab initio. Neither this nor any other statewide education standards may be adopted or implemented without the approval of the Legislature.
