Government Organization Act

ECONOMIC DEVELOPMENT AND TRADE GRANT AMENDMENT REGULATION

For information only: Made by the Lieutenant Governor in Council (O.C. 188/2016) on July 7, 2016 pursuant to section 13 of the Government Organization Act.

1 The Economic Development and Trade Grant Regulation (AR 5/2002) is amended by this Regulation.

2 Section 2 is amended

(a) in subsection (1) by striking out “Subject to subsection (2), the” and substituting “The”;

(b) by repealing subsection (2).

3 The following is added after section 8:

Deductions from grant

8.1(1) The Minister may deduct from a grant

(a) any amount that the recipient is required to repay under section 8(3),

(b) if the recipient or prospective recipient becomes indebted in any respect to the Government, any amount owing to the Government, or

(c) any amount if the Minister, in the Minister’s sole discretion, considers the deduction appropriate.

(2) The deduction may be any amount up to and including the total amount of the grant payable.

(3) The Minister may use all or any of the grant deducted for payment to a person who would be entitled to receive it from the prospective recipient.

4 Section 11 is repealed.

Schedule

Establishment

1 A regional services commission to be known as the Central Peace Fire and Rescue Commission is established.

Members

2 The following municipalities are members of the Commission:

(a) Town of Spirit River;

(b) Municipal District of Spirit River No. 133;

(c) Village of Rycroft.

Services

3 The Commission is authorized to provide fire services as defined in section 535.2(1)(c) of the Act.

Operating deficits

4 The Commission may not assume operating deficits that are shown on the books of any of the member municipalities.

Property

5(1) The member municipalities shall execute all documents and do all things necessary to transfer to the Commission all property listed in the Schedule.

(2) The Commission must not, without the approval of the Lieutenant Governor in Council, sell any of its land, buildings or personal property whose purchase has been funded wholly or partly by grants from the Government of Alberta.

(3) The Lieutenant Governor in Council may give approval under subsection (2) if satisfied

(a) as to the repayment of grants from the Government of Alberta and outstanding debt associated with that portion of the property to be sold,

(b) that the sale would not have a significant adverse effect on the services the Commission provides, and

(c) that the sale will be properly reflected in the rates subsequently charged to the member municipalities of the Commission.

Non-profit corporation

6(1) The Commission must operate as a non-profit corporation unless otherwise approved by the Minister.

(2) The Minister’s approval may contain any terms or conditions that the Minister considers appropriate.

RESIDENTIAL TENANCIES MINISTERIAL AMENDMENT REGULATION


For information only: Made by the Minister of Service Alberta (M.O. SA:016/2016) on July 11, 2016 pursuant to section 70(1) of the Residential Tenancies Act.

1 The Residential Tenancies Ministerial Regulation (AR 211/2004) is amended by this Regulation.


3 The Schedule is amended by adding the following after Form 6:

This form must be used by the designated authority to certify that there are grounds to terminate a tenancy under section 47.3 of the Act when the designated authority has

(a) completed the necessary assessment, and

(b) is satisfied that, if the tenancy continues, there is a risk to the safety of the tenant, the tenant’s dependent child or a protected adult who lives with the tenant.

The notice and certificate included in this form are for use to effect service on the landlord as required by section 47.3(2) of the Act.

NOTICE TO LANDLORD

This notice and certificate are valid if served within 90 days after the date on which the designated authority declaration (section 3) was signed.

You may be required to notify the other tenants listed on the certificate that the tenancy will terminate for all the tenants in the premises. However, you and the additional tenants may agree to enter into a new landlord and tenant relationship.

You are required by law to ensure that any information that you receive from or about the tenant named above that is related to this notice and certificate is kept confidential unless you are authorized under the Termination of Tenancy (Domestic Violence) Regulation to disclose that information. You can access the Regulation on the website of Alberta Queen’s Printer at: http://www.qp.alberta.ca.

You may apply to a court or the Residential Tenancy Dispute Resolution Service to set aside a notice to terminate only on the ground that the notice to terminate and the certificate were not properly served as required by section 47.3 of the Residential Tenancies Act.

Oil Sands Conservation Act

OIL SANDS CONSERVATION RULES AMENDMENT REGULATION


For information only: Made by the Alberta Energy Regulator on July 11, 2016 pursuant to section 20 of the Oil Sands Conservation Act.

1 The Oil Sands Conservation Rules (AR 76/88) are amended by this Regulation.

2 Section 1(2) is amended

(a) by repealing clauses (d.01) and (d.1);

(b) by adding the following after clause (d.12):

(d.13) “Directive 085” means Directive 085: Fluid Tailings Management for Oil Sands Mining Projects as published by the Regulator and as amended from time to time;

3 Section 15(1) is amended by striking out “or” at the end of clause (f) and by adding the following after clause (g):

(h) the fluid tailings volume profiles, fluid tailings management plans and fluid tailings management reports submitted to the Regulator,

(i) any information provided by an operator to the Regulator as part of an application,

(j) any monitoring data that is provided by an operator to the Regulator in accordance with Directive 085, and

(k) any report or study that is provided by an operator to the Regulator in accordance with a term or condition of an approval or Directive 085.

4 Section 24.1 is amended by striking out “Directive 074” and substituting “Directive 085”.

5 Section 28.1 is repealed.

6 Section 30(3) is amended by adding “and” to the end of clause (g), striking out “and” at the end of clause (h) and repealing clause (i).

7 Section 32.1 is repealed and the following is substituted:

Information to be provided

32.1 An operator shall submit to the Regulator, in accordance with Directive 085, and as the Regulator considers necessary,

(a) a fluid tailings volume profile for new and legacy fluid tailings,

(b) a fluid tailings management plan that addresses both new and legacy fluid tailings, and

(c) an annual fluid tailing management report in respect of fluid tailings management and performance and fluid tailings inventories.
