President’s Message November/December Newsletter
It’s not “Adieu”! It’s “Au revoir”. As I end my year leading EASGV, I look back at what we have accomplished and I have a really, really good feeling. Here is a list of what we have accomplished this year:

We answered the challenge for the City of Hope Walk for Hope
And we are establishing the guidelines for our Specialists Resource Center These are great accomplishments. We have won the awards every year for the last number of years so to other regionals it may seem like we win so handily, but that is so not true. Our members work hard for every single one of these awards and we deserve it. But I feel that my greatest accomplishment was starting the Pay It Forward program. That was my crown jewel and although it was the first year, our next President will take on its momentum and carry it on. I hope that Pay It Forward was successful in bringing in new and vibrant assistant staff into our organization. They are the future of our organization. So a great big “Thank you” to my Board, my committee chairs, and all those Volunteers that we snared in to help us in our various committees. Terri, Vanessa, Elia, Tricia, Karen, Emily, Phil, Greg, Kai, Judy, Dave, Miriam, Jacqueline, Teresa Shaver, Donna Inman, Lupe Landeros, Anna Millsap, Angela Hum, Jana DeTavis, Rosie Mares, and Maria Howard. This is just a portion of the list. After all, our Education Committee had 19 people on it! EASGV has such a huge reputation within the California Escrow Association. Our CEA Directors will agree that all the other regionals say they want to be us when they grow up. And when I am at State, I keep emphasizing how vibrant of an association we are. I put out a “Call To Arms”, and I get people ready, willing and able to step up. How many times have we saved the PD committees from other regionals when they needed to give the PD test and they couldn’t get their own people to volunteer? We sent people to Orange County and LA to help them Proctor! It’s unbelievable and unheard of! I need to end my Presidency here at EASGV because I have to take the fight to another level. Next year I will be sitting on CEA’s Executive Board as the PD Portfolio Chair. I will also be sitting on EIC’s Executive Board as First Vice President and National Affairs Chair. I will be joining the

National Certification committee at the American Escrow Association. I may be cracking my whip else-where, but I will report to Terri and your new Board here every step of the way. Wherever I go, I never for-get my roots are here, my support comes from all of you, and that I go as a Member of EASGV. So it’s not “Adieu”, it’s “au revoir”. It’s not “go with God” but “see you later” or as I say in private, “Laters, Baby”. At the last CEA Directors Leadership Committee meeting someone made this profound pronuncia-tion, which I took to heart: The Presidency is a Badge of Pride, not a Badge of Burden. And even more so when you are the President of the Escrow Associates of San Gabriel Valley.

California amends UCC Code regarding Name of Individual on Financing Statements

Effective January 1, 2015, this new bill addresses and provides guidance in what constitutes a sufficient
debtor’s name, the use of a driver’s license or ID card and prohibits discrimination. California now joins
40 states which have enacted a similar bill.

AB 1858, Perea. Commercial law: secured transactions.
The Uniform Commercial Code - Secured Transactions governs security interests in collateral, including personal property and
fixtures, as well as certain sales of accounts, contract rights, and chattel paper. That code, among other things, specifies
requirements and procedures regarding perfecting a security interest, including the filing of a financing statement with the
Secretary of State. Existing law specifies that a financing statement sufficiently provides the name of a debtor, where the debtor
is an individual, if it provides the individual name of the debtor or the surname and first personal name of the debtor.
This bill would revise the manner in which a financing statement sufficiently provides the name of the debtor, where that debtor
is an individual, to provide that, where the Department of Motor Vehicles has issued a driver’s license that has not expired or
identification card that has not expired to the individual, the statement sufficiently provides the name of the debtor only if the
statement provides the name of the individual indicated on the license or card and, if the individual has not been issued a driver’s
license or identification card, the statement sufficiently provides the name of the debtor if it provides the individual name of the
debtor or the surname and first personal name of the debtor. The bill would also implement transitional rules for carrying out these provisions.
Existing provisions of the Unruh Civil Rights Act, with certain exceptions, prohibit various forms of arbitrary discrimination by business establishments.
This bill would make it a violation of the Unruh Civil Rights Act for a secured party or proposed secured party to decline to
provide credit to a debtor or proposed debtor, or offer to make the terms and conditions of such credit less favorable to the debtor
or proposed debtor, if that decision was based on the fact that the debtor’s name to be included on the financing statement is or
would be that provided by a debtor to whom the Department of Motor Vehicles has not issued a driver’s license that has not
expired or an identification card that has not expired and all elements that would be required to establish a claim for violation of the Unruh Civil Rights Act are established.

Dear EASGV Members and Attendees-
It’s been an incredible 2014 Educational Year – it began back in our January meeting speaker with CFPB, and the subject will continue to be a H U G E issue in 2015.
Our Summer Seminar – An Escrow Revolution was actually 2 different training sessions: One for Escrow Assistants, the other for Seasoned Escrow Officers.
2015 begins on a very high note – Our January 15th meeting will feature the one and only Rose Pothier, who will return to EASGV with major updates. YOU DON’T WANT TO MISS THE INFORMATION!!!
Finally, we want to thank the most wonderful Education Committee in CEA for 2014– our entire committee worked very, very hard to bring us a line up of great topics and speakers.
As we move into 2015, both Vanessa and Phil will be assuming different rolls on your Board of Directors, but will stay in-volved with the Education committee. Would you consider volunteering an evening and joining our 2015 Education Com-mittee? It will open your world of Escrow and your Association, and you will make new Escrow friends! It will do your heart well to serve the Association which serves you.
We have enjoyed serving as Co-Chairmen for 2013 – 2014. We also appreciate all the support and direction our Board of Directors along with our President Juliana Tu gave us, and we optimistically look forward to the future.

EASGV supports the City of Hope!
Final numbers for the year
With the $100.00 donations each month from one particular member/organization, we sold raf-fle tickets that contributed $2,300.00 to the City of Hope. A big “Thank You” to all our mem-bers and non-members who bought raffle tickets in support. And “Thank you” to Greg Kunath, Anna Millsap, Angela Hum and Jana De Tevis for helping us sell those tickets!
Our “Wine Tasting Under the Stars” was a huge success, garnering $6,100.00 for the Biller Family Resource Center that is part of the City of Hope. “Thank You” to Greg Kunath, Phil Atwan for putting this fundraising together and Phil’s wife, Loretta, allowing us free run of her beauti-ful home and for graciously hosting the event. And let’s not forget Lupe Landeros and family, Debbie Anderson, and other helpers who worked crazily to decorate and Jana De Tevis who col-lected the sponsorships and entry tickets. Woo Hoo!
And finally, Our City of Hope – Walk for Hope event - spearheaded by Dave Shean and Sally Adams, drew 76 registered walkers and $13, 340.00 (and still counting!) donations to our 12-year main charity event. “Thank you” to all walk participants and Team Captains. Could not have done it without you!

BILL REVIEW
The spirited group met early Saturday morning with coffee cups in hand. Almost all that were present attended conference so
we did not linger over the bills that made it thru the 2013-2014 Legislative session. However, we did discuss what could have
happened if the membership had not acted when called upon. The grass roots reach out to your local Congressman is very val-
uable. When the Congressman has an understanding of effects on the industry, an informed decision can be made.
The results of the most recent November Election will have an impact on both Sacramento and of course, on the National level.
In preparation for the new Legislative year, the committee entertained whether or not CEA should sponsor any bills. Preparation
for that is now! The new Assembly people and State Senators will be sworn in December 1, 2014. If a bill is to be sponsored,
our advocate must locate the sponsor. This takes time. The Legislative session begins January 5th and the deadline for requests
for bills is January 25th. Then the bill must be authored and introduced by February 27th.
Your Bill Review committee suggested that consideration be given to two areas of concern. First, whether title or escrow can
make a clerical change on a notary acknowledgement/jurat without having the signer return to the notary/closing desk. It
was decided to first contact the Secretary of State to confirm the understanding that is prevalent within the real estate communi-
ty. Then if it is an accurate interpretation, our Advocates would work on getting a sponsor. The real life impact may be financial,
certainly consumer inconvenience and the obvious – delay.
Second, a request to revisit the issue of the per diem which is charged when a lender funds, and the funds are not be disbursed
within 24 hours. It was decided to form a sub-committee to revisit the law and the interpretation that the lenders are practicing.
More to follow after we meet in January.
Also Mike Belote suggested that the Bill Review committee be particularly vigilant. Last session, a bill was introduced to generate
revenue by charging a $75.00 fee for documents relating to real estate. It was defeated; but the feeling is that the surcharge fee
may be reintroduced.
Please share this article with others who are not members of their local Escrow Association. The Escrow practitioners’ voice is
not only relevant, but vital. The community can be heard, but the voice is loud when the membership numbers are up. The
year 2015 will bring new regulations, new manner of handling the desk, and new challenges as CFPB evolves. Be a part of your
profession. Join your local Escrow Association. Be aware and Be Educated.

General Session
The big topic at this last Directors meeting for 2014 was that voting of the Directors present of the change to the By-Laws. There were 2 changes we voted on:
Portfolio Chairs – requirement to serve as a committee chair for 1 year out of the preceding 5 years. – This change to By-Laws passed. It will be brought to all members for a vote.
Executive Board – No Professional Designation requirement in order to serve on the Executive Board but requirement to have a minimum of ten years of experience as an escrow officer within the past 15 years – This change did not pass so it will not go to the general members.
Leadership / Membership Committee -
It is very important within the regionals to provide continuity for the transfer of the positions from person to person at the end of the year, particular the President’s position. CEA’s website has a President’s ToolBox to help. In 2015 we will re-institute a President’s Training Session in January for the incoming Presidents.
At the beginning of the year we set a goal for the increase in membership and each regional committed to how much of an increase they were going to aim for. We have increased our total membership this year, but not by the percentage set in our goal. Several regionals did very well and exceeded their goals. EASGV met our goal and exceeded by one person.
Next year we will need to set a new goal for increase. But important is that we must maintain what we have achieved each year.
We must emphasize that our dinner meetings are a SAFE HAVEN FOR EDUCATION. We should not allow attendees to use the meeting arena to recruit employees.
The present Presidents of various regionals will be sharing their SOP and Check List with everyone so that we don’t have to re-create the wheel.
It is important to remember that we must wear the Presidency as a Badge of Pride, not a Badge of Burden.
Professional Designation Committee
Of 26 test takers at the PD test at Conference, we had 9 who achieved their goals. There are now 5 more new CSEO, 3 CEO and 1 CMHS.
In the next year we will be looking to do the following:
Increase the time allotment from 2.5 hours to 3 hours for taking the Multiple Choice / True False sections of the tests for
for CET, CEO, CBSS, CMHS
Add new Sample Tests on the website
Update the PD Workbook

General Session:
Election of the 2015 Board took place at this meeting. The following have been elected to serve the mem-
bership for 2015:

The Governance committee, after much heated discussion through the months, brought forth a motion to
change part of the Bylaws, which motion was approved by the Executive Board. This motion will go to vote
at the November Board meeting to all Directors and if it passes, then to all CEA members at large there-
after:
Article IV, Section 1, C – any Director of the Association, having a minimum of 10 years as an Escrow
Officer for the past 15 years in the escrow profession can serve on the Board. (The requirement for
being professionally designated was hereby removed).
Article IV Section 1, C item 5 – Portfolio chairs can be any member who served as committee chair
for 1 full year within the past 5 years.
Tip of the Month and the CEA Mike Belote video clip were very well received. Our members are asked to
submit their tip of the month if they have one to the regional Presidents so that we have a continuous
source through the years.

CEA News
We have a form now to hand to speakers at our regional’s asking them to write and article.
Working on getting the publication in flip book. The Cover of the January issue will be the
winner of the photo contest at conference, exciting to see who won.
Governance
The motion to remove Professional designation from the bylaws as a requirement to be on
the CEA executive board failed. The motion that increased the time from two years to five
year preceding as a Portfolio Chairman of a committee before moving on to the executive
board did pass. Then we started on a new topic of proxy voting by CEA directors if away on
CEA business.

National Affairs/ American Escrow Association Committee
AEA Committee Chair wants to remind every region to find out NOW who from your region will be able to attend the AEA Annual
business meeting in Albuquerque, New Mexico in June. If no one from your region will be able to attend a delegate may be ap-
pointed from another region, or a former CEA president, however, that person will need to be a member of your region PRIOR TO
December 31st. Last year California was missing 9 votes. We need every vote. Regions are encouraged to contact CEA as soon as
possible if a delegate cannot be found within their region so that there is time to help locate someone. Again, that delegate must
be a registered member of your regional association on 12/31/14 in order to meet one of the requirements for voting at AEA in
June.
Also, California is in charge of registration at the AEA Conference this year, happening June 10-14, 2015, so we need signups early
so we know who we can depend on to help.
In 2014, we did a 50/50 raffle with desks of playing cards which were held at both the AEA & CEA Conference. At AEA we netted
$572 and at the CEA Conference $613 for a total of $1,185.00!!! Thank you!
With the new CFPB regulations, AEA is looking for support with the Seller Financing Coalition. A proposal was made to set aside
$5000 to send Art Davis to represent us. More information can be found at www.savesellerfinancing.org
Education Committee
Due to the motion passed in August, the sale of the Escrow Books was a success!!! 81 sets of Escrow Books I, II & III books were
pre-ordered by conference attendees at the discount price of $50 and then another 10 full sets were sold at full price since then.
This comes out to $5000 just from the CEA conference alone!!! This same offer will be made available to AEA Conference
attendees this upcoming year as well. Which goes to show, members are interested in education, it just may be a matter of price.
Proposal of putting together a Commercial Workbook was discussed, which we hope we’ll be able to complete by the end of next
year.

♦We talked about the new CAR Residential Purchase Agreement last issue. Did you
know that CAR also has a “Residential Purchase Agreement Guide”?. It has 251

♦ For those of you who don’t know, San Bernardino County Recorder increased their
Real Estate Fraud Fee to add $10.00 to recordation of all documents. Therefore
the cost for the first page will now be up to $25.00.
♦Here are a quick 7 tips for protection your credit and debit cards from fraud:
1. Report lost or stolen cards immediately
2. Memorize your Personal Identification number- don’t write it down
3. Sign the back of your new card as soon as you receive it
4. Use caution when giving your account number over the phone or online
5. Check your monthly statement
6. Use Online Banking to view recent transactions
7. Sign up for email and mobile alerts

Cranberry Jezebel Sauce (submitted by Tricia Vagt)
Ingredients – Yields 3 cups:
1 cup water
1/2 cup sugar
1/2 cup firmly packed light brown sugar
1 (12 ounce) bag cranberries (fresh or frozen)
1/2 cup pineapple preserves
3 tablespoons prepared horseradish
1 tablespoon Dijon mustard
Directions:
1. Bring the first 3 ingredients to a boil, stirring often, in a saucepan over medium-high heat. 2. Add cranberries. 3. Return mixture to a boil. Reduce heat and simmer, stirring often, for 10 minutes or until the
cranberry skins begin to pop and mixture begins to thicken. Remove from heat. 4. Stir in pineapple preserves, horseradish and mustard; remove pan from heat and let sauce cool. 5. Cover and chill in fridge until ready to serve. NOTE: Sauce may be stored in an airtight container in the fridge for up to two weeks.
