IMPORTANT 1) All the relevant documents as per requirement of the Tender must be submitted physically (Excluding price bid) along with the Tender Fee, EMD cover in sealed cover on OR before due date and time. SPECIAL NOTE FOR PRE-QUALIFICATION


The tender documents are of two separate bids i.e. technical and price bids. You are requested to submit the technical bid with the following credentials for pre-qualification, both online as well as physical as per schedule. 1. Contractor should produce evidence of having experience of executed similar nature of jobs in last seven years related to above subjected name of work.

i) Experience of having successfully completed similar works during last 7 years ending last day of month previous to the one in which applications are invited should be either of the following: -

a. Three similar completed works costing not less than the amount equal to 40% of the estimated cost. Or

b. Two similar completed works costing not less than the amount equal to 50% of the estimated cost. Or

c. One similar completed work costing not less than the amount equal to 80% of the estimated cost.

The similar nature of work like railway maintenance work etc. executed successfully in Govt., /Semi Govt., along with certified copies of documentary evidence, preferably photo copy of orders secured from GSECL /GETCO / DISCOMS / GEB / Central / State Government/Semi- Government, / Railway department and satisfactory completion certificate from respective department thereof. The GSECL may verify the above certificates / documents from respective department, if necessary.

The experience certificate from Private Individuals / Company for, whom the work is executed/ being, executed shall not be acceptable.

ii) Average Annual financial turnover during the last 3 years, ending 31st March of the previous financial year, should be at least 30% of the estimated cost.

2. Latest bank solvency certificate from any Nationalized bank , Public Sector Banks, or IDBI Bank / AXIS Bank / HDFC Bank / ICICI Bank / The Kalupur Commercial Co-Operative Bank Limited for a sum of Minimum 20% of estimated cost, of this wok, not more than 12 months old.

GENERAL INSTRUCTIONS TO THE BIDDERS

Percentage rate E- tenders are hereby invited for work of “ BI-ENNIANAL CONTRACT FOR MAINTENANCE OF RAILWAY SIDING AT SIKKA TPS ” - For Gujarat State Electricity Corporation Ltd, TPS SIKKA (herein after referred to as GSECL). The project is located in JAMNAGAR District in the state of Gujarat. 1.0 The work shall be carried out according to the enclosed General Conditions, other conditions, Technical Specifications etc & such of the working drawings approved by the GSECL. 2.0 Tenders must be submitted in the enclosed schedule of work & quantities. Those received in any other form will not be accepted. They should be accompanied by a covering letter in which the bidder should give all information as called for in the specifications &any other point which he would like to be considered along with the tender. 3.0 EARNEST MONEY DEPOSIT (EMD) 3.1 Bidders are requested to pay tender fee & an earnest money deposit by demand draft only all Nationalized Banks including Public Sector Banks- IDBI Bank Private Banks – (1) AXIS Bank (2) HDFC Bank (3) ICICI , Commercials Banks (1) Kotak Mahindra Bank (2) Yes Bank (3) RBL Bank ( The Ratnakar Bank Ltd.) Tenders not accompanied by EMD shall be rejected as non-responsive. 3.3 If during the tender validity period, i.e. 180 days from opening of technical bid, the bidder withdraws his tender, the EMD shall be forfeited and the bidder may be disqualified from tendering for further works. 3.4 The EMD will be returned promptly to the unsuccessful bidder. The EMD will be returned to the successful bidder after he furnishes the Security Deposit for performance and duly enters in to the contract. If he fails to furnish the SD or to execute the contract for the work offered to him, his EMD shall be forfeited and the bidder may be disqualified from tendering for further work. 3.5 If the successful bidder not paying SD within 10 days from issue of LOI, then RPAD notice will be issued to pay Security Deposit within next 07 days, failing which EMD will be forfeited. 3.6 In case the successful bidder not at all responding within notice period or withdraws his offer then his EMD shall be forfeited and he will not be allowed to participate in the Tenders invited by this office for the period of ONE year for the Tender invited. In that particular case next successful bidder (L-2) may be consider to carry out the work at L-1 bidder rates or go for re-tenderize. 4.0 Bids are invited under a Single Stage – Two bid procedure. This will also include the process of post-qualification of the bidders. Bidders are to submit simultaneously, technical bid both online & physical as per the given schedule, however price bid will be submitted only by online & if price bid will be submitted physically the same will not be opened & will not be considered. Proposal including bidder‟s data on his technical and financial strengths along with experience profile to meet with post qualification criteria and Bidder‟s Technical proposals containing work methods, approach, construction program etc will be submitted by the bidder both online & physical. The Technical Proposal along with the data and information for qualification will be opened first. The technical proposal along with qualification information will be subjected to an evaluation process contained as a part of the tender document and bidders those who found fit to qualify will be invited for opening of the price bid. GSECL as an employer reserves its absolute and unchallengeable right to qualify or disqualify one or all bidders by following an objective and transparent system. The envelope containing the post qualification data and the technical bid

will be opened first for post qualification of the bidders and evaluation of their technical proposals and to determine the responsiveness of the bids. Price bids of only those contractors who are declared as substantial responsive to the requirements of the bid documents will be opened only online for further evaluation. Qualification requirement specifying financial capacity, technical, minimum acceptable levels with regards to bidders experience in relevant projects and other relevant factors, such as work in hand, future commitments and litigation history etc. will be evaluated first, and those qualifying the criteria will be considered for further price evaluation. Technical proposal, which are not substantially responsive will be rejected. 5.0 The price proposals will be opened online only as per the schedule, after conclusion of the Technical Evaluation and Post Qualification process. 6.0 Schedules for tools & tackles, equipments, personnel details etc., and all other necessary details shall also be submitted, in Envelope – I, i.e. Technical Bid. Tenders will be opened on the day & time indicated in the tender notice in the presence of such bidders who wish to remain present. 7.0 Any tender not bearing signature of the bidder & seal of the company on all the documents accompanying the tender is liable to rejection. Further it is specifically instructed that conditional tenders shall summarily be rejected. 8.0 The bidders shall note that no deviations from the technical specifications or commercial conditions with this bid are acceptable & it will be presumed that the bidder agrees entirely with the specifications & General terms &conditions of the contract. 9.0 The tenders received after time and date specified in the tender notice, will not be accepted. Once the offer submitted by the contractor before due date of submission, the contractor will not be allowed to submit revised / additional / modified / other even before due date. However, if the issue and receipt of tender is extended by the GSECL due to any reason, the contractor may submit the revised offer before due date of submission, if he wish to submit. 10.0 The work shall be completed within the period stipulated in the contract. However it may be noted that drawings shall be released progressively & site clearance arranged accordingly to the progress of work at site. Therefore the contractor has to organize & coordinate the works to suit these. In the event of any delay due to the above or due to any other reason not attributable to the contractor, reasonable extension in the completing the work may be given at the discretion & as decided by the GSECL but no compensation or idle charges will be paid to the contractor under any circumstances. 11.0 The GSECL reserves the right to accept any tender irrespective of whether it is lowest or not or to reject all the tenders without assigning any reasons there of. Tenders departing from the technical Specification or the method of bidding in a radical manner may also be rejected. 12.0 The bidders shall be presumed to have carefully examined the drawings, conditions &specifications of the work & to have acquainted themselves with all the details of the existing site conditions, locations, materials, geological & weather conditions/characteristics, labour conditions & in general necessary information & data etc. pertaining to & need of the work. 13.0 On acceptance of the tender the name(s) of the accredited representative(s) of the bidder who would be responsible for taking instructions from the Engineers of the GSECL shall be communicated to the Chief Engineer (Gen.), Gujarat State Electricity Corporation Ltd, TPS Sikka. Dist. Jamnagar Gujarat 14.0 All royalties, sales tax, toll tax, local tax, development charges, VAT tax, & any other taxes including works Contract taxes etc. in respect of this contract shall be payable by the contractor & Gujarat State Electricity Corporation Ltd will not entertain any claims whatsoever in this aspect. Any statutory variation in future towards the above mentioned taxes that shall also be payable by the contractor & Gujarat State Electricity Corporation Ltd shall not entertain any claim of whatsoever nature, during or after the completion of this tendered work. Proof of such payments made by the Contractor to the appropriate departments shall be produced to Gujarat State Electricity Corporation Ltd failing which appropriate amount shall be withheld on getting information / instruction from the concerned departments. 15.0 The service tax will be applicable as per Govt. Notification No. 30-2012 dt. 20/06/2012 as per prevailing GOVT rules & regulations or any revised Govt. notification.

16.0 This specification is intended as a general description of quality envisaged for materials & workmanship & of the finished work. It is not intended to cover minute details. The work shall be executed in accordance with the best modern practice & to the complete satisfaction of the GSECL. Special techniques approved by the GSECL shall be used if & where found necessary without any extra claim. This specification shall have precedence if any thing contrary to this is stated elsewhere in the contract documents, the GSECL‟s decision shall be final & binding to the contractor on any issue arising out of such discrepancies. 17.0 The price bid submitted on line by bidders should be without any deviation in commercial as well as in the technical specification of the work. 18.0 The successful contractor will have to sign an agreement as per the Gujarat State Electricity Corporation Ltd‟s rules on stamped paper & the necessary stamp duty charges shall be borne by the contractor. 19.0 The bidder shall carefully study the work to be carried at different elevations & shall take into account & consider all factors, method of demolition as well as construction, sequence of all activities, site situation location all conditions etc. & shall consider for all such information/data/Conditions in the rates quoted. The GSECL will not pay any extra rate for any reason in case the contractor claims, after acceptance of contract, to have misjudged the site condition. 20.0 The percentage quoted shall include cost towards all materials, & machinery including equipments, fixtures, labour, constructional equipments, scaffolding, staging, ramps, walkways, approach and haul road, temporary works, etc. bearing permanent or temporary nature necessary for the completion of the work in all respects, except for those items specifically mentioned to be issued by the GSECL. The contractor must also arrange for the transport of materials & include all such costs in the rates quoted by him for finished work. 21.0 The Quoted % above or below shall be written both in words, & figures & the units in words. If any discrepancy occurs between words & figures, then words shall prevail. The tender documents shall be written legibly & free from erasure, overwriting or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided. 22.0 During the execution of the work if it is found that the work is not progressing as per the Scheduled Progress Programmed, approved by the GSECL & planned by the Contractor, due to the reasons attributable to the Contractor suitable action shall be taken as per Clause No.3, 4 and other relevant clauses appearing in the section of ``Tender & Contract for Works’’ of tender document. And GSECL may also take such action as it may deem fit to ensure that the work is completed in time at risk and cost of the contractor. 23.0 The contract or any part thereof shall not be subject to change without the written permission of the Chief Engineer (Gen.), Gujarat State Electricity Corporation Ltd, TPS Sikka. Dist. Jamnagar Gujarat or his authorized representatives. 24.0 Tender shall remain open for acceptance for a period of 180 days from the date of Technical bid opening & during this period no bidder shall be allowed to withdraw his tender. Any such withdrawals, during the said period will entail forfeiture of the earnest money deposited with the tender, and GSECL will take further action for “not dealing” with party etc. 25.0 Further information required, if any, can be had from the office of the Chief Engineer (Gen.), Gujarat State Electricity Corporation Ltd, TPS Sikka. Dist. Jamnagar Gujarat, during working hours. But it must be clearly understood that the tenders must be received complete in every respects by the due date & time. 26.0 The electric power, at site, will be made available at one mutually agreed point, free of cost (connection only) by Gujarat State Electricity Corporation Ltd, SIKKA Thermal Power Station within GSECL premises only. Further distribution will have to be carried out by the contractor as per requirements at their own cost. The necessary consumption charges will be recovered as per the tariff rate of Gujarat State Electricity Corporation Ltd from time to time as per GSECL‟s rules or PGVCL‟s Rule. 27.0 GSECL cannot provide quarter facility for residence to contractor. If however there are any surplus quarters available after meeting the requirements of GSECL‟s staff, then GSECL will consider allotting of quarters on rent as per the GSECL‟s rules.

28.0 The contractor will have to make their own arrangement of water for construction work as well as for their labourers at his own cost. However if GSECL supply water then in that case it shall be given at one point on chargeable basis as per GSECL‟s rules. The recovery towards consumption of water, if construction water is supplied by Gujarat State Electricity Corporation Ltd, SIKKA Thermal Power Station, shall be affected at the rates prevailing, during that period of consumption, in the Gujarat State Electricity Corporation Ltd. 29.0 Work carried under this contract shall be completed in all respects WITHIN 24 (Twenty Four) CALENDAR MONTHS from the date of issue of letter of order to commence the work. However, interim mile stones of the work will have to be completed as per the priority, sequence, schedule given by GSECL time to time. 31.0 Bidders must quote firm price only, till completion of work under contract, & this is to be confirmed by bidder while submitting his offer. 32.0 No escalation towards labour and material / fuel shall be paid in this execution of entire contract. Price quoted shall be firm. Contractor shall pay minimum wages to his labourers as per the Minimum Wages Act, 448 & rules there under as applicable from time to time in pursuant to the State Government notification. The concerned contractor shall submit the details of the payment with due certificate of LWO/IRO of the GSECL 33.0 Each bidder shall also submit a Declaration to the effect that bidder is an engineering construction firm or an association of firm which has successfully carried out large works of this nature & has adequate organization & experienced personnel to handle this type & magnitude of work. Information should be also given regarding the constitution of the firm; it‟s authorized, subscribed & paid up capital, the date & place of registration, the place of business, the names of the directors & other relevant information. 34.0. In the case of non-Indian firms the declaration should also include an undertaking to the firm registered, within three months of the date of notice of the acceptance of the tender. 35.0. Failure to so, as required in above clauses, in registering the firm after due notice, the tender acceptance is liable to result in the annulment of the tender with forfeiture of the earnest money deposit & other penalties that may be leviable under the conditions specified in tender & contract documents. 36.0. Tenders by corporation shall be signed with the legal name of the corporation followed by the name of the state of incorporation & by the signature & designation of the president, secretary or other person authorized to bind it in the matter with rubber seal of the company. 39.0. GSECL reserves the right to delete any item of Schedule-B for which contractor shall not have any right to claim on this account. 40.0 The contractor shall carry out whole work without affecting the plant activities and power generation. The contractor shall carry out the whole work in such a way that plant operation, maintenance, vehicular movements and other construction activities/works may not affect 41.0 The Contractor shall prepare all required roads, including haul roads ramps, turning points diversion of drains, trenches, nalas conduits, pipes, cables etc to execute various items of this Contract & arrange all transport of materials & all such costs shall be taken care of while quoting the rates. No extra payments shall be admissible towards such costs. On completion, this shall be cleared if asked by GSECL at no extra cost. 42.0 No idle charges shall be entertained by Gujarat State Electricity Corporation Ltd for any site conditions or any circumstances.

43.0 The Contractor shall take all requisite & necessary care to observe that no damage is caused to the Existing structures, assets etc. For any damage to the Existing Structures, assets of Gujarat State Electricity Corporation Ltd, the Contractor shall be held responsible, and he will have to rectify/restore/replace the damage immediately up to the satisfaction of Engineer in Charge, at his own cost. 44.0 The Bidders shall note: I. Percentage rates quoted shall cater for the cost of all materials & labour including all leads & lifts, tools, plants, consumables such as but not limited to fuels, lubricants, etc. cost due to mobilizing / demobilizing, temporary / permanent constructions II. Percentage rates quoted shall include for the details of constructions, which are obviously & fairly intended & which may not have been specifically referred to in these documents but are essential for the satisfactory completion of the work. III. No price escalation on any account, will be payable. 45.0 Tenders who do not fulfill all the above conditions & those specified in the documents attached with this contract document or incomplete in any respect are liable to rejection. 46.0 The contractor shall have a separate Provident Fund Code of RPFC in the name of company. The contractor, who does not posses such separate P.F. code, shall not be considered for acceptance of tender. The contractor has to submit such certificate showing P.F. code along with tender. 47.0 EFFECT AND VALIDITY OF BID: The submission of any bid connected with these documents and specification shall constitute on agreement that bidder shall have no cause of action or claim against the owner for rejection of his bid. The GSECL shall always be at liberty to reject or accept split any bid or bids at his sole discretion and any action will not be called into question and the bidder shall have no claim in that regards against the owner. 48.0 SITE VISIT: The bidder is advised to visit the site and examine the site conditions and the area. Where in the work is proposed to be carried out and to get his acquainted him self on his own responsibility for all information that may be necessary for quoting the tender bid and entering in to contract. All cash and liabilities arising out of the site visit shall be at bidder account. 49.0 RECOVERIES: (I) In case of any damage to equipment/machinery or structure/building of GSECL or any public property due to negligence‟s of contractor or any other reasons attributed to contractor the decision of E.I.C. regarding the amount of recovery shall be final. (II) If the contractor fails to execute the work as per direction of E.I.C. within the time frame given by GSECL time to time, shall get the work done through any other contractor at the risk and cost of the contractor and the cost of execution of such work along with 15% overhead charges shall be deducted from contractor monthly bill over and above recovery as per rules. 50.0 The notice inviting tender, general instruction to bidders and all other documents of this tender shall form part of the contract.

51.0 ACCEPTANCE OR REJECTION OF BID

You as a part of the GSECL SIKKA TPS team and as defined by the scope of mentioned Standard, all contractors are required to comply with and participate to prevent the Occupational Health and Safety hazards and risks including observation of safety rules. 1.1 GENERAL The work to be performed under the all items and specifications consists of providing all labour, supervision, securities, materials, scaffolding, power, fuel, water, construction equipment, testing equipment, all required machineries tools and plants, supplies, transportation, risks securities obtaining required labour licenses , insurances complying all safety rules & labour laws, all Govt Liabilities all incidental items not shown or specified, but reasonably implied or necessary for successful completion of the work including pollution control measures, safety measures, approach / haulage roads, contractor‟s supervision and in strict accordance with the items ,drawings and specifications etc. The scope is also inclusive of site clearance, stripping, jungle cutting, carrying out detail Total station survey for setting out the line out with instruments before starting & completion work, shoring strutting shuttering staging dewatering and the contractor has to carry out all type of dismantling, Excavation works & construction works as mentioned in the items of schedule–B ,Special conditions, all other terms conditions, detail specifications drawings etc attached in the tender and as directed by EIC time to time and also it is in the scope to carry out other ancillary works associated with the subjected work as well as the other works which are not mentioned here in tender but shown by engineer in charge without any extra cost. The unit rates quoted by the contractor for all items shall be deemed to be inclusive of all the operations specified in the above paragraphs and also of any other contingency whatsoever required for completion of the work. No extra payment shall be made to the contractor on these accounts for other protective enabling works. 1.2 LAYOUT AND LEVELS 1.2.1 The layout and levels of all structures etc. shall be made by the contractor at his own cost from the general grid of the block & bench marks given by the Engineer. Initially before starting the works, the contractor will carry out the contour layout of the full area by taking vertical & horizontal ordinates marked with the help of precise equipment like total station and as directed by EIC. This will not be paid separately but will be included in the rate quoted by the contractor in schedule-B of the tender. He has to provide all help in instruments, materials and men to the Engineer at no extra cost for checking the detailed layout and correctness of the layout and levels. But the Contractor shall be solely responsible for correctness of lay out and levels. Detail working programme shall be prepared & got approved from E.I.C. 1.2.2 Permanent reference pillars shall be established by the contractor and under no circumstances shall the contractor remove or disturb any permanent bench mark without the approval of the Engineer. The Contractor shall follow reference points and shall lay out all his work by accurate reference thereto. 1.3 CONSTRUCTION METHOD 1.3.1 The contractor will be provided with construction drawings. The contractor shall prepare chart showing working of all items with the time schedule for the overall activities & the excavation & construction method to be adopted by him and shall be approved by the Engineer. The tender drawings are indicative only & may vary as per the actual site conditions and the designs etc. The construction shall have to be done as per the details, designs, instructions etc by E I C time to time. 1.4 HANDING OVER OF SITE

Efforts will be made by the Owner to hand over the site to the Contractor free of encumbrance. However, in case of any delay in handing over the site to the Contractor, the Owner shall only consider suitable extension of time for the execution of the work. It should be clearly understood that the owner shall not consider any other compensation whatsoever viz. towards idleness of contractor‟s labour, equipment etc.

1.5 QUALITY ASSURANCE CHECK LIST Quality assurance check list is enclosed or obtained to this specification giving details of Tests to be carried out on various materials however also to be followed as per the relevant I S Specifications for material testing and the agency shall be responsible for carrying out such tests at his own cost. The samples of all materials to be tested by the Contractor shall be tested by him in presence of authorized representative of the E.I.C. at the specified frequencies. However such check list shall in no way limit the liabilities and responsibilities of the contractor in regard to quality of work as detailed out in technical specification and documents. 1.6 APPROACH ROADS The Contractor shall make his own arrangement for approach to the work site and within the work area for movement of men, material, machinery, other equipments etc. required for carrying out the work included under this contract as per specifications and the rates quoted for various items under schedule of items & shall be inclusive of the cost for preparation and maintenance of approach roads/haulage roads/access roads, etc throughout contractual period. Providing and laying required diameter RCC pipe in rain water / Nala‟s / plant water drain/trenches pipes passing of water, cable etc. their diversions etc. for preparing the approach to carry out the work without affecting plant activities/ systems wherever necessary at no extra cost. 1.8 PREVENTION OF POLLUTION The contractor shall be solely responsible and liable for all the damages/activities caused by any pollution that may take place during the execution of works and he shall make arrangements, as approved by the Engineer for preventing pollution but, not withstanding, such approval, the entire responsibility for any pollution shall rest with the contractor. No separate payment shall be made for the pollution control measures and the quoted rates shall include the cost for all pollution control measures. 1.9. SAFETY MEASURES (Separate sheet attached Annexure-I) The contractor shall ensure the safety of workers, material and structure including existing structures during execution of the contract. Safety measures shall be followed during operations of equipments/machinery being used. No separate payment shall be made for the safety measures and the quoted rates shall include the cost for all safety measures. 1.10 EQUIPMENTS AND MACHINERY The contractor shall have to use his own latest safe technology equipment‟s machineries tools, tackles etc as required of good condition duly tested and certified with load proof tests from C.A. and any other machinery required for the entire scope of work. 1.12 The all construction materials and workmanship shall be in accordance with the items of Schedule-B as well as per the relevant I. S .Specifications, P.W.D. manuals / Railway norms, manuals/specifications, and as per the booklet of GSECL “General Specifications for Civil Works” The all materials to be used shall be the best and from manufacturers, make and brand as approved by Engineer In Charge. After getting the sample tested and approved the same materials only shall be procured and use in the work by the contractor The cost of all materials are to be included in quoted rates. GSECL will supply the material as per Schedule A only.

1.13 All the royalties, taxes (except service Tax), Govt. duties, welfare cess or any unforeseen expenses, if required to be made, shall be borne by the agency. The rates quoted shall be deemed to account all such factors after careful consideration of work and site condition. No extra claim shall be entertained in any circumstances on any account.

1.14 Any activity not specifically mentioned in the tender but necessary in the opinion of the EIC of the work, must be carried out for successful completion of job.

1.15 If due to any stoppages, or litigation / stay order etc. work is suspended then no idle charges will be paid. Only suitable time limit extension will be granted based on genuine reason but no extra claim will be entertained.

GENERAL RULES AND DIRECTIONS FOR THE GUIDENCE OF CONTRACTOR

Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the GSECL. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained. 1. All works proposed to be executed by the contract shall be noticed in one of the English and one of the vernacular local daily newspapers, stating the work to be carried of as well as the date of submitting and opening tenders and time allotted in carrying out the work. Also the amount of earnest money to be deposited with the tender and the security deposit to be deposited by the successful bidder and the percentage, if any, to be deducted from bills. 2. Copies of specifications, design, drawings, estimated rates, scheduled rates and any other documents required in connection with the work which will be signed by the Engineer-in-Charge for the purpose of identifications shall be open for inspections by the contractors at the office of the Executive Engineer during office hours. 3. Whether the works are proposed to be executed according to the specifications recommended by the contractor and approved by a competent authority on behalf of the Gujarat State Electricity Corporation Ltd, such specifications with designs and drawings shall form part of the accepted tender. 4. The bidders and receipts for payments made on account of any work, when executed by a firm should be signed by all the partners except where the contractors are described in their tender as a firm, in which case the receipt shall be signed in the name of firm including the partners or some other person having authority to do so. 5. The bidder at shall fill up the usual form stating at what percentage above or below rates specified, he is willing to under take the work. Only one rate or such percentage on all the estimated rates or schedule rates shall be mentioned. 6. Bidder which proposes any alternation in the work specified in the form in invitation to tender or in the time allowed for carrying out the works or which contain any other conditions of any sort, will be liable to rejection. 7. No single tender shall include more than one work, but contractors who wish to tender, for two or more works, shall submit a separate tender for each work. Tender shall have the name and the number of the works, of which they pertain, be super scribed on the envelope. 8. The Engineer-in-charge or his duly authorized assistant will open tenders in the presence of any intending contractors who may be present at the time and will enter the amount of the several tenders in a comparative statement in a suitable form. In the event of a tender being accepted, the contractor shall there upon, for the purpose of identification, sign copies of the specifications and other documents. In the event of tender being rejected, the officer (Engineer-in-charge) shall authorize the paying officer concerned to refund the amount of the earnest money deposited to the contractor making the tender on his giving a receipt for the return of the money 9. The officer, competent to dispose off the tenders, shall have the right of rejecting all or any of the tenders, without assigning any reasons thereof. 10 The receipt for any payment alleged to have been made by contractor in regard to any matter relating to tender of the contract shall be valid of binding on the GSECL unless it is signed by the Engineer-in-charge. 11 The memorandum of work to be tendered for and the schedule of materials to be supplied by the Gujarat State Electricity Corporation Ltd and their rates shall be filled in and completed by the office of the Engineer-in-charge before the tender form is issued if a form issued, to an intending bidder has not been so filled in and uncompleted he shall request the said office to have this done, before the completes and delivery his tender. 12. All works shall be measured, meet by standard measure and according to rules are custom and usual in the use in the Gujarat State Electricity Corporation Ltd, and no proposal to adopt alternative method will be accepted, the Engineer-in-

charge decision as to what is “the usual method in use in the Gujarat State Electricity Corporation Ltd” shall be final. 13. Every contractor shall, except the registered contractor on the approved list of the GSECL, produced, along with the tender a solvency certificate from the collector of the District within which he resides, of a banker‟s certificate of his financial stability, if he fails to produce such a certificate his tender will not be considered. 14. All corrections and addition or pasted slips should be initialed 15. Bidder shall be deemed to have full knowledge of relevant documents, site conditions etc. whether inspected or not by him. 16. Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done and conditions and rates at which stores materials etc. will be issued to him and local conditions and other factors bearing on the execution of the work. 17. Under no circumstances shall any contractor be entitled to claim enhanced rates for any item of contract without prior sanction of the competent authority. 18. CONDITIONS OF CONTRACTS

1. DEFINIATIONS: (a) The Contract means the documents forming the tender and acceptance thereof, together with the documents referred to therein or individual work order in the case of term contract, including these conditions, schedules and / or additional conditions attached to the form of tender or individual work, order, rate schedule, the specifications and the drawings and all these documents as applicable taken together shall be deemed to form the contract. (b) The “Tender Document” means the form of tender, the applicable schedules and/or additional conditions and the specifications and/ro drawings as issued to the contractors for the purpose preparing tender. (c) The expression “works” or “work” when used in the conditions of contract shall, unless there be something in the subject or context repugnant to such construction means, the works or the work contracted to be executed under or in virtue of the contract whether original or altered. (d) The “Contractor” means the individual or firm or company, whether incorporated or not, undertaking the works and shall include his or its legal personal representative, successors and permitted assignees. (e) “GSECL” means the Gujarat State Electricity Corporation Ltds and the “Accepting Officer” means the officer who is authorized to sign and signs the contract on behalf of the “GSECL.” (f) The letter “EE” means Executive Engineer who in the case of measurement and lump sum contract, direct the contractor and the letters “S.E.” means Superintending Engineer” and “C.E.” means Chief Engineer who administers and in the case of the term contracts directs the contract. (g) The “Engineer-in-charge” means all officers of the GSECL appointed by the Chief Engineer to supervise the works or part of the works. (h) “Approved” and “Directed” means the approval or direction of the Chief Engineer to Superintending Engineer or the person deputed by him for the particular purpose. (i) “B.S.” means the “British Standard” as issued by the British Standards institution. “A.S.” means the American Standards as issued by the American Standard Institutions and “I.S.” means the “Indian Standards” as issued by the Indian Standards Institutions. Wherever the above mentioned abbreviations are preferred to, in the specifications and / or work orders, they mean the addition with all amendments current at the date of issue of tender documents of work orders. In the case of measurement and terms of contracts “Specifications” means those contained in Gujarat State Electricity Corporation Ltd schedule together with any amendments etc. embodied in the tender documents, “Drawings” refer to those accompanying the tender documents and/or any work orders referred therein. (j) The “Contract Sum” means the sum accepted or the sum calculated in accordance with the prices accepted in the tender and/or the contract rate as payable to the contractor for the full and entire executing and completion of works. (j) “The date of completion” is the date or dates of completion of the work or any part of the works set out or ascertained in accordance with the individual work orders and the tender documents or any subsequent agreed amendments thereto. 2. SECURITY DEPOSIT:- The contractor shall pay, within 10 days of the issue of Letter Of Intent, 5% of contract value as Security Deposit, Alternatively the Bank Guarantee from any nationalized bank or selected private/ public sector banks as stated elsewhere in this tender. All damages, costs, charges, expenses and other sums which may be or may become due or payable by the contractor to the GSECL under the terms of the contract may be deducted from the cash in the proceeds of sale of the Securities/Bank Guarantee to deposited (which the officer or person to whom the same may be endorsed as aforesaid is hereby authorized to sell / to encase for that purpose) or from the interest of any such securities of from any sums due or which may become due to the contractor by the GSECL or from the whole or the balance unpaid as aforesaid of the encase securities so

deposited being repaid or transferred and returned as may be to contractor after finalization of final bill or completion of guarantee period whichever is later. 3. COMPENSATION FOR THE DELAY The time limit allowed for carrying out the work as entered in the tender shall strictly observed by the contractor and shall be reckoned from the date on which the order to commerce the work is given to the contractor. The work shall through out the stipulated period of contract the proceeds with due diligence (time being deemed to be essence of contract) and for delay, the contractor shall pay compensation, an amount equal to half percent per one week for the contract amount of work or such smaller amount as per the decision of the Competent Authority of the GSECL. However, the total amount of compensation to be paid by the contractor, under the provision of the clauses shall not exceed 10 percent of the amount of contract value as decided by the competent authority of the GSECL. The penalty will be invariably deducted from the bills of the contractor and no refund will be given unless the competent authorities approves the reduction the reasons for delay attributable to GSECL as well as to party will be brought out clearly while putting the proposal for waiver reduction in penalty. 4. ACTION WHEN WHOLE OF SECURITY DEPOSIT IS FORFEITED In any case in which under any clause or clauses of this contract the contractor shall have tendered himself to pay compensation amounting to the whole of his security deposit (whether paid one sum or deducted by installments) or in the case of abandonment for the work owing to serious illness or death of the contractor or any other cause, the Executive Engineer on behalf of the GSECL, shall have powers to adopt, (a) below and any of the following courses under (b) and (c) as he may deem best suited to the interest of the GSECL. (a) To rescind the contract (for which rescission notice of 10 days) in writing to the contractor under the hand of the Executive Engineer shall be conclusive evidence and in that case the security deposit of the contractor shall stand forfeited and absolutely at the disposal of the GSECL. (b) To employ labour paid by the GSECL, to supply materials to carry out of the works or any part of the works debiting the contractor with the cost of the labour and the price of the materials (as to the correctness of which cost and price the certificate of the Executive Engineer shall be final and conclusive against the contractor) and crediting him with value of the work done, in all respects in the same manner and at the same rates as if it had been carried out by the contractor under the terms of this contract and in that case the certificate of the Executive Engineer as to the value of the work done shall be final and conclusive against the contractor. (c) To order that the work of the contractor be measured up and to take such part thereof, as shall be unexecuted, out of his heads and to give it to another contractor to complete, in which case, any expenses, which may be incurred in excess of the sum, which would have been paid to the original contractor, if the whole work had been executed by him as to the amount of which excess expenses the certificate in writing of the Engineer-in-charge shall be final, conclusive and shall be borne and shall be paid by the original contractors and shall be deducted from any money due to him by the GSECL under the contract or otherwise from his security deposit of the proceeds sale thereof or a sufficient part thereof. In the event of the above courses being adopted by the Executive Engineer the contractor shall have no claim to compensation for any loss sustained by him by reason of his having purchased or procured any materials or entered into any engagements or made any advances on account of or with a view to the execution of the work or the performance of the contract. And in case the contract shall be rescind under the provision aforesaid, the contractor shall not be entitled to recover or be paid any sum for any works thereof actually performed by him under this contract unless and until the Executive Engineer shall have certified in writing the performance of such works and the amount payable to him in respect thereof and he only be entitled to be paid the amount so certified. 5. NOTICE FOR UNSATISFACTORY PROGRESS If the progress or a particular portion of the work is unsatisfactory the Executive Engineer whose decision shall be final, shall notwithstanding that the general progress of work is satisfactory; be

entitled to take action under Clause 4(c) after giving the contractor 10 days notice in writing and the contractor will have no claim for compensation for any loss sustained by him owing to such actions. 6. ACTION IN THE CASE OF DEFAULT BY CONTRACTOR If any case in which any of the powers conferred upon the Executive Engineer by Clauses 4 and 5 hereof, shall have exercised and the same shall not have been exercised, the non exercised thereof shall not constitute a waiver of any of the conditions hereof and such powers shall not withstanding be exercisable in any further case of default by the contractor for which, by any clauses hereof, he is declared liable to pay compensation amounting to the whole of his security deposit and liability of the contractor for past and future compensation shall remain unaffected in the event of the Executive Engineer taking action under sub clause (a) or (c) of Clause 4 he may, if he so desires, take possessions of all or any tools, plants, materials, and stores in such upon the work or the site thereof belonging to the contractor, or procured by him and intended to be used for the execution of the work of any part thereof paying for allowing for the same in account at the contract rates, or in the case of a contract rates not being applicable to current market rates to be certified by the Executive Engineer whose certificate thereof shall be final. In the alternative, the Executive Engineer may by notice in writing to the contractor or his clerk of works, foremen or other authorized agent, require him to remove such tools, plants, materials or stores from the premises within a time to be specified in such requisition to decisions to the contractor failing to comply with any such requisition, the decision of the Executive Engineer as to the expenses of any such removal and the amount of the proceed and expense of any such sale, be final and conclusive against the contractor. 7. EXTENSION OF TIME LIMIT If the contractor shall desire an extension of the time limit for completion of the work on the ground of his having been unavoidably hinder in it‟s execution or on any other ground, he shall apply in writing to the Executive Engineer and the Executive Engineer may, if in his opinion there are reasonable grounds for granting extension, recommend such extension as he may think necessary or proper. The decision of the Competent Authority in this regard shall be final and binding to the contractor. Any delay attributed to GSECL shall be compensated only by way of extending the limit. 8. COMPLETION CERTIFICATE On completion of the work the Contractor shall be furnished with Completion Certificate by the Executive Engineer of such completion but no such certificate shall be given nor shall be the work considered to be complete until works are taken over and/or duly tested and put to operative as the case may be, nor until the work shall have been measured by the Engineer-In-Charge or where the measurement have been taken by his subordinated until they have received the approval of the Executive Engineer the said measurement being binding and conclusive against the contractor. 9. EFFECT OF THE CERTIFICATE No payment shall be made for any work estimated to cost less than Rs.1,000/- till after the whole of said work shall have been completed and certificate of completion given. But in the case of works estimated to cost more than Rs.1,000/- Contractor shall on submitting a monthly bill thereof, be entitled to receive payments. Proportionate to the part of the work then approved and passed by the Engineer-in-charge, whose certificate of such approval and a passing of the sum so payable shall be final and conclusive against the contract. All such intermediate payments shall be regarded as payment by way of advance against the final payment only and not as payments for work actually done or completed and shall not preclude the Engineer-in-charge from requiring bad, unsound, imperfect or unskillful work to be removed and taken away and reconstructed or re-erected nor shall any such payment be considered as admission of the due performance of the contract or any part thereof in any respect of the accruing of the claim nor shall conclude, determine or effect in any way the powers of the Engineer-in-charge as to the final settlement and adjustment of the accounts otherwise or in any other way, vary or affect the contract. The final bill shall be submitted by the contractor within one month of the date fixed for completion of work, otherwise the certificate of Engineer-in-charge of the measurement and of total amount payable for the work shall be final and binding on all parties.

10. PAYMENT TO CONTRACTORS The rates for several items of works estimated to cost more than Rs.1,000/- agreed to within shall be valid only when the item concerned is accepted, having been completed full, in accordance with the sanctioned specification. In case, where the items of the work, are not accepted, as so completed the Engineer-in-charge, may make payment on account of such items at such reduced rates, as he may consider reasonable in the preparation of final or running accounts bills. Quantity shown in Schedule – B of tender is approximate and payment will be made accordingly to actual quantity of work done. 11. BILLS Shall be submitted by the contractor each month on or before the date fixed by the Engineer-in-charge, for all works, executed in the previous month and the Engineer-in-charge shall take or cause to be taken the requisite measurement for the purpose or having the same verified and the claim so far as it is admissible, shall be adjusted, if possible, within ten days from the presentation of the bills. If the contractor does not submit the bill, within the time fixed, as aforesaid, the Engineer-in-charge may depute a subordinate to measure up the said work in the presence of the contractor or his duly authorized agent, whose counter signature in the measurement shall be sufficient warrant and the Engineer-in-charge may prepare a bill from such list which shall be binding on the contractor in all respects. 12. SUPPLY OF MATERIALS TO CONTRACTOR If the specification of the estimated work provides for use of any special description of material to be supplied from the GSECL‟s Stores or if it is required that the contractor shall use certain stores to be provided by the Engineer-in-charge (such material and stores and the prices to be charged thereof as here in after mentioned being so far as practicable for the convenience of contractor but not so as in any way to control, the meaning or effect of the contract specified in the schedule or memorandum here to annexed) the contractor shall be supplied with such materials and stores as may be required from time to time be used by him for the purpose of the contract only and the value of the full quantity of materials and stores so supplied shall be set off or deducted from any sum due to thereafter to become due to the contractor, under the contract or otherwise or from the security deposit or the proceeds of sale thereof if the deposit is held in Government Securities the same or a sufficient portion thereof, shall be sold for the purpose. All materials supplied to the contract shall remain the absolute property of GSECL and shall on no account be removed from the site of the work and shall at all time be open to inspection by the Engineer-in-charge. Any such materials un used and in perfectly good condition at time of completion or determination of the contract shall be returned to the GSECL‟s store if the Engineer-in-charge so requires by notice in writing given under his hands but the contractor shall not be entitled to return any such materials except with consent and he shall have no claim for compensation on account of any such materials supplied to him as aforesaid but remaining unused by him or for any wastage in or damage thereto. The contractor shall be responsible for the loss, destruction or deterioration of the materials, stores or articles supplied to him by the GSECL even if such loss, destruction or deterioration has occurred under any circumstances whatsoever beyond his control as if the materials, stores or articles so supplied were his property. 13. WORKS TO BE EXECUTED IN ACORDANCE WITH SPECIFICATIONS, DRAWINGS, ORDERS ETC. The contractor shall execute in whole and every part of work in the most substantial and workmanlike manner and both as regarding materials and in every other respect in strict accordance with the specification. The Contractor also shall confirm exactly, fully and faithfully to the designs, drawings and instructions in writing relating to the work signed by the Engineer-in-charge and lodged in his office and to which the contractor shall be entitled to have access for the purpose of Inspection at such office, or in the site of the work, during office hours and the contractor shall, also if he so requires, be entitled at his own expenses to make or cause to be made copies of the specification, and of all such designs, drawings and instructions as aforesaid. 14. ALTERATION IN SPECIFICATION AND DESIGNS NOT TO INVALIDATE CONTRACTS. The Executive Engineer shall have powers to make any alteration, or addition to the original specification designs, and instructions that may appear to him to be necessary or advisable

during the progress of the work and the contractor shall be bound to carry out the work in accordance with any instructions in this connection which may be given to him in writing, signed by the Engineer-in-charge and such alterations shall not invalidate the contract. Any additional work which the contractor may be directed to do in the manner above specified as part of the work shall be carried out by the contractor on the same conditions in all respect on which he agreed to do the main works, and at the same rates as are specified in the tender for the main work. Where, however, the works is to be executed according to the designs, drawing and specifications recommended by the contractor and accepted by the competent authority, the alteration above referred to shall be within the scope of such designs, drawings, and specifications appended to the tender. 15. RATES FOR WORKS NOT ENTERED IN ESTIMATE OR SCHEDULE OF RATE OF THE DISTRICT. If the additional and altered work includes any class of work for which no rate is specified in this contract, then such class of work shall be carried out the rates entered in the Schedule of Rates of the Division or at the rate mutually agreed upon between the Executive Engineer and the contractor, whichever are lower. If the additional or altered work for which no rate is entered in the Schedule of Rates of the Division is ordered to be carried out before the rates agreed upon then the contractor within seven days of date of receipt by him of the order to carry out the work inform the Executive Engineer for the rate which in his intension to charge for such class of work and if the Executive Engineer does not agree to this rate he shall be noticed in writing be at liberty to cancel his order to carry out such class of work and arrange to carry it out in such manner as he may consider advisable provided always that if the rates shall have been determined as lastly here in before mentioned then in such case he shall only be entitled to be paid in respect of the work carried out or expenditure incurred by him prior to the date of the determination of the rate as aforesaid according to such rate or rates as shall be fixed by the Executive Engineer. In the event of dispute, the decision of the Superintending Engineer of the Circle will be final. 16. EXTENSION OF TIME LIMIT IN CONSEQUENCE OF ADDITION OR ALTERATION. The time limit for the work shall be extended in the proportion that the increase in its cost occasioned by alterations or additions bears to the cost of the original contract work and the certificate of the Engineer-in-charge as to such proportions shall be conclusive.

17 NO COMPENSATION FOR ALTERATION IN OR RESTRICTION OF THE WORK TO BE CARRIED OUT. If at any time, after the execution of the contract documents the Engineer-in-charge shall, for any reason whatsoever, require the whole or any part of the work, as specified in the tender, to be stopped for any period or shall not require he whole or part of the work to be carried out at all or to be carried out by the contractor, he shall give notice in writing of the fact to the contractor who shall thereupon suspend or stop the work totally or partially as the case may be in any such case, except as provided here under the contractor shall have no claim to any payment or compensation what so ever on account of any profit or advantage which he might have derived from the execution, of the work in full but which he did not so derive in consequence of the full amount of work not having been carried out or on account of any loss that he may be put to on account of materials purchased or agree to be purchased or for unemployment of labour recruited by him. He shall not also have any; claim for compensation by reason of any alterations having been made in the original specification, drawings, designs and instructions which may involve any curtailment of the work as originally contemplated. Where however, materials have already been purchased or agreed to be purchased by the contractor before receipt by him of said notice, the Executive Engineer provided they are not in excess or requirement and are of approved quality and /or shall be compensated for the loss, if any, that he may put to in respect of materials agreed to be purchased by him. The amount of such compensation to be determined by the Executive Engineer whose decision shall be final. If the contractor suffers any loss on account of his having to pay, his labour charges during the period, during which the stoppage of work has been ordered under this clause the contractor

shall on application be entitled to such compensation on account of labour charges as the Executive Engineer whose decision shall be final, may consider reasonable provided that the contractor shall not be entitled to any compensation on account of labour charges if, in the opinion of the Executive Engineer, the labour could have been employed by the contractor elsewhere for the whole or part of the period during which the stoppage of the work has been ordered as aforesaid. 18. NO CLAIM TO COMPENSATION ON ACCOUNT OF LOSS DUE TO DELAY IN SUPPLY OF MATERIALS BY GSECL. The contractor shall not be entitled to claim any compensation from GSECL for the loss suffered by him on account of delay by GSECL in the supply of materials entered in Schedule A where such delay is caused by:

i. Difficulties relating to supply of railway wagons ii. Force Majeure iii. Act of God iv. Any other reasonable cause beyond the control of GSECL including Shortage of materials to be supplied by the GSECLs & difficulties in time by reaching at the site of any materials equipments In the case of such delay in the supply of materials, GSECL shall grant such extension of time for the completion of the works as shall appear to the Executive Engineer to be reasonable in accordance with circumstances of the case. The decision in the Executive Engineer as to the extension of time shall be accepted as final by the contractor.

19. TIME LIMIT FOR COMPENSATION CLAIMS. Under no circumstances, whatsoever, shall the contractor be entitled to any compensation from GSECL on any account unless the contractor has claimed in writing to the Executive Engineer within one month of the cause thereof.

20. ACTION AND COMPENSATION PAYABLE IN CASE OF BAD WORK. If at any time, before the security deposit is refunded to the contractor, it shall appear to the Executive Engineer or his subordinate in charge of the work that any work has been executed with unsound, imperfect or unskillful workmanship or with materials of inferior quality or that any materials or articles provided by him for the execution of the work are unsound or of a inferior quality to that contracted for or are otherwise not in accordance with the contract, it shall be lawful for Engineer-in-charge to intimate this fact in writing to the contractor and then no withstanding the fact that the work, materials or articles complained of, may have been inadvertently passed, certified and paid for, the contractor shall be bound forthwith to rectify or remove and reconstruct the work so specified in whole or any part, as the case may require or if so required shall remove the materials or articles so specified and provided other suitable materials or articles at his own charge and cost, and in the event of his failing to do so within a period to be specified by the Engineer-in-charge in the written intimation aforesaid the contractor shall be liable to pay compensation at the rate of one percent on the amount of the estimate for every day, not exceeding ten days during which the failure so continue and in the event of any such failure as aforesaid the Engineer-in-charge may rectify or remove and re-execute the work or remove and replace the materials or articles complained of, as the case may be, at the risk and expense in all respects of contractor should the Engineer-in-charge consider that any such inferior work or materials as described above may be accepted, or made use of, it shall be within his discretion to accept the same as such reduced rates as he may fix thereof. Provided that in the case of any work of which visible check is not possible, if the Engineer-in-charge or his subordinate in charge of the work feels that such work has been executed with unsound, imperfect or unskillful workmanship or with materials of inferior quality, he shall take sample tests at random, cost of which shall have to be borne by the contractor and if after taking such test, part of such work is found to be defective in any respect or to have been executed with materials of inferior quality, then the contractor shall be paid for the whole work such amount as may be fixed by the office of the Engineer-in-charge on the basis of the lowest

quality of work found by him in such samples tests. EXPLANATION: I Sample Test shall mean: (i) In relation to poles fixed as line supports, the token of one pole out of every 100 poles after taking it out from its foundation for inspection. (ii) In relation to any other work, such test as may be considered necessary, by the Engineer-in-charge or his subordinate in charge of the work. EXPLANATION: II Cost of the sample test shall mean cost incurred for the purpose of taking Samples & test and for restoring tested work to its original condition. 21. WORK TO BE OPENED TO INSPECTION, CONTRACTOR OR RESPONSIBLE AGENT TO BE PRESENT. All works under execution or in course of execution in pursuance of the contract shall at all times be open to the inspection and supervision of the Executive Engineer and his subordinate and contractor shall at all times, during the usual working hours and at all other times at which reasonable notice of the intension of the Executive Engineer or his subordinates to visit the works shall have been given to the contractor, during which period either he should be present to receive order and instruction, or have a responsible agent duly accredited in writing, present for that purpose. Orders given to the contractor‟s duly authorised Agent shall be considered to have the same force and effect as if they had been given to the contractor himself. 22. NOTICE TO BE GIVEN BEFORE WORK IS COVERED UP. The contractor shall give not less than 5 days notice in writing to the Executive Engineer or his subordinates in charge of the work, before covering up or otherwise placing beyond the reach of measurement of any work, in order that the same may be measured and correct dimensions thereof, taken before the same is so covered up or placed beyond the reach of measurement and shall not covered up or placed beyond the reach of measurement and work without the consent in writing of Executive Engineer or his subordinate in charge of work, If any work shall be covered up or placed beyond the reach without such notice having been given or consent obtained, the same shall be uncovered at the contractor‟s expense, and in default thereof, no payment or allowance shall be made for such work, or for the materials, with which the same, was executed.

23. CONTRACTOR’S LIABILITES The Contractor shall supply, at his own cost, all materials (except such special materials, if any as may be supplied form the GSECL stored in accordance with the contract) plant, tools, appliances, implements, ladders, cordage, tackles, scaffolding and any temporary works which may be required for the proper execution of the work., in the original, altered or substituted form and whether included in the specification or other document forming part of the contract or referred to in these conditions or not and which may be necessary for the purpose of satisfying or complying with the requirements of the Engineer-in-charge as to any matter on which under these conditions, he is entitled to be satisfied or which he is entitled to require together with carriage thereof to and from the work, the contractor shall also supply without charge, the requisite number of persons for setting out works, and counting, weighting and assisting in the measurement of, examinations at the time and from time to time of the work or materials, failing this, the same may be provided by the Engineer-in-charge at the expenses of the contractor and the expenses may be deducted from any money due to the contractor under the contract or from his security deposit or the proceeds of sale thereof or of a sufficient portion thereof the contractor shall provide all necessary fencing and light required to protect the public from accident and shall also be bound to bear expenses of defense of every suit, action or other legal proceedings of law that may be brought by any person for injury sustained. Owing to neglect of the above precautions and to pay any damage and costs which may be awarded in any such suit, action or proceedings to any such persons, or which may with the consent of the contractor be paid in compromising any claim by any such person.

24. CONTRACROR LIABLE FOR ALL DAMAGES. Compensation for all damage done intentionally or unintentionally by contractor‟s labourer, whether in or beyond the limit of GSECL‟s property, shall be estimated by the Executive Engineer, or such other office, as he may appoint and the estimate of the Executive Engineer, subject to the decision of the Superintending Engineer, on appeal, shall be final and the contractor shall be bound to pay the amount of the assessed compensation demand, failing which, the same will be recovered from the contractor as damages or deducted by the Engineer in charge from any sums that may be due to or become due from GSECL to the contractor under this contract or otherwise. The contractor shall bear the expenses of defending any action or other legal proceedings that may be brought by any person for injury sustained by him owing to neglect of precautions to prevent the spread of fire and he shall also pay any damage and costs that may be awarded by the court if in consequence. 25. RESCISSION OF CONTRACT AND FURNITURE OF DEPOSIT. The contractor shall not assign or sublet, without the written approval of the Engineer-in-charge and if the contractor assign or sublet his contract, or attempt to do so or become insolvent or commence any proceedings to be adjudicated as insolvent or make any composition with creditors, attempt to do so, the Engineer-in-charge may, by notice in writing rescind the contract. Also, if any bribe, gratuity, gift, loan, perquisite, reward or advantage pecuniary or otherwise shall either directly or indirectly be given, promised or offered by the contractor or any of his servants, or agents, or any person to the employee of GSECL in any way relating to his office or employment or if nay such officers or persons shall become in any way directly or indirectly interested in the contract, the Executive Engineer may, by 10 day‟s notice in writing, rescind the contract. In the event of a contract being rescinded the Security Deposit of the contractor shall there upon stand forfeited and be absolutely at the disposal of GSECL and the same consequences shall ensure as it the contract has been rescinded under clause 4 thereof and in addition the contractor shall not be entitled to recover or be paid for any work thereof actually performed under the contract. 26. COMPENSATION. All sums payable by a contractor by way of compensation under any of these conditions shall be considered as a reasonable compensation to be applied to the use of GSECL, without reference to the actual loss or damage sustained and whether any damage has not been sustained. 27. CHANGE IN THE CONSTITUTION OF FIRM TO BE NOTIFIED. In the case of tender by partners of a firm, any change in the constitution of firm shall be forthwith notified by the contractor to the Executive Engineer for his information. 28. WORKS UNDER DIRECTION OF SUPERINTENDING ENGINEER. All works to be executed under the contract shall be executed under the direction and subject to the approval of the Superintending Engineer of the Circle, Engineer-in-charge for the time being who shall be entitled to direct at what point or points and in what manner they are to be commenced and from time to time carried on. 29. DESCISION OF SUPERINTENDING ENGINEER TO BE FINAL. Except where otherwise specified in contract and subject to the power delegated to him by GSECL under the GSECL‟s rule, then in force the decision of the Superintending Engineer of the Circle / EIC. for the time being shall be final, conclusive and binding on all of the specification, designs, drawings and instructions herein before mentioned and as to the quality of workmanship or material used on the or as to any other question, claim, right matter or thing whatsoever in any way arising out of or relating to the contract, designs, drawings, specifications, estimates, instructions, orders or these conditions or otherwise concerning, the works or the execution or failure to execute the same, whether arising during the progress of the work or after the completion or abandonment thereof. 30. ARBITRATION. „ALL QUESTIONS, DISPUTES OR DIFFERENCES, WHATSOEVER WHICH MAY AT AN TIME ARISE BETWEEN THE PARTIES TO THIS CONTRACT IN CONNECTION WITH THE CONTRACT OR ANY MATTER ARISING OUT OF OR IN RELATION THERE TO, SHALL BE REFERRED TO THE “GUJARAT PUBLIC WORKS CONTRACTS DISPUTES ARBITRATION TRIBUNAL” AS PER

THE PROVISIONS OF THE GUJARAT PUBLIC WORKS CONTRACTS DISPUTES ARBITRATION TRIBUNAL ACT, 1992. 31. STORES TO BE OBTAINED FROM GSECL. The Contractor shall obtain from the GSECL Stores, such articles as are mentioned in Schedule „A‟ which may be required for the work or any part of the work or in making up any articles required there fore or in connection therewith, unless he has obtained permission in writing from the Executive Engineer or obtained such stores and articles from elsewhere. The value of such stores and articles as may be supplied to the contractor by the Engineer-in-charge will be debited to the contractor in his account at the rate shown in the Schedule “A” attached the contractor and if they are not entered in said schedule they shall debited to him at cost price which for the purpose of this contract shall include cost of carriage and all other expenses whatsoever which may have to be incurred in obtaining delivery of the same at the stores aforesaid and further overhead charges 15%. The Contractor shall be responsible for the loss destruction or deterioration of the materials, stores or articles supplied to him by the GSECL, even if such loss destruction or deterioration has occurred under any circumstances whatsoever beyond his control as if the material, stores or articles so supplied were his property. The contractor shall be responsible for returning the residual materials after completion of the contract and if fails to return, the balance material supplied to him by the GSECL, the cost of the residual materials will be recovered form the contractor at the market rate or stock issue rate whichever be higher at the time of materials account plus 15%. 32.1 LUMP SUM IN ESTIMATE. When the estimate on which tender is made, includes lump sums in respect of parts of the works the contractor shall be entitled to payment in respect of the items of works involved or the part of the work in question at the same rates as are payable under this contract or such items or if the part of work in question is not in the opinion of the Engineer-in-charge capable to measurement the Engineer-in-charge may at his discretion pay the lump sum amount entered in the estimate and the certificate in writing of the Engineer shall be final and conclusive against the contractor with regard to any sum or sums payable to him under the provisions of the clause. 32.2 LUMP SUM TENDERS. Whenever lump sum tenders have been invited for building or other structures of the same type, design, the contractor shall submit his bill stated in Clause No.11 and the Engineer-in-charge not below the rank of Executive Engineer shall certify by general measurement or by other method considered suitable to him, the value of work done and the contractor shall be paid monthly a sum equal to 90% of the total value the work so certified, since the last payment, after deducting a part or whole of the secured advance if not already paid for the materials utilized on the works. An additional secured advance for any fresh materials brought on site will also be paid if certified by the officer not below the rank of Executive Engineer. After the work is completed final bill would be paid on the certification of officer not below the rank of Executive Engineer, that the work is done according to drawing and specifications attached to the tender. If any additions and alteration have been carried out, detailed measurements in respect thereof shall be recorded and extra payment or deductions are regulated as per item rates quoted by the contractor while submitting the tender and if there are any items in the additions and alterations for which the contractor has not quoted a rate, the payment shall be as per Clause 15 above. 33. ACTION WHERE NO SPECIFICATIONS. In the case of any class of work for which there is no such specifications as is mentioned in clause 1. such work shall be carried out in accordance with the divisional specifications and in there event of there being no divisional specifications, the work shall be carried out in all respects in accordance with the instructions and requirements of the Engineer-in-charge / consultant of the GSECL etc. 34. NO CLAIM FOR VARIATION IN QUANTITISE OF WORK:- Quantities shown in the tender are approximate and no claim shall be entertained for quantities of work actually executed, being either more or less up to 25% or 5 lacs, for individual items

which ever is more as per site requirement. However , overall amount of quantities to be executed will be within the amount of technical sanction.

35. NO CLAIM FOR COMPENSATION FOR DELAY IN STARTING WORK:- No compensation shall be allowed for any delay caused into starting of work on account of acquisition of land and in the case of clearance for works or any delay in according sanction to estimates.

36. NO CLAIM FOR COMPENSATION FOR DELAY IN EXECUTION OF WORK:- No compensation shall be allowed for any delay in execution of the work on account of water standing in borrow pits or compartment. The rates are inclusive for hard or cracked soil, excavation in mud, sub-soil water or water standing in borrows pits and no claim for an extra rate shall be entertained unless otherwise expressly specified & mentioned in the tender.

37. ENTERING UPON OR COMMENCING ANY PORTION OF WORK:- The contractor shall not enter upon or commence any portion of work except with the written authority or instructions of the Executive Engineer or his subordinate in charge of the work, failing such the contractor shall have no claim to ask for measurement or payment for work.

38. METHOD OF PAYMENT Payment to contractors shall be made by A/c payee cheques provided the amount exceeds Rs.50/-. Amount not exceeding Rs.50/- will be paid in cash. Generally payment may take 30 to 60 days after passing of bills depending on availability of fund.

39. ACCEPTANCE OF CONDITIONS ON TENDERING FOR WORK.

Submission to tender or acceptance of work order shall imply acceptance of these conditions of tender by contractor.

40. EMPLOYMENT OF SCARCITY LABOUR. If government declares a state of scarcity or famine to exist in any village situated within 5kms of the work, the piece worker / contractor shall employ upon such part of the work as are suitable for unskilled labour; any person certified to him by the Executive Engineer or by any person to whom Executive Engineer may have delegated this duty in writing to be in need of relief and shall be bound to pay such person wage not below the minimum, which Government may have fixed in this behalf from time to time. Any implementation of this clause shall be decided by the Superintending engineer / Engineer-in-Charge whose decision shall be final and binding on the piece worker/contractor.

41. EMPLOYMENTS OF TECHNICAL PERSONS. The contractor who executes the works of Rs.5 lakhs and above shall employ the technically qualified personnel possessing minimum a Diploma of reconciled Technical institution, for executing the work of the GSECL.

1.0 CONTRACTOR TO INFORM HIMSELF FULLY. The contractor shall be deemed to have carefully examined the work & site conditions, the general conditions, the special conditions, specifications, schedules & drawings & shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions. Copy of Appendix V attached with tender shall have to be filled up before quoting the rate, for confirmation of site visit. If there shall have any doubts as to the meaning of any portion of these general conditions or special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed. 2.0 DATA TO BE FURNISHED BY CONTRACTOR. a. The contractor shall submit to the Executive Engineer for approval within one month of the date of contract, a layout plan of the construction plant & equipment for the execution of work, which the contractor proposes to adopt at site. b. Prior to the commencement of work, the contractor shall submit to the Executive Engineer for approval, plan showing detailed programme for completing the work within time limit. c. No change in the approved plan & layout shall be carried out without specific written approval of the Executive Engineer in charge. 3.0 ERRORS OMISSIONS & DISCREPANCIES. In all cases of errors, omissions, doubts or discrepancies in the dimensions, or discrepancies in the drawings & items of work on specifications, reference shall be made to the Executive Engineer whose elucidation & elaboration shall be considered as authoritative. The contractor shall be held responsible for any error that may occur in the work thorough lack of such reference. 4.0 USE OF LAND: 4.1 The area if available will be allocated temporarily, for construction of site office& store godown only, and temporary construction if any will have to be removed after completion of work by the contractor. 4.1.5 The contractor shall preserve all existing vegetation such as trees on or adjacent, to the works site which does not interfere with the construction as determined by the GSECL. 4.1.6 The contractor shall take all possible precautions in felling trees authorized for removal to avoid any unnecessary damage to vegetation & trees not to be felled & to structures or to workmen, & shall be responsible for any damage if it occurs in such operations. 4.1.7 All produce from cutting of trees, grass etc. shall be the property of GSECL &shall be stacked at the directed places. No claim shall be made for such tree felling / cutting &stacking of trees/produce or grass etc. by the contractor. 4.1.8 The contractor shall not unnecessarily or for use as fuel, cut any trees, bushes, grass or other vegetation nor shall set fire. 4.1.9 The land shall as herein before mentioned be handed over to GSECL / Owner of Land immediately after the completion of the work under this contract. Also no land shall be held by the contractor longer than the GSECL shall deem fit & necessary & the contractor shall, on due notice by the GSECL, vacate & return the land which the Engineer In Charge may certify as no longer required by the contractor for purposes of the work. 5.0 START OF WORK: The contractor shall not enter upon or commence any portion of the work except with the written permission of the authority of the GSECL, failing which the contractor shall have no claim to ask for measurement of or payment for work & shall be responsible for any claims or damages that may arise due to such unauthorized commencement or entry. No compensation shall be allowed for any delay caused in starting the work on account of any delay in clearance of the work site.

6.0 WORK TO EXECUTE TO THE SATIFACTION OF THE GSECL’S ENGINEERS: The contractor shall proceed with the work with diligence & expedition & the whole of the work herein specified as well as the mode of execution shall be under the supervision & the direction & shall be carried on to the entire satisfaction of the GSECL‟s site Engineers, who shall have full powers to order the contractor to alter, enlarge or diminish the form, dimensions, positions, or quantities of any of the work or to make use of materials & workmanship of different descriptions & qualities from this herein specified. In the case of any class of work for which there are no Technical Specifications, these shall be carried out in accordance with the latest IS Codes & in the event of being no relevant IS Code, the works shall be carried out in accordance with the directions & instructions of the GSECL‟s Engineers at site or as per IRPWM (Indian Railway Permanent Way Manual) 7.0 WORKMANSHIP ETC.: The work shall be executed in thoroughly substantial manner with workmanship of best quality & strictly in accordance with the specifications & with the drawings, or with such other drawings or written instructions as may from time to time be furnished to the contractor, in accordance with terms of this contract & shall be completed in every respect with workmanship implied & necessary according to the fair interpretation & meaning of the same & should there be any discrepancy between the drawings & specifications or any difference or dispute as to the dimensions to be worked out or the mode of doing periodical quantity of the work to be executed or with respect to any subject arising out of this contract, the decision of the GSECL‟s authorized Engineers shall be final & binding on all parties. 7.1 SAMPLES OF DESCRIPTIVE DATA: Samples of descriptive data requiring approval shall be submitted by the Contractor to the GSECL‟s Engineers in good time before the use of such material to permit its inspection & testing & there-by the approval. The samples shall be properly marked to show the name of material, manufacture place or origin & the place where it is intended to be used etc. Failure of any samples to pass specified tests requirements; it shall be sufficient cause for the refusal to consider any further samples from that source. 8.0 BASELINES & GRADES: The GSECL near to the site of work shall furnish one permanent Bench Mark. Semi-permanent baselines & cross lines shall be established at sufficiently spaced intervals with benchmarks by the Contractor at his own cost & risk. The contractor shall provide at his expense, all the required pillars, equipments, materials, & labour for the establishment of the grade lines & bench marks, for that the Contractor shall be responsible for their further maintenance during the execution of the actual work till the complete period of construction. The contractor shall be responsible for the proper execution of work to such lines & levels & grades as may be specified in the drawings, established, or indicated by the GSECL‟s Engineers. All the survey work, if required, shall be checked by the GSECL‟s engineers. However this shall not absolve the contractor for the correctness of survey/ temporary or permanent Benchmarks. 9.0 CONTRACTOR NOT TO DISPOSE OFF SOIL ETC. The contractor shall not sell or otherwise dispose off or remove except for the purpose of this contract the sand, ballast, earth, rock or other substances or materials that may be obtained from any execution made for the purpose of this contract or produce upon the site at the time of delivery of the possession of the land but also such substances materials & produce shall be the property of the GSECL & shall be disposed off in the manner & place as directed by the GSECL‟s Engineers. 10.0 GOLD, SILVER, MINERALS, OIL RELICS, ETC. FOUND ON THE SITE: All gold silver, oil relics, or other minerals, of any description & all precious stones, coins, treasures relic, antiquities, & other similar things that shall be found in or upon the site shall be the property of the GSECL. The contractor shall return the gathered things as above to the authorized representative of the GSECL. 11.0 FENCING, LIGHTING & VENTILATION: The contractor shall be responsible for the proper lighting, fencing, guarding & taking of all the necessary safety measures for all works comprised in the contract & or the proper provision of temporary roadways, footways, guards fences, caution notices etc. as far as the same may be

rendered necessary by reasons for the work for the accommodation & protection of workmen foot passenger or other traffic & of the GSECL & occupiers of adjacent villages, property of the public & shall remain responsible for any accidents that may occur on account of his failure & timely precautions. All the works & approaches shall be adequately illuminated with electric lights to the satisfaction of the GSECL‟s Engineers. The power & lighting connections, wiring equipment shall be subject to the inspection & passing by Electrical Inspector to GOG authorized under the Indian Electricity Act. Any additions alterations or omissions shall be got approved from the GSECL‟s Engineers got certified from the Electrical Inspector. Work spots such as faces of excavation of borrow pits; filling area etc. shall be adequately illuminated with floodlights to the satisfaction of the GSECL‟s Engineers. 12.0 EXPLOSIVE PROCUREMENT & STORAGE: Explosives, petrol, oils, fuels, &other inflammable materials shall be stored strictly in accordance with the rules of the Explosive Department. The contractor shall at his own expense construct & maintain proper magazines which are required for the storage of explosive & arrange for storage facilities for oils, petrol, fuels etc. for use in connection with the work. The contractor shall at his own cost obtain the necessary license for the storage & use of explosives, oils, petrol, diesel etc. The GSECL shall not take any responsibility whatsoever in connection with the storage or use of explosives on the site, any accident occurs in the connection at site or nearby village or vicinity. All operations of the contractor in which or for which explosives are employed shall be at the risk of the contractor & upon his own responsibility. 13.0 LIABILITY FOR ACCIDENTS TO PERSIONS: 13.0.1 The contractor or subcontractor shall indemnity the GSECL against any claims which may be made under the workman‟s compensation Act, 423, or any statutory modification or other wise for or in respect of any damages or compensation payable in consequence of any accident or injury caused, by fault of contractor or subcontractor &sustained by any workmen or other person on the employment of the contractor or subcontractor. In every case in which by virtue of the provisions of subsection (1) of section 12 of the workman‟s Compensation Act, 423, the GSECL is obliged to pay compensation to a workman employed by the contactor or subcontractor in execution of the work, the GSECL will recover from the contractor the amount of compensation so paid, and without prejudice to the rights of the GSECL under subsection 12 of the said Act, such amount will be paid back to the GSECL in 30 days, failing which the GSECL will be at liberty to recover such amount of any part thereof by deducting it from the dues by the GSECL to the contractor under this contract or otherwise. The GSECL shall not be bound to contract any claim made against either of them under section 12, subsection (1) of the said Act, except on written request from the contractor & upon his giving to the GSECL full security for all costs for which the GSECL might become liable in consequence for entertaining such claims. 13.0.2 The contractor and/or subcontractor named in the contract shall indemnity the GSECL against all claims based upon injury or death to any person in the employment of the contractor or sub contactor, or to the third parties under paragraph (a) 2 or condition no.47 to the extent of any sums recovered under the insurance policy. 13.0.3 On occurrence of the accident which result on the death of workman employed by the contractor or subcontractor, which is so serious as to be likely to result in the death of any workman, the contractor shall within 24 hours of happening of such event intimate in writing to the Engineers of the GSECL the fact of such accidents. The contractor or subcontractor shall indemnity the GSECL against all loss or damage sustained, by the GSECL resulting directly or indirectly from his failure to give intimation in the manner aforesaid including penalties or fine if any, payable by GSECL as a consequence of GSECL‟s failure, to give notice under workman‟s compensation Act or otherwise to confirm to the provisions of the said Act in regard to such accident.

14 LIABILITY FOR DAMAGE TO WORKS & MATERIALS: 14.0.1 The contractor shall during, the progress of the work, properly protect the works & the existing Ash Disposal pipelines & materials placed at his disposal or acquired for him by the GSECL, & shall remain answerable & liable for all accidents, damages. Loss etc. & shall be made good in the most complete & substantial manner by & at the sole cost of the contractor & to the reasonable satisfaction of the GSECL‟s Engineers. If the contractor fails to make good such losses, damages within the specified time given by the GSECL, the GSECL shall be at liberty to recover the amount towards such expenses fixed by the GSECL‟s Engineers & shall be recovered from the amount due under this contract to the contractor. 14.0.2 Further the contractor shall, at all times, protect & preserve all materials, machinery, equipments, Ash Disposal pipelines, allied structures such as spillway chambers, ADP, haul road and ramps etc., materials &so acquired by himself or GSECL for the execution of the work. All reasonable requests of the GSECL‟s Engineers to enclose or especially protect any of the above shall be expeditiously complied with at no extra cost. 14.0.3 If the Engineer considers that the work, asked for in the aforesaid Para, is not sufficiently & satisfactorily protected by the contractor, on requests made for, the GSECL shall be entitled to arrange for such protection at his unfetters discretion & recover the cost thereof from the contractor. 14.0.4 Until the work shall be or deemed to be taken, over as aforesaid, the contractor shall also be liable for &shall be deemed to have indemnified the GSECL in respect of all damage or injury to any person or any property of the GSECL or of others in villages near by, occasioned by the negligence of the contractor or his workmen, or his subcontractor, or by defective /ill methods of working. 15 MATERIALS, TOOLS, MACHINERY BROUGHT ON THE SITE OF WORK: All materials, tools & tackles, machinery etc. of the contractor brought to & delivered upon the site for the work shall be the time of their being so brought shall be deemed to be the property of the GSECL in it‟s possession to be used for the purpose of the work & for that purpose only &shall not on any account be removed or taken away by the contractor or any other person without the permission of the GSECL‟s Engineers in charge, but the contractor shall be fully responsible for & loss, destruction thereof or damage thereto. The GSECL may have a lien on such materials, tools, tackles, machinery for any sum or sums which may at any time prior to the completion of the works be or owing to the GSECL by the contractor, under in respect of & dispose of any such materials, tools. Tackles, machinery in such a manner as the GSECL may think fit & to apply the proceeds in or towards the satisfaction of such sum or sums due or owing as aforesaid but subject to such lien & power of sale & disposal such surplus materials, tools, tackles, machinery shall belong to the contractor & may be removed & disposed off by him as he may think fit. 16 ACCESS TO SITE & WORK ON SITE: The Engineer or his authorized representative may if he considers fit from time to time enter upon any lands which may be in the possession of the contractor under this contract, for the purpose of executing any work not included in this contract & may execute by other contractors at his opinion & the contractor shall in accordance with the requirements of the Engineer, afford all reasonable facilities for execution of the works including occupation of lands by structure or other wise for any other contractor employed by the GSECL & his workmen or for the execution on or near site of the works not included in the contract. The contractor shall not be entitled for any extra claims on such executions. 17 INSPECTION OF WORK: The GSECL‟s Engineers or their authorized representatives shall have at all times power to inspect the works, wherever in progress, either on site, on the contractor‟s premises in connection with this contract. Further, the contractor shall not allow any person other than GSECL‟s Engineers or their authorized representatives to the work sites. The contractor shall, during working hours, maintain supervisors of sufficient training & experience to supervise the work as a whole. All orders & directions given to such supervisors or other staff shall be deemed to have been given to the contractor. Further the GSECL may by due notice, desire a high

ranking member of the supervisor staff of the contractor to be present on any specified inspection & the contractor shall comply with such directions. 18 CLEANING UP: a. The contractor shall at all time keep the construction areas & his labour colony & storage areas free from accumulation of waste, or rejected materials. b. Prior to the completion of the work the contractor shall remove all rubbish from & about the premises, & tools, tackles, machinery, left out materials consumable, rejected materials, scaffolding etc. which are not the part of the permanent work/structure. The premises will be left fully satisfactorily to the GSECL‟s Engineers/representatives; thereafter only the completion certificate will be issued. 19 CONTRACTOR’S INVENTORY OF EQUIPMENTS & MACHINERY: The contractor shall prepare & maintain an inventory of all machinery, equipments, temporary rolling stock, and plant purchased or hired for the use of this contract‟s execution. 20 PROGRESS SCHEDULE: 20.1. Contractor shall furnish a Construction Schedule on receipt of LOI or Work Order which ever is earlier, in quadruplicate, indicating the date of start, the monthly progress expected to be achieved & anticipated completion of each major items of the work under this contract & procurement of equipments, machinery & other materials. The schedule should be such as is practicable of achievement the whole work in the time limit & of the particular items on due date specified in the contract & shall have the approval of the GSECL‟s Engineers. Detailed schedules for each working season showing the progress month by month to be achieved is to be submitted to the GSECL. The GSECL is empowered to ask for more detailed progress schedule week by week for any item or for all items & the contractor shall comply when asked for. 20.2. The GSECL shall have, at all times the right without in any way violating this contract, or forming grounds for claim to alter the order of the works or any part thereof & the contractor shall after receiving such direction proceed in the order directed. The contractor shall revise the progress schedule accordingly & submit to the GSECL in four copies. 20.3. The contractor shall furnish sufficient machinery, equipment, labourers & materials shall work for such hours & shifts as may be necessary to maintain/achieve the progress of the scheduled, after getting written permission of Engineer In Charge. 20.4. The progress schedules shall be in the form of bar charts, statements &/or reports as may be necessary & directed by the GSECL‟s representatives. 20.5. Unsatisfactory Progress: In the case of unsatisfactory progress by the contractor not proceeding as per the Scheduled Programme approved by the GSECL, suitable actions shall be taken in accordance with Clauses No. 3 & 4 of the booklet prescribed by the GSECL for ``Tender & Contract for Works‟‟. 20.6. RECOVERIES: Recoveries due from the contractor, up to the end of the month previous to the one in which the bill is prepared shall be made from bills approved for payment every month or at other periods when the bills are prepared, for the enlisted, but not limited to, in the order of priorities & extents. (a) Penalty, if leviable, (b) Expenditure, in full, incurred by the GSECL on contractor‟s behalf in labour, machinery,

equipment etc., (c) Charges for services such as water & power supply, etc. in full, (d) Hire charges for GSECL‟s or Government machinery if any,

20.7 SUPPLY OF WATER: - Water for construction work shall be arranged by the contractor at his own cost. If possible water for construction may be supplied by the GSECL at single point and onwards distribution shall be arranged by contractor at his own cost. 20.8 ELECTRICITY SUPPLY: - The electric power, at site, will be made available at one mutually agreed point, free of cost (connection only) by Gujarat State Electricity Corporation Ltd, SIKKA Thermal Power Station within GSECL premises only. Further distribution will have to be carried out by the contractor as per requirements at their own cost. The necessary consumption charges will be recovered as per the tariff rate of Gujarat State Electricity Corporation Ltd from time to time as per GSECL‟s rules or PGVCL‟s Rule. 21 DATE OF COMPLEATION: The contractor shall complete the whole work & hand over to the GSECL on or before the date specified in the work order. Provided always that if in the opinion of the GSECL the completion of the works shall be delayed by any change of original design or by the order of the GSECL, of any altered, modified substituted or additional works or materials omitted or by strikes, lock outs or stoppages of labour, or revolution, riots, civil or political disturbance or by the contractor not being given possession of the site or by the GSECL taking possession of & using the site or part thereof or the works or part thereof or any part of the work or delayed supply of material by the GSECL or by the not receiving any orders, drawings, instructions or directions in time or by the suspensions if the works or by fire, flood exceptionally bad weather tempest , storm or by from unforeseen circumstances(& whether the same shall be due to any act or omission of the GSECL or it‟s representatives) the GSECL may in the unfettered discretion thinks fit either forthwith or at a later time & from time to time not withstanding that the prescribed or extended time for completion has expired or work have been completed, extend the date for the completion of the works to such a date as deemed fit as practical & acceptable. 22 SUBLETTING OF CONTRACT: There will be generally no objection on the component parts if the work, being given over to responsible subcontractors but GSECL shall under no circumstances recognize these subcontractors & the responsibility of executing the work in the accordance with the conditions of contract will entirely rest on the main contractor. However written consent of C.E. (G) shall be obtained before subletting. The main contractor will therefore always have the very responsible member, preferably a technical hand present on the works with power to sign all work orders issued on the site of work & to take requisite actions in the interest of efficient execution of work. 23. OTHER CONTRACTS FOR THE SUSPENSION STOPPAGE OR CURTAILMENTS OF WORK: If during the pendency of the contract the Engineer shall for any reason (which shall be unquestioned) whatsoever require the whole or any part of the work as specified in the contract to be suspended for any period or shall not require the whole or any part of the work as specified in the contract to be carried out at all by the contractor, he shall give notice in writing of the fact to the contractor who shall thereupon suspend or stop the work totally or partially as the case may be. In any case except as provided hereunder, the contractor shall have no claim to any payment or compensation whatsoever on account of any profit or advantage which he might have derived from the execution of the work in full but he did not so derive in consequence of the full amount of the work not having being carried out, or on account of any loss that he may be put on account of materials purchased or agreed to be purchased or for unemployment of labour recruited by him. He shall not also have any claim for compensation but reason of any alterations having been made in the original specifications, drawings, designs & instructions that may involve any curtailment of the work as originally contemplated. Where however, materials have already been purchased or agreed to be purchased by the contractor, before receipt of the aforesaid notice, the contractor shall be paid for such materials at the rate determined by the GSECL, provided they would have been useful for the work curtailed or stopped are not in excess of requirements are of approved quality & cannot be used on other contract works or otherwise by the contractor &/or shall be compensated for the loss if any, that he may put to, on respect of materials agreed to be purchased by him, the amount of such compensation to be determined by the GSECL, whose decision shall be final.

The GSECL may order the contractor to suspend any work on account of bad weather; rain or storm & such other adverse climate conditions & the contractor shall comply with the same. The contractor shall not be entitled to any compensation for such suspensions of work. 24. OTHER CONTRACTORS: Apart from this work, the other works connected with this work will be simultaneously going on either departmentally or through any other contractors. The contractors shall co-operate with others to their fullest extent & shall allow each other every facility & coordination for the execution of their works simultaneously & satisfactorily, during their action of machinery or execution of any other co-ordination works, the contractor will have to co-operate as directed buy the GSECL‟s Engineers in the charge of the works. In such cases the contractor shall not be entitled for any compensation on account of reduction or stoppage of labour force/machinery/equipments etc. In the matter of dumps, haul, roads, drainage, diversion & the like, each contractor shall take into considerations the needs & the requirements of the other contractors if any working in the vicinity. Further no contractor shall take or cause to be taken any stops or action that may cause disruption, discontent or disturbance to the work, labour arrangements etc. to other contractors. Any action, by any contractor, which the GSECL in the unquestioned discretion may consider as infringement of the above code, would be considered as a breach of the contract conditions & the GSECL may take such action as may deem fit against the contractor & the action taken shall be considered as final & binding. 25.0. SPEED OF WORK: The contractor shall at all times maintain the speed of work to confirm to the latest operative progress schedule but the GSECL may at any time with sufficient notice in writing direct the contractor to slow down or to accelerate any part or the whole work for any reason (which shall not be questioned whatsoever) & the contractor shall comply with such orders of the GSECL. The compliance of such orders shall not entitle the contractor to any claim or compensation. 26.0 CCNTRACT DOCUMENT & MATTERS TO BE TREATED AS CONFIDENTIAL: All documents, correspondence, decision & other matters concerning the contract shall be considered as of confident & restricted nature by the contractor & he shall not divulge or allow access there to any unauthorized persons of any kind. 27.0 ACCESS TO THE CONTRACTOR’S BOOK: Whenever it is considered necessary by the GSECL to ascertain the actual cost for execution of any particular item of work, the GSECL may do so by directing the contractor to produce the original invoices. 28.0 INTREST ON MONEY DUE TO THE CONTRACTOR: The contractor shall not be entitled to receive the interest on the payment due to him upon measurements or otherwise or on any balance payable to the contractor. Also, contractor shall not be allowed to relate it with the progress of work at site in any case. 29.0 MEASUREMENTS TO BE PROVISIONAL & SUBJECT TO CORRECTION: Every measurement for running payment on account of work done be subject to adjustment or final measurements. In case there is disagreement between such intermediate & final measurements, the latter shall prevail. 30.0 R.A. BILLS: The contractor shall submit his R/A bill every month, which shall be processed in reasonable time after checking and recording the MB. The contractor shall be responsible to submit R/A bills well in time and shall depute his representative for joint checking of the measurements; so that the bills can be processed in time. The contractor shall take due care in this regard, failing to which consequences will be up to him. 31.0 NORMALLY one measured R. A. bill payment shall be made every month on submission of bill by the contractor in GSECL' prescribed format. 32.0. BREACH ON PAR OF GSECL NOT TO ANNUL CONTRACT: No breach or non-observance on the part of the GSECL of any the agreements contained herein, shall annul this contract of discharge the contractor from the observance & performance thereof, or of any part thereof, but on application by the contractor & in the unfettered discretion of the GSECL an extension of time may be given to the contractor in respect of such breach or non-observance by the GSECL.

33.0 LABOUR CONDITIONS: 32.1 The contactor shall comply with the labour laws laid as may be current & shall furnish the returns & information as may be specified from time to time. 34.0 The contractor shall as far as possible obtain his requirements of labour, skilled & unskilled from the local areas. 32.2. The contractor shall pay wages as per the latest circulars applicable at the times for the minimum wages to be paid to unskilled, semiskilled & skilled labour prescribed by the Govt. of Gujarat. 32.3. The GSECL shall have the authority to remove from the work site any person, who may be considered unfit or undesirable & no responsibility shall be accepted by the GSECL for any delay or extra expense caused towards the completion of the work by such removal. 32.4. If Govt. declares a state of scarcity or famine to exist in any village situated within 10 Km. of the work site then the piece worker or contractor shall employ upon such parts of work, as are suitable for unskilled labour any person certified by the GSECL or by any person to whom the GSECL has authorized, & shall pay the minimum wages as fixed by the Govt. of Gujarat in this behalf. Any dispute that may arise in the implementation of the clause the decision of the Supdt. Engineer (civil) shall be final & binding. 32.5. The contractor shall provide reasonable facilities to the labour employed by him. The usual facilities are weather proof shelter for rest & meal, supply of whole some drinking water, facilities for obtaining food, reasonable washing & sanitary facilities, special facilities for women workers, suitable residential accommodation, general sanitation & health measures etc. 32.6. The implementation of any & all provisions of this clause in no way entitles the contractor to claim in this contract. 33. LOCAL LAW: 33.1. All local laws in force at the time entering into the contract & those enacted there after shall be binding on the contractor & he shall abide by the same. 33.2 All import duties, sales tax & other local taxes shall be borne by the contractor & they shall be deemed to have covered by this quoted rate. 34 PERFORMA RETURNS: The contractor shall maintain Performa, charts & details regarding machinery, equipments, materials labour, personnel & other matters as may be specified by the GSECL time to time. 35 WORK IN SHIFT DUTY: 35.1. Works shall be planned in shifts, if possible in three shifts, depending upon the emergency of the work with prior approval of the GSECL. On Sundays or any other holiday work shall be continued in order to maintain progress of work with prior approval of the GSECL. Such works shall not form any ground for complaint, compensation or extension of time limit. If on the other hand, the GSECL directs that the work shall be proceeded with, on days & during hours otherwise non-permissible under this contract, the contractor shall proceed with the work as directed without in any way vitiating this contract or forming any grounds for compensation of claim. 35.2. The contractor shall in his dealing with labour, at all times, during the period of this contract, have due regard to local festivals & religious & other customs. 35.3. A working day shall consist of two shifts of 8 hours each. A working day shall constitute any day on which in the opinion of the GSECL, work can be carried out on one or more shifts. 35.4. The time of completion as defined in this Contract shall be deemed to exclude working during night hours. If, however it is required to complete the work in time, the GSECL may permit to execute the work in night hours. Night work shall not entitle the Contractor to any or such claims/extra payments due to night works. Where night work is in progress, the Contractor at no extra cost, to safeguard the workmen & public shall provide sufficient lights. The excavated areas in all the cases shall have to sufficiently & satisfactorily cordoned & barricaded with red signal lights to prevent accidents of any nature etc.

36.0 LIENS: Final payment to the contractor shall not be made until the contractor shall deliver to the GSECL receipt in full in lieu thereof, & in either case, an affidavit that so far he has knowledge or information the releases & materials for which in line could be filed. If any line remains unsatisfied after all the payments are made, the contractor shall refund to the GSECL all money that the latter may be compelled to pay in discharging such a line, including all costs & reasonable attorney. 37.0 SPECIAL CONDITIONS: 37.1 The successful bidder, on receipt of Letter of Intent will submit within a week‟s time his planning/program of work for the scrutiny of the GSECL in a PART/BAR CHART format, clearly indicating the GSECL‟s inputs also. 37.2 Contractor will plan his work such that the works on all the fronts released by the GSECL, simultaneous works should progress in such a way that the entire job is completed in the schedule time limit. 37.3 The work commencement date will start from the date of issue of letter of commencement. 37.4 The successful bidder will have to depute his authorized representative to attend progress review meeting to be held at site or the GSECL‟ Sikka, DIST - JAMNAGAR 37.5 The contractor will be responsible for complying with all rules & regulation & the labour laws applicable to him & the GSECL will not be responsible for any lapses committed by them. If there is any claim from the Govt. Authority pertaining to the contractor the same amount will be deducted from the contractor‟s bill. 37.6 The contractor shall be depute sufficient numbers of qualified engineers/supervisors to look after the work. The engineers/supervisors shall remain present at site at all the times. In no circumstances, contractor shall be allowed to continue work without engineering supervision. 38 PAYMENTS SHALL BE RELEASED ON THE AVAILABILITY OF FUND WITH GSECL. 39.0. CONTRACT After the tender has been accepted by the GSECL, all orders or instructions to the contractor shall, except as herein otherwise provided to be given by the GSECL‟s engineers at site on behalf of the GSECL for the speedy execution of the work. 40. INSURANCE: 40.1 The contractor shall procure, or arrange for the Subcontractor to procure insurance coverage in amounts approved by the GSECL & sufficient to protect against the following risks arising out of the work. (1) Accidents & professional & non-professional sickness of all labourers & personnel engaged in the work as required by Law pursuant to Workmen‟s Compensation Act, 423 or Revised version thereof. (2) Injury or death to third parties including without limitation injury or death caused by any of the construction aids or vehicles or rented machinery, equipments used by the contractor or subcontractor whether at the site or elsewhere. (3) Damage to contractors tools machinery; construction equipments form works, scaffolding materials etc. due to floods, earthquake or any such cause. (4) Damage to the existing permanent structures of the GSECL & nearby villages, equipments of the GSECL or of the co-contractors working in the area for other works. 40.2All the above conditions referred for the insurance cover shall be in effect from the date of commencement of the work until the GSECL has accepted the work. 40.3In the policies covering the insurances referred to above, the GSECL, contractor & the subcontractor shall be as co-ensured where possible. 40.4. The cost of insurance shall be borne by the contractor. 41. LABOUR COLONY/ STAFF QUARTERS. The contractor shall arrange the quarters for his staff and labour colony at their own cost as per the labour laws. GSECL will not allocate area for the same.

42. EMPLOYEE PROVIDENT FUND: Bidders shall note that they possess P.F. Code No. in the name of the company [under Employees Provident Fund Organization, Regional Office, Ahmedabad directive] obtained from the concerned Authorities of their respective jurisdictions. In the event of non–possession of the separate P.F. Code No. as detailed in the foregoing para, the offer shall summarily not be considered for the acceptance despite the offer is the lowest quoted offer in the price bid opening. 43. PERFORMANCE GURANTEE PERIOD:

The Contractor shall guarantee the total work under the Contract for its Workman ship and

satisfactory performance in accordance with the relevant section of this Contract.

under the Contract for the workmanship and satisfactory performance of the work in all respects

GENERAL SAFETY GUIDELINES FOR ALL TYPES OF CONTRACTORS

1.0 PURPOSE: The purpose of the document is to outline the procedure for establishing and maintaining Occupational Health and Safety requirements for all types (ARC/BRC /AOH /Project work / short term job work) of contractors and their employees. 2.0 SCOPE: The document applies to the entire power station. 3.0 RESPONSIBILITY: Concerned Sectional Head / Engineer In-charge / Security /Safety officer / Medical Officer /HR shall ensure that requirements specified in this procedure are complied with. 4.0 PROCEDURE: All the contractors working at Sikka Thermal Power Station shall have to strictly observe the following Safety Rules. Concerned Contractors are responsible for informing & observance of these rules by their supervisors/employees/ labours as well as the supervisors/ employees/ labours of agencies/ sub-Contractors engaged, if any, by them for the work contract awarded to them. Prior to commencement of the work, Contractor shall have to submit a written assurance on their letterhead to the concerned Sectional Head / Engineer-in-charge that they have thoroughly gone through these Rules, have educated their employees / employees of their sub contractor and will strictly observe the said Rules while execution of work under work contract awarded to them. They will have to indemnify the Corporation for any loss or damage / accident / injury to the Corporation‟s property / employee or employee of their own in default of non - observing these rules.

01 Persons to be employed for carrying out the work shall possess required qualification, are fully trained and conversant for works to be done. All persons should have gate pass. Register consisting the full details i.e. address, ph no, nearest relative, of all persons to be maintained. During the work execution, one trained & competent supervisor should always remain present at site.

02 The contractor shall take all the required safety measures prior to commencement of work on dangerous substances, machineries or area at which cautionary notice is displayed and obtain “Line Clear” or “Work Permit” through the concerned Department / Section.

03 Prior to carrying out welding, gas cutting, furnace heating or any other hot work job, remove all the inflammable material lying at or nearby worksite or cover it properly by suitable protective covering. Also, special care shall be taken before carrying out such job & see that all possible contributing factors to set fire shall be removed / vanished prior to commencement of the work. Advance intimation shall be given to concerned section / fire section to commence the work in fire prone areas. They should also keep ready all the First Aid Fire Extinguishers / equipments& fire extinguishing media / material like sand / water buckets / water carboys or other appropriate equipment at such place.

04 While carrying out work in confined space or inside vessel, obtain necessary “CONFINED SPACE SAFETY PERMIT” from concerned department prior to commencement of the work. For lighting in such areas, only 24-volt (ISI certified & with proper guard) hand lamp shall be used. Air hose/ blower to be provide for adequate air circulation. If required, provide flood light from outside. For taking care of the persons working inside the confined space / vessel, a supervisor / person capable to keep continuous watch on person(s) working inside, assist them incase of emergency or arrange to get immediate outside help, shall remain present at entry point. Use full body safety belt without failed. While working inside sewage, trench or in-depth, a person to warn outsiders / entrants / passers etc shall remain available near entry point or the entry point shall be cordoned by a barricaded tape with a cautionary notice. After completion of the works, all the lids / covers / grills / grits opened, shall be re-fixed / re-placed in the original position as it were prior to commencement of the work and leave the work place in safe condition in all

respect, so as to prevent accident to fellow workers. 05 The contractor shall see that he / his persons do not work on or block (by stacking

material, spare parts, tools-tackles, equipmentsetc), any passages / walkways / gangways / aisles / staircases / ladders / lifts or any other approaches / roads leading to plans or its auxiliaries, on which there is traffic movements or possible traffic movements in case of emergency. Such passages are meant for safe escape in the event of emergency. If it is utmost necessary to carry out work in such area with blocking of passage, prior permission of Competent Authority or the Engineer-In-Charge shall be obtained. To demarcate / declare the area as “UNSAFE”, cordon it using barricading tape & display suitable caution notice or keep a person to restrict / divert the traffic on this route through other safe passage.

06 Prior to use power / electrically operated hand tools / equipments / machines / gadgets like welding machine, hand grinder, hand drill etc, ensure for its safe operation & use it only if it is found safe to use. Do not use defective, unsafe or improperly maintained equipments. The electrical power supply required to run such equipments shall not be taken directly at their own but shall be obtained through concerned Electrical Maintenance Departments or their authorized persons or under their observations / guidance only. The Electrical Section shall provide temporary electrical connection up to contractor‟s Mains Board on which it is compulsory to install mains switch, ELCB & fuses of adequate capacity. All such equipments shall invariably be earthed adequately to prevent electrical shock, sparking, short circuit etc. Power cord to be used shall be of adequate capacity, without any joint & shall consist of earth wire also. Hence, it is necessary to use adequate capacity 3-wire power cord for single & 5-wire power cord for three phase power connections. The plugs, receptacles, pins, holders etc shall be of adequate capacity & safe to use. All electrical & mechanical equipments / tools-tackles viz. welding machine, cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks etc required to be used during work execution shall be of standard make & bear ISI certification mark on it. The consumables like welding electrodes, grinding wheels / discs etc which has specific prescribed life span shall not be used in any case if its expiry date is over.

07 It is compulsory (mandatory) to use standard make Personal Protective Equipments (P.P.Es.) as per the job requirement. Do not work without use of required P.P.Es. Contractor is responsible to provide standard make (ISI approved) Personal Protective Equipments / Safety Gadgets suitable to give sufficient protection against hazards involved in their work / job to their staff, as per the job requirement and insist / enforce their staff to put on the same while at works. 08 Before using lifting machines / tackles (like C.P.Bs., Hook chooks, winch, forklift, mobile crane, EOT crane etc) & its attachments (like D-shackles, slings, U-clamps, Eye bolts or any fixtures), it shall be checked and used only if found safe to use. Also, ensure that these are tested, examined & certified in form no.10 by Competent Person as per the Factory act-1948 & Gujarat Factories Rules and its validity do not expire. Further, it shall be fixed properly and firmly prior to lifting the weight. Test certificate of all Lifting machines used by Contractor to be submitted to concerned Engineer & Safety Officer before commencement of work.

09 Scaffoldings to be used for working at height shall be of adequate size & capacity. Obtain the work permit when working at height. While climbing on such scaffolding or working on any structure at height, use of full body safety belt & Helmet is compulsory. It is also necessary to fasten chinstraps of the helmet.

Contractor or their employee shall not interfere in day-to-day routine plant activities / works except the work assigned to them, shall not loiter in the areas other than their work jurisdiction, as well as shall not temper / operate / touch the machineries/equipments/auxiliaries with which they are not concerned. Also, the contractor shall strictly instruct their staff for not to sit or take rest at/near/below running plants, auxiliaries, systems or any place which is risky, hazardous & prone to accident.

The cylinders containing poisonous / toxic or inflammable / explosive gas like Oxygen, Acetylene, commercial LPG, Hydrogen, Ammonia, Chlorine, CO2etc shall be handled safely taking due care. To handle / shift such cylinders a special trolley /cage meant for it must be used but in no case it should be rolled.

On completion of the work, cotton waste, spilled oil / grease, pieces of welding rod & other waste material shall be removed from work site and the area shall be left safe, neat & clean.

In case of any injury / accident while working, it shall immediately be reported to Safety Department through concerned Sectional Head / Engineer. The prescribed Form No. 21 may be obtained from concerned section or Safety Officer. In case of any electrical accident, it shall immediately be reported to Safety Department through concerned Sectional Head / Engineer. The prescribed Electrical accident form no. A as per electricity act-2003 & Form No. 21 as per Gujarat Factories rules shall be filled up by concerned department with written consent of contractor. The Form may be obtained from concerned section or Safety Officer. For any incident occurred but have no injury to any persons should also reported as per GSECL format and informed to safety officer as Near Miss Incident.

accident will be considered. Lacuna in Safety measures in unsafe act /conditions are also observed. Steps can be taken to review the job assignment up to cancellation for negligence.

16 In case of noticing smoke or fire during their work execution, they shall make immediate efforts to extinguish / control it and simultaneously inform the Fire Brigade on intercom phone No. 222 or 221, WLL Mobile No:90990 69658. Shift the casualty to nearby hospital or GSECL hospital after rendering first aid in case of accident.

No women or young person shall be allowed to clean, lubricate or adjust any part of a prime mover or of any transmission machinery while the prime mover or transmission machinery is in motion. Examination or operation of motion machinery shall be made or carried out only by a specially trained adult male worker wearing tight fitting clothing as per section 22 of factories act 1948.

Over & above these, contractor shall have to follow all the safety requirements / rules & regulations / norms and legal provisions laid down in various statutes. Particularly the provisions of The Factories Act-1948 & The Gujarat State Factories Rules-1963 (Amended up to date) shall be followed strictly. The contractor shall also obey the rules / regulations / instructions of the local Competent Authority for safety requirements.

It is felt necessary to deploy safety officers / Safety supervisors by contractors / Agencies involved in carrying out hazardous activities / Project activity / Dangerous operation to have better and constant supervision in terms of Health Safety and Environment activities.

If any worker working in a factory contravenes any of the provision of section 111 of Factories act or of any rule or order made there under, he shall be punishable with imprisonment for a term which may extend to three months, or with fine may extend to Rs.100/-(One Hundred rupees only), or with both.

Ensure that contractor workers are skilled for their job and having experiences for particular job. 3. Ensure that contractor workers are provided required personal protective equipments like helmet, safety belt, etc,,& using it while on work. 4. Ensure that necessary Safety procedure and valid permit to work procedure followed by contractor and also standard wok procedure followed by contractor. 5. Contractor shall deploy Supervisor for work control during their job. 6. Before starting work, contractor shall inform concerned sectional Head regarding safety precautions taken at site and Sectional Head should visit site to ensure it. 7. TERMS AND CONDITIONS REGARDING INDUSTRIAL LAWS, CONTRACT LABOUR ACT, AND OTHER RELATED MATTERS

1. WAGES TO BE PAID, TIME OF PAYMENT, ETC. BY THE CONTRACTOR : A) The Monthly payment of wages to the contract labourers will be compulsorily made through bank. The Contractor shall supply copy of Bank Statement duly stamped by the concern Bank as a Token of Proof towards payment of wages to HR Dept. If any problem may arise for payment of wages through bank, same may inform to Chief Engineer (G) and after approval the payment shall be disbursed in presence of the GSECL representative i.e. HR officer during the working hours in the factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GSECL. Any default will result in cancellation of contract forthwith or else the contractor shall be punishable to the extend of Rs. 100/- per day by way of fine. B) The contractor shall give his telephone number, address to the GSECL, so that in case of labour unrest etc. the contractor can be contracted. 02. Labour Laws: The labour laws applicable and amended from time to time have to be followed scrupulously. A few of them for information are as under: i). Person below the age of eighteen years and above sixty year shall not be employed for the works. ii). No female worker shall be employed in the night shift between 19:00 hrs and 06:00 hrs. iii). Contractor shall maintain a valid labour license under the Contract Labour (Regulation & Abolition) Act for employing necessary manpower to be required by him. In the absence of such license, the contract shall be liable to be terminated without assigning any reasons thereof. iv). The contractor shall, at his own expense, comply with all labour laws and keep the GSECL indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws, which the contractor shall comply with, are as under: a. Payment of contribution of employees (contract labour) as well as employer‟s (contractor‟s) contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administration charges, inspection charges, etc., at the rates applicable from time to time by the Government of Gujarat/Government of India or other statutory authorities. b. The contractor shall maintain a valid labour license under the contract labour (Regulation and Abolition) Act for employing necessary man power to be required by contractor. In the absence of such license the contract shall be liable to be terminated without assigning any reasons thereof. c. Paid leave facility and wages as per the provision of the Factories Act at the rate of one day for every 20 days of working. d. No laboures are allowed to enter in power station premises that don‟t Identity cards as prescribed under the Factories Act or by the Thermal power station with photograph affixed thereon, for identification of workers. e. Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act, 1947. Any payment to the contractor‟s employees arising out of any claim or disputes under the Industrial Disputes Act, 1947 or any other labour laws. f. Payment of compensation in case of accidental injury, under Workmen‟s Compensation Act. g. If the female labour employed is more than 30numbers then Provision of crèche, shall be complied accordingly. h. Maternity leave as per the provision of the Maternity Benefits Act. i. If any workmanengage by contractor / agency meet with fatal or non fatal accident while on duty, then contractor / agency shall be liable to pay compensation to legal hair or to the workman as case may be as per workman compensation act. The above are some of the major liabilities of the contractor in addition to other liabilities prescribed under the various labour laws in force from time to time by the statutory authorities, like State Government/Government of India, which the contractor shall have to comply with.

2. PROVIDENT FUND AND FAMILY PENSION SCHEME: The contractor shall submit along with his bill ( month – wise ) a statement regarding deductions against employees Provident Fund ( EPF ) and Family Pension Scheme (FPS) in respect of each concerned employee at the rate of 12% or at the rates made applicable by the government from to time of wages. The contractor‟s contribution and the worker‟s contribution towards PF and FPS shall be deposited by the contractor with the Regional Provident Fund Commissioner, of respective RPFC office or to the authority prescribed under the Act along with the other charges. 3. DEPOSIT LINKED INSURANCE SCHEME: The contractor shall have to deposit 0.50% (half percent) or the rate applicable from time to time of the wages in respect of employees who are members of the PF, as the contribution to the Deposit Linked Insurance Scheme, with the Regional Provident Fund Commissioner. 4. MINIMUM WAGES ACT: The contractor shall pay prevailing minimum wages as applicable from time to time to the laborers engaged by him as per the Minimum Wages Act payment in Bank / presence of the GSECL‟s officer or representative. 5. ADMINISTRATIVE CHARGES: Administrative charges for maintaining Provident Fund account shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahmedabad, at the rates applicable. 6. PAID LEAVE FACILITY: Paid leave facility at the rate of one day for every twenty days of actual work by the contract labour shall be provided by the contractor to his workers. He shall maintain leave record / verified and approved / certified by the authorized officer of the GSECL. 7. E.S.I. ACT: The contractors shall comply with the provisions of E.S.I. Act wherever applicable as per the prevailing provisions of the Act and as amended from time to time. 8. SAFETY: The contractor shall strictly observe all safety rules and provide safety equipment to the contract labourers as per the Factories Act, 1948, and whatever amendments made from time to time to avoid any chance of accident. The contractor shall strictly observe all instructions of Safety Officer and Factory Inspector to avoid any chance of accident. 9. LABOUR LICENSE FOR LABOUR CONTRACT: The Contractor / Agency shall have to obtain the copy of Labour Contract License under contract Labour (Regulation & Abolition) Act from the appropriate authorities before commencement of work. 10. WORKMEN’S COMPENSATION FUND AND EMPLOYER’S LIABILITY INSURACE: Insurance shall be affected for all the contract employees engaged in the performance of this contract. If any of the work is sublet after due permission in writing from the GSECL, the contractor shall require the sub – contractor to provide workmen‟s compensation and employer‟s liability insurance for the later employees, unless such employees are covered under the contractor‟s insurance. It shall be the liability of contractor for employees of his sub – contractor. The contractor must insure that all the laborers may cover before starting the works 11. SUBMISSION OF RETURNS & MAINTENANCE OF RECORDS: The contractor shall submit the returns under the Contract Labour Act, payment of Bonus Act, Payment of Gratuity Act etc. and shall have to maintain all up to date records / registers in

respect his employee as prescribed under various Labour Laws and produce the same as and when demanded by GSECL‟s or Govt. appropriate authorities. 12. CONTRACTOR TO INDEMNIFY THE GSECL: The contractor shall indemnify and keep indemnified the GSECL and every member, officer and employees of the GSECL, including Engineer – in – Charge and his staff, against all actions. Proceedings, claims, demands, costs and expenses whatever arising out of or in connection with the matters referred in above clauses and elsewhere and against all actions, claims, demands, Costa and expenses which may be made against the GSECK, by any workman / employee of the contractor or sub – contractor or any other person under any law, rules or regulations having the force of law, including, but not limited to, claims against the owner under Workmen‟s Compensation Act, 1970. The force of law, including, but not be liable for or in respect of or in consequence of any accident or injury to any workman or other person in the employment of the contractor. The contractor shall indemnify and keep indemnified. The GSECL against all such damages and compensation and against all claims, demands, proceeding costs, charges and expenses whatever in respect thereof or in relation thereto. The contractor shall also indemnify GSECL in all respect against any liability due to breach of legal provisions contained in any of the Labour Laws. As per the industrial Tribunal order the concerned contract workers of 29/99 and 105/99 presently engaged for the same activity are to be continued by bidder, till further order of Honorable Industrial [Rajkot] / Hon. H.C., A‟bad Hence bidder/contractor shall employed the contract workers engaged by previous contractors. Who are concerned workmen in I. T. ref.-29/99 and 105/99. The Contractor shall also indemnify GSECL for injury or damage to third party other than employees of the GSECL contractor or sub – contractor. 13. Contractor / Agency shall have to issue the contractual appointment letter for a specific period to their Labour engaged during the contract period each and every instance & should narrated clear out terms & conditions for the liabilities of the concerned employees. 14. The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintaining of various registers and records required under the law and contracts. No payment for such supervision shall be admissible. 15. As a contractor, the contractor shall be responsible and liable to pay difference in wages, if any, and / or observe the revised service conditions that may be awarded by the Honorable Industrial Tribunal effective from the date directed in the award. 16. The contractor must be maintaining regular Labour record and should be paying all acquired benefits to Labour force and contractor should obtain certificates to this effect from HR Officer of GSECL. 17. The contractor will make arrangements at his own cost to insure all men, materials and equipment employed for this work. The GSECL will to be responsible for any loss or damage either to the contractor‟s personnel or his equipment. 18. Dispute, if any, taking place between the contractor and laborers must be intimated to LWO/DGM, Sikka, immediately. 19. Any casualty will also have to be borne by the contractor for the period the contract continues. 20. For ARC/BRC contract, The Contractor shall deposit 15 days salary at the rate of last drawn salary for every completed one year of services for each worker for the liabilities of Gratuity.

21. The Contractor / Agency shall have to produce / submit the copy of Wage Register, Muster Roll, PF Deposition Challan, PF Schedule, Copy of Bank Statement duly stamped by the concern Bank and relevant records under various Labour Laws for the contract work to HR Department to ensure compliance to provisions of various legislations. 22. Attendance of contract laborers will be through punching machines for which punching machines shall installed to facilitate the contractors by GSECL for which monthly charges of Rs. 10/- will be levied on contractor as administrative charges.

CIRCULAR – I

The following are the major obligations to be fulfilled by the Contractors as per the Contract Labour (R&A) Act 1970 and rule mentioned there under: 1. License to be obtained before starting the Work where number of contract laborers is ten or more. 2. Payment to contract labourers has to be made in presence of IRO/LWO. Wages rates for contract labourers are applicable as per the terms and conditions of the license. Minimum rate of the wages for unskilled labour is Rs. 278.30 for semiskilled labour is Rs. 286.30 and for skilled labour is Rs. 294.30 w.e.f. 01-10-2015 to 31.03.2016 or as per the circular of GoG time to time. 3. Every contractor shall have to maintain the muster roll and wages register in respect of his contract labour. 4. Every contractor is required to issue employment card, wages slip and attendance card to their laborers. 5. The contractor has to maintain the register No. 13 containing details of contract labors employed by him. 6. Earned leave register/ card as per the Factories Act and Rules. 7. Other registers required under Contract Labour Rules and the Factories Act and Rules. 8. Every contractor shall have to obtain insurance policy in respect of the contract labors engaged by him to cover them under workmen‟s Compensation Act. 9. To send half yearly return to licensing officer as per Rule 82 (1) as per schedule time. 10. Before starting the work as per the contract awarded to him, he should make arrangement to enter into the agreement in the prescribed format on the stamp paper as applicable. CONDITION FOR ISSUE OF MATERIAL [GENERAL]

1. The above material shall be issued to the contractor only to meet the immediate requirement of contractor and not much in advance 2. The contractor will submit the material accounts for the material issued free of cost along with their bills. Bills shall also be supported with MR / CRs wise material accounts. 3. The account for issue of material shall be settled by the contractor before payment of final bills. 4. The steel material will be issued to the contractor by the GSECL on weight basis if so specified i.e. weighing on weighbridge wherever possible. If there is no weighbridge the material shall be issued on sectional weight basis. However, measurements for the work done will be on linear measurement as per ISS. 5. The contractor will be allowed, accountable wastage maximum up to 3% for reinforcement steel only. This includes all the scrap left out after the completion of work. 6. The contractor will be allowed unaccountable wastage up to 2% for reinforcement steel only. However, in no case the contractor will be allowed to take away material of GSECL. 7. If the accountable and unaccountable wastages together exceed 5% then the contractor will be charged at book rate or market rate whichever is higher +15% supervision charges as per the rules of GSECL for all the wastage quantity in excess of 5%. 8. If any steel material including structural steel is not available in GSECL‟s stores and if work is likely to be delayed then the Engineer-In-Charge of the work will permit the contractor to purchase such material from the open market for which actual procurement cost shall be reimbursed by the GSECL. However, in such cases the contractor shall be indicate the price on which he can procure the material based on the price so indicated the Engineer-in-Charge shall obtain prior approval from GSECL, H.O., Baroda i.e. Chief Engineer before permitting such purchases. 9. If on finalizing the material account by the GSECL, it is found that the material issued in excess of the actual consumption [plus permissible] then agency shall return the balance material to GSECL‟s store from which it was originally issued. In case the contractor fails to return the excess material either in full or part, the unreturned material, the GSECL shall recover cost @ stock rate or market rate whichever is higher plus 15% supervision charges. 10. For the material to be issued by the GSECL, the contractor shall have to furnish indemnity bond on stamp paper of Rs. 100/- over and above of agreement. 11. The maintenance programme shall be as per the standard Railway practice and of preventive nature. The annual track maintenance programme will be decided into 3 periods as under... a. OR ITS authorized representative. 1.3 The „CONTRACTOR‟ shall mean the tenderer selected by the owner for the performance of the work and shall include the successors and permitted assigns of the contractor. 1.4 The „Work and scope of work‟ shall mean the totality of the work by expression of implication envisaged in the contract and shall include all materials, equipments and labour required for or relative or incidental to or in connection of day to day work and or for incorporation in the works. 1.5 The „Works‟ shall mean the product[s] of the work. 1.6 The „Contract‟ shall mean the totally of the agreements between the parties as derived from the contract documents. 1.7 „Order‟ and „Instruction‟ shall respectively mean any written order or instruction given by the authorized persons of the GSECL within the scope of their respective power in terms of the contract. 2.0 INSTRUCTION OF TENDERERS: 2.1 SUBMISSION OF TENDERS: Tender duly filled in by tenderer should invariably be submitted alongwith earnest money as stipulated in the notice inviting tender. GSECL reserves the right to reject any or all tender with assigning any reason thereof. All covering letters, information, specifications, experience, details, construction equipment details, etc. shall be submitted alongwith tender. The tender duly completed and signed on each page should be submitted alongwith the offer. The set of drawing dully signed shall be submitted along with tender. 2.2 SITE ORGANIZATION: The tenderer should indicate in his offer the site organization and the maintenance equipments to be committed for this work. 2.3 ACCEPTANCE OF TENDER: The GSECL reserves the right to award the work in parts of two or more agencies. The quoted rates shall hold good for such an eventuality. 2.4 INCOME TAX: Income Tax at the rate of at prevailing rates of Income Tax on the gross amount billed shall be as per the Income Tax Act. 2.5 VALIDITY OF OFFER: Tenders submitted by tenderer shall remain valid for acceptance for a period of six months from the date of opening of TECHNICAL BID of the tender.

The tenderer shall not be entitled during the said period of six months without the consent in writing of the GSECL to revoke or cancel his tender or to vary the tender given in any term of varying any terms in regard thereof without the written consent of GSECL. GSECL shall forfeit earnest money paid by him also along with tender. 2.6 SCHEDULE OF RATES: All the items of work mentioned in the schedule of rates and covering by the contract shall be carried out as per the drawing specifications and directions of Engineer-in-Charge and shall include all labour, materials, tools, plants, tackles, testing if any, with contractors testing appliances etc. required to complete the job. 2.7 STIPULATIONS AND DEVIATIONS TO TENDER CLAUSES: Tenderers are advised to submit quotations based strictly on the terms and conditions and specifications contained in the tender documents and not to stipulate any deviations, however in case of technical specification if it becomes unavoidable, deviations should be stipulated with reference to the clause No., para and page No. of the tender document. 2.8 SAFETY AND SECURITY REGULATION: In addition to above, bidders should visit the site and familiarizes themselves with the site and various security / safety regulations as mentioned above before [\sr. No. 1.6.0] submitting their bids. 2.9 In case of conflict amongst the provisions Schedule of Rate, Specification and Drawings, all of them shall be read in conjunction with each other and if needed clarifications shall be obtained from the Engineer-In-Charge. In such cases, his decisions shall be final and binding and following procedure may generally be followed: Description of items in Schedule of Rates shall be followed when provision therein are different from those in specifications. Where the descriptions of item do not call for some specific requirement but the some are given in specification the specifications shall be followed, in addition to the requirement given in description of items. Where drawings call out for requirement different from or additional to those given in item description and specification, the decision of the Engineer-In-Charge shall be obtained as to what shall he followed. The provision of Indian Railway and works manual shall prevail in absence of work specifications and method of working. 3.0 SPECIAL CONDITIONS OF CONTRACT: Special conditions of contract shall be read in conjunction with the General conditions of contract, specifications of work, drawings and any other documents forming part of this contract wherever the context so requires. Not with standing the subdivision of the documents into these separate section and volume every part of each shall be deemed to be supplementary to and complementary to every other part and shall be read with and into the contract so far as it may be practical to do so. Where any portion of the General conditions of contract is repugnant to or at varies with any provisions of the special conditions of contract, then unless a different intention appears, the provisions of the special conditions of contract shall be deemed to over ride with provision of the General conditions of contract and shall to the extent of such repugnancy of variation prevail. Wherever it is mentioned in the specifications that the contractor shall perform certain work or provide certain facilities, it is understood that the contractor shall do so at his cost.

The materials, design and workmanship shall satisfy the relevant Indian standard / Indian Railway standard, the job specifications stipulate requirement in addition to those contained in the standard codes and specifications, these additional requirements shall be satisfied. 3.2 LOCATION OF SITE: The work site is along the GSECL Railway siding at Sikka TPS. 3.3 SITE PARTICULARS: The intending tenderer shall be deemed to have visited the site and familiarized themselves thoroughly with the site conditions before submitting the tender. No familiarity with the site conditions will not be considered a reason either for extra claims or for not carrying out the work in strict conformity with the drawing and specifications. For site visit the intending tenderers may contact E.E. [C] Sikka Thermal Power Station. The complete site shall be handed over to the contractor as exists, while starting fresh contract. 3.4 BILLING AND PAYMENT: The contractor shall submit his bills to Engineer-in-charge once a month in triplicate giving reference to the work order No. and date. He will enclose necessary challans duly endorsed and all other relevant documents in support of evidences of the performance. The payment will be effected by GSECL BY Account payee cheque within 60 days from the date of receipt of the bills, if these are found in order in all respects. No interest will be payable on the bill in any circumstances. [Refer to clause No. 10 and 11 of Booklet for works contract] 3.5 UNSATISFACTORY WORK: In case of unsatisfactory performance or violation of any of the terms and conditions of the contract, GSECL shall have the rights to terminate there by the reasons or termination or to get the work done through other agencies at the risk and cost of the defaulting contractor. 3.6 FORCE MANURES: Neither the tenderer not GSECL shall be held responsible for non-performance either in whole or in part or thereon in consequence of any strike, lock outs, interruption of the traffic, fires, flood, act of God, orders of degree of any Govt. authority, revolutions, wars, acts if enemies, damage or accident to the contractor‟s mill or machinery, damage or breakdown to GSECL by any other acts not within the contracts of the parties, fulfillment on whose part is interfered with and which by the exercise of reasonable diligence the said party is unable to prevent. 3.7 The contract is subject to general terms and conditions of the contract booklet approved herein to the extent not covered / contained here in above. 3.8 DAILY RECORD: The contractor shall maintain the details of daily work done indicating the spot of work, extent of work done and the nature of work done. Daily work report shall be submitted to GSECL to this effect in a suitable information format. The contractor shall attend the day to day maintenance schedule as drawn out by GSECL and in line with the maintenance schedule drawn and followed by Indian Railway. 3.9 TRACK MAINTENANCE PROGRAMME: Annual track maintenance programme shall be as per Annexure „A‟. The contractor shall not deviate from the annual track maintenance programme unless and until it is felt by the PWI / RM that exigencies exist elsewhere. Opinion of permanent way Inspector Rail Ministry in deciding such exigencies shall be final.

3.10 CONTRACTOR’S TOOLS AND EQUIPMENTS: Contractor shall maintain the tools, tackles, equipments, inspection tools, etc. in working condition and as per Annexure „B‟. 3.11 CONTRACTOR’S OFFICE AND STORES: GSECL shall provide open space in the plant area of about 500 M2 for keeping materials, tools, equipments, etc. and for making temporary office, at a token rent of Rs. 2.00 per month per M2. On completion of work / contract the contractor shall have to vacate the premises within three months from the date of completion. 3.12 WORK PROGRAMME TIME SCHEDULE: Monthly / Weekly maintenance programme shall be drawn up mutually / by the owner and the contractor based on the availability of work fronts and keeping in view the tracks stated in the Annual maintenance programme. The contractor shall seriously adhere to this schedule by developing adequate personnel and working tools and tackles. The progress achieved against the work plan for each work shall be summarized by the contractor and the same shall be submitted by him to the Engineer-In-Charge. 3.13 WORK DANGEROUS TO TRAFFIC: When any work dangerous to traffic is required to be undertaken by the contractor, the work has to be planned in one day advance from Engineer – In – Charge, to enable him to plan the operation of loading / unloading, contractor shall take all possible precautions such as providing red flags, banner flags and hand signals. In case of emergencies the same can be taken up by the contractor with verbal permission of concerned department so as to avoid accidents. When it is felt by the contractor that the work can not be completed in day time, the PW / RM shall have authority to block the portion of Railway Track so affected, keeping in view the operational requirement. 3.14 GSECL’S OBLIGATION: Work is to be carried out under railway stock out and in consolation in GSECL. 3.15 MATERIALS: The contractor‟s scope of work for the day to day time maintenance of railway siding shall be limited to the replacement of small fittings such as MS keys, fish bolts, dog spikes and other small fittings. The owners shall maintain adequate stock of major fittings, such as rails, sleepers, fish plates etc. in regular stock. The contractor shall intimate to GSECL within a period of one month indicating the minimum stock requirement for each major fittings. The above materials shall be issued by the GSECL from their main stores and the contractor shall bear all other costs including handling, transportation to work site and replacing the same in the track. No additional payment shall be made to the contractor for such replacement. The contractor shall also deposit the released materials to the GSECL‟s store without any extra cost and get a credit note for that. The contractor shall maintain proper records of the receipt of materials from stores and their consumption indicating the stock in his custody at the end of every month. The reshipment of the material, if considered necessary, will be decided by the Engineer-in-charge.

3.15.1 SUPPLY OF MATERIALS: Normally GSECL is keeping sufficient stock of P. Way materials, however, in case need the contractor will supply the P. Way materials as per rate as mentioned in Schedule „C‟. The quantities mentioned in the schedule are estimated quantities and may vary. Please note that material will be purchased only as per request of GSECL and contractor shall not press for the supply as per schedule. 3.15.2 SPACE FOR CONTRACTOR’S LABOURS: Necessary space for contractor‟s labours shall be provided by the GSECL to the contractor. The space for the contractor‟s labour shall be as decided by the Engineer-in-charge as per monthly rent decided by EIC. 3.15.3 QUARTERS FOR CONTRACTOR’S ENGINEER: The GSECL shall provide one, two room kitchen quarter for the contractor‟s Engineer for residence cum office at standard rent, to be charged as per GSECL‟s rules. 3.15.4 CANTEEN FACILITIES: There are necessary canteen facilities to the worker of the contractor‟s labours in plant premises. 3.15.5 TELE-COMMUNICATION FACILITY: If possible GSECL shall take suitable action for providing P&T telephone connection on chargeable basis. The contractor will also be allowed to use internal telecommunication system of GSECL. One internal telephone shall also be provided at contractor‟s work spot / residence to enable him to attend at the time of emergency. 3.15.6 The contractor shall have to continue the work after expiry of time limit till the new contract is awarded and the new contractor starts the work. The contractor shall have to work at the same rates, terms and conditions without charging any extra cost. Necessary extension in the time limit beyond expiry date shall be given by the GSECL. 3.16 MODE OF PAYMENT AND SUBMISSION OF WORK: The total value of the contract may vary, if more kilometers of track is added for the maintenance purpose during the currency of the contract. Therefore, the payment at the accepted lump sum rate shall also be made proportionately in the terms of the track length and the period of its operations / use. Payment of the maintenance charges will be made once in month basis by way of cheque issued in favour of the contractor. Every month, for the month during which the maintenance work has been done. The bill will be submitted by the contractor, in triplicate after certifying that no work is pending. 3.17 DERAILMENT / ACCIDENT AND RESTORATION OF TRACKS: The contractor shall maintain the track as per railway norms and instructions safe for rail movement. In case of any accident or derailment n the railway line, the Engineer-in-charge will make enquiry and if the accident has occurred due to the fault of track maintenance, then a fine of maximum Rs. 5000.00 may be imposed / charged per derailment and shall be recovered from the bill solely at the discretion of Engineer-in-charge concerned. The contractor will have to restore the track free of cost by his labour. Material will be supplied by GSECL free of cost. In case where maintenance is not the cause of accident the contractor will be paid charges for restoration as per schedule of rates. The GSECL will however render assistance in supplying crane with operator if possible. The restoration work shall not be delayed for any reasons of dispute based on joint observation at site of accident. All the unserviceable materials collected at the time of routine maintenance / accident shall be transported and credited by the contractor at location decided by the stores department without any additional cost. traffic after the accident at a short notice, sufficient labour tools and tackles shall be provided by him for restoration of track in original shape and alignment within a responsible time. The GSECL will however render assistance in supplying crane with operator if possible. The restoration work shall not be delayed for any reasons of dispute based of joint observation at site of accident. 3.18 SALE TAX FROM WORKS CONTRACT: At present there is no sales tax on works contract however, in favour by way of any statutory provision by the Govt. machinery if, it becomes applicable the same shall be borne by the owner. 3.19 INSPECTION CHARGES: As per Railway norms and procedure, it is obligatory on the part of private siding owners to get the railway siding inspected by the Railway authority as and when necessary. Inspection reports are submitted by the railway officials for improving maintenance, defects observation at any safety requirement. However, comments / defects noticed by the Railway shall have to be rectified by the contractor promptly and effectively. 3.20 ASSIGNMENT OF TRANSFER: Contractor shall not assign or transfer whole or part of this contract awarded to him hereunder or whole or part of the work, services, obligations here under, to any person or party without prior written consent of the company, GSECL. 3.21 LIQUIDATED DAMAGES: If contractor fails to do, perform, render, execute fulfill, carry out, discharge of handle any each and every of his work, services, obligations, responsibilities, assigned to him inspect through contract in time and manner satisfactory to GSECL and GSECL shall at its opinion to terminate this contract or to get any portion of it through other agency at his risk, cost in consequence and consequences and without any prior notice or reference to contractor cost and consequence. GSECL shall also be entitled to make any other alternative arrangement as deemed fit at contractor‟s cost, risk and consequence without prejudice to other rights and remedies available to GSECL under this contract. 3.21 [A] PENALTY: If the workmanship of work and maintenance of track is not found satisfactory by Engineer-in-charge, 10% amount of bill will be withheld. The amount withheld will be refunded on making good effect to the entire satisfaction of the Engineer-in-charge. 4.0 OPERATION AREA: 4.1 Sikka TPS is an operation area, therefore contractor and his employees shall confirm to all fire and safety regulations of the GSECL and shall so organized his work as not to interfere with the running of the plant in any manner whatsoever. Before starting any work, contractor shall apply one day ahead of fire and safety permit for excavation, welding and cutting work to the Engineer In Charge of work / works on turn will arrange for such permits. The contractor shall make all arrangement of the precaution given in the permit before starting of the work to satisfaction of engineer in charge, or his authorized representative. Due to operational problems, it is possible that the clearance permit may be delayed for which the contractor shall / will not ask for idle labours for that work and so such claim shall be entertained by owner. All equipment such as fire extinguishers, the hoses and nozzles required for such precautions can be had from GSECL, fire station free of charge and shall be returned after completion of work / works in working condition to the satisfaction to the fire deptt. If the contractor shall damage to the fire equipments, then the contractor shall bear the cost in full, and will be recovered from his bill. GSECL reserve the right to terminate the contract or to forfeit any or all amount due to him in case the like precautions are not taken by the contractor.

4.2 NO SMOKING: Contractor shall instruct his concerned personnel NOT TO SMOKE in plant area. No matches shall be permitted to carry out inside the plant area. The contractor shall be held responsible for all defaults of his workers in this regards and engineer in charge reserve the right to TERMINATE the work of the contractor and forfeit any or all the amount which may be due to him. 4.3 LABOUR LAWS: The contractor shall ensure that the existing labour laws as amended from time to time as application in the locality in respective of the payment of wages, holidays working hours, compensation under workman‟s compensation act, contract labour Act, 1970, Minimum Wages Act, PF Act of or such other status are applicable from time to time. Documents / records are produced as and when demanded by GSECL. In the event of any claim arising due to the breach of any of these laws, rules and regulations relation to the above subject the contractor would be personally held responsible of the above laws rules, codes, etc. and in case of his failure to make payment, if the GSECL is required to pay the contractor shall indemnity the GSECL against all such claims. The contractor shall at all times indemnity and keep indemnified the GSECL and its officers, servants from and against all third party claims whatsoever including but not limited to property losses / damages, personnel accident, injury or death / to property or person of any sub-contractor and / or any third party in respect of all liability, under the Motor Vehicle Act, Workman Compensation Act, Fatal accident Act and / or other Industrial legislation from time to time in force in India. The contractor shall not employ any workman / staff under 18 years of age. 4.4 SAFETY: The contractor shall adhere to safety practices and guard against hazardous and unsafe working conditions and shall comply with the safety rules in force from time to time at GUJARAT STATE ELECTRICITY CORPORATION LTD. 4.5 SECURITY OF CONTRACTOR, EQUIPMENT, ETC: The contractor shall have to make own arrangement for safe custody of his equipments, tools and tackles, consumable etc. either brought by him or issued to him by GSECL. Only on special permission night watchman of contractor may allow inside the plant area. 4.6 In case of accident, the contractor shall report in writing to the Engineer In Charge immediately the caused nature of the accident. The contractor‟s employees who suffers on account of accident can be reemployed by the contractor after he is declared medically fit for doing the job. This information shall be submitted in writing by the contractor to the GSECL Engineer In Charge.

5.0 TECHNICAL SPECIFICATION SCOPE OF WORK:

ITEM NO. 1 TO 9 5.1 GENERAL: The scope of work covers the upkeep of the total yard area including maintenance of Railway tracks, points and crossing bridges, culverts, loco yards, tracks at loading platform track at unloading area, dead ends, buffer stops, etc. related to day to day operation of railway siding in the premises of GUJARAT STATE ELECTRICITY CORPORATION LTD., Sikka TPS. 5.1.1 Cutting grass, vegetation, etc. in yard area / tippler on the track formation as per P. Way manual. 5.1.2 Cleaning of cross drainage works for the effective storm water drainage system of the yard up to the disposal point near the railway track formation as per P. Way manual. 5.1.3 Painting of point box, levers, painting and numbering point levers, fouling marks, buffer stops etc. 5.1.4 Removal of mud, grass debris, etc. generated as part of track maintenance operations. 5.1.5 All works and mentioned in the P. Way manual of Indian Railway relating to the maintenance of permanent way. 5.1.6 The Railway material shall be kept stacked in an orderly manner as so as not to cause any infringement to the railway shunting operations and also shall not hamper the movements the man involved with shunting operations. 5.2.0 MODE OF CERTIFICATION OF WORK: 5.2.1 The track work shall be carried out subject to the day to day maintenance and supervision and yearly inspection of the Railway Administration. The defects and deficiencies observed by the inspecting officials should be immediately rectified and attended to as per standards laid down without any extra cost. 5.2.2 The GSECL‟s qualified representative will normally be conducting random checks and inspections without prior information and will normally assess the standard or maintenance once in fortnight. 5.2.3 The Railway Administration will normally inspect the worthiness of the track once in a 3 year. However, the frequency of inspections may increases if considered necessary by Railway Administration doe to change in policy or otherwise. 5.2.4 The contractor‟s primary responsibility shall be to keep track fit for traffic use to ensure accident free service all the time. Such maintenance will be on routing basis and will involve following activities during the month. 1. Keeping track neat and clean. 2. Tightening of nuts, bolts, dog spikes and track fittings. 3. Recoupment of track fitting materials due to war and tear and pilferage etc. 4. Ensuring correct gauging, leveling, squaring of sleeper and ballast sectioning. 5. Ensuring smooth working of points and crossing etc. 5.2.5 The bill will be certified normally on the efficient performance of the activities as enumerated in para above every month.

5.3.0 The terms here in to prevail in case of contradictions. 5.3.1 Not with standing anything contrary contained in any of the correspondence, documents and discussions referred to or connected with this contract, the terms and conditions contained herein as per contractor‟s commitments shall prevail and shall be binding on him. 5.3.2 Contractor shall be liable and responsible for the safety, and any loss, damage or injury caused to him or suffered by, any of his employee, labours, agents, sub-contractors, vehicle or equipments, goods, materials, or other properties accidents, for compensation for loss damages, or injuries to his employee, labours, agents, sub-contractors, etc. He shall save a GSECL harmless and reimburse all the costs and / or the settlements made by GSECL. 5.3.3 The contractor shall at his own cost take out and maintain insurance policies in respect of all insurable liabilities including but not listed to third party insurance act, personnel injuries insurance act. Emergency Risk Insurance with Insurance, such policies shall be of not lesser limits hereunder specified with reference to the matter hereunder specified namely: 5.3.4 A. Workmen‟s Compensation Insurance Co. to the limit to which compensation may be payable under the laws of the Republic of India. B. Third party insurance body injury and property damage to the limit of not less than Rs. 100000.00 [Rs. One Lac only] in each accident at this job site. C. Provided that the limits specified above shall operate only as specification of minimum limits for insurance purpose, but shall not any way limit his liability in terms of the limits specified. D. The insurance policy in question shall be kept in force during the currency of the contract to GSECL entire satisfaction and submit to the GSECL‟s true copy of such insurance policy / policies. 5.4.0 THROUGH PACKING: Contractor shall perform systematic through packing as per the biennial track maintenance programme. He shall perform systematic through packing for about six month from October to March after end of monsoon. This will include opening of the road, examination of rails, sleepers and fastening squaring sleepers, slewing of track to correct alignment, gauging, packing of sleepers, repacking of joint, sleepers boxing of ballast section and tidying etc. Each of the above operations should be carried out as detailed below. 5.4.1 OPENING OF THE ROAD: Ballast should be opened out on either side of the rail seats to the extent shown hereunder to depth of 50mm below the packing surface without disturbing the coarse under the sleepers. a. End of sleepers to 450mm inside to the rail seat. In the case of C.I. Plate or pot sleepers, the opening out should be to the extent of the plates or pots to enable packing being done conveniently. The ballast should be drawn by shovels or powrahs outward and inwards i.e. that portion of the ballast on the outside of the rail should be drawn outward, the portion between the rails being drawn towards the centre, care however, shall be taken that the ridge of ballast formed between the rails does not project more than 50mm above rail levels. 5.4.2 EXAMINATION OF RAILS, SLEEPERS AND FASTENINGS: a. Rails should be examined the underside for corrosion, rail joints for wear on the fishing plates and tightening of fish bolts and rail and for cracks, kinker in rail should be removed by jam crowing. b. Sleepers should be inspected for their condition and soundness particularly at rail seats. In case of old steel sleepers, the rail seats should be examined for cracks.

In the case of wooden sleepers, the dog spikes and fang bolts should be examined for cracks. In case of CI pot or plate sleepers, the condition and firmness of good, cotters and keys should be broken ones being immediately replaced. 5.4.3 SQUARING OF SLEEPERS: Gauge variations and kinks inevitably result from sleepers getting out of square. a. The spacing of sleepers on the sighting rail should first be checked and correctly check marked. Corresponding marks should be than made on the other rail using the square at ever point. The cores of sleepers that are out of square should than be picked with the pick ends of beaters, the fastenings, loosened and the sleepers leveled and squared to correct position. b. Squaring should be done by planting the crowbars firmly against the sleepers and pushing it. Under no circumstances sleepers should be hammered. Sleepers that are squared should be regauged immediately, the fastening tightened and the packing restored. 5.4.4 SLEWING OF TRACK OF CORRECT ALIGNMENT: 1. Heavy slewing will only be required during realigning of curves when it would be necessary to loosen the rail joints and in the case of steel sleepers and CI plate or not sleepers to loosen the fastenings, the packing cores being broken with the pick ends of beaters. Slewing of track for normal maintenance will be or a small order should be done after opening but the road, loosening the pores at ends and drawing out sufficient ballast at the ends of sleepers. 2. Slewing of track shall be directed by the meter who on straights should sight the rail free distance of 30 to 50m on curves, he should sight the inner rail and adjust this distance, according to the degree of curvature. Slewing is best done in the morning unless it is cloudy weather, as later on sighting condition becomes unfavourable. 5.4.5 GAUGING: 1. Gauging should only done after assuring that sleepers are truly square, standard keying manners shall always be used. Beaters and heavier hammers should not be used as this causes over driving of key and standard lug on steel sleepers. 2. The gauge should be held firm with one lug to against the base rail, the other end being swiveled over the opposite rail. The tightest position obtained is the correct point to test the gauge. The gauge should not be forced as that cause considerable were of the gauge lug. 3. The track should be adjusted to correct gauge on the rail opposite to the base rail. The permissible slackness on sharp curves should be attained by using liners of the requisite thickness against the lug of the gauge. 4. While it is essential that correct gauge should be maintained, it is not desirable to re-gauge frequently on the wooden sleepers road as this will result in spike willing the rail seats nor on the pot or plate sleepers road as this will result in the packing getting disturbed. Where due to the age and condition of sleepers, it is to possible to maintain correct gauge, it is good practice to work within the following maximum tolerance, inclusive of side wear on rails, provided uniform gauge can be maintained over long lengths. a. On straight – 1/8” tight to ½” slack. b. On curves upto 4-1.3” tight to ½” slack. When slew in, the crow bars should be painted well in t the ballast at as angle not more than 30 degrees from vertical otherwise lifting of track will result.

5.4.6 PACKING OF SLEEPERS: 1. The base rail shall be signed by the mate with the eye along the edge of the rail and any dip or low joints lifted correctly. The adjustment sleepers should be then packed and the top checked. After two rail length have been attended to the rail on the other side should be brought upto the correct level using the straight edge and the spirit level. Cross level with the straight edge and spirit level should be checked at every rail lengths should than be taken up and the process continue. 2. No joint or dip should be lifted more than the proper level in the expectation that it will settle to the correct level, instead of it will settle more under traffic as a result of being high and cause rough running. 3. Having aligned the track and adjusted the top the gang men should be distributed to pack all the sleepers in a systematic manner commencing from the one end. Four men should deal with every sleeper successively, two at each rail seal. The ballast under the sleeper should be packed by the men standing back and working their beaters diagonally under the rail seat at the time to ensure firm packing. 4. It is important that the man should thoroughly „break‟ the cores with the pick ends and then use the head ends as otherwise uniform packing will not be achieved and the elasticity of the road bed affected. After packing under the rail seat the men should pack to the requisite extents on each side of the rail seat i.e. end of sleeper to 18” inside on the ends of sleeper. During packing, the beaters should not be lifted above the head. All men should aim to work the beater, from the same height upto chest level so that the sleepers are uniformly packed. Higher or lower lifting of the beater results in uneven compactness and the packing does not last long. 5. In the case of steel through and wooden sleepers the packing under the rail seats causes the ballast to work towards in center. Before final dressing is done, it should be ensured that no sleeper is center bound by working the pick ends over the central range “Centre bound” sleepers tend to rock and set up „rolling‟. 6. In the case of CI plate or pot sleepers, it should be ensured that the plates or pots are not tilted in the process of packing, on pot sleepers the ballast should finally be planned through the hole provided at the top of the pot and rammed in the crow bars. 7. The packing on the inside and outside at every rail seat should before boxing the track, be checked by the Mate by tapping. A hollow sound would indicate defective packing which should attended to again. 8. As soon as the packing is systematically completed the alignment and top should be carefully checked by the Mate and minor adjustment carried out, the sleepers disturbed for this purpose being finally repacked. 5.4.7 RE-PACKING OF JOINT SLEEPERS: The joint and shoulder sleeper should be repacked before boxing is done and the cross level at joints checked. The rail joint being the weakest portion, firmness of its support is essential. 5.4.8 BOXING BALLAST SECTION AND TIDYING: 1. After completing the proceeding operations in sequence, clean ballast should be worked in with ballast forks or rakes and compactly filled between the sleepers along the rail seats. The ballast section should be dressed to the specified dimension and template or the yard stick being used for the purpose.

Kemp cord ¼” dia of sufficient length should be used for lining the top and bottom edges of the ballast section. Where ballast is deficient of the full section, the deficiency should be shown along the center of the track and not under the rails or in the shoulders. 5.5.0 PICKING UP SLACKS: Slacks usually occur on stretches of yielding formation on high banks, in cutting, on approaches of bridges on badly alignment curves, where the ballast is poor in quality and where the drainage is defective. 5.5.1 As opposed to through packing, picking up slacks should be done where the alignment, top or level is incorrect, and the track has to be restored to normal condition quality. The quantum of work turn out by a gang during the day will depend on the defects assessed and marks made on sleepers to be dealt with in chalk. The marked sleepers should then be opened out and dealt with as in the case of through packing. 5.6.0 BALLAST SECTION: 5.6.1 The top with of the ballast section shall be 11 feet. The top line of the ballast section from end to end shall be the top of sleepers. In case of CI sleeper road, the top line shall be kept to the tie bar level. 5.6.2 On the outside of the curve sharper than three degree the width of the outside shoulder, i.e. the distance from the end of the sleeper to the outside corner of the top line of ballast section should be increased to a maximum to 15” to afford additional lateral support. 5.6.3 The slopes at the sides of the ballast section on banks or cuttings without ballast walls should be 1 to 1. 5.6.4 On the approach line the minimum depth of ballast below bottom of sleeper plate or pot at the rail seat should be 8”. 5.6.5 Drainage may be obtained by providing a cross fall of 1 on 40 from the center of the formation towards the center. On curves the formation should be made up according to the track profile, no extra ballast being used for the purpose of super elevation. 5.7.0 Lifting of the track will become necessary during regarding and for elimination of minor sags which develop through improper maintenance of yielding soil. For this purpose, correct level pegs should be fixed at suitable interval. 5.7.1 Heavy lifting should be always be carried out under the protection of engineering signals by not more than 3” to a time so as to allow for proper consolidation. The ballast for this purpose should be removed and stacked separately and the track lifted on murrum, sand or ash. Lifting should be a rule be carried out in the direction of rising grade. The casing of the track for the passage of train should not be sleeper than 1” per rail length. The operation should be repeated until the required level is attained when the road should be finally ballast, through packed and boxes, the cess being made upto proper level. 5.8.0 LOWERING OF TRACK: The lowering of the track should not be resorted to except under special exigencies. 5.8.1 As it is difficult to obtain good running, in a reasonable time. When it becomes necessary, however, trenches should be cut every 100 feet to the final level in order to give a continuous indication while the operation is in progress.

The entire ballast should be removed sufficiently for away from the track to prevent it getting mixed with excavated materials. 5.8.2 The procedure should be to clear the spaces between the sleepers then slightly lift the track, break the beneath and level it in to the spaces so left. This material is once more removed and the operation repeated until the final levels are reached. The road should then finally ballasted, through packed and boxed, the case being cut down to proper level. Lowering as in lifting should be restricted to a maximum of 3” at a time exceeds 1” per rail length. As proposed to lifting, lowering should be carried out in the direction of the falling grade. 5.9 DISTANCE PIECES OF PLATFORM LINES: Tracks adjacent to platforms may be provided, where necessary, with distance piece made of unserviceable timer fixed at intervals of about 100 feet, one end of each such piece being fastened to the near rail and the other butted against the face of platform wall to aviate the possibility of infringement of the horizontal distance from the center of track during normal maintenance, where platforms are on outside of curves, distance piece shall be provided. 5.10 FOULING MARKS: 5.10.1 Fouling marks should be distinctly visible and difficult to remove. 5.10.2 These are fixed at the point at which the spacing between cracks beings to reduce to less than the minimum. 5.10.3 The fouling marks consist of a stone about 5: thick, with the top edges rounded off and the top surface white washed, or a cement concrete block to dimension given and surface white wasted or of unserviceable rail piece‟s embedded in concrete supports and painted white. These should be laid level with the top line of the ballast section. 5.10.4 The number of wagons which can be accommodated in siding should be marked on each fouling mark. 5.11 POINTS AND CROSSING MAINTENANCE: 5.11.1 At all points and crossings the gauge shall be exact, the clearances correct as prescribed in Indian Railway‟s “Way and works manual” the switches and crossings in good condition and alignment, the sleepers well packed and chairs and fastenings and all the other fittings properly secured. The top of the switch the gauge will however, be slightly slack between stock rails. 5.11.2 The condition of wear, top as well as side in stock and switch rails and in crossings should be carefully examined. Bent tongue rails should be straightened where possible, badly worn or damaged stock and tongue rails and crossings should be replaced by serviceable ones. 5.11.3 Stock and tongue rails should be replaced as complete set as far as possible. 5.11.4 The leads and radi of turnouts should be correct accreting the section of rail and the angle of crossing used. 5.11.5 Whenever renewals are carried out, the correct standard turnout should be provided. “Fitting in” new materials in existing layouts by what may be terms multiplication of standard parts and the use of non standard of improper fittings should be avoided. 5.11.6 The following are the usual defects noticed in points and crossing and should be guarded against...

1. Loose heel block bolts. The first two bolts in the switch rail must grip, the other two in the lead rail being tight. 2. Defective packing of sleepers causing the stock rail to settle, the switch to rise and clips to come off later. 3. Loose crossing bolts, keys of fang bolts. 4. Crossing bolts of incorrect length and diameter. 5. Defective packing of crossing sleepers. 6. Incorrect clearance. 7. Incorrectly bent fish plates for the need of switch. 5.11.7 DATE OF LAYING PAINTS AND CROSSINGS: The month and year of laying new or second hand points and crossing should be painted in white block letters on the webs of switches about 2” from the heel joint connected to the lead rails. Then second hand points and crossings are subsequently laid at another site, the dates previously marked should not be obliterate, as indication of the total life will then be available. LIMITING WEAR ON CROSSINGS: The maximum vertical wear on wing rails and point rails should not be allowed to exceed 3/8”. 5.12.0 SCREENING OF BALLAST SECTIO: 5.12.1 For good drainage, periodical screening of stone ballast and making up of ballast section is essential. 5.12.2 On an average formation, 25 to 33 percent, on one gauge length should be screened each year as necessary, starting from one end in the first year and finishing at the other end in 3 to 4 years. Particularly mileages may warrants more frequently screening. 5.12.3 The material in ballast shoulders to full depth and between sleepers to depth 2” to 3” below bottom or sleeper should be removed, cleaned and put back. Care should be taken that the packing under sleeper is not disturbed and the much removed is not allowed to raise the cess above the correct level. The continuous spaces between sleepers should not be worked at the same time. Screening should be progressed in alternative panels of one rail length. In no circumstances should several rail lengths of track be stripped of ballast. Where drains across the track exist, these should be cleaned and filled with boulders or ballast to prevent packing from working out and forming slacks. 5.13 ASSESSMENT OF BALLAST REQUIREMENTS: The requirement of ballast for maintenance purposes shall be estimated by increasing the ballast section to full depth over a length at every quarter of half mile and assessing the clean ballast percentage. Care should be taken that area of under the sleepers are not disturbed forming slacks. 5.14 SIDE AND CATCH WATER DRAINS: 5.14.1 For the efficient drainage of every cutting and uncertain cases of the surroundings of the cutting side and catch water drained shall be varied in type according to the nature of the cutting and in size according to the volume of water catered for.

Adequate openings to take that full flow of side drains should be provided sufficiently for from the top of the cutting to avoid any danger of breach occurring between the drain and the cutting itself. The excavation soil should be used to form a “bund” between the drain and the top of the cutting. 5.14.2 Ballast walls where provided in cuttings should be regularly inspected. The efficient maintenance of ballast walls include the regular cleaning of weep of holes, the provision of weep holes where none exist and rebuilding where necessary. 5.14.3The annual cleaning of side and catch water drain should be carried out methodically and completed before the monsoons sets in. 5.15 LUBRICATION OF RAIL JOINTS: 5.15.1 The purpose of lubricating rail joints is not only to facilitate expansion of rails but also to retread the inherent feature of wear on fishing planes is one of the preventives for low joints. 5.15.2 A stiff paste plumbing [graphite] and cheap kerosene oil, made up in the proportion of 6lbs of plumage to 4 lbs of kerosene oil may be used. Black oil or reclaimed oil for fish bolts and nuts may be used once in six months. The following quantities to the specification mentioned should suffice for 100 single joints. Plumber : 11lbs. Kerosene oil : 7-1/4” Black or reclaimed oil : 6lbs 5.15.3 The lubrication of rail joints and reversing of fish bolts should be carried out as followed 1. Unscrew the nuts and remove the fish plates on the inside leaving the other fish plate and bolts in position. 2. Clean the fishing surfaces of the fish plates and the rails with a wire brush, lubricate and replace the fish plate. 3. Take out fish bolts, one at a time and put each back, after oiling, in the reverse position. 4. Treat the other fish plate and fishing surface or the rail similarly. 5. Replace the nuts and tighten to the extent possible with the standard fish bolts spanner without overstraining the bolts. 6. Two joints opposite each other shall not be opened out at the same time. It should be particularly noted that at no time during the operation there is less than one fish plate and three fish bolts without nut connecting the two rails. 7. Both the fish plates should be fixed and at least one fish bolt and nut on either side of each joint should be tightened when a train / load is approaching the site of work. This must be done before the banner flag protecting the site of work is ordered to be removed. 5.16 COUNTERACTION AND ADJUSTMENT OF CREEP: 5.16.1 Rails have a tendency to gradually move in the direction of dominant traffic. The reason is believed to be the ironing out by moving loads, augmented by breaking loads and the impact of the wheels on the running on ends of rails, particularly when they are in a state of expansion or contraction.

The troubles caused by “Creep” are... 1. Sleepers getting out of square. 2. Detraction of gauge. 3. Loosening of joints. 4. Shearing and breaking of spikes, bolts and fish plates as a result of bucking in extreme cases. 5.16.2 The following are some of the avoidable causes to which creep is attributed: 1. Uneven cross levels. 2. Rail not secured as tightly as required to each sleeper. 3. Yielding road bed. 4. Lack of proper drainage. 5. Decaying sleepers. 6. Uneven spacing of sleepers. 7. Badly adjusted super elevation on curves. 8. Rails too light for the traffic then carry. 9. Sufficient or badly maintained rail joints. 10. Scant or excessive provision for rail expansion. 11. Defective packing. 12. Poor or insufficient ballast. 13. Improper use of train brakes. Careful maintenance of the track, particularly in regard to the driving home of all spikes and keys and the continued careful packing of “slacks” as soon as they appear, should assist in reducing creep. 5.16.3 With steel through and CI plate sleepers no trouble is experienced. On CI pot or wooden sleepers road, careful watch should be kept for a series of jammed joints. Not more than six should be permitted continuously. 5.16.4 For track laid with wooden and pot sleepers and such other where creep is excessive, creep registers should be maintained by the contractor. Creep indication, posts square to the track should be erected on either side of the cess at interval of about half a Km. These may be unserviceable peace or creep occurring on any section. Entries should be completed as regards mileage, section and length of rail sleeper density, type and number of anchors per rail length is used periodical readings of creep one way of the other with dates should be recorded with dates when last adjusted and in case additional anchors are fixed, their disposition and date of fixtures. 5.16.5 Creep in excess of six inches shall not be permitted. Adjustments should be carried out as necessitated. Correct expansion lines shall be used for the purpose. 5.16.6 Creep on cast iron plate sleepers should be counter acted as follows: 1. On plate sleepers fitted with two way keys, all keys, should be driven alternately in opposite direction. 2. In the case of plate sleepers of the type which do not have two way keys, the sleepers should be arranged in the track so that the keys can be driven in the same way. 5.17 ACTION ON BUCKLING OF TRACK: 5.17.1 A special watch should be kept on lengths where a wooden or pot sleeper road butts against a CST-9 or steel through sleeper road.

If owing to creep or other causes, a number of successive rail joints have closed up or if the joints are rusted, there a possibility that the track may be distorted or “buckled” in hot weather. Such serious occurrence could only be attributed to neglect of track maintenance. 5.17.2 If buckling does occur or appear imminent, the track should be slewed to a flat reverse curve, on curves, the track should be slewed outwards. 5.18 TREATMENT OF SLACK SPOTS ON SOFT FORMATION: The formation of remedial measure for the treatment of bad soil spots in banks or cutting should be based in following principles: a. Drainage of track. b. Drainage of formation. c. Reduction of intensity of pressure on formation. d. Improvement in the bearing power of formation. The principles can be achieved respectively by: 1. Clean ballast. 2. Adequate drains, the more the better. 3. More sleepers and / or greater depth of ballast resulting better distribution of pressure. 4. Sand cinders or clean murrum topping 1‟ to 1‟6” in depth to the full width of formation, this tends to mix with clay or black cotton soil, improves its characteristics and full filling cracks. Form of blanketing meets most ordinary cases. Occasionally patches occur where there are springs of super charged water. These causes will be few, but when diagnosed, they will require treatment by drainage. 5.19 SLEEPER RENEWAL: a. Laying: Sleepers shall be laid and maintained square to the rails on straights and radial on curves. 5.19.1 WOODEN SLEEPERS: a. The average life of wooden sleepers varies accordingly to the kind of timber. In the interests of both safety and economy, it is essential that wooden sleepers more than five years old to be thoroughly inspected every year according to the following procedure. b. Imperfect packing is the cause of the majority of breakages of cast iron plates or pots. Defective plates or pots should not be boxed with ballast until replaced. c. Cast iron plate or pot sleepers tend to corrode in the channels through which the tie bars pass. To prevent tie bars from corroding into a solid mass, alternate tie bars should be drawn out of the sleepers and treated with coal tar for 2‟ at each end between the cotter bolts and reopened at intervals dependent of such conditions as type of soil and rainfall. 5.19.2 END BINDING: To save hard wood sleepers from splitting, the ends after, being pressed shall be bound firmly with wire, hoop iron or clips as and when required at no extra cost. 5.19.3 ADZING: a. When wooden sleepers are used without bearing plates the rail seats should be adzed to a slope of 1 in 20, planned for the section of rail with the correct template and treated with coal tar or creosote.

b. When bearing plates or chair are used, it should be ensured that the seating is adzed or planned to ensure even bearing and that the two bearings and that the two bearings are truly in the same plane. c. For treated sleepers, adzing should be done before treatment. 5.19.4 AURUGING: a. Spike holes should be bored vertically and right through the sleeper. The size of augur for boring should be as follows: 5/8” dog spikes with deodar or soft wood sleepers 9/13”. 5/8” dog spikes with deodar hardwood sleepers 5/8”. During the process of boring the tips of augurs should frequently be dipped in oil to facilitate work. When sleepers are being bored outside the track, correct templates should be used. Than boring bored of re-bored while in the track the auguring should be done correctly with the gauge held position. b. The holes after being bored, should be given a costing or coal tar or creosote. c. For treated sleepers, the boring should be done before treatment. 5.19.5 USE OF BEARING PLATES: a. MS bearing plates need not be provided hardwood sleepers except on. 1. All sleepers on girder bridges. 2. All sleepers or turnouts. 3. All timbers of ash pits examining pits. 5.19.6 DOG SPIKES AT RAIL SEAT: a. The number of spikes per rail seat should be as given below... 1. All joint sleepers, bridge sleeper, turn out sleepers and ash pit timber – four. 2. Intermediate sleepers on curves = three, two outside and one inside. 3. Intermediate sleepers curves, primary lines – three, two outside and one inside and tertiary line = two. b. The sleeper spacing on straights and curves shall be in accordance with approved plans. Rail joints shall be suspended and joint sleepers spaced as closely together as consistent with good packing. The maximum space between the joint sleeper on centers shall not exceed 12” for wooden and 15” for CST-9 and steel through sleepers, followed greater packing between the „shoulder‟ and the joint sleeper and increased spacing between intermediate sleepers. c. On plate sleeper fitted with two keys all keys should be driven alternatively in opposite directions. In the case of plate sleepers which do not have too many keys, sleepers should be so arranged that the keys could be driven in opposite directions over alternates sleepers. d. On steel sleepers, the keys on the outside and these on the inside should be driven to the same extents respectively, unless this is achieved during laying, adjustment of gauge in the course of maintenance would necessitate slewing of sleepers one way of the other and re-keying. Untreated wooden sleepers shall be laid with sap wood top and heard wood below. Treated sleepers shall be laid with heart wood on top and sap wood below.

Gauge on straights and curves upto and including 4” the gauge shall be neat i.e. exact. 5.20 RESPACING SLEEPERS: 5.20.1 When re-spacing CI steel through sleepers, the keys should be removed, and the packing core, broken before shifting the sleeper. The packing, the sleepers, dog spikes shall be loosened to just enough to admit the sleeper being shifted. 5.21 INSPECTION AND RENEWALS: 5.21.1 When the spikes are used, the outer ones should be in line on one side and the inner ones in line on the other side of the center line of the sleeper. 5.21.2 Where cast iron plates are used on intermediate sleepers for arresting creep, the number of spikes or fish bolts per plate should be four. 5.21.3 Dog spikes should be dipped in coal tar before use. If it is necessary to draw and re-drive spikes or to drive spikes in holes other than those freshly bored, such spike holes should first be carefully plugged with well fitting tarred wooden plugs and rebored before spikes are driven. 5.21.4 Enhanced life from „spike-killed‟ sleepers should be obtained wherever possible by internally shifting to a small extent and providing new rail seats. 5.22 MAINTENANCE OF RAILS: 5.22.1 The efficient maintenance of rails depends on: 1. The efficiency of fastenings. 2. The efficiency of the packing and the correct spacing of the sleepers. 3. The provision and maintenance of correct of the sleeper expansion spaces. 4. The lubrication and fishing of the joints. 5. The correct maintenance of the gauge and cross level. 5.22.2 BENT RAIL, KINKED RAIL: Bent rail usually caused by careless handling shall on no account, be put into the road, these should be straightened with Jim Crow before laid. Kinked rails in the track shall be Jim Crowed in position, the keys or dog spikes of at least four sleepers on either dog spikes side of the kink being remove during the operation. 5.22.3 HOGGED RAILS: A hogged rail is one with its end or ends having a permanent set. A hogged rail end in the track is ascertained by unfishing the joint, removing the fastening and measuring the extent of the hog at the rail end by placing a two feet long straight edge over the rail table. Adequate attention should be paid to the joint sleepers in regard to their spacing and proper packing to prevent hogging of rails. Joints with worn fishing plates shall be improved by the use of tapered shins or reconditioned fish plates if required. 5.23 CRIPPING AND PATTERING OF RAIL ENDS: The impact of wheels on the running on end of a rail causes the rail end to be hammered down particularly if the fish plates do not fir snugly. Hogging of rail ends occurs where the joint sleepers are improperly spaced or loosely packed for long periods, also occurs on the fishing plates at joints, particularly, if lubrication of rail joints has been neglected. 1. The ground is leveled. 2. The rails are supported at least at four points in their length. 3. Rails of one section and on one length are stacked separately. 5.24 AVOIDANCE OF JOINTS AT LEVEL CROSSING AND BRIDGE: A joint in the track is the weakest spot, joints should be therefore, receive greater and sustained attention. 1. In a level crossing. 2. On the approach within 10‟ of a bridge abutment. 3. On short spans of any type. 5.24.1 CAREFUL USAGE OF FISH PLATE: The hammering of fish plates shall be strictly forbidden. When adjusting creep, the correct method is to loosen the fastening and, if the rail can not be moved to gently hammer against the fish plate with a wooden piece interposed. 5.24.2 TIGHTENING FISH PLATES: Over tightening of fish plates shall be avoided. Fish bolt spanners of standard length 2‟3” to 2‟6” shall be used. 5.24.3 COMBINATION OF FISH PLATES: Rails at such joints should butt against each other and fish bolts tightened. 5.25 USE OF SHIMS: Tapered shims of the correct size may be used where the wear in the fishing plates is appreciable. The size should be arrived at by the use of feeler gauges in the fishing plates. 5.26 MISCELLANEOUS: Normally, 4 days per week should be allotted for picking up slacks and remaining days are required for about 4 months, i.e. June to September, during monsoon. Patrolling of the line by gang men should be carried out in addition to regular maintenance gang at night. 5.27 WORK SUPERVISION: Contractor shall engage qualified staff for the daily examination, of entire track and report the representative of GSECL in writing in case of any defect / damage to track or any dangerous condition affecting traffic movement. Simultaneously, contractor shall take necessary precautions to avert further damage accident till the safe condition are restored. The earth work on the bank wherever already completed shall be maintained by the contractor. 5.28 REPLACEMENT OF FITTINGS: Contractor shall replace bolts, fittings, dog spikes, fish plate from time to time as and when required. However, the material for renewal of rail sleepers, ballast, packing material etc. where already complete and found deficient during the period of maintenance shall be provided for this purpose by contractor at no extra cost. 5.29 CONTRACTOR’S LIABILITY: Contractor shall do, execute, carryout and perform all necessary and incidental services and operations as and may be necessary for the purpose of this contract or as may be directed by GSECL from time to time. If due to negligence attributable to contractor or due to any failure on his part in exercise of due diligence, care or caution or due to non compliance of any of the provisions or directions given

by GSECL and the GSECL is required to pay any penalty, suffers and loss / damages to incur and pay expenditure contractor shall be liable to reimburse such loss or damage of expenditure. 5.30 METHOD OF MEASUREMENT / PAYMENT: ITEM NO. 1: Track length shall be measured in straight / curves / bridges / culverts etc. and shall be paid on length per kilometer per month basis. The total length of Railway track which is in running condition, as shown by EIC will be paid every month. However the length of railway track, which is not in use and / or kept as idle shall not be paid for. ITEM NO. 2 TO 9 the quantity is taken in tender approximately. The payment is to be made as per actual work done. 5.31 DISCONTINUATION OF WORK: GSECL may discontinue the maintenance work for what so ever reasons. No payment shall be made for maintenance work during that discontinuation period. However, payment shall be made on pro-rate basis for the Nos. of days the actual work done during the discontinued month in monthly maintenance item.

SPECIAL CONDITION OF WORK

NAME OF WORK: - Biennial Contract for Maintenance of Railway Siding for the year of 2016-18 @ STPS.

01. If any areas are left out in descriptions, it shall be maintained as per instructions of the EIC and it will be paid in respective items. 02. Any modification in timing of period of maintenance shall be agreed upon by the contractor without any extra cost. 03. The workers, supervisory staff and manager or contractors authorized representative of contractor himself shall be available full time on site of work. 04. The daily report of work done on each day and same checked and signed by GSECL supervisor, JE / DE shall be submitted by contractor in prescribed printed forms shall be brought by the contractor at his own cost for such reports. The contractor shall submit the daily report regularly. 05. Contractor shall be responsible for any accident or damage to road, gutter, manholes, dustbins, water closets, pipe line, etc. or any inconveniency caused by contractor for which the necessary compensation shall be paid by the contract or recovered from the bill as deem fit by the GSECL. 06. This bi-ennial contract shall be continued till the new agency is fixed without any extra rate or increase in rates and the time limit of the work shall be considered accordingly. 07. It is the responsibility of the contractor to get the work done satisfactorily by engaging the full strength of manpower as per the work requirement failing to that the reduced rates shall be paid and necessary action shall be taken as per GSECL rules. 08. The contractor or his authorized representative and his supervisor shall remain present during working hours. 09. Any description is left out in specification the work shall be executed as per the instruction of EIC. 10. If the work is not completed in time satisfactorily, the recovery for the same shall be made as estimated rate plus 15% supervision charges. 11. If work is not carried out by contractor, same will be get done at risk and cost of contractor with 15% supervision charges will be recovered from the next R.A. Bill. 12. If any dispute arise the booklet of “TENDER AND CONTRACT FOR WORKS‟ may be referred and it will be treated as part of the contract. 13. Contractor has to carry out the work as per quantity allotted to him every month. If he fails to carry out the work 100% then the recovery will be made at 10% of the left out quantities at A/T rate, at the discretion of E.E.(C) 14. Contractor should keep the instruction book readily available at site. 15. Successful contractor shall have to arrange required labour strength for maintenance works daily for execution of respective items of the tender. Whenever contractor fails to arrange for required minimum labour strength or extra labour as per item of Schedule – B recoveries shall be effected from the due payments of the contractor at the existing rate for laborers fixed by GOG. Contractor shall engage sufficient labours for item no 1 by giving weekly off. If One Labours is absent then recovery shall be made as follows:- 01 X Rs.278.30 per day per labours = Rs 278.30 15.00% supervision charge = Rs. 41.75 Total recovery for absent of one labour = Rs 320.05 16. Contractor shall be held fully responsible for any accident or damage to GSECL assets or persons or inconvenience is caused for the work, the necessary compensation shall be paid by the contractor or recovered from his bill. The contractor shall engage all the labours / personals at his own risk and cost and shall comply binding with all the labour laws, acts, securities, all types of insurances, regulation of compensation for accident etc. at his own risk and cost.

17. Weekly off to labours shall be given in staggered manner. 18. Labours engaged for maintenance work can be delivered at any other place for any type of work by the EIC and for that work payment shall be made and no recovery shall be made for left out maintenance work by particular labours, which are shifted elsewhere. 19. Contractor shall engaged new labours with the prior approval of GSECL. 20. Looking to the urgency of the particular work, the EIC will instruct to take up and complete that particular job / work in specified time. Otherwise for incomplete work the EIC will arrange to execute the same without giving any notice or intimation and work will be executed through any other agency and recovery will be made as per actual payment made to other agency plus 15% supervision charges and this will be recovered from R.A. Bills. 21. The contractor shall be responsible for proper behavior of his labours / persons. Also he should instruct his person / labours to work as per the instruction of EIC. 22. The contractor should maintained all the works as per daily schedule timing i.e. from 8-00 AM to 1-00 PM and from 2-00 PM to 5-00 PM as directed by EIC. 23. For execution of the work as per schedule – B, if additional labours over and above the labour at present as specified in condition no. 17 above and have to be arranged by the contractor with required tools and tackles as per instruction of EIC. 24. If contractor fails in arranging sufficient labours as per instructions, it will be get done through other agency at contractor‟s risk and cost and recovery shall be effected as per prevailing labour rates fixed by Govt. 25. Quantities shown in the Tender are approximate. No claim shall be entertained for quantities of work executed being more or less than those entered in the Schedule –B of the Tender. 26. Since this is the bi-ennial contract work, no any labour escalation shall be paid to the contractor. 27. The GSECL reserves the right to terminate this contract at any time, without assigning any reason whatsoever by giving a notice period of one month from the date of notice of termination of the contract. Contractor will not be entitled for any compensation / damages / losses. Whatsoever, on account of such termination of the contract. 28. THE CONTRACT IS FOR THE PERIOD OF TWO YEAR FROM THE DATE OF AWARD OF CONTRACT. HOWEVER SAME IS EXTENDABLE BY FURTHER PERIODS ON THE SAME RATES AND TERMS AND CONDITIONS OF CONTRACT. ACCORDINGLY SCHEDULE ALSO GETS REVISED FOR QUANTITY. THIS WILL FORM THE PART OF ORIGINAL CONTRACT AND THE SAME SHALL BE DEALT AS ORIGINAL CONTRACT FOR ALL THE PURPOSE.
