This is the last will of me, Gloria Leslie Schaller, of Little Shoal Bay, Auckland, Concert Pianist. Earlier wills 1. I REVOKE all my earlier wills. Executors and Trustees 2. I APPOINT RANGI FRANCIS SCHALLER (“Rangi”) of Devonport, Automobile Salesman , and ALASTAIR STANLEY TREMAINE (Alai of Auckland, Solicitor ("my trustees") executors and trustees of this my will. Gifts 3. I GIVE five thousand dollars ($ 5000) to each of the following who are alive at the time of my death, RANGI, MARY ROSE SCHALLER (“Mary Rose”) of Auckland, Feldenkreis Instructor, PHILIP HENRY CHRISTIAN (“Philip”) of Christchurch, University Lecturer, WILLIAM FRANCIS SCHALLER (“William”) of Devonport, Chief Petty officer (collectively “my children”) and to my foster child ANTHONY KRUCINSKI (“Anthony”) of Hamilton, Electricians apprentice. This gift is to be paid immediately after my death and to rank in priority to all other gifts made by this my will. 4. I GIVE the house and land situate at and known as 337 Onepoto Avenue, Little Shoal Bay (“the house”) to MARY ROSE. 5. I GIVE the bach and land situate at and known as 11 Crofters Lane, Akaroa, Banks Peninsula (“the bach”) in equal shares to PHILIP and WILLIAM. 6. I GIVE my Steinway concert grand piano (“the piano”) to RANGI, on the condition that he will only dispose of it by giving it to a professional orchestra, but if I do not own that piano at my death I give to him any such piano as I own at that time on the same condition. 7. I GIVE any such Porcelain figurines (“the figurines”) as I own at the time of my death to RANGI.

Gifts

3. 9. I GIVE any benefit payment (“the superannuation”) that comes from my NZSO pension fund to RANGI.

Residue

10. I DIRECT my trustees to hold the rest of my estate on trust to pay my debts, funeral and graveyard expenses, my executors’ administration fees expenses and any taxes on my estate.My trustees will DIVIDE the residue (“my residuary estate”) equally between MY CHILDREN. If any of MY CHILDREN dies before me, their share of my residuary estate is to be shared equally between their children (“the grandchildren”).

Cremation direction

11. I DIRECT that my body be cremated and the ashes buried beneath the Morton Bay fig tree at the bach in Akaroa.

Trustee Powers

12. My trustees will have these powers:

12.1 My trustees may retain any investments which I own at my death, even if they are not investments which could properly be made by my trustee. My trustees will not be liable for any loss caused by their retention.

12.2 My trustees may let any part of my estate on such terms and conditions as my trustees think desirable. My trustees may also manage any leases and tenancies in my estate and accept surrenders of them.

12.3 My trustees may sell all or part of my estate in the manner and on the terms my trustees choose, including a term allowing all or part of the purchase price to remain owing on mortgage. My trustees may also grant options and rights of first refusal in respect of all or part of my estate.

12.4 My trustees may purchase, as an asset of my estate, any property which my trustees consider may benefit my estate or any of my beneficiaries.
