Agenda Note

Appointment of three Information Commissioners in the Central Information Commission.

Rule Position

1. As per section 12 (2) of the Act, the Central Information Commission shall consist of

the Chief Information Commissioner and such number of Central Information Commissioners,

not exceeding ten, as may be deemed necessary. At present, the Central Information

Commission has Chief Information Commissioner and 7(seven) Information Commissioners.

2. Section 12 (3) of the Act stipulates that the Chief Information Commissioner end the

Information Commissioners shall be appointed by the President on the recommendation of a

Committee consisting of the following:-

(i) the PrimeMinister who shall be the Chairman of the Committee,

(ii) the Leader of the Opposition in the LokSabha, and

(iii) a Union Cabinet Minister to be nominated by the Prime Minister.

The Act further explains that for the purpose of removal of doubts, it is hereby declared

that where the Leader of the Opposition in the House of the People has not been recognized

as such, the Leader of the single largest group in opposition of the Government in the House

of the People shall be deemed to be the Leader of Opposition.

3. As per Section 12(5) of the RTIAct, 2005, the Chief Information Commissioner and

Information Commissioners shall be persons of eminence in public life with wide knowledge

and experience in "law, science and technology, social service, management, journalism,

mass media or administration and governance."

Legal Position

4. Section 12(6) of the RTI Act, 2005 mandates that "The Chief Information

Commissioner or an Information Commissioner shall not be a Member of Parliament or

Member of the Legislatureof any State or Union territory, as the case may be, or hold any

other office of profit or connected with any political party or carrying on any businessor

pursuingany profession."

5. As per the past policy, the Chief Information Commissioner/Information Commissioners

are selected through the process of advertisement, short listing by Search Committee and

recommendations of Committee chaired by PrimeMinisterand thereafter appointed by the

President.

6. It is pertinent to mention that in a Review Petition filed by Union of India against

Hon'ble Supreme Court judgement dated 13.09.2012 in Namit Sharma case, the Hon'ble

SupremeCourt vide itsjudgement dated 03.09.2013,inter-alia, gave the following directions:-

(i) We direct that only persons of eminence in public life with wide knowledge and

experience in the fields mentioned in Sections 12 (5) and 15 (5) of the Act be

considered for appointment as Information Commissioner and Chief Information

Commissioner.

(ii) We further direct that persons of eminence in public life with wide knowledge and

experience in all the fields mentioned in Section 12 (5) and 15 (5) of the Act,

namely, law, science and technology, social service, management, journalism,

mass media or administration and governance, be considered by the Committee

under Sections 12 (3) and 15 (3) of the Act for appointment as Chief Information

Commissioner or Information Commissioners.

(iii) We further direct that the Committees under Section 12 (3) and 15 (3) of the Act

while making recommendations to the President or to the Governor, as the case

may be, for appointment of Chief Information Commissioner and Information

Commissioners must mention against the name of each candidate recommended,

the facts to indicate his eminence in public life, his knowledge in the particular field

and his experience in the particular field and these facts must be accessible to the

citizens as part of their right to information under the Act after the appointment is

made.

Background

7. In February 2014, the Govt. of India decided to fill up two posts of Information

Commissionersin the CIC. At that time, the CIC had Chief Information Commissionerand 08

Information Commissioners.

8. On 25.02.2014,DoPT invited applications from interested persons for the post of

Information Commissionersin the CIC, the last date for receipt of applications was 25.03.2014.

In responseto thiscircular a total number of 293applications were received.

9. The process of appointment of Information Commissionerswas started but before the

Selection Committee could meet, one of the Information Commissioners,Shri Rajiv Mathur

was elevated to the post of CIC on 22.05.2014 making the strength of Information

Commissionersseven.

10. A fresh advertisement was issuedon 16.07.2014.It was mentioned that those who had

applied against advertisement issuedon 25.2.2014need not apply afresh. In response to the

circular dated 16.7.2014,260 applications were received. Thusa total of 553 applications

were received for the post of Information Commissioners in response to advertisements

published on 25.2.2014and 16.7.2014.

11. Accordingly, all these 553 applications were broadly categorised into 7 categories

of knowledge and experience, as mentioned above. Few applications which did not fall

within those 7 categories, had been mentioned in "others" category.

Detailsof 553applications isat Annexure - I. However, for the sake of categorisation, only the

main field of knowledge and experience were mentioned, while the additional fields of

knowledge and experience, if any, were not indicated. Tabulated details on the basisof such

12. The Government had approved constitution of Search Committee for shortlisting a

panel of names for the post of Information Commissioners and Chief Information

Commissionerin Central Information Commissionas under:-

(i) Cabinet Secretary Chairman

(ii) Addl Principal Secretary to PM Member

(iii) Secretary (Personnel) Member

(iv) Home Secretary Member

(v) Secretary D/o Expenditure Member

(vi) ProfessorRameshChand Member

Director National Center for Agricultural Economics and Policy (NCAP)

13. In the meanwhile, Shri Rajiv Mathur completed his tenure as Chief Information

Commissioner and demitted the office on 22.8.2014.TheCentral Information Commission on

23.8.2014 was without a Chief Information Commissioner and had seven Information

Commissioners.

14. Applications were invited from interested personsto fill up the post of Chief Information

Commissioner through advertisement on 24.10.2014.A total of 203 applications were

received by the last date i.e. 24.11.2014.

15. On 6th April. 2015,a writ Petition(C) 3386was filed by R.K.Jain & ors.VIs Unionof India

before HighCourt of Delhi regarding delay in appointment of Chief Information Commissioner

and Information Commissioner.The case was heard on 9.4.2015, 11.5.2015and 21.5.2015.

Hon'ble Court on 21.05.2015was informed that appointments are at advance stage of

finalization, however, Hon'ble Court reserved itsjudgment.

16. The 553applications for the post of Information Commissionersagainst advertisements

dated 25.2.2014 and 16.7.2014and 203 applications for the post of Chief Information

Commissioneragainst the advertisement dated 24.10.2014were considered by the Search

Committee in its meetings on 16.1.2015,6.2.2015, 27.4.2015 and 14.5.2015.The Search

Committee prepared a panel of three applicants for the post of Chief Information

Commissionerand a panel of nine applicants for three posts of Information Commissioners.

Thesepanels were to be considered by the Selection Committee. TheSelection Committee

met on 23.5.2015and 1.6.2015,considered the panels suggested by Search Committee and

selected Shri Vijai Sharma, the then IC as Chief Information Commissioner and ShriSudhir

Bhargava as IC.Theywere appointed on 10.6.2015and 11.6.2015respectively. Thestrength of

Central Information Commissionon 12.6.2015was - one Chief Information Commissionerand

seven Information Commissioners.

17. The tenure of ShriVijai Sharma, Chief Information Commissionerwas upto 1.12.2015.It

was decided in September 2015, to start the process of appointment of new Chief

Information Commissioner and more (upto 3) Information Commissioners in the Central

Information Commission, through the prevailing policy of advertisement, shortlisting.

Accordingly, a combined advertisement inviting applications for the post of Chief Information

Commissionerand more (upto three) Information Commissionerswas published on 9.9.2015.

The lastdate for receiving the applications was 12.10.2015.

18. A total of 341 applications (including Chief Information Commissioner) were received.

330 applications were received for the post Information Commissioners. A detailed list of 330

applications may be seen at Annexure - II.

19. The Government, in the meanwhile, for the current round of selection, approved

constitution of Search Committee for short-listinga panel of names for the post of Information

Commissionersand Chief Information Commission in Central Information Commission as

20. On 24.09.2015, Hon'ble Delhi High Court re-notified the case W.P. No. 3386/2015 and

directed on 6.11.2015 as under:-

(i) The selection process that has already been commenced vide Notifications dated

25.02.2014 and 16.07.2014 shall be finalized within six weeks from today and the three

vacancies of Information Commissioners existing as of today shall be filled up amongst

the 553 applications that were received in response to the said two notifications.

(ii) Theselection process pursuant to the Circular dated 09.09.2015shall be confined for

selection and appointment of the Chief Information Commissionerin the vacancy that

would arisew.eJ. 02.12.2015and one Information Commissionerwhich is likely to arise

w.eJ.02.12.2015.

21. The Unionof India decided to challenge the order of Court on point (i) of para 24and

comply with point (ii) of the said para. Accordingly, the Search Committee consisting of

following met on 10.11.2015and 16.11.2015and shortlistedthree names for the post of Chief

Information Commissionerand sixnames for the post of Information Commissionerwhich was

likelyto arisew.eJ. 2.12.2015.

22. In response to notification dated 9.9.2015and in pursuance of direction of Hon'ble

High Court, the Govt. of India appointed ShriR.K.Mathur as Chief Information Commissioner

on 4.1.2016.

Supreme Court Directions

23. As regards, selection of ICs,pursuant to decision of Hon'ble High Court, the Govt.

had challenged the verdict of HighCourt, Delhi by way of SLPNo. 34495/2015in the Supreme

Court. The case was heard on 8.1.2016.TheHon'ble Supreme Court ordered (formal order yet

to be received) as under:

(i) To fill up three posts of Information Commissioners in the Central Information

Commissionwithin sixweeks.

(ii) Three Information Commissionersto be selected from the personswho had applied

against advertisementsdated 25.2.2014,16.7.2014(553applications) and 9.9.2015(330

applications) i.e. a total of 883applications.

Selection of Information Commissioners

24. As per the directions of Hon'ble SupremeCourt, three Information Commissionersare

to be appointed from amongst the applicants who applied against three advertisements

dated 25.2.2014,16.7.2014(553applications) and 9.9.2015(330applications). 83 applicants

are common in two setsof applications.

The Search Committee was informed that Shri Sunil Arora hassought to recuse himself.

2. The Search Committee was informed that as per Section 12(2)(b) ofthe RTI Act, the Central Information Commission shall consist of suchnumber of Information Commissioners (ICs), not exceeding ten, as may bedeemed necessary. At present there is one CIC and seven ICs in theCentral Information Commission (a list of the existing ICs is at Annexure­I). The Committee took note of the provisions of Section 12(5) of the RTIAct that the CIC and IC shall be persons of eminence in public life withwide knowledge and experience in law, science and technology, socialservice, management, journalism, mass media or administration andgovernance.

3. The Committee was informed that during the last round of selectionofIC, Shri Sudhir Bhargava was appointed on 11.6.2015 after considering553 applications received against advertisements dated 25.02.2014 and16.07.2014.

4. The Committee was informed that Circular No. 4/2/2015-IR dated09.09.2015 seeking applications from interested persons for the posts ofCIC and ICs was posted on the website of Department of Personnel andTraining (DoPT) and adveiiisement was published in The Hindu, Times of

~. The Committee was further informed that High Court of Delhi vide itsJudgmentdated 06.11.2015 had given the following directions:

(i) The, .se/~ction process that has already been commenced videNotlticeiions dated 25.02.2014 and 16.07.2014 shall be finalizedwithin six weeks from today and the three vacancies of InformationCommissioners existing as of today shall be filled up amongst the553 applications that were received in response to the said twonotifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015shall be confined for selection and appointment of the ChiefInformation Commissioner in the vacancy that would arise w.e.f.02.12.2015 and one Information Commissioner which is likely toarise w.e.f. 02.12.2015.

6. The Committee had accordingly proposed a panel of names for thepost of CIC and IC in its meetings dated 10.11.2015 and 16.11.2015. Thepanel for IC was to be utilized in case Shri Basant Seth was recommendedfor the post of CIC by the Selection Committee. The Selection Committeerecommended Shri R.K.Mathur for the post of CIC and hence the panel forthe post of IC was not utilized.

7. The Committee was informed that the Union of India challenged theorder of High Court on point (i) of para 6 by way of SLP No. 34495/2015wherein the Supreme Court passed an order on 08.01.2016. Though copyof the order is not available online, Attorney General who was present inthe Court has informed that the operative portion of the order is as under:

(i) To fill up three posts of Information Commissioners in the CentralInformation Commission within six weeks.

(ii) Three Information Commissioners to be selected from the personswho had applied against advertisements dated 25.02.2014,16.07.2014 (553 applications) and 09.09.2015 (330 applications).

1. Introduction

Section 12(2) of the Right to Information Act, 2005, mandates

constitution of a Central Information Commission consisting of the Chief

Information Commissioner (CIC) and such number of Information

Commissioners (ICs) not exceeding ten, as may be deemed necessary. The

Commission adjudicates appeals and complaints under the RTIAct. At

present, the Central Information Commission has Chief Information

Commissioner and seven Information Commissioners.The current constitution

of the CIC isat Annexure-'J'.

2. Rule and Legal position

2.1 The Rule position with respect to qualification, tenure etc. of Information

Commissioner isat Annexure - 'II'.

2.2 Constitution of the Committee

Section 12 (3) of the Act stipulates that the Chief Information

Commissioner and the Information Commissionersshall be appointed by the

President on the recommendation of a Committee which has been

constituted with the following composition:

I. The PrimeMinisterwho shall be the Chairman of the committee,

II. Leader of single Larg~stParty in opposition in LokSabha (ShriMallikarjun

Kharge, INC).

III. Union Cabinet Minister to be nominated by the Prime Minister i.e. Shri

Arun Jaitley (UnionFinanceMinister).

2.3 Hon'ble Supreme Court in its judgment dated 03.09.2013in a Review

Petition filed by Union of India against Hon'ble Supreme Court judgment

dated 13.09.2012in Namit Sharma case gave certain directions for making

appointments to the post of Chief Information Commissionerand Information

Commissioners.The operative part of the judgment is placed at Annexure­

'III'. Forthe sake of emphasis, some of the directions are mentioned below:

(i) We further direct that persons of eminence in public life with wide

knowledge and experience in all the fields mentioned in Sections

12(5) and 15(5) of the Act, namely, law, .science and technology,

social service, management, journalism, mass media or

administration and governance, be considered by the Committees

under Sections 12(3)and 15(3)of the Act for appointment as Chief

Information Commissioneror Information Commissioners.

(ii) We further direct that the Committees under Sections 12(3) and

15(3)of the Act while making recommendations to the Presidentor

to the Governor, as the case may be, for appointment of Chief

Information Commissioner and Information Commissioners must

mention against the name of each candidate recommended, the

facts to indicate his eminence in public life, his knowledge in the

particular field and his experience in the particular field and these

facts must be accessible to the citizens as part of their right to

information under the Act after the appointment ismade.

3 Search Procedure

Background of the case

3.1 It is pertinent to note that the process for selection of Information

Commissioners was initiated on 17.02.2014, with inviting applications

through advertisements dated 25.2.2014 and 16.7.2014. A totai of 553

applications were received and the details are at Annexure IV.

3.2 A writ Petition(C) 3386was filed by R.K.Jain & ors.vis Union of India in

Public Interest under Article 226 of the Constitution of India before Hon'ble

High Court of Delhi regarding delay in appointment of Chief Information

Commissioner and Information Commissioners in the Central Information

Commission. After hearing both the sides on 21.5.2015, the Hon'ble Court

reserved the matter for orders. Meanwhile, the selection committee decided

to fill only one post of Information Commissioner in addition to the Chief

Information Commissioner. Accordingly, based on the Committee's

recommendations, Shri Vijai Sharma was appointed as Chief Information

Commissioner on 10.06.2015 and Shri Sudhir Bhargava as Information

Commissioneron 11.06.2015.

3.3 A Circular dated 9.9.2015seeking applications from interested persons

for the post of Chief Information Commissioner and Information

Commissioners in the Central Information Commission was posted on the

website of DoPT on 9.9.2015 after approval of the competent authority.

Advertisement was also published in The Hindu and Timesof India in English,

Dainik Bhaskarand Hindustan in Hindi in all its edition in India on 9.9.2015.The

last date of receiving applications was 12.10.2015.

3.4 A total of 341 applications [11 for CIC, 157for IC and 173for both posts

of CIC and IC] had been received by the last date. The number of

applications for IC comes to 330 (157+173)and the details of applicants can

be seen at Annexure V. Sixapplications were received after the last date and

were not considered, the details of which are in Annexure VI.

3.5 Meanwhile, the above-mentioned case was re-notified for hearing on

09.10.2015.After hearing the arguments, the Hon'ble Court had pronounced

its order on 06.11.2015 In WP(C) 3386 (Annexure-VII) and gave following

directions:

(i) The selection process that had commenced vide Notifications

dated 25.02.2014and 16.07.2014shall be finalized within six weeks

from today and the three vacancies of Information Commissioners

existing as of today shall be filled up from amongst the 553

applications that were received in response to the said two

notifications.

(ii) The selection process pursuant to the circular dated 09.09.2015

shall be confined for selection and appointment of the Chief

Information Commissioner in the vacancy that would arise w.e.f.

02.12.2015and one Information Commissionerwhich is likely to arise

w.e.f.02.12.2015.

3.6 The Union of India decided to challenge the order of the Court on

point (i) of para 3.5 and to comply with point (ii) of the said para.

4. Search Committee and shortlisting of candidates

4.1 PrimeMinister on 26.10.2015had approved re-constitution of a Search

Committee for the present round of selection process, as given below:-

(i) Cabinet Secretary Chairman

(ii) Additional Principal Secretary to PrimeMinister Member

(iii) Secretary (Personnel) Member

(iv) Secretary (I&B) Member

4.2 Accordingly, the Search Committee consisting of the above met on

10.11.2015and 16.11.2015and shortlisted three names for the post of Chief

Information Commissioner and six names for the post of Information

Commissioner. The six names for IC were to be utilized in case the name of

any existing Information Commissionerswas recommended by the Selection

Committee for the post of Chief Information Commissioner.

4.3 In response to the notification dated 9.9.2015 and in pursuance of

direction of Hon'ble High Court, the selection committee chaired by Prime

Minister met on 11.12.2015 and 16.12.2015. Consequent to the

recommendations of the selection committee, Government of India

appointed ShriR.K.Mathur as Chief Information Commissioner on 04.01.2016.

Supreme Court Directions

5 As regards selection of ICs pursuant to decision of Hon'ble High Court,

(as mentioned in para 3.6 of pre-page) the Government had challenged the

verdict of Hon'ble High Court, Delhi by way of SLPNo. 34495/2015 in the

Hon'ble Supreme Court. The case was heard on 08.01.2016. The certified

copy of the order of Hon'ble Supreme Court is not yet received. However, Ld.

Attorney General, who appeared for Union of India, vide communication

dated 19.01.2016has informed as under:

"The Hon'ble Supreme Court has directed that the three posts of Information

Commissioners,currently vacant, to be filled up within sixweeks. Thecourt has

further allowed the Government to fill up the vacancies from the applicants,

who applied under the two advertisements of 2014as also the advertisement

of September, 2015."

The qualification, tenure etc of Chief Information Commissioner and InformationCommissioner.

1. Section 12(3)of the RTIAct;- TheChief InformationCommissionerand theInformation Commissioners are appointed by the President on therecommendation of a Committee consistingof -i. ThePrimeMinister;ii. TheLeader of Oppositionin LokSabha ; andiii. A UnionCabinet Ministerto be nominated by the PrimeMinister

Exp/anation.-For the purposes of removal of doubts, it is hereby declared thatwhere the Leader of Opposition in the House of the People has not beenrecognised as such, the Leader of the single largest group in opposition of theGovernment in the House of the People shall be deemed to be the Leader ofOpposition.

Ministry of Law and Justice has opined that in the absence of Leader ofopposition, the Leader of the single largest party in opposition can beconsidered as the leader of the single largest group in opposition, only for thelimited purpose of RTf Act.

The Prime Minister on 28.8.2015 has nominated Shri Arun Jaitley, UnionFinance Minister as the Member of the Selection Committee under Section 12(3)of the RTf Act.

2. Section 12 (5) of the RTIAct;- The Chief Information CommissionerandInformation Commissionersshall be personsof eminence in public life with wideknowledge and experience in law, science and technology, social service,management, journalism,massmedia or administrationand governance.

3. Section 12(6) of the RTIAct;- The Chief Information CommissionerandInformation Commissionershall not be a Member of Parliament or Member ofLegislatureof any state or Union Territoryor hold any other office of profit orconnected with any political party or carrying on any businessor pursuinganyprofession.

4. Section 13(1) of the RTIAct;- The Chief Information Commissioner shallhold office for a term of five years from the date on which he enters upon hisoffice and shall not be eligible for reappointment: Provided that no ChiefInformation Commissioner shall hold office as such after he has attained the ageof sixty-five years.

5. Section 13 (2) of the RTIAct;- Every Information Commissioner shall holdoffice for a term of five years from the date on which he enters upon his office ortill he attains the age of 65 years, whichever is earlier, and shall not be eligiblefor reappointment as such Information Commissioner:

Provided that every Information Commissioner shall, on vacating his officeunder this sub-section be eligible for appointment as the Chief InformationCommissioner in the manner specified in sub-section (3) of section 12:

Provided further that where the Information Commissioner is appointed asthe Chief Information Commissioner, his term of office shall not be more thanfive years in aggregate as the Information Commissioner and the ChiefInformation Commissioner.

Annexure -III

Operative part in the Judgement dated 3.9.2013 of Hon'ble Supreme Court in theReview Petition CCl No. 2309 of 2012 in the case of Union of India Vs Namit Sharma

(i) We declare that Sections 12(5) and 15(5) of the Act are not ultra vires theConstitution.

(ii) We declare that Sections 12(6)and 15(6)of the Act do not debar a Member ofParliamentor Member of the Legislatureof any State or UnionTerritory,as the case maybe, or a person holding any other office of profit or connected with any political partyor carrying on any businessor pursuing any profession from being considered forappointment as Chief Information Commissioneror Information Commissioner,but aftersuch person is appointed as Chief Information Commissioner or InformationCommissioner, he has to discontinue as Member of Parliament or Member of theLegislatureof any State or Union Territory,or discontinue to hold any other office ofprofit or remain connected with any political party or carry on any businessor pursueany professionduring the period he functions as Chief Information CommissionerorInformation Commissioner.

(iii) We direct that only personsof eminence in public life with wide knowledge andexperience in the fieldsmentioned in Sections12(5)and 15(5)of the Act be consideredfor appointment as'InformationCommissionerand Chief InformationCommissioner.

(iv)We further direct that personsof eminence in public life with wide knowledge andexperience in all the fields mentioned in Sections 12(5)and 15(5)of the Act, namely,law, science and technology, social service, management, journalism,massmedia oradministration and governance, be considered by the Committees under Sections12(3) and 15(3) of the Act for appointment as Chief Information Commissioner orInformation Commissioners.

(v) We further direct that the Committees under Sections 12(3)and 15(3) of the Actwhile making recommendations to the Presidentor to the Governor, as the case maybe, for appointment of Chief Information Commissionerand InformationCommissionersmust mention against the name of each candidate recommended, the facts toindicate his eminence in public life, his knowledge in the particular field and hisexperience in the particular field and these facts must be accessible to the citizensaspart of their right to information under the Act after the appointment ismade.

(vi) We also direct that wherever Chief Information Commissionerisof the opinion thatintricate questionsof law will have to be decided in a matter coming up before theInformation Commission, he will ensure that the matter is heard by an InformationCommissionerwho haswide knowledge and experience in the field of law.

1. This petition as a Public Interest Litigation, is filed alleging inaction

on the part of the respondents in filling up the vacancies of Chief

Information Commissioner and three Information Commissioners in the

Central Information Commission and contending that the same has

frustrated the very object of the Right to Information Act, 2005 (for short

'RTI Act').

2. We have heard the learned counsel for both the parties.

3. As per Section 12 of the RTI Act which provides for constitution of

Central Information Commission, the Central Information Commission shall

consist of the Chief Information Commissioner and such number of Central

Information Commissioners not exceeding 10 as may be deemed necessary.

4. As against the total sanctioned strength of Information

Commissioners of 10, by the date of filing of the petition on 06.04.2015,

three posts were lying vacant for the past one year in addition to the post of

Chief Information Commissioner which was lying vacant since 23.08.2014.

5. It is explained by the Under Secretary, Department of Personnel and

Training, Government of India in his affidavit dated 09.04.2015 that an

advertisement was published on 28.02.2014 in two English newspapers and

one Hindi newspaper inviting applications for filling up two posts of

Information Commissioners that were lying vacant by that time and in

response to the same, 293 applications were received. The Search

Committee which met on 21.04.2014 considered the applications and

recommended panels for consideration of the Selection Committee

constituted under Section 12(3) of the RTI Act. Even before the Selection

Committee could meet, one of the Central Information Commissioners

(Shri Rajeev Mathur) was elevated to the post of Chief Information

Commissioner on 22.05.2014 and thus one more vacancy of the Central

Information Commissioner arose. Therefore, a fresh advertisement was

issued on 16.07.2014 inviting applications making it clear that those who

have applied earlier in response to the earlier advertisement need not apply

afresh. In pursuance thereof, 260 fresh applications were received by the

last date i.e. 19.08.2014. Thus, the total applications received were 553

(293+260). While so, the tenure of the Chief Information Commissioner

(Shri Rajeev Mathur) expired on 22.08.2014 and thus the post of CIC also

fell vacant. On 24.10.2014, a Circular was posted on the website of

Department of Personnel and Training inviting applications for the post of

CIC and in response to the same a total number of 203 applications were

received. It was further stated that the Search Committee met twice on

16.01.2015 and 06.02.2015 to shortlist the applicants for the Chief

Information Commissioner and Information Commissioners respectively

and that the selection would be made by the Selection Committee as

provided under Section 12(3) of the RTI Act after the IBICBI inputs and

Vigilance Clearances were received.

6. Having taken note of the contents of the said affidavit, we passed the

following order on 09.04.2015:

"In pursuance of the order passed by us on 08.04.2015, adetailed affidavit has been filed by the Under Secretary,Department of Personnel & Training explaining the steps thathave already been taken for filling up the vacancies of the postsof the Chief Information Commissioner and the 3 CentralInformation Commissioners and assuring that the entire processof selection and appointment would be completedexpeditiously.

We have heard the learned counsel for both the parties.Having regard to the undisputed fact that the non-appointmentof the Chief Information Commissioner has virtually frustratedthe very purpose of the Right to Information Act, 2005, we areof the view that it is necessary for this court to monitor the stepsthat are being taken for filling up the vacancies in question soas to ensure that all the vacancies are filled up within atimeframe.

Therefore, let the petition be listed on 11.05.2015 bywhich date the respondents shall report to this court theprogress made.

Since it is pointed out by the learned ASG that therespondent has been wrongly described in the memo of partiesand that as a matter of fact the Union of India is represented bythe Department of Personnel & Training, the respondent in thememo of parties shall stand substituted as under:-

'Union of India through the Department of Personnel &Training, Ministry of Personnel, Public Grievances &Pensions, North Block, New Delhi'.

The amended memo of parties be filed by the petitionerwithin one week from today."

7. When the petition was listed again on 21.05.2015, a status note on

behalf of the Respondent - Union of India (DoPT) has been filed stating that

the process of appointment of the Chief Information Commissioner and

Information Commissioners is at an advanced stage and that the Search

Committee met on 27.04.2015 and shortlisted the applicants. It is also

stated that the selection would be made soon after the vigilance clearance

from the respective Cadre Controlling Authority in respect of shortlisted

serving officers and inputs from the Intelligence Bureau in respect of retired

officers is received. In the circumstances, it was submitted by Shri Sanjay

Jain, the learned ASG that no further orders are necessary in the petition.

However, Shri Prashant Bhushan, the learned counsel appearing for the

petitioner submitted that it is necessary to issue directions to complete the

selection process within a time schedule in view of the fact that more than

35,000 cases are pending in the Central Information Commission as of

today.

8. After we have reserved the judgment on 21.05.2015, the petitioners

filed a fresh application being CM No.20965/2015 bringing to the notice of

this court that on 08.06.2015 the senior most Information Commissioner by

name Shri Vijay Sharma was appointed as the Chief Information

Commissioner and in the vacancy arose, Shri Sudhir Bhargava was

appointed as the Information Commissioner. While pointing out that the

three vacancies of Information Commissioners have not been filled up so

far, it is further stated that the Department of P&T has issued a fresh

Circular dated 09.09.2015 inviting applications for the post of Chief

Information Commissioner and the Information Commissioners.

Contending that the said Circular dated 09.09.2015 is nothing but an attempt

to delay the entire process of appointment of the Information

Commissioners against the existing 3 vacancies, the petitioners sought a

direction to forthwith appoint the remaining three Information

Commissioners in CIC and to set aside the Circular dated 09.09.2015.

9. The learned counsel for the petitioners Shri Prashant Bhushan

submitted that the Circular dated 09.09.2015 is bad firstly for the reason that

despite the pendency of the present writ petition, the respondent failed to

take the leave of this court to put up a fresh Circular inviting applications

and secondly there is no reason to terminate the process of selection that was

already initiated on 25.02.2014. It is also contended that the Circular dated

09.09.2015 is absolutely vague and did not even disclose the number of

vacancies intended to be filled up.

10. The Circular dated 09.09.2015 issued by the Department of Personnel

and Training reads as under:

2. It is proposed to appoint Chief InformationCommissioner and more Information Commissioners in theCommission. The Act provides that the Chief InformationCommissioner and Information Commissioner shall be personof eminence inpublic life with wide knowledge and experiencein law, science and technology, social service, management,journalism, mass-media or administration and governance.

3. Further, the Chief Information Commissioner andInformation Commissioner shall not be a Member ofParliament or Member of the Legislature of any State or UnionTerritory, as the case may be, or hold any other office of profitor connected with any political party or carrying on anybusiness or pursuing any profession. It is clarified thatcessation/termination of holding of office of profit, pursuingany profession or carrying any business is a condition precedentto the appointment of a person as Chief InformationCommissioner and Information Commissioner.

4. The Chief Information Commissioner and InformationCommissioner shall hold office for a term of five years from thedate on which he enters upon his office or till he attains the ageof 65 years, whichever is earlier. The salary and allowancespayable to the Chief Information Commissioner shall be thesame as that of the Chief Election Commissioner and ElectionCommissioner respectively, subject to adjustment of thepensionary/retirement benefits availed by him, if any, inaccordance with the provisions of the Act.

5. Persons fulfilling the criteria and interested forappointment to the post of Chief Information Commissionerand/or Information Commissioner may send their particulars inthe enclosed proforma by post to Under Secretary CRTI),Department of Personnel and Training, North Block, NewDelhi or through e-mail to [email protected] by lih October,2015. 11. Having perused the Circular dated 09.09.2015, we found that it is

absolutely silent about the process of selection that was already initiated

vide Notifications dated 25.02.2014 and 16.07.2014. It also does not

disclose the number of vacancies that are sought to be filled up. In the status

note dated 07.05.2015 filed by the Department of Personnel and Training, it

was stated that in response to the earlier advertisements, altogether 553

applications were received. It was also stated that the said applicants were

already shortlisted and vide communication dated 05.05.2015 and

02.05.2015, the vigilance clearance was sought from the respective Cadre

Controlling Authority in respect of shortlisted serving officers and inputs

from the Intelligence Bureau in respect of retired officers. We have taken

note of the fact that during the pendency of the writ petition, the vacancy of

Chief Information Commissioner has been filled up and one Information

Commissioner has been appointed in the fresh vacancy that arose. That

being so, we are unable to understand as to why the Respondents have again

issued a fresh notification dated 09.09.2015.

12. However, the list of the Chief Information Commissioner and the

Information Commissioners holding office as of today, furnished by the

learned Standing Counsel for Central Government, reflects that the tenure of

one of the Information Commissioners out of seven would expire on

31.12.2016 and the others have a long tenure of more than two years. As is

evident, there is no likelihood of any vacancy of Information Commissioner

in near future. However, the Chief Information Commissioner's tenure will

be completed on 01.12.2015. In case one of the serving Information

Commissioners is appointed as the Chief Information Commissioner in the

vacancy that would arise w.e.f. 02.12.2015, one more vacancy of the

Information Commissioner is likely to arise.

13. In these circumstances, instead of setting aside the Notification dated

09.09.2015, we consider it appropriate to issue the following directions:

(i) The selection process that has already been commenced vide

Notifications dated 25.02.2014 and 16.07.2014 shall be

finalized within six weeks from today and the three vacancies

of Information Commissioners existing as of today shall be

filled up amongst the 553 applications that were received in

response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015

shall be confined for selection and appointment of the Chief

Information Commissioner in the vacancy that would arise

w.e.f. 02.12.2015 and one Information Commissioner which is

likely to arise w.e.f. 02.12.2015.

14. The writ petition is accordingly disposed of.

The Committee constituted under Section 12 (3) of the Right to InformationAct, 2005 met under the Chairmanship of the Prime Minister of India at 4.00 pm on11.12.2015 and then at 5.00 pm on 16.12.2015 in Room No 10 Parliament House,New Delhi to make recommendation for appointment of Chief InformationCommissioner in the CIC.

The meeting was attended by the following:

Shri Narendra Modi, Prime Minister, ChairmanShri Mallikarjun Kharge, Leader of Indian National Congress, the singielargest party in Opposition in Lok Sabha, MemberShri Arun Jaitley, Finance Minister, Member(iii)

Dr. Jitendra Singh, Minister of State, Ministry of Personnel, Pubiic Grievancesand Pensions, and Shri Sanjay Kothari, Secretary (Personnel) also attended themeeting and assisted the Committee.

2. The Committee was apprised that there could be a maximum of ten InformationCommissioners in the Central Information Commission. At present, there are sevenInformation Commissioners. There is no Chief Information Commissioner (CIC) as theprevious CIC has demitted office on 01.12.2015. The Committee was also apprisedthat the Chief Information Commissioner and Information Commissioner shall bepersons of eminence in public life with wide knowledge and experience in law, scienceand technology, social service, management, journalism, mass media oradministration and governance.

3. The Committee considered the directions of the Hon'ble Supreme Court in aReview Petition No. 2309/2012 filed by Union of India against Hon'ble Supreme Courtjudgement dated 13.9.2012 in the matter of Namit Sharma versus Union of India.

4. The Committee also considered the orders of Hon'ble High Court of Delhi issuedon 06.11.2015 and the opinion of Ld. Attorney General for India in the matter of WP(C)3386 filed by R.K. Jain & ors. versus Union of India. The operative parts of the abovementioned order as given in para 13 of the judgment are as fol!ows:

5. It was noted that consequent to the Notification dated 09.09.2015 there were184 applicants for Chief Information Commissioner and 330 applicants for InformationCommissioners. The Search Committee met on 10.11.2015 and 16.11.2015 andshortlisted names for Chief Information Commissioner and names of Information

Commissioner.

6. The Committee perused the detailed agenda including the process involved in thesearch procedure for short-listing the applicants for consideration. Notwithstanding theshort-listing done, the Committee considered all eligible applicants who applied inresponse to advertisement made on 09.09.2015 for the post of Chief Information

Commissioner.

7. The Committee decided that recommendations will be done while complyingwith para 13(ii) of the orders dated 06.11.2015 of hon'ble High Court in of WP(C) 3386filed by RK. Jain & ors. versus Union of India. Regarding para 13(i) of the order,appropriate action will be taken based on the outcome of the Special Leave Petition

filed in the matter.

8. After taking into account all the relevant factors, the Committee recommendedthe following for appointment as Chief Information Commissioner in the CentralInformation Commission:

The following Search Committee has been constituted with theapproval of Prime Minister vide order dated 26.10.2015:

The Search Committee was informed that Shri Sunil Arora hassought to recuse himself.

2. The Search Committee was informed that as per Section 12(2)(b) ofthe RTI Act, the Central Information Commission shall consist of suchnumber of Information Commissioners (ICs), not exceeding ten, as may bedeemed necessary. At present there is one CIC and seven ICs in the.Central Information Commission (a list of the existing ICs is at Annexure­I). The Committee took note of the provisions of Section 12(5) of the RTIAct that the CIC and IC shall be persons of eminence in public life withwide knowledge and experience in law, science and technology, socialservice, management, journalism, mass media or administration andgovernance.

3. The Committee was informed that during the last round of selection ofIC, Shri Sudhir Bhargava was appointed on 11.6.2015 after considering553 applications received against advertisements dated 25.02.2014 and16.07.2014.

4. The Committee was informed that Circular No. 4/2/2015-IR dated09.09.2015 seeking applications from interested persons for the posts ofCIC and ICs was posted on the website of Department of Personnel andTraining (DoPT) and advertisement was published in The Hindu, Times of

India (English) and Oainik Bhaskar and Hindustan (Hindi) in all their=diticns in India on 09.09.2015. The last date for receipt of applications was12.10.2015. A total of 330 applications had been received by the last datefor the post of ICs. The Committee was also informed that 83 applicationsare common to the advertisement dated 09.09.2015 and the earlier

advertisements dated 25.02.2014 and 16.07.2014.

5. The Committee was further informed that High Court of Delhi vide itsjudgment dated 06.11.2015 had given the following directions:

(i) _The selection process that has already been commenced videNotifications dated 25. 02.2014 and 16.07.2014 shall be finalizedwithin six weeks from today and the three vacancies of InformationCommissioners existing as of today shall be filled up amongst the553 applications that were received in response to the said twonotifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015shall be confined for selection and appointment of the ChiefInformation Commissioner in the vacancy that would arise w.e.f.02.12.2015 and one Information Commissioner vl'hich is likely toarise w.e.i. 02.12.2015.

6. The Committee had accordingly proposed a panel of names for thepost of CIC and Ie in its meetings dated 10.11.2015 and 16.11.2015. Thepanel for IC was to be utilized in case Shri Basant Seth was recommended.for the post of CIC by the Selection Committee. The Selection Committee. recommended Shri R.K.Mathur for the post of CIC and hence the panel forthe post of IC was not utilized.

7. The Committee was informed that the Union of India challenged theorder of High Court on point (i) of para 6 by way of SLP No. 34495/2015wherein the Supreme Court passed an order on 08.01.2016. Though copyof the order is not available online, Attorney General who was present inthe Court has informed that the operative portion of the order is as under:

(i) To fill up three posts of Information Commissioners in the CentralInformation Commission within six weeks.

(ii) Three Information Commissioners to be selected from the personswho had applied against advertisements dated 25.02.2014,16.07.2014 (553 applications) and 09.09.2015 (330 applications).

8. With a view to shortlisting the candidates, the Committee deliberatedupon the eligibility and suitability of each candidate in terms of her/hisknowledge, eminence and experience in the categories mentioned inSection 12(5) of the RTI Act.

9. After scrutinizing all applications received against the above threeadvertisements and after detailed deliberations, the Committee shortlistedthe following applicants (in alphabetical order of surname) for three posts of

Commissioners, out of the candidates who had responded to the

notifications dated 25.2.2014, 16.7.2014 and 9.9.2015.

Prayer is allowed.

Needful be done within six weeks from today.

JUDGMENT

G.ROHINI, CHIEF JUSTICE

1. This petition as a Public Interest Litigation, is filed alleging inaction

on the part of the respondents in filling up the vacancies of Chief

Information Commissioner and three Information Commissioners in the

Central Information Commission and contending that the same has

frustrated the very object of the Right to Information Act, 2005 (for short

'RTI Act').

2. We have heard the learned counsel for both the parties .

3. As per Section 12 of the RTI Act which provides for constitution of

Central Information Commission, the Central Information Commission shall

consist of the Chief Information CommissioJer and such number of Central/

Information Commissioners not exceeding 10 as may be deemed necessary.

4. As against the total sanctioned strength of Information

Commissioners of 10, by the date of filing of the petition on 06.04.2015,

three posts were lying vacant for the past one year in addition to the post of

Chief Information Commissioner which was lying vacant since 23.08.2014.

5. It is explained by the Under Secretary, Department of Personnel and

Training, Government of India in his affidavit dated 09.04.2015 that an

advertisement was published on 28.02.2014 in two English newspapers and

one Hindi newspaper inviting applications for filling up two posts of

Information Commissioners that were lying vacant by that time and inIresponse to the same, 293 applications were received. The Search

Committee which met on 2l.04.2014 considered the applications and

recommended panels for consideration of the Selection Committee

constituted under Section 12(3) of the RTI Act. Even before the Selection

Committee could meet, one of the Central Information Commissioners

(Shri Rajeev Mathur) was elevated to the post of Chief Information

Commissioner on 22.05.2014 and thus one more vacancy of the Central

Information Commissioner arose. Therefore, a fresh advertisement was

issued on 16.07.2014 inviting applications making it clear that those who

have applied earlier in response to the earlier advertisement need not apply

afresh. In pursuance thereof, 260 fresh applications were received by the

last date i.e. 19.08.2014. Thus, the total applications received were 553

r: (293+260). While so, the tenure of the Chief Information Commissioner

(Shri Rajeev Mathur) expired on 22.08.2014 and thus the post of CIC also

fell vacant. On 24.10.2014, a Circular was posted on the website of

Department of Personnel and Training inviting applications for the post of

CIC and in response to the same a total number of 203 applications were

received. It was further stated that the Search Committee met twice on

16.01.2015 and 06.02.2015 to shortlist the applicants for the Chief

Information Commissioner and Information Commissioners respectively

and that the selection would be made by the Selection Committee as

provided under Section 12(3) of the RTI Act after the IB/CBI inputs and

Vigilance Clearanceswere received.

6. Having taken note of the contents of the said affidavit, we passed the

following order on 09.04.2015:

"In pursuance of the order passed by us on 08.04.2015, adetailed affidavit has been filed by the Under Secretary,Department of Personnel & Training explaining the steps thathave already been taken for filling up the vacancies of the postsof the Chief Information Commissioner and the 3 CentralInformation Commissioners and assuring that the entire processof selection and appointment would be completedexpeditiously.

We have heard the learned counsel for both the parties.Having regard to the undisputed fact that the non-appointmentof the Chief Information Commissioner has virtually frustratedthe very purpose of the Right to Information Act, 2005, we areof the view that it is necessary for this court to monitor the stepsthat are being taken for filling up the vacancies in question soas to ensure that all the vacancies are filled up within atimeframe.

Therefore, let the petition be listed on 11.05.2015 bywhich date the respondents shall report to this court theprogress made.

Since it is pointed out by the learned ASG that therespondent has been wrongly described in the memo of partiesand that as a matter of fact the Union of India is represented bythe Department of Personnel & Training, the respondent in the/memo of parties shall stand substituted as under:-

'Union of India through the Department of Personnel &Training, Ministry of Personnel, Public Grievances &Pensions, North Block, New Delhi'.

The amended memo of parties be filed by the petitionerwithin one week from today.":

7. When the petition was listed again on 21.05.2015, a status note on

behalf of the Respondent - Union of India (DoPT) has been filed stating that

the process of appointment of the Chief Information Commissioner and

Information Commissioners is at an advanced stage and that the Search

Committee met on 27.04.2015 and shortlisted the applicants. It is also

stated that the selection would be made soon after the vigilance clearance

from the respective Cadre Controlling Authority in respect of shortlisted

serving officers and inputs from the Intelligence Bureau in respect of retired

officers is received. In the circumstances, it was submitted by Shri Sanjay

Jain, the learned ASG that no further orders are necessary in the petition.

However, Shri Prashant Bhushan, the learned counsel appearing for the

petitioner submitted that it is necessary to issue directions to complete the

selection process within a time schedule in view of the fact that more than

35,000 cases are pending in the Central Information Commission as of

today.

8. After we have reserved the judgment on 21.05.2015, the petitioners

filed a fresh application being CM NO.20965l2015 bringing to the notice of

this court that on 08.06.2015 the senior most Information Commissioner by

name Shri Vijay Sharma was appointed as the Chief Information

Commissioner and in the vacancy arose, Shri Sudhir Bhargava was

appointed as the Information Commissioner. While pointing out that the

three vacancies of Information Commissioners have not been filled up so

far, it is further stated that the Department of P&T has issued a fresh

Circular dated 09.09.2015 inviting applications for the post of Chief

Information Commissioner and the Information Commissioners.

Contending that the said Circular dated 09.09.2015 is nothing but an attempt

to delay the entire process of appointment of the Information

Commissioners against the existing 3 vacancies, the petitioners sought a

direction to forthwith appoint the remammg three Information

Commissioners in CIC and to set aside the Circular dated 09.09.2015.

9. The learned counsel for the petitioners Shri Prashant Bhushan

submitted that the Circular dated 09.09.2015 is bad firstly for the reason that

despite the pendency of the present writ petition, the respondent failed to

take the leave of this court to put up a fresh Circular inviting applications

and secondly there is no reason to terminate the process of selection that was

already initiated on 25.02.2014. It is also contended that the Circular dated

09.09.2015 is absolutely vague and did not even disclose the number of

vacancies intended to be filled up.

10. The Circular dated 09.09.2015 issued by the Department of Personnel

and Training reads as under:

The Government of India has constituted a body underthe Right to Information Act, 2005 (the Act) known as the.Central Information Commission (Commission) to exercise thepowers conferred on and to perform the functions assigned to itunder the Act. It is located in New Delhi. The Commissionshall have the Chief Information Commissioner and upto tenInformation Commissioners. The powers and functions of theChief Information Commissioner in the Central InformationCommission are as per the RTI Act.

2. It is proposed to appoint Chief InformationCommissioner and more Information Commissioners in theCommission. The Act provides that the Chief InformationCommissioner and Information Commissioner shall be personof eminence in public life with wide knowledge and experiencein law, science and technology, social service, management,journalism, mass-media or administration and governance.

3. Further, the Chief Information Commissioner andInformation Commissioner' shall not be a Member ofParliament or Member of the Legislature of any State or UnionTerritory, as the case may be, or hold any other office of profitor connected with any political party or carrying on anybusiness or pursuing any profession. It is clarified thatcessation/termination of holding of office of profit, pursuingany profession or carrying any business is a condition precedentto' the appointment of a person as Chief InformationCommissioner and Information Commissioner.

4. The Chief Information Commissioner and InformationCommissioner shall hold office for a term of five years from thedate on which he enters upon his office or till he attains the ageof 65 years, whichever is earlier. The salary and allowancespayable to the Chief Information commissioner shall be thesame as that of the Chief Election commissioner and ElectionCommissioner respectively, subject to adjustment of thepensionary/retirement benefits availed by him, if any, inaccordance with the provisions of the Act.

5. Persons fulfilling the criteria and interested forappointment to the post of Chief Information Commissionerand/or Information Commissioner may send their particulars inthe enclosed proforma by post to Under Secretary (RTI) ,Department of Personnel and Training, North Block, NewDelhi or through e-mail to [email protected] by 12th October,2015. Persons who are serving under the State/CentralGovernment or any other Organization, should send theirparticulars through proper channel (administrative Ministry /Department / State / UTs). In case an advance copy of theapplication is sent before the due date the applications throughproper channel should be furnished as soori as possible to beconsidered for further processing.

11. Having perused the Circular dated 09.09.2015, we found that it is

absolutely silent about the process of selection that was already initiated

vide Notifications dated 25.02.2014 and 16.07.2014. It also does not

disclose the number of vacancies that are sought to be filled up. In the status

note dated 07.05.2015 filed by the Department of Personnel and Training, it

was stated that in response to the earlier advertisements, altogether 553

applications were received. It was also stated that the said applicants were

already shortlisted and vide communication dated 05.05.2015 and

02.05.2015, the vigilance clearance was sought from the respective Cadre

Controlling Authority in respect of shortlisted serving officers and inputs

from the Intelligence Bureau in respect of retired officers. We have taken

note of the fact that during the pendency of the writ petition, the vacancy of

Chief Information Commissioner has been filled up and one Information

Commissioner has been appointed in the fresh vacancy that arose. That

being so, we are unable to understand as to why the Respondents have again

issued a fresh notification dated 09.09.2015.

12. However, the list of the Chief Information Commissioner and the

Information Commissioners holding office as of today, furnished by the

learned Standing Counsel for Central Government, reflects that the tenure of

one of the Information Commissioners out of seven would expire on

31.12.2016 and the others have a long tenure of more than two years. As is

evident, there is no likelihood of any vacancy of Information Commissioner

in near future. However, the Chief Information Commissioner's tenure will

be completed on 01.12.2015. In case one of the serving Information

Commissioners is appointed as the Chief Information Commissioner in the

vacancy that would arise w.e.f. 02.12.2015, one more vacancy of the

Information Commissioner is likely to arise.

13. In these circumstances, instead of setting aside the Notification dated

09.09.2015, we consider it appropriate to issue the following directions:

(i) The selection process that has already been commenced vide

Notifications dated 25.02.2014 and 16.07.2014 shall be

finalized within six weeks from today and the three vacancies

of Information Commissioners existing as of today shall be

filled up amongst the 553 applications that were received in

response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015

shall be confined for selection and appointment of the Chief

Information Commissioner in the vacancy that would arise

w.e.f. 02.12.2015 and one Information Commissioner which is

likely to arise w.e.f. 02.12.2015.

14. The writ petition is accordingly disposed of.

Minutes of the meeting of the Selection Committee held on 19th February, 2016at 11 am in South Block, New Delhi for making recommendation forappointment of Information Commissioners in the Central InformationCommission.

The Committee constituted under Section 12 (3) of the Right to InformationAct, 2005 met under the chairmanship of the Prime Minister of India at 11 am on19.02.2016 in South Block, New Delhi to make recommendation for appointment ofInformation Commissioners in the Central InformationCommission.

The meeting was attended by the following:

(i) Shri Narendra Modi, Prime Minister, Chairman(ii) Shri Mallikarjun Kharge, Leader of Indian National Congress, the single largest

party in Opposition in Lok Sabha, Member(iii) Shri Arun Jaitley, FinanceMinister, Member

Dr. Jitendra Singh, Minister of State, Ministry of Personnel, Public Grievancesand Pensions, and Shri Sanjay Kothari, Secretary (Personnel) also attended themeeting and assisted the Committee.

2. The Committee was apprised that as per Section 12 (2) of the Right toInformation Act, 2005, the Central Information Commission consists of the ChiefInformation Commissioner; and such number of Central InformationCommissioners,not exceeding ten, as may be deemed necessary. At present, there are sevenInformation Commissioners in the Central Information Commission. The Committeewas also apprised that the Information Commissioner shall be a person of eminencein public life with wide knowledge and experience in law, science and technology,social service, management, journalism, mass media or administration andgovernance.

3. The Committee considered the directions dated 03.09.2013 of the SupremeCourt in Review Petition No. 2309/2012 filed by Union of India against its judgmentdated 13.09.2012 in the matter of Namit Sharma versus Union of India.

4. The Committee also considered the record of proceedingsof Supreme Court ofIndia for the hearing held on 08.01.2016 in SLP number 34495/2015 in the matter ofUnion of India versus R.K. Jain & ors, The Court had allowed six weeks time toenable Union of India to fill up the remaining three vacancies of InformationCommissioners out of the candidates who had responded to the notifications dated25.02.2014, 16.07.2014 and 09.09.2015. The case is listed for further considerationon 26.02.2016. . . ~

5. The Committee noted that in the notifications dated 25.02.2014, 16.07.2014and 09.09.2015, it had been mentioned that applications are being invited forInformation Commissioners in the Central Information Commission. It was also notedthat consequent to the Notifications dated 25.02.2014, 16.07.2014 there were 553applicants for the post of Information Commissioners and against the notificationdated 09.09.2015, the number of applicants for such posts was 330. The SearchCommittee chaired by Cabinet Secretary had met on 19.01.2016 and shortlistednames for filling up the vacancies of Information Commissioners.

6. The Committee perused the detailed agenda including the process involved in thesearcf procedure for short-listing the applicants for consideration. Notwithstandingthe short-listing done, the Committee considered all eligible applicants who applied inresponse to advertisements dated 25.02.2014, 16.07.2014 and 09.09.2015 for thepost of Information Commissioner.

7. After taking into account all the relevant factors and inputs provided, theCommittee recommended the following for appointment as InformationCommissioner in the Central Information Commission:

(i) Shri Amitava Bhattacharya, lAS (Retd) (GJ:1980) - InformationCommissioner(ii) Shri Bimal Julka, lAS (Retd) (MP:1979) - Information Commissioner(iii) Shri D.P. Sinha, IPS (Retd) (MT:1979) - InformationCommissioner

8. The details on eminence in public life, knowledge and experience in therespective field in respect of the above recommended persons is at Annexure-I. Themeeting thereafter ended.
