I INTRODUCTION

In June 1998, the Delaware Department of Natural Resources and Environmental Control, Site Investigation and Restoration Branch ("DNREC-SIRB") performed a Remedial Investigation ("RI") of the Paul 's Antiques Site ("Site" or "Facility") in Dover, Delaware under the direction of the Hazardous Substance Cleanup Act ("HSCA") 7 Del. C. Chapter 91. The RI was conducted in accordance with the Delaware Regulations Governing Hazardous Substance Cleanup ("Regulations"). The RI included sampling of surface soil, subsurface soil, and groundwater at various locations throughout and adjacent the facility. The RI was completed in July 1998, and a report written in May 1999. Based on the RI performed for the Site, DNREC-SIRB concluded that the Site in its present condition does not present an unacceptable risk to public health, welfare or the environment.

II. PURPOSE

This Final Plan of Remedial Action ("Final Plan") is based on the RI completed by DNREC­SIRB. The Final Plan is issued under the provisions of the HSCA and the Regulations. This Final Plan presents the Department's assessment of the human health and environmental risk posed by the impacted areas of concern.

The Department provided public notice and opportunity to comment on the Proposed Plan in accordance with HSCA and Section 12 of the Regulations. At the conclusion of the comment period, the Department issues this Final Plan of Remedial Action ("Final Plan") which will designate the selected procedures and stipulations concerning current and future activities. The Proposed Plan , the comments received from the public, the Department's responses to the comments, and all of the Site documents which form the basis for the Proposed and Final Plans will constitute the remedial decision record .

The contents of this Final Plan includes a description of the Site and the analytical results of the RI.

III. SITE DESCRIPTION AND HISTORY

The Paul 's Antiques Site is a furniture refinishing and resale business located between northbound Rt. 13 and County Road 154 (Hatchery Road) in Dover, Delaware. The Site is an operating facility which has operated at the current location since 1978. The area surrounding the Site is a mix of commercial, light industrial and residential zoning, with a small community of homes across Hatchery Road on Liberto Lane. Several other residences and a small commercial center line the east side of Hatchery Road.

The Site came to the attention of DNREC when Kent County ("County") contacted the DNREC-Hazardous Waste Management Branch ("HWMB") to report a severely degraded PVC sewer pipe adjacent the Paul's Antiques facility. The County was concerned that the damage to the pipe may have caused a leak which may have resulted in soil and groundwater contamination. Consequently, the County and DNREC-HWMB collected soil and groundwater samples in an effort to determine the nature of the potential impacts. These results were finalized in a Facility Evaluation ("FE") report in 1997. DNREC-SIRB became involved when the FE recommended further action.

IV. INVESTIGATION RESULTS

The FE soil sampling identified elevated concentrations of ethylbenzene, toluene, xylenes and methylene chloride. Groundwater samples yielded low concentrations of chlorobenzene Isomers.

The June 1998 Rl consisted of surface and subsurface soil sampling from thirteen (13) soil boring locations, plus groundwater samples from one on-site monitor well and nearby residential wells.

Soil samples were screened by use of the DNREC Mobile Laboratory for metals, polynuclear aromatic hydrocarbons ("PAHs"), pesticides and polychlorinated biphenyls ("PCBs"). Confirmatory soil samples, and all groundwater samples were submitted for laboratory analysis at DNREC's Environmental Services Laboratory in Dover, in accordance with the DNREC Standard Operating Procedures for Chemical Analytical Programs procedures and methods.

In sharp contrast to the FE findings, Rl soil samples did not contain any volatile organic compounds ("VOC's"; e.g. toluene, ethylbenzene, methylene chloride) or pesticides. Very low concentrations of several PAH's were identified, but at concentrations at least one order of magnitude below DNREC-SIRB remediation standards. Observed metals' concentrations were within measured State background values.

Three groundwater samples contained low concentrations of chioro benzene, toluene and methylene chloride and slightly elevated iron and manganese. Only one methylene chloride detection was above drinking water thresholds in the Paul's Antiques' well. A point-of-use treatment system in the form of a carbon-filtration unit was recommended. The elevated iron and manganese were above secondary drinking water standards, which are based upon aesthetic, not health, concerns. Elevated iron and manganese can be characteristic of shallow groundwater, and it was undetermined if this was Site-related.

V. FINAL PLAN OF REMEDIAL ACTION

Based upon the information and results of the Rl at the Paul's Antiques Facility in Dover, Delaware, the DNREC-SIRB Final Plan of Remedial Action is No Further Action due to the lack of documented contamination identified during the Rl.

VI. PUBLIC PARTICIPATION

The Department actively solicited public comments or suggestions on the Proposed Plan of Remedial Action and welcomed opportunities to answer questions. Copies of the Proposed Plan could have been seen at DNREC-SIRB's New Castle office and the Dover Public Library. The comment period began on June 5, 1999 and ended at the close of business (4:30pm) on June 25 , 1999. No questions or comments were received.

VII. DECLARATION

This Final Plan of Remedial Action for the Paul's Antiques site is protective of human health, welfare and the environment, and is consistent with the requirements of the Delaware Hazardous Substance Cleanup Act.
