DEFENDANTS would urge, advise, procure, persuade, and ins t ruc t

the witness James Michael Neveras to present false bank records

of The Trust Company of New Jersey, Jersey City, New Jersey to

said Grand Jury.

OVERT ACTS

In furtherance of the said conspiracy and to ef fec t the

objectives thereof, in the Southern is t r ic t of Florida, in the

Northern Distr ict o f Ohio, and the is t r ic t of New Jersey, and

e l sewhere, the DEFENDANTS committed and caused to be committed

the following overt acts , among others:

.1 . On or about March 29, 1976, the defendant DOMINICK

Dom EDWARD BARTONE had a telephone conversation with James

Michael Neve ras.

2. On or about March 30, 1976, the defendant DOMINICK

''Dom EDWARD BARTONE had a telephone conversation with James

Michael Neveras.

3. On or about March 31, 1976, the defendant DOMINICK

Dom EDW RD BARTONE had a telephone conversation with James Michael

Neveras.

4. On or about April 1, 1976, the defendant DOMINICK

Dom Em•J'ARD BARTONE had a telephone conversation with Gera l d

Wayne Cunningham.

5. On or about April 1, 19 76, the defendant MORTON Mort

H. FRANKLIN had a telephone conversation with Gera ld Wayne

6. On or about April 2 1976 Gerald Wayne Cunningham

and Earl Warren Dameworth went to the Doral Country ClUb, 4400

N W 87th Avenue, Miami, Florida.

7. On or about April 2 1976 the defendant

DOMINICK Dom EDW RD BARTONE had a telephone conversation with

James Michael Neveras.

8. On or about April 6 1976 James Michael Neveras

THE GRAND JURY FURTHER CHARGES:

1. On or about April 6, 1976, in the Southern Dist r ic t

of Florida, OOMINICK Dom .Em-lARD BARTONE and MORTON Mort H.

FRANKLIN hereinaf ter referred to as the DEFENDANTS corruptly

did endeavor to influence, obstruct , and impede, and did inf luence,

obstruct , and impede the due administrat ion of jus t ice in the

United States Dist r ic t Court for the Southern Dis t r ic t of Florida,

in that the DEFENDANTS knowing that one James Michael Neveras had

received a subpoena to appear before the Federal Grand Jury for

the Southern Dist r ic t of Florida, aided, abet ted, counseled,

commanded, induced, procured and caused James Michael Neveras to

give false testimony under oath before said Grand Jury and present

fa lse bank records of The Trust Company of New Jersey to sa id

Grand Jury with respect to material matters being inquired in to

by the Federal Grand Jury·and did thereby corruptly endeavor to

inf luence, obstruct , and impede and did inf luence, obstruct , and

impede the due administration of jus t ice .

2. The Federal Grand Jury for the Southern Dis t r i c t of

Florida during April 6, 1976, was conducting an invest igat ion in to

possible violat ions of the Neutral i ty Act of the United States

Tit le 22, United States · Code, Section 1934; fraud to obtain a loan

from a federal ly insured bank, Ti t le 18, United States Code, Section

1014; Federal Firearms laws, Tit le 26, United States Code·, Section

5861; and conspiracy, Tit le 18, United States Code, Section 371.

3. On April 6, 1976, James Michael Neveras did appear

as required by subpoena before the said Grand Jury as a witness,

was duly sworn, and took his oath as a witness in said proceeding.

4. I t was then and there and a t a l l times mentioned

herein a material matter in said Grand Jury proceeding:

(a) whether DOlUNICK Dom Em.JARD BARTONE was an

endorser of the loan of money from said Trust

Company to D.W.I.E.R., INC., in November 1975;

( a) that DOMINICK Dom EDWARD BARTONE was not

an endorser of the lo an of money from said

Trust Company t o D.W . I .E . R. INC. , in Novembe r

1975;

signed attorneys . and fi les this i ts complaint against DOMINICK BARTONE.

to wit:

1. Plaintiff is a corporation duly organized and existing under the

laws of the State of Florida, with i ts principal place of business in Dade

County, Florida; defendant DOMINICK BARTONE. is a citizen and resident

of a state other than Florida, to wit: Ohio; the cause of action herein

alleged .ifivolves a sum of money in excess of Ten Thousand ($10, 000. 00)

Dollars exclusive of interest and costs; at all t imes pertinent hereto there

has been and is a diversity of citizenship as between the plaintiff and the

defendant.

2. On or about April 11, 1960, in Miami. Dade County, Florida.

plaintiff, AERO O R D N N C E ~ INC. did loan to defendant, DOMINICK

BARTONE   the sum of Fifteen Thousand Eight Hundred Two and 57/100. .

($15, 802. 57) Dollars for a period of six (6) months, the same b e ing due

and payable in full on or before October 11, 1960, t no interest .

3. That on or about May 5, 1960, in Miami, Dade County,

Florida, AERO ORDNANCE, INC. did loan to the said defendant, DOMINICK

BARTONE, the sum of Five Thousand ($5, 000. 00) Dollars, without interest ,

·for a period of Fifteen (15) days, the same being due and payable in full on

May 20, 1960.

4. Th,at t,he f irst of sa id loans ($15, 802. 57) was advanced by the

plaintiff through i ts President , Edward Browder, Jr . , while there were

certain arms transactions pending between the plaintiff and certain persons

in various Latin-American countries which were to be participated in by

the defendant by the aforesaid amounts being credited against future com-

missions which might become due the said defendant, DOMINICK BARTONE,

for his part n said arms transactions; that sa id arms _ransact ions did

not material ize and demand was made by plaintiff through i ts President ,

Edward Browder, Jr. upon the said OOMINICK BARTONE to repay the said

amounts; however, despite his· avowals that he w o u ~ repay the said amounts

the said defendant has refused and neglected to do so.

5. That the sa id Five Thousand ($5. 000. 00) Dollar loan was loaned

to th defendant by the plaintiff, the defendant well knowing that plaintiff

had obligations becoming due shortly after May 20., 1960, and that in the

event the said loan were not repaid by that date, the plaintiff would suffer

·a substantial financial loss; that as a result of his failure to rep3:y the said

Five Thousand ($5, 000. 00) Dollars on or before May 20, 1960, plaintiff

suffered a financial loss of Twenty-Six Thousand Eight Hundred Forty-two

($26, 842. 00) Dollars, being the value of electronic merchandise seized and

sold for freight and storage charges by the Ryder Trucking Company due

to the failure of plaintiff to pay the said charges; that as a further resul t

of defendant's failure to pay said sum on the date due, plaintiff suffered

damages in the amount of Twenty-five Thousand ( 25, 000. 00) Dollars ,

representing lost profit on the said merchandise.

WHEREFORE, plaintiff sues the defendant and alleges damages

to be Fifty-one Thousand Eight Hundred Forty-two ( 51, 842. 00) Dollars

plus interest and ·costs.
