Dear Mr. Savage:
This is in response to your Freedom of Information Act (FOIA) request dated and
received in this Office on April 25, 2013, in which you requested a list of the name of eachdetainee at Guantanamo Bay and their status as determined by the Guantanamo Detainee Task
Force. Your request was originally directed to the Department of Defense. That agencyforwarded your request to this Office. This response is made on behalf of the Office of theAttorney General.
One document, totaling fifteen pages, is responsive to your request. This document isappropriate for release with excisions made pursuant to Exemptions 1, 5, and 6 of the FOIA,
5 U.S.C. 552(b)(1), (b)(5), (b)(6), and a copy is enclosed. Exemption 1 pertains to
information that is currently and properly classified in the interest of national security pursuant
to Executive Order 13526. Exemption 5 pertains to certain inter- and intra-agencycommunications protected by the deliberative process privilege. Exemption 6 pertains to
information the release of which could reasonably be expected to constitute an unwarranted
invasion of personal privacy. None of this information is appropriate for discretionary release.
For your information, Congress excluded three discrete categories of law enforcement
and national security records from the requirements of the FOIA. See 5 U.S.C. 552(c) (2006 &Supp. IV 2010). This response is limited to those records that are subject to the requirements of
the FOIA. This is a standard notification that is given to all our requesters and should not be
taken as an indication that excluded records do, or do not, exist.
If you are not satisfied with my response to this request, you may administratively
appeal by writing to the Director, Office of Information Policy, United States Department ofJustice, Suite 11050, 1425 New York Avenue, NW, Washington, DC 20530-0001, or you may
submit an appeal through this Offices eFOIA portal at http://www.justice.gov/oip/efoia-
portal.html. Your appeal must be received within sixty days from the date of this letter. If yousubmit your appeal by mail, both the letter and the envelope should be clearly marked
Freedom of Information Act Appeal.
Sincerely,
Vanessa R. Brinkmann,
